U.S. Emulates Communist China in New TikTok Draft Agreement
Plus: Americans vote too much, Indiana abortion ban to take effect, and more...

TikTok asked to pledge allegiance to U.S. security over corporate profits. To avoid being banned, TikTok might have to give the government "unprecedented control over essential functions that it does not have over any other major free speech platform," reports Forbes, which reviewed a draft agreement between the company and the feds from last summer.
The situation is sadly ironic, considering that the ostensible concern U.S. lawmakers have about TikTok is that it could be subject to too much government surveillance and control by the Chinese government.
Of course, U.S. lawmakers and politicians have never actually been strictly opposed to government snooping on digital communications or strong-arming tech companies. Just look at the Snowden revelations or the Facebook Files. They just don't like it when they're left out of the game.
And spreading unproven tales about how the Chinese Communist Party (CCP) might access TikTok's U.S. user data served the dual purpose of stirring up anti-China sentiment (always a win for a certain strain of hawkish Republican) and giving American authorities a pretense to grab more control of TikTok themselves (a bipartisan desire).
The confidential draft agreement viewed by Forbes comes from summer 2022. It's "nearly 100 pages long" and "contains comment exchanges between lawyers for ByteDance and the Committee on Foreign Investment in the United States (CFIUS), a group of federal agencies that investigates foreign investment in business deals that could threaten national interests," notes Forbes:
The draft agreement, as it was being negotiated at the time, would give government agencies like the DOJ or the DOD the authority to:
• Examine TikTok's U.S. facilities, records, equipment and servers with minimal or no notice,
• Block changes to the app's U.S. terms of service, moderation policies and privacy policy,
• Veto the hiring of any executive involved in leading TikTok's U.S. Data Security org,
• Order TikTok and ByteDance to pay for and subject themselves to various audits, assessments and other reports on the security of TikTok's U.S. functions, and,
• In some circumstances, require ByteDance to temporarily stop TikTok from functioning in the United States.
And it gets worse:
The draft agreement would make TikTok's U.S. operations subject to extensive supervision by an array of independent investigative bodies, including a third-party monitor, a third-party auditor, a cybersecurity auditor and a source code inspector. It would also force TikTok U.S. to exclude ByteDance leaders from certain security-related decision making, and instead rely on an executive security committee that would operate in secrecy from ByteDance. Members of this committee would be responsible first for protecting the national security of the United States, as defined by the Executive Branch, and only then for making the company money.
Ama Adams, a managing partner and CFIUS expert at Ropes & Gray, said that some of the government powers in the draft agreement were somewhat typical — including the right to inspect a company's facilities and materials, and the use of a third-party monitor. But "setting up a structure that has allegiance to the United States — I've never seen language, per se, to that extent."
Corporate structures that must put allegiance to government first—hmm, where have we heard of something like that before?
It seems that, once again, machinations to "protect" Americans from the CCP values some worry are being smuggled into the U.S. through TikTok videos is resulting in… America acting a lot like the CCP.

In one revealing comment exchange, attorneys for ByteDance explain to CFIUS that they have added language that prevents the government from demanding changes to TikTok's recommendation algorithm simply because it recommended content that the government does not like.
"If this agreement would give the U.S. government the power to dictate what content TikTok can or cannot carry, or how it makes those decisions, that would raise serious concerns about the government's ability to censor or distort what people are saying or watching on TikTok," Patrick Toomey, deputy director of the ACLU's National Security Project, told Forbes.
It's unclear how much the draft agreement has changed in the past year. After CFIUS demanded in March that ByteDance sell TikTok or find it banned, TikTok and CFIUS have gone quiet about where negotiations stand.
TikTok spokesperson Alex Haurek told Forbes the company has "been working with CFIUS for well over a year to implement a national security agreement and have invested significant resources in implementing a firewall to isolate U.S. user data. Today, all new protected U.S. user data is stored in the Oracle Cloud Infrastructure in the U.S. with tightly controlled and monitored gateways. We are doing more than any peer company to safeguard U.S. national security interests."

An abortion ban in Indiana is set to take effect within days. The Indiana Supreme Court held in June that a law banning abortion in most cases does not violate the Indiana constitution. Under the new law—the first to pass after the U.S. Supreme Court overturned Roe v. Wade last summer—abortion will only be allowed 1) when continuing a pregnancy presents a serious risk to the mother's life or health, 2) up to 12 weeks, if the pregnancy is the result of rape or incest, or 3) up to 22 weeks when the fetus has a lethal anomaly.
On Monday, the Court denied an American Civil Liberties Union of Indiana request for a rehearing in the case. The denial "means the ban will take effect once a June 30 ruling upholding the ban is certified, a procedural step expected to take just days," reports the Associated Press. "Indiana's six abortion clinics stopped providing abortions late last month ahead of the ban officially taking effect."
Another suit challenging the law—this one on religious freedom grounds—is still playing out.

There are reports circulating that colleges and offices are beginning to reinstate COVID mask mandates and contact tracing despite no new cases of the virus being reported.
The Atlanta Journal-Constitution reported Monday that Morris Brown College, a black private liberal arts college has reinstated the measures as part of a “precautionary step.”
The report notes that students and staff will all be asked to mask up while on campus, only one week after classes began.
The measures, which include social distancing, temperature checks and no large gatherings are to be in place for two weeks, it is claimed.
In addition, it has been reported that California-based film studio Lionsgate has reimplemented a mask mandate at its Santa Monica office.

To be fair, they did ask if I had COVID symptoms and took my temperature, but given the fact that that population is uniquely vulnerable, I found it entirely reasonable. Nobody ever raised an eyebrow at the face that I was blowing my nose because the freshly-mowed grass had activated my allergies.

A small number of low-level employees of a national enterprise called GBI Strategies illegally submitted fake voter registration applications to Muskegon County. They did this because GBI Strategies compensated them, at least in part, on a per-submission basis. And their plot was foiled only when the local clerk detected fake addresses and forged signatures. After looking into the matter, Michigan authorities shoved the case to the FBI and wiped their hands of it.
For one, we’re asked to see GBI Strategies, an entity financed by Joe Biden’s presidential campaign, as the innocent victim of its employees’ fraud. But trustworthy enterprises have internal controls to deter and detect fraud by their employees. The better view is that even if GBI Strategies as a whole did not willfully perpetrate fraud, surely its procedures for detecting fraud were woefully insufficient. Smaller failures in businesses far less important to our democracy have spurred investigations, prosecutions, and onerous new laws.

The New York Times shamelessly ran this headline: Climate Change Turned Lush Hawaii into a Tinder Box.
The White House has similarly blamed the Canadian and California wildfires on climate change.
But what could have prevented the near-100 deaths, the loss of thousands of homes and the billions of dollars of property damage was better planning for just this kind of event.
That risk mitigation didn’t happen despite years of warnings by climate experts, the utility companies and local residents.
Why didn’t it? Well, herein lies the real scandal of the Hawaii fires.
It wasn’t our fossil-fuel use that caused the fires. It was climate-change alarmists who demanded all the money go to green energy rather than saving at-risk homes and lives.
It turns out that in recent years the forest fires in California and Canada and now Hawaii have emitted so much carbon into the planet’s atmosphere that they have undone most of the supposed benefits of the hundreds upon hundreds of billions of dollars the United States has spent to reduce greenhouse-gas emissions over the past decade.
In other words, if we simply took a small fraction of the money governments spend on wind and solar and batteries and taking away people’s cars, gas stoves and pizza ovens and instead spent the money on better forest management, we would be doing more to clean the air.
And we’d be saving many more lives — of humans and animal life and trees. Isn’t that the objective of a true “green” agenda?
The US really does have one of the dumbest forest management policies imaginable, and it's obvious even by their own direct admission. Go to parks out west with a lot of forest land, and the exhibits at the visitor center constantly emphasize how low-level fires in centuries past helped clear out a lot of the underbrush, kept trees spaced at a good distance, and thus made megafires a lot less common.
The smart thing to do would be to provide leases to logging and land clearance companies to come in and clear out dead-standing trees and underbrush once or twice a year. But they tend to let Forest Service/BLM employees do that instead, so you don't get the mass clearance that could be achieved through scale, and thus it all builds up until you have an event like Maui or the various forest fires out west that happen on an annual basis now.
The expensive neighborhoods around Breckenridge get fairly good management. The poor neighborhoods? Not so much.
Many people are still exclusively blaming PG&E for the Camp fire in California.
The thing the Camp fire and Maui fire have in common - authorities chose deliberately to not use the warning systems.

I grew up in the church and found it all offputting, not for me, and mostly had issues with a lot of what I found to be non-sensical ideas. As I got older it just felt like a lot of nice people, who had a tight knit community, who just happen to believe wacky shit (IMO). But it does seem to do a lot of good for the community, and there are lots of great values that come from it.

I would agree that Americans have too many elections. Some of the elections, spring primaries especially, get very little participation. I think politicians of both parties tend to use low participation election to their advantage. So, I like to see elections condensed to a single part of the calendar, likely have all elections in fall. I also like to see primaries reduced also with more use of instant primary/rank choice voting. I would keep primaries where voter participation is good, but if a primary is bringing out less than 50% of eligible voters then just switch it to RCV.

I would agree where there is a partisan race, but many office at state, county and local levels are non-partisan. He I would suggest an RCV approach to eliminate funding an extra primary election.

America has roughly 90,000 local governing bodies, and states do not—at least publicly—track all of the elections taking place on their watch, making an exhaustive accounting nearly impossible.
We used to have a ton more. At the end of WW2, before the growth of suburbs and before school districts, we had 140,000 governing bodies solely for education. And really who gives a fuck about some 'exhaustive accounting' other than some central planner. There's more than 300 million Americans.
In America, voters don't do too little; the system demands too much. We have too many elections, for too many offices, on too many days. We have turned the role of citizen into a full-time, unpaid job.
This is worse than nonsense. Voting is not an act of citizenship. It is the ABANDONMENT of citizenship. The idiocy of spending zero time/effort choosing which bar of soap will do the actual work of citizenship. And no - spending more time/effort/knowledge choosing the bar of soap 'more wisely' is missing the point.
The notion of citizenship goes back to Aristotle and Plato and every other philosopher that the founders knew about and that came later.
In the Aristotle model, citizens are those who SHARE in the HOLDING of offices. Same as the militia for defense. At the local levels, that looks like Toquevillean civic association, or the FreeMason notion that everyone had to serve on the school board at some point or the notion that only a jury-of-peers has the responsibility to determine life/death in a capital criminal trial. That is NOT VOTING.
It is that knowledge of holding an office that MAY provide the skills necessary to judge who else is capable of holding an office in a more extensive polity (eg federal or state). That is voting but it can only be based on the knowledge of holding an office.
Failure to provide citizens with their obligation to share in the holding of office can only result in an extremely manipulative form of oligarchy if the 'vote based on ignorance/exhaustion' becomes the form of selection. Or a dictatorship/monarchy if we decide, as this author seems to hint at, to eliminate even voting based on ignorance/exhaustion.

As of July 1, 2022, there were 852 public school districts, including 368 elementary districts, 97 high school districts, 386 unit districts, and one Illinois Department of Juvenile Justice district, and two cooperative high schools.
Of these, a stunning number are one-school school districts, even in Chicagoland.
Looks like Illinois did less consolidating than most places. Midwest was the most hesitant to consolidate school districts. Even so - high schools all definitely used to be one-school board (even if not one-school tax entity) and there are 1000+ public high schools in IL.
The Illinois Policy site has good info but is dead wrong about their premise that more governing bodies = higher taxes. The only thing fewer governing bodies results in is more centralization of decisions. By definition. If you think centralization itself results in something more then you are just going along with one strain of progressivism. That being:
1. We can all agree on what really needs to be done.
2. Centralization will create economies of scale and efficiencies.
3. Once we do that thing, we can
do something elsecut taxes.That mindset is anti-Hayekian. It is also the source of why people get increasingly apocalyptic and tribal about what will happen when your side loses the next election. Because in fact we don't all agree on what needs doing. We are just tied together in one entity like a scorpion with two tails.
The problem is that the various taxing bodies pile on. Since they're mostly funded through property taxes, they each add onto a property tax bill. For example, you can be in a K-8 school district, high school district, mosquito abatement district, sewerage district, fire protection district, township, municipality, port authority, library district, and community college district all at the same time.
In addition, Illinois used to have a cap on how much a taxing body could raise/increase taxes in any given year (the cap is gone). So the only way to raise more money through taxes was to add on another taxing body.
Well it is certainly true that land/property taxes can be (though not necessarily as many states make the allocation decision at state level) extremely local. Income/sales (and for that matter debt) won't be local at all. They each tend to apply to different people and can be avoided by other people so they are each part of the tax-him-not-me-but-spend-on-me-and-not-on-thee electoral game.
That latter problem is the biggest problem since it is what feeds the free lunch brigade. And since this is all a complete financial mess, it is one of the reasons we've given up on self-governance and instead just vote for someone else to steal what we want stolen.

A lot this resulted from the increasing professionalization of politics that took place in the decades after World War II as well. Poli-sci majors, activists, and lawyers who spend their entire careers climbing the political ladder from the school board to governor and senatorships, because they're addicted to the intrigue and getting their name in the paper.
I don't know what caused the whole Bowling Alone or the end of the masons/elks/etc thing. But that's imo what caused it. WE chose to disengage.
Honestly, probably the breakdown of the that post-WW2 civic consensus during the 60s and into the 70s, plus the efforts to desegregate voting in the South inadvertently led to a cultural perception that voting rather than civic participation was more important. Even with all the mass migration that took place in the 1950s, there were still organizations like the Jaycees and those Elks/Masons/VFW civic groups you mentioned that people participated in. You see that slowly becoming less common as the New Left became more politically active, and it was effectively dead by the time Reagan's term was in full swing and the Greatest Generation gave way to the Silents and the Boomers as the nation's political leaders.
re the masons/etc, I’d posit that it was the postwar migration and generation shift that broke them. Some of the older generation that moved after WW2 kept their existing membership – but in the old location (where they had friends) not the new. They never set up a lodge in the new and so never recruited the next generation. The GI Bill generation moved to places that were generationally homogeneous. By the time they were old enough to become more active in a group like the masons (say kids out of elementary school), and all at the same time, there weren’t any lodges in their town because the town was greenfield. The masons peaked in 1960.
Organizations like that spread personally and by word of mouth rather than active marketing. When they fail, it’s because there is a failure to connect old with new.
