California Is Set To Outlaw Unannounced Condom Removal

California is set to outlaw unannounced condom removal. A bill that passed the California legislature earlier this week and now awaits Gov. Gavin Newsom's signature would be the first in the country to make such "stealthing" a cause for legal action.

But the measure (Assembly Bill 453) will not work through the state's criminal code. Rather, removing a condom without a sexual partner's verbal consent will become grounds for a civil lawsuit and punitive damages, with the act added to the state's civil definition of sexual battery.

Under A.B. 453, "a person commits a sexual battery who causes contact between a sexual organ, from which a condom has been removed, and the intimate part of another who did not verbally consent to the condom being removed."

In effect, it creates an affirmative consent rule for condom removal.

Supporters of the legislation say that consenting to safe sex doesn't mean consenting to sex without a condom. Thus, furtively removing a condom before or during sexual activity amounts to rape.

Yet determining who is telling the truth in such cases will be incredibly tricky. If nothing else, this seems like a very difficult claim to prove in court. ("How the fuck is this enforceable?" comments Nancy Rommelmann on Twitter. "It's not.")

Even folks who agree with the theory behind the law note that proving an offense may be impossible.

Regulating sexual conduct is a pain practice, since usually there are only two people present, the accuser and accused. But in theory, makes perfect sense: if sex if consented to conditional on a condom being worn, removal would result in sex without consent.

And what if someone never puts on a condom in the first place but their partner mistakenly thinks they did—could that partner still sue? Will the law punish people who inadvertently lose a condom during sex? Won't people sued under the law simply claim this is what happened?

All in all, enforcement here seems like a logistical nightmare. That's not necessarily a reason to oppose the law. (Proving sexual assault claims in general can be difficult, of course.) But it does suggest that the measure may be more symbolic than anything else.

It also means the measure could be ripe for abuse—disproportionately wielded against the same parties who routinely suffer most under U.S. laws.

In any event, it seems at odds with California's 2017 move to reduce penalties for knowingly exposing someone to HIV.

Spectacular though the 9/11 attacks were, they did not, as many feared, indicate that large and powerful terrorist organizations had laid down roots in the West and threatened the foundations of its social order. Meanwhile, the persistent fear of that outcome—which was never likely—has blinded many to an opposing trend: the steadily growing coercive power of the technocratic state. With artificial intelligence already entrenching this advantage, the threat of a major armed rebellion, in developed countries at least, is becoming virtually nonexistent.

In New York City, cops use war-on-terror tools against minor crime suspects and innocent people. The New York Times details some of these:

New Yorkers simply going about their daily lives routinely encounter post-9/11 digital surveillance tools like facial recognition software, license plate readers or mobile X-ray vans that can see through car doors. Surveillance drones hover above mass demonstrations and protesters say they have been questioned by antiterrorism officers after marches. The department's Intelligence Division, redesigned in 2002 to confront Al Qaeda operatives, now uses antiterror tactics to fight gang violence and street crime.

                    It seems I was mistaken, it was this ad with rioting imagery I was thinking of, but upon checking there don't appear to be any burning flags. I probably mistook it for actual riot footage. It's all blended the last few years.

                      Even if some companies were using that imagery, burning the flag for a large company that trades on its brand image is going to be risky. Because some people took that risk, doesn't mean it was a good idea--or that other people are likely to emulate them. If this or that company made a mistake and got away with it, doesn't mean there isn't a general rule. And generally speaking, you will alienate a fat slice of American consumers by denigrating the flag and the national anthem.

                      In fact, the reason BLM denigrated the national anthem is because they knew it would offend a large number of people. If no one had cared, they wouldn't have kept doing it. Meanwhile, as recently as last Sunday in San Diego during a Padres game, everyone stood up for the national anthem, the Navy jets from Miramar did a flyover, the Padres wore camo uniforms to salute the troops, and most everyone stands up and claps (if they don't sing) along with the Marines' Hymn, which they serenade hundreds of Marine recruits with every Sunday at the stadium.

                      Baseball and Football fans are probably more patriotic than the average American, but then the people of San Diego are probably more liberal than average--and the Padres draw a pretty good sized crowd day in, day out--even when they aren't playing well. Moral of the story: I suspect the NFL has damaged its brand with some of its most important customers over the last couple of years. They could hide behind lost ticket sales and empty stadiums to explain the drop in viewership over the course of the pandemic. It'll be interesting to see how the NFL does in the ratings over the course of the weekend vs. how they did in 2019.

      I used to be a diehard football fan, watched every game I could. Had NFL Sunday Ticket, never missed a Seahawks game. Now I am ehhh, whatever. If I see the Seahawks are being broadcast in my area (generally only get one NFC team and that game is usually the Vikings) I'll watch. I'll check scores on Monday, watch the Superbowl, but other than that, I don't really watch like I used to. Some of it is because of all the politics. I started getting turned off when the announcers starting getting into politics, long before the kneeling. I want to watch football not listen to some brain dead twit expunge on their personal political views (NBC Sunday night football was the worst for this). It didn't help that 99%of the time their political views were the opposite of mine. I also got frustrated with the bandwagon, head nodding analysis, and toing the line with whatever Goodel proclaimed (the refs suck, tend to be biased and every NFL fans knows it, Goodel refuses to do anything about it). Also, it frustrated me when the networks decreased coverage. Used to be both channels would run double headers every Sunday, but now they only run one game a day, almost always the east coast broadcast (the game running when I'm at church, when I go to church). And the final straw has been how resistant the NFL has been to making games available for streaming. I'd probably watch more if I could find a way to stream every Seahawks game (I think maybe I can do it on YouTube, but I haven't figured out how). When it comes to the Vikings I am eh whatever. Hey NFL, just because I live closer to the twin cities than Seattle doesn't make me a Vikings fan.

                      Oh, the last time I tested whether it’s still possible to spoof handles was several months ago. And it was.

                      I think it was around the time they added the Mute feature. One nice thing about the Mute feature is it is account-based, so even if Tulpa (or whoever) goes in and edits his handle everyday, it still muted his comments. It’s really cut down on the spoofing (that I have to look at, at least).

    I recently saw a woman online argue that she'd been raped--because the guy she slept with, effectively, lied about his profession and his income. She claimed that she wouldn't have consented to sleep with him if she'd known he was poor, and so he basically had sex with her without her consent.

    From a libertarian perspective, we often end up with the position that something should be legal despite it being unethical. Because libertarians don't think people should be criminally charged for adultery doesn't mean we need to pretend that cheating on your spouse is ethical, and the same thing applies to abortion.

    I see removing condoms during sex and lying about your income through pretty much the same lens. If you would have consented to sex with the guy if he'd had a higher income, then the sex wasn't non-consensual. You were defrauded, and if you can persuade a majority of a jury by a preponderance of the evidence that you should be awarded damages because the guy you consented to have sex with wasn't as wealthy, educated, or Italian as he said, then those damages may be appropriate, but good luck convincing a jury of that.

    It's the same thing with taking off a condom. If that results in an unwanted pregnancy, an STD, or some other negative outcome, then you should be entitled to sue for damages in civil court. Rape is nonconsensual sex. If a rape victim asks the rapist to put a condom on first, that doesn't make the rape consensual, and taking a condom off doesn't make the sex itself non-consensual either.

    P.S. Women who lie about being on the pill or run pinholes through condoms should be subject to civil law, as well. If a woman lies about being on the pill or damages condoms before you use them, that also doesn't mean the sex itself was non-consensual.
