The Department of Justice is Very Unhappy With Joe Arpaio
Nearly 20 years since he was first elected sheriff, awful person Joe Arpaio is in trouble and his law enforcement practices will have to change. Not because democracy works and people stopped electing him, but because a three-year investigation by the Department of Justice's civil rights division has confirmed what a lot of people already suspected about Arpaio— not only is he super into chain gangs and humiliating prisoners by making them wear pink uniforms, but his heavy-handed law enforcement tactics target Latinos in a manner which is both a violation of their civil rights and the Constitution.
It's so bad that the Department of Homeland Security announced they will no longer coordinate with Maricopa County on immigration enforcement.
Arpaio has not been having the best of times recently. The man has cost Arizona's Maricopa County $5 million in lawsuit settlements (with another $177 million filed by various and sundry), has used $99.5 million in public funds to pay his staff instead of housing prisoners, and Reason readers might recall that he completed some kind of media whore trifecta by combining Steven Seagal, a tank, and television cameras in order to arrest a man for alleged cock-fighting, but that led to yet another lawsuit.
All this, yet the man has Republican primary candidates working for his endorsement as if it's a great honor — Michele Bachmann slobbered out the word "hero" during her attempts to get Arpaio's support, but he somewhat surprisingly threw that to Rick Perry, who is defending Arpaio even now.
But it turns out not only is Arpaio good at violating the rights of people who at best were actually in the country illegally, he is also really awful at following up on serious criminal complaints. While Sheriff Joe and his deputies were ignoring 400 sexual abuse reports between 2005 and 2007, many of which involved the Hispanic community, they were busy with their trademark heavy-handed immigration raids. Fifteen hundred people have been arrested or detained in these sweeping raids since 2008, but neither Arpaio nor his drones have the gift of identifying by sight which Hispanic-looking people are legally in the United States and which are not. According to his own office, just 57 percent of people caught or detained were are illegal immigrants.
According to an excellent, in-depth report from the the Associated Press, the investigation also found:
Latino inmates with limited English skills were punished for failing to understand commands in English by being put in solitary confinement for up to 23 hours a day or keeping prisoners locked down in their jail pods for as long as 72 hours without a trip to the canteen area or making nonlegal phone calls….
Detention officers refused to accept forms requesting basic daily services and reporting mistreatment when the documents were completed in Spanish and pressured Latinos with limited English skills to sign forms that implicate their legal rights without language assistance.
The agency pressures Latinos with limited English skills to sign forms by yelling at them and keeping them in uncomfortably cold cells for long periods of time.
Furthermore:
The civil rights report said Latinos are four to nine times more likely to be stopped in traffic stops in Maricopa County than non-Latinos and that the agency's immigration policies treat Latinos as if they are all in the country illegally. Deputies on the immigrant-smuggling squad stop and arrest Latino drivers without good cause, the investigation found.
A review done as part of the investigation found that 20 percent of traffic reports handled by Arpaio's immigrant-smuggling squad from March 2006 to March 2009 were stops — almost all involving Latino drivers — that were done without reasonable suspicion. The squad's stops rarely led to smuggling arrests.
The harsh conclusions reached by the DOJ do not mean any kind of litigation is forthcoming, only that it's being seriously threatened. Arpaio has 60 days to begin to get his house in order, meanwhile the investigation continues and schadenfreude should reign throughout the land.

I think it means something a little different, Ken. The way I understand it, the DHS will not use the MCSD to assist in enforcement of federal immigration laws because they cannot trust them to not violate civil rights or to investigate correctly.
Somebody correct me if I'm wrong here, but a lot of federal crime is investigated by local and state officials. They are typically part of a task force with the feds, but the grunt work is done by locals because the feds are just too thinly staffed (ha!) to do it all themselves. The MCSD has proven themselves to be so incompetent, biased and heavy-handed that the DHS has said "no thanks" to having them help out.
No, what it means is that MCSO can't be part of the S-Comm program, 287(g) (although I think Arpaio was already kicked out of that) and so on. Local law enforcement is allowed to enforce federal immigration law -- the feds are not debating that point -- but they have to follow the rules. SB1070 was an attempt by AZ to say, "we're going to enforce it anyway and you can't stop us!"
Oh, and how come we can't get this lucky on the drug war? Where some state refuses to enforce federal laws against marijuana, and the feds refuse to coordinate with local law enforcement on marijuana charges--because local law enforcement is prejudiced against people of color.
Arizona isn't refusing to enforce federal immigration laws. And the feds have decided not to coordinate with him cause it's possible he might be a racist asshole that is enforcing law in a prejudiced manner.
Not really in the DOJ's best interest to be helping a racist xenophobe in an election year when your boss is trying to court the Latino vote. Plus you know, civil rights violations and all that.

Two things. First, I don't suppose you know any hard numbers for how many cops get put on admin leave only to come back with no wrong doing being found? (I suspect it is not huge, but there are a decent amount of cases where the cop was wrong in the publics eyes and retains their job. And yes I know the public doesn't get the whole story, but maybe they should if you want public opinion of these situations to be different.)

Well then, I guess he's got a pretty good case of slander against the DoJ then. Accusing a LEO of blanket civil rights violations and serial breach of the Constitution are not charges to be made lightly, especially in an official reprimand/request to change behavior.
And the steps they ask him to take are addressing direct and calculated violations of the CRA and the Constitution. They are telling him that he's breaking the law. In fact, they're telling him that he's a serial lawbreaker and that he's also been warned repeatedly to stop breaking it. What they aren't telling him, however, is that he's under arrest for doing it.
Read the report. They are alleging that he is consistently and calculatedly breaking multiple laws, that they list.
And I'm out. If you want to contend this after reading the DoJ report, go right ahead. You can slog it out with somebody else. I'm going to go have a few beers and not think about arguing with you for one night. when i worked as a cop in hawaii, i ran into (literally) a cock fight on two occasions, just driving down some very rural out of the way dirt road.

If he avers that Sheriff Joe's kind are not cops, he could cite all sorts of anecdotal evidence, say, like almost all of the cops to whom he has ever spoken to on the subject have told him that being a deputy sheriff is just one step up from being Paul Blart.

sheriffs are usually elected politicians. they may or may not be actual cops, or a politician playing cop
sheriff deputies vary substantially. in some states, like Mass they are jail guards. they have very limited arrest powers, and do not do traditional patrol
in many other states (like california, WA, etc.) sheriff's are fully fledged LEO's and do the exact same thing that city cops do, except with broader jurisdiction, and often more power (in many states sheriffs have both civil and criminal enforcement power... although usually, only special units in sheriff;'s dept's will deal with civil stuff)
but in brief, don't be an idiot
sheriff's in AZ are just as much real cops (if not moreso) than city cops.

There is nothing wrong with Lama Smiths E-Verify "the Legal Workforce Act." At the very least, it is a step in the right direction. Even if E-Verify has some flaws and some illegal aliens are able to obtain employment, it won't last very long. Those hired illegally will be caught eventually when the irregularities are corrected with the electronic verification program. It's better to have something as a deterrent, than to have nothing at all. E-Verify and to some extent 'Secure Communities' is an official order to fingerprint of all individuals who pass through booking halls of police precincts. This is all we have at this present time, to slow and finally end the hiring of illegal workers. E-Verify will place the burden firmly on every United States business, to check every new hire or be sanctioned, fined or even be imprisoned.
