Sedition Cases Against Capitol Rioters 'Will Bear Fruit Very Soon,' Says FBI
Plus: Senators call impeachment trial unconstitutional, Biden cancels private prison contracts, Apple sued over Telegram, and more...

Sedition charges in the works for Capitol rioters. On Tuesday, the Department of Justice announced that it will bring sedition charges against people who stormed the U.S. Capitol on January 6. The punishment for seditious conspiracy is up to 20 years in prison.
So far, the Capitol riot has spawned more than 150 federal cases and more than 50 cases in D.C. court, FBI Assistant Director in Charge Steven D'Antuono said yesterday, adding that the FBI has opened more than 400 subject case files. (Back on January 15, only 42 people faced federal charges.)
As for seditious conspiracy cases: "Yes, we're working on those cases, and I think those results will bear fruit very soon," D'Antuono said.
Calls for sedition charges haven't stopped with people who stormed the Capitol, with some raising the possibility of sedition charges against politicians who spread election fraud conspiracy theories or encouraged people to come to D.C. to protest.
Under federal law, the crime of seditious conspiracy is defined as two or more people conspiring "to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof."
While this might technically apply to some folks involved in the events of January 6, "sedition charges are almost always a terrible idea," cautions Reason's J.D. Tuccille.
"Sedition prosecutions in the U.S. have a particularly shameful history," as Bloomberg's Noah Feldman pointed out last fall in a piece titled "Sedition laws are the last resort of weak governments."
Not only is their historical use full of horror stories, but their very nature makes them ripe for abuse at any time, as a catchall threat against anyone who challenges government policy or criticizes government actions. They can also be used to escalate criminal acts at any protest around the country into a federal case, as former Attorney General William Barr endorsed last year.
Many of the people who stormed the Capitol deserve some charges, and seditious conspiracy might seem as good as any at a glance. But reviving the use of sedition charges like this could backfire against free speech and protests more broadly.
Law professor and blogger Eugene Volokh explains a little bit more about sedition and seditious conspiracy charges:
This is just a special case of the broader proposition that conspiring to commit a crime can itself be a crime. You can be punished under state law for conspiring to commit murder or theft or what have you. You can be punished under federal law for conspiring to commit bank robbery, or to defraud the federal government. Likewise, you can be punished under the "seditious conspiracy" statute for conspiring to illegally oppose the enforcement of the law.
The current federal statute on sedition is, at the very least, much less severe than its historical counterpart:
[Seditious conspiracy] is quite a different statute from the Sedition Act of 1798 (or from the common-law crime of seditious libel), which punished (among other things) false and malicious speech intended to defame the federal government. And to the extent that the seditious conspiracy law punishes agreements to commit crime, which may be expressed by speech, such conspiracy is viewed as constitutionally unprotected, because it is speech integral to the criminal conduct that is being planned. For more on this, see U.S. v. Rahman (2d Cir. 1999).
IMPEACHMENT UPDATE
Republicans declare impeachment trial itself unconstitutional. The majority of GOP senators designating the latest Trump impeachment trial unconstitutional wasn't enough to stop it from moving forward. But its ultimate prospects aren't good. "Lawmakers narrowly killed a Republican effort to dismiss the impeachment charge as unconstitutional," says The New York Times. But the 55–45 vote "strongly suggested that the Senate would not be able to convict the former president." All Democrats plus at least 17 Republican senators need to vote to convict Trump in order for it to happen.

Indiana lawmakers are trying to make it harder for Libertarians to get on ballots. A new measure (House Bill 1134) from state Rep. Ethan Manning (R–Denver) "would require Libertarians to collect signatures of registered voters to run for governor or U.S. Senate. Under current law, Libertarians nominate those offices in a primary convention and are not required to gather signatures required of Republicans and Democrats as part of the primary ballot process," notes The Journal Gazette.
Manning's bill would still allow Libertarians to nominate governor and U.S. Senate candidates via convention but would then also require the nominee to meet the signature requirement, which is 500 registered voters for each of the state's nine congressional districts."
"Rep. Matt Pierce, D-Bloomington, said a cynical person would see it as a bill to punish Libertarians because they did well in the last gubernatorial election, and some believe they siphon votes from Republicans. …
Rep. Cherrish Pryor, D-Indianapolis, said the bill adds more requirements on Libertarians without giving them any new powers or advantages."

Apple and Google sued over Telegram posts. "Here's an interesting lawsuit, brought to you by some familiar names," writes Tim Cushing at Techdirt. "And by 'interesting,' I mean 'exceedingly stupid.'"
Apparently, former U.S. ambassador and Coalition for A Safer Web head Marc Ginsberg is suing Apple over content posted to encrypted messaging app Telegram, which is not affiliated with Apple except insofar as the Telegram app is available through the Apple app store. Ginsberg argues that some Telegram posts and chats are bad, so Apple shouldn't even make Telegram available. More from Cushing:
Ginsberg claims the Telegram app violates Apple's developer guidelines and California's hate speech law and should be removed from the app store. Because Apple hasn't removed the app, it has been downloaded and used by people who engage in anti-Semitic speech. (Ginsberg is Jewish.) Because Telegram refuses to remove this content, it somehow leaks into Ginsberg's life through the app store—even if Ginsberg has never downloaded the app or engaged with its users.
Ginsberg is also suing Google over making Telegram available through the Google Play store.

In reality, it would give them an incentive to censor far more aggressively. To protect themselves from being sued over content, they would remove anything remotely controversial. Help me out here though. I had thought that graduating Ranger School meant one was "Ranger-qualified," not a "Ranger?" "Ranger" was reserved for those who had served in the actual 75th Ranger Regiment. Further, service in Regiment meant assignment to one of the battalions, whose insignia is a scroll. Hence "Scroll" vs "Tab." I had thought it was considered a douchebag move to refer to oneself as a Ranger without having served in the Regiment.
Finally, AIUI, Jason Crow served as a JAG augmentee after he was a platoon leader in the 82nd. Very valiant, served in combat, graduate of Ranger School. (As is everyone in Infantry who wants to advance beyond O-4.) Was he actually in Ranger Regiment, and if so, was it as something other than the JAG guy back at Brigade? His slapfight with Cotton over this sounds like a "when assholes collide," moment.
I was in the Army for a long time and whenever I saw the tab I thought "Ranger" and not "Ranger qualified". Anyway, it seems to me that if you are in the regiment having the tab is what matters and if you go to Ranger school from the regiment and fail you get reassigned. The school is what separates the "men from the boys" (or the whoever from the whatever now). As far as I'm concerned the Ranger regiment is just a very high speed light infantry regiment, they might be SOF but they had to be bailed out by good old straight leg grunts during Gothic Serpent (just like the SEALs in "Red Wings").
That happens when you don't bring armor (even APCs) or significant air to a large urban infantry fight. And when you cleverly rely on truck exfiltration from said urban target area. At a time of day for maximum enemy alertness. Oops. And compound the error by emplacing around the high value target (the first downed UH-60), instead of cutting the dead out, destroying anything sensitive, and GTFO. If the Somalis had any indirect fire worth the name, those Rangers would have been fucked.
That said, when they play to their strengths (fight at night, bring all the toys) they're probably the best raiding/DA force in the world. Probably just as good at the LRS mission too. I doubt a Ranger element would have made the fundamental errors that were made by the SEALs in RedWings, for instance.
Most guys I know he served in the Regiments didn't have their tabs, didn't have time to go to the school because of how high tempo their training was. Many were a bit salty when they saw a REMF/POG with the tab, while they wore the 75th scroll on their right shoulder but no tab on their left. I also would qualify the failure is automatic drop from the regiment. It depends on why you were DQd, I had a friend who was DQd for medical (pneumonia, and he was forced to go on sick call) and stayed with the Regiment.
That's more or less how my husband described it to me (graduated Ranger School but left service before he could serve in the regiment). He never refers to himself as a Ranger.
During the 1950s and 60s, they had Ranger school but no active Ranger Regiment. It was expected of infantry officers to go to Ranger school.

Three people are in custody and five more are wanted after a mail theft ring bust that uncovered two dozen high-caliber weapons, hundreds of rounds of ammunition and meth inside a luxury condo Thursday morning near downtown Houston.
Deputies with the Harris County Precinct 5 Constable's Office raided the condo on St. Emanuel at Tuam, where authorities initially reported a bazooka was among the stash. They later said it was not. The condo is a $650 per night rental, they said.
They call an AR15, as in a glorified .22, "High Caliber." News has become meaningless.

Can't tell what optic is in the Scar, other than it's some sort of LPVO. I liked shooting the Scar when I tried it. Surprisingly controllable in burst.

Here's a piece of stupid. I've got a Marlin Model 60. It's a .22 with a tube magazine. I can tell it was manufactured before the assault rifle ban because the tube is roughly equal to the barrel length. They cut the tube down to comply with the ban because a plinker that holds 16 rounds is an assault rifle, while the same plinker with a 10 round tube is not.

My buddy just got a Savage 30-06 bolt action. Definitely not the finest fit and finish, but seems solid and pleasant to shoot and great for the money.
Savage's business model had been for decades to build accurate out of the box rifles at affordable prices by sacrificing looks. The 110 series was the most accurate out of the box rifles (maybe still is) of any major gun manufacturer. My son still shoots my savage 110E that my Dad bought for me new in 1988. The stock is all dinged up but it still drives a .270 winchester with reliability.

870 or Mossberg 500. I prefer the Mossberg, shot it for years (my son now shoots it as I've moved onto a Franchi Affinity (just a bit more expensive and less felt recoil). The Mossberg is a drop in the mud, work the action and ready to fire type weapon. So is the 870. Also, the sound of a pump is enough to freeze most people in their tracks.

I have an 870. A friend brought his mossberg over last week. We shot the mossberg. An order of magnitude nicer. The Remington works and has never failed me, but the Mossberg was just finished nicely, while I was a bit embarressed by how poorly fit out the 870 was. Works though and I am good with that as it is paid for.
As for the M17, I like the modularity and the fact that I can shoot three different calibers with a simple barrel change. 9mm, .357 sig and .40 S&W. Mount tactical flashlight on the rails or a laser sight and can easily swap between the two. It is the AR of handguns.

You can do that with a Glock too, FWIW. Storm Lake drop in barrel, buy the right mags, and you're done. Maybe futz with the springs if you must.
I do recommend very highly---especially if you're starting to be an old fart, like I am---looking into either a reflex sight or laser sighting system for your pistol. I can't anymore, line up and keep focused sufficiently on the front sight and still maintain target awareness. With the dot, I can.
Worth the minor hit on concealment, and even there, a laser dot system like Crimson Trace doesn't make the pistol any more difficult to conceal.
Anyway, if I had an extra gun's worth of cash burning a hole in my pocket, I'd get a red dot or laser vs buying another gun.
Don't have a carry weapon currently. I do have a .22 magnum in my glove box, but it's there for coyotes and such.
Funnily enough growing up I didn't shoot pistols much but have found I am a better pistol shot than rifle shot or shotgun (wing shooting). I killed a gopher at 25 yards off hand using a Freedom Arms SAA clone, chambered in .22 mag last spring, head shot using fixed sites.
I also split a one inch trig with the same pistol twice in a row at 15 yards.

And I like the .40 S&W for self defense. Loaded with winchester elite defender 165 gr rounds, it is the perfect balance of hitting power and reduced recoil in my opinion. It is what I got my wife, a Springfield XD-40.
I have a Springfield XD-E (as in Exposed hammer) in 9mm. Thought I'd like a single-stack double action, but I don't like it. I don't shoot well with it. Grip is too thin.
My wife's XD-40 is a double stack. Biggest issue I have is it is a bit stiff to chamber a round for her, and not a big fan of trigger safeties. But I have looked into devices for helping her jack the slide, any suggestions?
I can shoot under a 4 inch group off hand at 35nyardd out of the 4 1/2 inch barrel. My wife was concerned that her 5 inch group was not good enough. I said "hun, if you can put 5 shots into an inch group at 25 yards, at self defense range (under 10 yards mostly) you are more than accurate enough."

That said...there are a variety of pistols that are made to be easy to cycle/manipulate. There are the barrel tilt-up models like some small Berettas. Smith makes an EZ line for the Shield. My girlfriend did not find the EAA Witness models for women that much easier to manipulate, even though that's how they're marketed. Walther makes a CCP that utilizes gas assisted retardation of the slide, AIUI, which allows the spring weights to be much less. Pity it's of the quality of their Umarex line, and not their PPQ. There are choices, IOW. Try a bunch.

Grab the slide, push with the other hand. So it's not manipulating the slide. It's holding the slide tight and pushing the gun. Maybe that might work for her.
I have had her do that and like Grey said it is practice she needs. She was able to rack it easier that way. She just needs range time.
Then do it. Make a point of buying a box of ammo every week, and using it up. Make it routine.
I walk a mile on the beach every day. Rain, shine, tourists, blizzard, whatever. Got a tides app on my phone, and when I'm not getting my feet wet I go. Maybe do something like that with shooting. "Hey Hon, time to put some holes in some innocent pieces of paper, let's go!"
I just bought some snap caps. Maybe you could get some of those and she could practice clearing a mag, but with harmless snap caps. Make it safer.
We do have snap caps and I have had her practicing with them.
Dry fire. With snap caps if need be, but you don't need them. Racking the slide after every shot will toughen up her muscles and tighten her technique.
If you attach a laser, like I mentioned upthread, you will be absolutely amazed at how much that thing dances during your trigger press. You'll tighten up your technique, just from that feedback. And a hell of a lot cheaper than what centerfire pistol amm ogoes for these days.

That's the whole point of 230, though--that platforms can't be held liable for what their users post. It's when they are classed as a publisher that the liability clause kicks in.
It's why I keep saying that there's no reason to repeal 230 to solve this--just re-classify the Tech Trust social media platforms as publishers, since they are actively curating content now. If they don't want to lose that privileged status, then they should fire 90% of their moderators and let things operate like they did in 2007, when it was freewheeling.
The fact that Reason doesn't even weed out its spam comments is a big reason why L'Affaire Woodchipper turned out in its favor, because, technically, they could be considered a publisher in all other aspects as a politically partisan magazine.
I have a suspicion that "getting rid of Section 230" might be stealing a base as well - it might be that a lot of these people don't actually favor getting rid of Section 230, they just favor getting rid of Section 230 for platforms that censor viewpoints they find disagreeable. If Susan Collins weren't in the Senate, and a Democrat were in her place, Schumer would not have had to enter a power sharing agreement with McConnell (with an equal number of committee members from both parties and the filibuster intact for the time being). The extent to which other factors impact policy, they are all secondary to control of the chambers of Congress and the White House.
Again, the belief that the authoritarian and socialist policies of Biden and the Democrats would have less chance of passing (or passing in a milder form) because the Democrats had absolute control of the Senate is absurd.

I think there are a lot of old-school libertarians who have become accustomed to never being in power. And they may have a hard time transitioning to the idea that policy differences are primarily a function of who controls which chamber.
There wasn't much of a difference between Democrats and Republicans--from a libertarian perspective--for at least 20 years. There wasn't a substantial difference between Bush Jr. and Obama on issues that mattered to libertarians--not even on issues like the Drug War, mass surveillance, war mongering, TARP, and gay marriage.
Obama campaigned on "Marriage is between a man and a woman".
Obama raided medical marijuana dispensaries in California hundreds of times during his first term.
For libertarians who lived through every day of that 20 years, when there was no substantial difference between Republicans and Democrats on libertarian issues, it is hard to suddenly see the differences--especially when so much of the reason to support Republicans is because the Democrats have become so awful from a libertarian and capitalist perspective.
I didn't vote for Trump in 2016, and when I voted for him in 2020, it was in spite of Trump being wrong about immigration, trade, and Section 230. One of the reasons it's so important to be honest in our criticisms of the candidates we support is because that's how we persuade people who need to overcome the same obstacles. Trump was wrong about x, y, and z, and when he lost it was avoidable travesty for libertarian capitalists.
This election was unusual, and we shouldn't necessarily fault our fellow libertarians for not realizing how much was at stake and what the consequences of one party or the other winning would be. Being lulled into complacency by 20 years of no significant policy differences between the Democrats and Republicans is an easy trap to fall into. Refusing to crawl out of it is another issue.

This is what I see too, except for the timing, which was actually about 20 years earlier than you thought. The LP organized at the peak of Demoblicanism, which extended from about the US entry into World War 2 to the fall of the Iron Curtain. By about 1995, Don Ernsberger was easily able to discern the divide between the Democrats and Republicans on a libertarian scale in a study he did.

WASHINGTON (Reuters) - The Biden administration is “actively looking” at expanding mandatory COVID-19 testing to travelers on U.S. domestic flights, a senior Centers for Disease Control and Prevention official said on Tuesday.
On a call with reporters, Dr. Marty Cetron, director for the Division of Global Migration and Quarantine at CDC, was asked about whether new domestic travel testing requirements might be employed. Cetron replied that there were “conversations that are ongoing and looking at what the types and locations of testing might be... We’re actively looking at it.”
Last week, President Joe Biden directed U.S. agencies to make recommendations to “impose additional public health measures for domestic travel” and to consider new requirements for people crossing land borders. Reuters reported Friday that administration officials said that could include requiring negative COVID-19 tests before flying domestically.
This looks like one of the Democrats' "float this idea to our media shills and see how people react" psyops that became common during the Obama administration. If the pushback is too strong, they'll retract it and say it was "only looked at as an option, but never seriously considered," and if it's ignored, they'll push through with it.
Imposing coof tests for domestic travel would crater the airline industry. We've already had to bail these guys out twice because Democrats are terrified of a common cold bug that's killed a smaller percentage of Americans than the Hong Kong flu did in 1969, and that's assuming the numbers aren't a complete stock market-style pump operation. Long-standing racial and ethnic tension—including opposition to immigration—has driven DVE attacks, including a 2019 shooting in El Paso, Texas that killed 23 people.
DHS is concerned these same drivers to violence will remain through early 2021 and some DVEs may be emboldened by the January 6, 2021 breach of the U.S. Capitol Building in Washington, D.C. to target elected officials and government facilities.
DHS remains concerned that Homegrown Violent Extremists (HVEs) inspired by foreign terrorist groups, who committed three attacks targeting government officials in 2020, remain a threat.
Threats of violence against critical infrastructure, including the electric, telecommunications and healthcare sectors, increased in 2020 with violent extremists citing misinformation and conspiracy theories about COVID-19 for their actions.
DHS, as well as other Federal agencies and law enforcement partners will continue to take precautions to protect people and infrastructure across the United States.

This was sedition by government against citizen voters, not citizens challenging government policy or criticizing government actions. The historical horror stories of sedition charges against private citizens by abusive government are totally inapplicable to these government seditionists. That is an argument that past government bad actors abusing private citizens licenses Trump and his fellow government bad actors to continue in abusing private citizens. In addition to seditious conspiracy and other appropriate charges, they should all be charged for violating civil rights under the color of law.

Protesters gained entrance to the Hart Senate office building's atrium and dropped two banners, one reading "End War Now" and the other "People for the People."
NBC News reports as soon as demonstrators unfurled their signs, Capitol Police placed them under arrest. At least six have been arrested for unlawful conduct - demonstrating. Dozens of other demonstrators ran through the building's upper levels chanting and waving smaller signs.
The offices of Democratic senators Dianne Feinstein and Harry Reid are located inside the Hart building, as well as Republican Marco Rubio.
The political protests rumble into a second week in the nation's capital. The demonstrations, smaller in size than the Occupy Wall Street protest in New York City, have for the most part been restrained and peaceful. On Saturday, one demonstrator was arrested after a group attempted to enter the Smithsonian Air and Space museum. Guards repelled the demonstrators with pepper spray, and the museum shut down early.

More than 300 people were taken into custody by police on Capitol Hill after descending on a pair of Senate office buildings Thursday afternoon to protest the confirmation process of Brett Kavanaugh, President Trump's Supreme Court nominee.
The vast majority of the arrests, 293, were a result of protests in the Hart Senate Office Building, where protesters crowded in the atrium. Loud chants could be heard throughout the building, which is structured so the hallways of each floor open up and look out onto the first floor.
Those arrested in Hart were charged with crowding, obstructing or incommoding, according to Capitol Police. Another nine people were arrested on the fourth floor of Dirksen Senate Office Building and charged with unlawful demonstrations.

Demonstrators protesting President Donald Trump and the prospect of war in Iran occupied the Hart Senate Office building Monday. Active protests are prohibited in the Senate office buildings, but demonstrators maintained that they would work within those limitations by not chanting or waving signs, occasionally invoking the ire of Capitol Police but not the handcuffs.

WASHINGTON (Reuters) - Black-clad activists among hundreds of demonstrators protesting Donald Trump’s swearing-in on Friday clashed with police a few blocks from the White House, in an outburst of violence rare for an inauguration.
At least 217 people were arrested in the melees, police said.
The burst of civil disorder followed a fierce presidential campaign that ended in a stunning victory for Republican Trump over Democrat Hillary Clinton on Nov. 8 and left the country divided.
Many of Trump’s supporters traveled to Washington to cheer their new president on Inauguration Day. Tens of thousands of detractors are expected to march peacefully on Saturday.
In the violence, knots of activists in black clothes and masks threw rocks and bottles at officers wearing riot gear, who responded with volleys of tear gas and stun grenades as a helicopter hovered low overhead.
At one flash point, a protester hurled an object through the passenger window of a police van, which sped away in reverse as demonstrators cheered. Earlier, activists used chunks of pavement and baseball bats to shatter the windows of a Bank of America branch and a McDonald’s outlet, all symbols of American capitalism.
Multiple vehicles were set on fire, including a black limousine. A knot of people dragged garbage cans into a street a few blocks from the White House and set them ablaze, later throwing a red cap bearing Trump’s “Make America Great Again” campaign slogan into the flames.
Police said six officers were injured in scuffles with protesters. The people arrested would be held overnight before making court appearances on Saturday, Peter Newsham, interim chief of the Metropolitan Police Department, told a news conference. Newsham added that police would continue to monitor security around the night’s celebrations.
Friday’s protests played out just blocks from Pennsylvania Avenue.

John Earle Sullivan was charged by complaint with one count of knowingly entering or remaining in any restricted building or grounds without lawful authority, one count of violent entry and disorderly conduct on Capitol grounds, and one count of interfering with law enforcement engaged in the lawful performance of their official duties incident to and during the commission of civil disorder. The Complaint alleges that during the events at the U.S. Capitol, Sullivan, wearing a ballistics vest and gas mask, entered the U.S. Capitol through a window that had been broken out, pushing past U.S. Capitol Police once inside. The Complaint also alleges that Sullivan admits to filming and being depicted in video footage that shows him present, outside of the Speaker’s Lobby within the U.S. Capitol, at the shooting of a woman by a U.S. Capitol Police officer.
The man showed up at a peaceful protest with ballistic vest and gas mask and a camera crew to "document" his activities? Who needs that stuff at a peaceful protest?
"PolitiFact reviewed Sullivan’s video of the mob into the Capitol and Babbitt’s shooting. It doesn’t show Sullivan clearly engaged in the violence or leading the run up to the Capitol, although it does show him animated as he spoke with police and rioters from the frontlines.
"At points in the video, Sullivan can be heard telling others he was only filming and discouraging violence. At other points, he appeared to encourage what was happening. As rioters scaled a wall outside, for example, he cheered them on. "We did this s---, together," he said after the barricades came down. "This is f------ history. We’re all a part of this f------ history."
"Let’s burn this s--- down," Sullivan can be heard saying on the video before heading inside.
Social media users have linked Sullivan to antifa and Black Lives Matter because of his past protest history and social media activity. His Twitter accounts have frequently used #antifa, #blm, and other anti-Trump or anti-police hashtags, PolitiFact found. The cover photo for one of his accounts advertised a Jan. 6 Insurgence USA event to "Kick These Fascists Out of DC."
Sullivan has also been filmed using incendiary language in the past. At a small August rally in Washington, D.C., he described the need to "rip" Trump out of office, according to Fox News. Photos highlighted on his personal website show him holding a firearm.
[Former CNN documentary filmmaker Jade] Sacker [who, with Sullivan, entered the Capitol with the "rioters" said she has followed Sullivan for four months and accompanied him to many protests, including some affiliated with Black Lives Matter. He is not pro-Trump, she said, but he cares about "dismantling the system." She said she had not personally seen him be violent.
Sedition is the law to silence dissidents, people like you and me who speak truth when the oligarchs don’t want us to.
