Two Big New Ways the Biden Administration Plans To Overstep Its Pandemic Authority

President Joe Biden has announced the next stage of his administration's COVID-19 pandemic response—and it's a doozy of dubious constitutionality and executive branch overreach. The biggest news is that Biden is ordering all private businesses with more than 100 employees to make their workers get the COVID-19 vaccine or submit to weekly testing.

Enforcement of this policy will be handled through the Department of Labor's Occupational Safety and Health Administration (OSHA). "OSHA will issue an Emergency Temporary Standard (ETS) to implement this requirement," says the White House. "This requirement will impact over 80 million workers in private sector businesses."

The administration claims OSHA has the authority to do this because it's permitted to issue temporary regulations "necessary to protect employees" from dangerous "exposure to substances or agents determined to be toxic or physically harmful." But interpreting this to mean not just limited toxic exposures within a particular area or workplace but any virus or disease plaguing the country would drastically alter the scope of OSHA's alleged authority.

The fact that this order is coming not from Congress but from Biden and an administrative body is also…problematic, to put it mildly.

"This is legislative action that bypasses the legislative branch," commented former Rep. Justin Amash (L–Mich.) yesterday. "If you care about representative government—if you're consistent regardless of who's president—then it doesn't matter that you like the policy; this mandate is an abuse of power."

"I am a strong proponent of vaccines (get yours if you haven't!) but President Biden doing an end-run around the legislative process by ordering an administrative agency like @OSHA_DOL to mandate vaccinations for employees of private business is outrageous overreach," tweeted Rep. Peter Meijer (R–Mich.).

"Biden is presiding over a vast expansion of federal authority, one that Democrats will certainly come to regret the next time a Republican takes power," suggested Reason's Robby Soave in a New York Times op-ed today. "Moreover, the mechanism of enforcement — a presidential decree smuggled into law by the Department of Labor and its Occupational Safety and Health Administration — is fundamentally undemocratic. Congress is supposed to make new laws, not an unaccountable bureaucratic agency."

How OSHA—and employers—will actually enforce this mandate remains a big question mark.

So… as a practical matter how enforceable are these mandates really? The record of immunization most folks have is a tiny square of cardboard that's equally easily lost, destroyed, or forged.

Obviously there are ways to check, in principle, via insurance or the direct providers, but that sounds like it would require significant infrastructure if suddenly you've got a massive number of employers needing to check vax status for 80 million workers…

Another big unknown: Will workers really walk away rather than get the vaccine? In polls, at least, many unvaccinated workers say they would quit their jobs before getting vaccinated:

In addition to mandating that workers at businesses of a certain size be vaccinated or regularly tested, Biden's new order says health care businesses—regardless of size—must see that all staff, volunteers, and contractors are vaccinated if these businesses take Medicare or Medicaid patients. The requirement includes volunteers and staff "who are not involved in direct patient, resident, or client care" and will "apply to approximately 50,000 providers and cover a majority of health care workers across the country," the White House says.

The other big overreach in yesterday's order involves the Defense Production Act and COVID-19 tests.

"The reason that Americans don't have access to cheap, fast COVID-19 self-tests right now is because the hypercautious regulators at the Food and Drug Administration (FDA) have been ridiculously slow to approve such tests," as Reason's Ron Bailey noted yesterday.

Yet, rather than approve more COVID-19 tests—including those made (and proven to work) overseas—the federal government will invoke the Defense Production Act to force U.S. manufacturers to make more of the already-approved tests here.

The Biden administration will also strike a deal with major retailers (including Walmart, Kroger, and Amazon) to sell the tests at cost for three months. While this is ostensibly voluntary on the part of the businesses, it may not make much of a dent in our at-home testing scarcity.

"One huge immediate problem: COVID-19 self-tests are already increasingly hard to find in stores at current prices," notes Bailey. "Lowering the prices of already scarce tests will not make more magically appear."

"At-home rapid tests are expensive & hard to find in the US. So instead of just approving/importing the *dozens* of cheap tests now sitting at the FDA (& already approved in EU), the WH is gonna fix the problem w…industrial policy & a discount coupon," scoffs Cato Institute Senior Fellow Scott Lincicome.

Neither side likes this analogy. ("Pregnancy isn't contagious!" point out pro-choice advocates. "Abortion is about more than just one body," argue pro-lifers.) But at the root of both issues is bodily autonomy. And even each side's objections share a similarity, in invoking other lives at stake.

Unemployment claims are approaching pre-pandemic numbers. "The number of Americans seeking unemployment benefits fell last week to 310,000, a pandemic low," reports the Associated Press. At this rate, "weekly applications for benefits are edging toward their pre-pandemic figure of roughly 225,000.

        Ultimately, as soon as you accept the deeply creepy as fuck premise that people have some sort of responsibility to perform medical procedures on themselves for the protection of others, all these other deeply creepy as fuck actions are just a natural progression on that slippery slope.           This slow step towards liberty reduction in the name safety began years ago, but the libertarians and even the ACLU once fought against it. In 2008 ACLU released a report against mandates, now they fully embrace it.

          We have seen an increase in the embracing of soft fascism of government control through corporate guidance. The first big step was Operation Chokepoint with the bankers pushing morality. And this continues with the support of SV colluding with large market share to disrupt opposing voices. This is happening with the CDC threatening the cruise industry with liability. Etc.

          People need to push back hard against the corporations working in conjunction with government to enforce these mandates through fascism.

          It is going to get worse. Democrats love China social credit systems.

        I'd be very skeptical of that sort of information. Mainly because it just doesn't fit with the reality of what ivermectin is.

        Ivermectin based products (eg. Stromectol, or SKlice) contain ivermectin and inactive excipients - binders and fillers for tablets and carrier vehicle for the lotion.

        There are no known protease inhibitors in those products and nobody has ever noted protease activity for ivermectin during previous drug product development and testing. If ivermectin itself has protease activity that alone would be big big news.

        So I would suggest revisiting your source and clarifying exactly what it is that is being alleged.

        None of which says that ivermectin does not have benefit for treating covid. On that front I'm agnostic, but will say that at normal human doses (300 mcg/kg or thereabouts) it is very safe and anyone who wants to try it certainly should consider it.

        Historically, the president's party losses in the House are in the mid-twenties during his first midterm. When the president's agenda is particularly controversial, they fare much worse.

        I don't think the question is whether the Democrats will lose the House but by how much, at this point, and whether the Democrats will lose more than three seats in the senate.

        The few presidents who escaped that kind of thing in their first midterm usually did so because of historically rare events that were beyond their control. George W. Bush did really well in 2002 because the country unified behind him in the wake of 9/11--before he invaded Iraq in 2003. Can you imagine an event that would cause the American people to unify behind Joe Biden at this point?

        I don't think war with China would do it.

        Reinvading Afghanistan would probably make more independents oppose Biden rather than support him.

        A lot can happen in a year, but I think the question is whether his goose will be cooked well-done or medium-well. And I don't think he becomes more popular from here.

            2) The current Supreme Court supported the changes to Arizona's voting laws, and they did the same thing to Georgia's voting laws. Chances are that they'll side with Texas and the other states too for the same reasons.

                      It's a mandate for employers and that is not being pedantic. Employers must test pre-employment, randomly, and post-accident. And they typically throw everybody in the company in the pool so they can't be accused of having a discriminatory policy.

            The House Republicans won in 2020 despite the rules you're talking about, and the Court keeps ruling in favor of laws like Arizona's and Georgia's.

            Here's another fact, Republicans picked up seats in blue states like California in 2020.

                Fact 1: The Republicans gained 14 seats in the 2020 election--including California--despite the chicanery.

                Fact 2: The Court upheld the election laws in Arizona and Georgia, and they're likely to rule the same way in Texas and other states for the same reasons.

                Fact 3: Ballot stuffing is nothing new. To whatever extent the historical trends I'm referring to emerged over the course of the last century, they did so in spite of whatever ballot stuffing was happening.

                Fact 4: At least three moderate Democrats in the Senate (Manchin, Sinema, and Tester) and at least nine Democrats in the House (the nine that want to vote on the infrastructure deal but want to vote against the $3.5 trillion budget reconciliation bill) are all acting is if they're afraid of what will happen to them in future elections if they toe the Democrat party line. What do you know that they don't know?

                Forget faith in the system. I have an appropriate amount of faith in conclusions that are rational and account for the facts, and I have no faith in conclusions that ignore the facts because they conflict with your favored theory. It isn't even a question of trying to craft a theory that somehow accounts for those facts and still supports your favorite conclusion. That's rationalizing rather than reasoning. If you want to persuade me, your theory needs to arise naturally from the facts without torturing the them to conform to your favorite theory.

                My conclusion is that the Republican gains in the House will probably be in the mid-twenties or greater come November of 2022 because that conclusion arises naturally and rationally from the facts. If you want to convince me I'm wrong, you don't attack me for having faith in the system. You either challenge me on the facts, show me where the logic is wrong, or build a rational argument that contradicts mine from other facts.

                P.S. The outcome of the 2020 midterms will be what they are regardless of whether I have faith in the system.

    It is time to wake up, America. Team Red, Team Blue- they are just that: TEAMS. They are playing a heavily orchestrated and contrived game where the stakes are reserved to them and them only. Never forget that no matter who wins the Super Bowl, all that money goes to the NFL to be divvied out among the teams involved. You might cheer for one team, and idolize some of the players, but never forget that their ultimate goal is the preservation of the NFL, and your support is just a means to the goal. So to, Team Red and Blue aren't their for YOU. They are there for the National Federal League- a closed club that has one goal- to appropriate your money and freedom.

            Team Red took Team Blue's legislation and passed it for them. The Patriot Act was developed BY BIDEN as a reaction to American Citizens who bombed a government building in Oklahoma. By design it was meant to counter domestic terrorists. Team Red passed under the justification of protection from foreign threats, but that is not how it originated. And surprise surprise, Team Blue then used it against American Citizens. Despite Team Blue and Red getting on the air and demonizing the other, they were BOTH complicit in passing these bills.

            Team Blue passed health care legislation CREATED by Team Red. Obamacare was a scaled up version of Romneycare. Team Red passed a Medicare Prescription Drug Benefit that merely aped Team Blue's Medicare.

            To the extent that he was a maverick outsider, Trump at least threatened to upset their game. That is why the entire government united to destroy him. But even for all this, Trump became a player in the same game. His Tariffs are now Biden's Tariffs that will forever syphon money from poorer americans to corporations at home (regardless of whatever strategic pretense they were originally passed under). Trump's eviction moratorium is now Biden's.

            I'm sure the Lakers would love to beat the Spurs this year, because that will mean bonuses and such for the Lakers. But neither team is out to break the league. Even if you are a poor Ref, you know that giving leeway to the superstars keeps your paycheck coming. Even if you are losing this year, as a player or coach or HR rep, you know that as long as the system keeps churning along, you'll get a bite at the apple next year, and if not even the participation trophy will not be so bad.

            As I noted above, I may sympathize with the politics of the Right more than the Left, but if you are counting on Team Red to defend the politics of the right when that conflicts with getting their bread buttered, you still need to take that red pill.

              I agree but I'm not sure what team Red looks like anymore. Once it became clear that Trump was wildly popular with the base the country club Republicans publicly supported him while privately sabotaging him. Trump was popular not because he was a Republican but because he was a disrupter. I voted for a Republican presidential candidate for the first time in my life at age 64 in 2020. I would have voted for him if he were a Democrat or independent because he upended the status quo. Team red couldn't wait to get rid of Trump and get back to business as usual. But they didn't get rid of Trump voters that includes a whole lot of independents like me who don't give a shit about their team. They know that if they don't start acting like Trump they're done. I'm not a Republican and I've never been a Republican but at this point if we don't get divided government in 2022 we'll end up like Australia. So in the short term at least it's easy to see the lesser of evils.

              In the wake of mass shootings, there's often a quick fact check that tells us the gun was acquired legally. My understanding is that the feds aren't supposed to be keeping a record of who purchases a gun, but they get that information out so quickly. I know there are other sources than the FBI or the ATF to get this data, but I simply don't believe that all this data is being generated and no one is archiving it. You know how Say's law has it, oversimplified, that "Supply creates its own demand"? There must be a parallel or related phenomenon, where the existence of data creates the demand to archive it.

              When the NSA started logging our metadata, it wasn't because it became legal. It was because it became possible. Amazon and Facebook collect every piece of data they can about us and our purchases, but no one in the federal government is tracking who bought a gun and who is vaccinated? This data is at the center of our policy debates, and no one is bothering to collect it and archive it? I want to believe in the incompetence of government bureaucrats, but the one thing they are--even the incompetent ones--is meticulous. Cuneiform, the first writing in history, was invented so bureaucrats could keep meticulous records.

                  When you see what most of those cuneiform tablet said, it's a bureaucrat's record of how much he collected in barley from this person, how many goats he had and was taxed for, etc. They didn't want to be accused of corruption, so they used a wedge to cut the record into a clay tablet, and then they had the tablet baked in a kiln to make the record permanent. If they reported what they collected, they couldn't be accused of pocketing any or letting anybody off the hook.

                  If we looked at the first thing written on the first clay tablet, it could probably be accurately translated to say, "Procedures were followed".

    I work for a very large medical provider in upstate NY.
    The state has mandated that ALL healthcare employees be vaccinated by the middle of the month with NO medical or religious exemptions.
    Roughly 20% of our employees aren't vaccinated and about 80% of those say they are willing to lose their job rather than get the shot.

      Smallpox, TB, MMR, chicken pox, and all the other vaccines that are required for school and travel have something in common; they actually prevent the recipient from contracting and transmitting the disease. It is unquestionably pointless to mandate a vaccine that doesn't actually prevent spread. People are not as stupid as you hope they are.

          I work with quite a few Hispanic small contractors here in Central Texas. I don't think any of them are vaccinated.

In reality, most of the unvaccinated are people who are just working too hard to take a chance that the shot will make them sick.

      Because Delta is more of URI than LRI, far more likely to be detected in asymptomatic / mildly symptomatic individuals, and is far more transmissible. In equivalent vaccinated populations it is far less likely to result in complications, thanks to the internal protection conferred.

But at the root of both issues is bodily autonomy. And even each side's objections share a similarity, in invoking other lives at stake.

    More than being about bodily autonomy, it's about personal responsibility. Each of us must answer to whatever we hold sacred, whether it be a diety, or our own moral integrity.

      Meanwhile Iceland has nearly eradicated Down by killing them all in utero, and many are now so bold as to tout its benefits here. Technology continues to rapidly advance the ability to diagnose (and thereby thusly easily "prevent") more and more birth defects and other ailments, even as it pushes viability so early even judges are saying we need to scrap the very notion. That, plus the hard shift away from anything resembling "liberalism" on the center-to-left--in this case, the bolder and bolder advocacy for abortion itself as a true moral good not just a right; and the deemphasis on "bodily autonomy" in general--and you will probably see "pro-choice" rhetoric notably shifting toward the utilitarian or even eugenicist.

        I know that down syndrome, specifically, isn't caused by incest, but the people of Iceland may have been especially enthusiastic about prenatal screening because they have a small, genetically homogeneous population and a tradition of using surnames derived from their father's first name--which makes it easy to accidentally mate with a close relative. There are only 350,000 people in the whole country.

        There's an incest prevention app there, now, that lets people bump their phones together to see if they're related before they start dating.

        No, down syndrome isn't caused by inbreeding, but prenatal screening for any artifacts of incest probably caught the flags for down syndrome, too. That outcome seems to have driven by popular demand because of a real problem.

        Because something happens in Iceland, of course, doesn't mean it will work here or that Iceland's consumer driven solution should be inflicted on the American people by bureaucrats and scientific experts.

I hadn't really thought about how Iceland--smaller than some neighborhoods in the world's great cities--might be inbred, or that their first-names-only system might be exacerbating it. (Truthfully I have my doubts surnames really would be much help after so many generations, unless they were very numerous or were historically geographical or some such thing.) Icelanders--successful, beautiful--are of course just so cartoonishly far away from the "inbred" stereotype. I'd imagine that many other places--even, in Scandinavia, places like the Faroes and Åland (the island territory in Finland where essentially no one speaks what is now of course by far the more popular of Finland's two official languages, and it is not even official and you will find no signage or anything in it)--would have similarly enduring self-contained populations even into today and have need of similar screening. I know it is big among Jews especially Chasidim.

          Of course the moral issue arises only with post conception screening and therapeutic use of abortion. Pre-hookup screening is certainly the future and cannot advance in technology and use fast enough IMO. It will be a real challenge to make it work as pregnancy increasingly decouples from the decision to get married.

I was providing information to show that other European countries were also doing high amounts of prenatal screening without the inbreeding excuse. They are doing the prenatal screen for down syndrome and other abnormalities.

It's just as easy to come up with some reason or other why anything is a social good (without even getting into the how one defines what is socially good), and thus the exact same logic that justifies mandating vaccines/abortions/etc. can be used to justify, for example, banning vaccines/abortions/etc.

    I'm Pro-Vaccine for me as an individual as I decided to get the vaccine, but I'm absolutely anti-mandate. I absolutely despised Trump, but at this point, I would prefer Donald Trump's version of exceeding his Presidential authority while in office over Joe Biden's increased level of exceeding his Presidential authority.

    I see the world in authoritarians versus libertarians. Both Donald Trump and Joe Biden are authoritarians, however Trump is authoritarian-lite compared to Joe Biden.

    Joe Biden should be removed from office, but not sure that I want Kamala Harris to hold the office. Pretty scary how brazen the authoritarians have become.
