Yes, you are well within your First Amendment rights to livestream video of police officers in action. The U.S. Court of Appeals for the 4th Circuit confirmed that in a ruling released this week.

It really shouldn't have been a question. Courts have, on a number of occasions, upheld the right to photograph or take video of police officers.

But police officers in Winterville, North Carolina, insisted that livestreaming that video on social media is different. During a 2018 traffic stop—which car passenger Dijon Sharpe started sharing on Facebook Live—an officer tried to take away Sharpe's phone, calling it an "officer safety issue." Another officer told Sharpe, "In the future, if you're on Facebook Live, your phone is gonna be taken from you…and if you don't want to give up your phone, you'll go to jail."

Sharpe sued. And a U.S. district court sided against him, writing "that an individual's right under the First Amendment to record a traffic stop" and to "real-time broadcast a traffic stop from within the stopped car" was not "clearly established." That meant the officers involved were entitled to qualified immunity.

Sharpe then took the case to a federal appeals court, with a horde of civil liberties groups —including the American Civil Liberties Union, the Institute for Justice, the Cato Institute, and the National Police Accountability Project—backing his position.

This time, the court sided with Sharpe in part.

Winterville "failed to establish that the alleged livestreaming policy is sufficiently grounded in, and tailored to, strong governmental interests to survive First Amendment scrutiny," the court held in a Tuesday decision, penned by Judge Julius N. Richardson. "So we vacate the district court's order declaring the policy constitutional and remand for further proceedings."

"Creating and disseminating information is protected speech under the First Amendment," noted Richardson:

And other courts have routinely recognized these principles extend the First Amendment to cover recording—particularly when the information involves matters of public interest like police encounters….

We agree. Recording police encounters creates information that contributes to discussion about governmental affairs. So too does livestreaming disseminate that information, often creating its own record. We thus hold that livestreaming a police traffic stop is speech protected by the First Amendment.

Nonetheless, the Winterville police officers are still entitled to qualified immunity, the court held. Under the doctrine of qualified immunity, police officers are only open to individual liability if they violate a clearly established right that is protected by the Constitution. But the legality of livestreaming traffic stops was not clearly established, the judges said.

      Live streaming does seem to be the ideal method. The footage is taken off your phone near immediately, so it can't be deleted.

        I can actually see a valid counter argument here.

        They don't let a detainee use his cellphone from the side of the road, just in case he is a wanted ganster who could call his crew in to rescue him.

        There are plenty of ways that a Livestream could pose a risk that shooting video and posting it later does not. Livestreaming a swat raid could reveal the tactics being used, location of officers, etc.

        Is it likely? No.

        But there is not "no government interest" in blocking such Livestream.

          All of this is also pretty specifically or diametrically 1A oriented though, rather than the stupid tangential or orthogonality we witnessed in 2019-2021 whereby retarded livestreamer goes into a private business, starts being disruptive, and then cries out "MUH 1A!" when the cops show up to escort them from the premises.

          Throw in selective editing, which we also saw a lot of 2019-2021 and you're either going to have to curtail/control how the narrative gets out around the edges in some way or, once again, just hand everything over to looters and arsonists.

            In specific cases? Sure.

            is anyone going to argue that if there was a (far right / far left ) terrorist attack on, say, a school, and SWAT was moving in, that the police could not stop all video broadcast (tv and streamers) to protect operational security?

            That seems like a no-brainer. Some group with semi-aitomatic rifles, hostages and loads of ammunition… And they are watching what police are doing on the TV or Twitch?

            I would say that clearly passes the “reasonable restriction” hurdle.

            Now, if they stop a 63 year old grandma in her yaris on the way to CVS and they want to block streaming? Probably completely different calculus.

            Drug arrest of a mid level dealer? Now we have more interests to consider.

            It would be interesting to come up with a clear standard that cannot be abused.

              And, again, this represents a clear/strict case of tactical advantage of pro-police action rather than a case of one civilian claiming 1A rights over another civilian's rights with police effectively arbitrating. That is, I don't think anyone would argue that Jordan Hill, Tesfaye Cooper, Brittany Covington, and Tanishia Covington's 1A right to livestream their political statements of "Fuck Trump" and "Fuck white people" while putting lit cigarettes out on their "white male victim", supersedes the right of their disabled, minor victim to be secure in his person and effects.

I had to look up this judge ( James C Dever III) and since it's a federal court, it's not an elected position. Dude was a Bush appointee.       You seem to have this misconception about the role of judges. Judges are a bulwark to protect government from the people. Their job is to justify the actions of the police and other government officials, along with interpreting plain language like "shall not be infringed" or "Congress shall make no law" to mean "infringement is necessary" or "Congress shall make laws."

      Once you accept that then the actions of the courts make a lot more sense.

            It was as good as a confession.

            Anyone waiting for a reporter to confirm might be relieved to see this story. But we didn't actually need it to know what happened. The number of parties who are both capable and motivated is in the low single digits.

It was like watching your average auto mechanic explain how a Russian could drive a Honda Civic so disastrously as to reduce an entire city block to rubble rather than admit that, to do that amount of damage, someone woudl’ve had to have packed the car with plastic explosives.

                Like, I get it, Russians driving into the buildings on a city block that turned to rubble seconds later certainly wouldn't have help things, if that's what happened, and it’s not perfectly clear as to whether the bomb was there and Russian incompetence triggered it or whatever. Industrial accidents certainly do happen. But the explanation that Russians did it recklessly is, at several layers, an obvious case of denial.

                Trump has always been his own worst enemy. As many people as he may interest in his comments, he can also turn a number of them off just as well. I'll be honest, I've never been a fan of the man, and in 2016, I voted for Gary Johnson (L) as I didn't like him and didn't like Hillary Clinton. That said, I thought he was a better choice than Hillary. History has proven that. I did vote for Trump in 2020 as I really, really do not like Joe Biden, and I do not like what his party has done. If the primary were held today, amongst all possible declared and undeclared players, I'd vote for someone else like DeSantis.

                I do think that Trump's time in the sun of the Presidency has come and gone. He's almost as old as Joe Biden, and we've seen what he can/cannot do. New blood might be a better option at this juncture. How many more late Silents and Boomers do we need in office?

It doesn't really make a lot of sense that GER would destroy the pipeline, or the US for that matter. I am no quite buying what Hersh is claiming. Let's see proof.

        As for inflation, it is not an indicator of a hot economy, it is an indicator of too much money in the economy. Money, like eggs or steel, is a commodity, and it works in inverse to most commodities. When there is too much money, it is worth less. When there is too little money, it's worth quite a bit. But, money is just another commodity. I strongly suggest reviewing the stagflation of the 1970s where we had inflation yet a stagnating economy caused by Johnson's attempt to pay for the Vietnam War, the Great Society, and not raise taxes. In other words, money printer went "burrrrrrrrrrrrrrrrrrr".

      Reading that report and the comments put me in mind of a line by Michael Duncan Clarke during his amazing performance as the empath John Coffey in The Green Mile.

      He killed them with their love. That's how it is every day, all over the world.

      That is how this shit gets out of control. People making money off the research, therapies and surgeries promote the need for their work by declaring its urgency. Shrouded in the color of authority, they convince confounded parents seeking professional advice that their child is suffering and on the verge of suicide. The now desperate parents, who find themselves going to work every day fearing that their child will have killed themselves before they make it back home, will do just about anything to quell that anxiety.

      The most insidious groomers use parents love to get them to willingly hand over their children. Ironic that Stephen King is such a douchebag about the trans movement when he pegged how it secures its victims so well.

        One commenter argued that the biggest reason these guys become liberals is because they're actually Americanized from growing up here, and having been indoctrinated by public school teachers how racist and evil the US is. While that's not always the case ( for Brahmin Indians who live here like Saira Rao and KShitma Sawant, it's because they're still in a caste-system mindset where they have trouble fathoming why they aren't the top of the social ladder), it's generally the rule these days. No one hates the US more than 2nd-generation immigrants, and US schools exploit that from kindergarten all the way through college.
