Judge will decide: "The Trump administration and Harvard University will appear before a federal judge on Monday as each party seeks outright victory in their clash over billions of dollars in research money that the government has taken from the school," reports The New York Times. "The hearing is likely to be a milestone in a lawsuit that partly hinges on what the government's role in higher education should be."

Judge Allison D. Burroughs is expected to issue a summary judgment, which decides the lawsuit without it advancing to trial. Harvard has sued the Trump administration over its pulling of research funding following Harvard's refusal to comply with the administration's demands, which included auditing to make sure there was sufficient viewpoint diversity in academic departments, verifying that professors weren't plagiarizing, and reporting lists of international students who had gotten into trouble. The Trump administration also claims Harvard has not handled antisemitism on campus. Harvard believes this crackdown to be an egregious and improper First Amendment violation and attempt by the federal government to wield control over the university.

"By August 2025, Harvard must make meaningful governance reform and restructuring to make possible major change consistent with this letter," wrote federal government officials back in April, "including: fostering clear lines of authority and accountability; empowering tenured professors and senior leadership, and, from among the tenured professoriate and senior leadership, exclusively those most devoted to the scholarly mission of the University and committed to the changes indicated in this letter; reducing the power held by students and untenured faculty; reducing the power held by faculty (whether tenured or untenured) and administrators more committed to activism than scholarship; and reducing forms of governance bloat, duplication, or decentralization that interfere with the possibility of the reforms indicated in this letter."

Other demands: "By August 2025, the University must adopt and implement merit-based hiring policies, and cease all preferences based on race, color, religion, sex, or national origin throughout its hiring, promotion, compensation, and related practices among faculty, staff, and leadership." Ditto with admissions policies.

But more worrisome, just below, in the same letter: "By August 2025, the University must reform its recruitment, screening, and admissions of international students to prevent admitting students hostile to the American values and institutions inscribed in the U.S. Constitution and Declaration of Independence, including students supportive of terrorism or anti-Semitism. Harvard will immediately report to federal authorities, including the Department of Homeland Security and State Department, any foreign student, including those on visas and with green cards, who commits a conduct violation." Given the March arrest of Columbia University graduate student Mahmoud Khalil for his role in anti-Israel protests by plainclothes federal agents, it's just not clear that the government will actually give wide berth to universities to allow a range of expressive speech—even odious, offensive speech—on campus.

How Burroughs rules will be of great significance in the government vs. higher ed battles that have characterized President Donald Trump's second term. Of course, most libertarians are in favor of the federal government getting wholly out of funding higher education, something it never should have done in the first place. But, if it comes at the cost of speech rights on campus and greater crackdown on foreign students, will it be worth it? The federal government might be (marginally) shrinking its outlays, but still growing its power in ways that should disturb libertarians.

Zohran Mamdani doesn't seem to get it: One way we can try to judge whether New York City's city-owned grocery stores will succeed is by judging whether they've succeeded in other places where a similar concept has been tried. Kansas City is one such place: "KC Sun Fresh lost $885,000 last year and now has only about 4,000 shoppers a week," reports The Washington Post. "That's down from 14,000 a few years ago, according to Emmet Pierson Jr., who leads Community Builders of Kansas City, the nonprofit that leases the site from the city. Despite a recent $750,000 cash infusion from the city, the shelves are almost bare."

Shoppers report frequent shortages, but also issues with drug dealing and theft inside and outside the store.

The city opened the grocery store back in 2018, having used $17 million to fix up an old privately-owned one. At first, it was a sort of private-public partnership, where a private company owned the store, but the government gave a massive infusion of cash to get it all started. Then, in 2022, ownership switched to Community Builders of Kansas City, a nonprofit that leases the site from the city; the grocery store has asked for more and more cash infusions.

"We typically have the same group of offenders every week that are recognizable by face and by name," said city police Maj. Chris Young. Incidents have included someone peeing in the grocery store vestibule and a naked woman going on a rampage in the store. "A small percentage of people are ruining it for the rest of the community that deserves to go to their grocery store and their library." The city apparently doesn't currently have a jail, "so people arrested for minor crimes are quickly released instead of being held in rural counties miles away," reports the Post. 

I wonder how this would work in New York City! I guess, if Mamdani gets elected mayor, we'll get the pleasure of finding out, won't we?

    It's not an either or problem. Stop funding Harvard and all other universities with grants, etc., irrespective of whether they comply with these somewhat illiberal demands. Harvard can choose to not adopt a law-enforcement position without getting "punished" since there won't be any spigot of cash to turn off.

        It's not just that--the show itself has lost around $50 million in ad revenues, and the audience plummeted from 6-7 million during Letterman's run (keep in mind Letterman routinely got the brakes beat off him in the ratings by Leno, even with the mass media complex blowing smoke up his ass for 20 years), to around 2-2.5 million now.

        Kimmel and Fallon are doing even worse, although we don't know how much money their own shows might be losing. Gutfeld gets about 2.5-3 million, but he's got the excuse of being on a cable network, while the others can be had for free on network TV.

        Late night talk shows are a dying medium indulged mostly by aging Boomers who still watch it out of habit, and a sprinkling of Gen-Xers and older Millennials who had their brains broken in the 2000s from treating The Daily Show like incisive political commentary instead of left-wing propaganda. These shows are the Blockbuster Video or indoor shopping mall of mass media. Colbert getting the ax next year is just the first of the dominoes to fall.

        Craig Ferguson was the last great late-night talk show host.

    Judge Allison D. Burroughs notable cases (I don't think Harvard will lose)

    Burroughs is most notable for her order that put a hold on President Donald Trump's travel ban in January 2017 (Executive Order 13769) and as the judge who presided over United States v. Salemme, Students for Fair Admissions v. Harvard University, and United States v. Babich. Salemme was the last major trial of La Cosa Nostra mobsters. Francis Salemme (aka "Cadillac Frank") and co-defendant Paul Weadick were convicted of the murder of 43-year-old Steven A. DiSarro, who disappeared in May 1993. Salemme and Weadick were sentenced to life in prison in September 2018. In October 2018, Burroughs held a three-week bench trial in SFFA v. Harvard, a lawsuit challenging Harvard's admissions program as discriminatory against Asian Americans.[8] A decision in favor of the university was announced on October 1, 2019.[9] United States v. Babich is a criminal case brought against several former executives of the pharmaceutical company Insys Therapeutics. The government alleged that the executives violated the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. 1692 et seq., by engaging in a scheme to sell the fentanyl-based pain medication Subsys by bribing physicians to prescribe the drug. The indictments led to guilty pleas, including by former Insys CEO Michael Babich. The remaining defendants were tried from January through April 2019.[10] All five remaining defendants, including former billionaire John Kapoor, were convicted of racketeering.

    Burroughs also presided over a July 2020 lawsuit filed by Harvard and the Massachusetts Institute of Technology (MIT) that sought to halt an Immigration and Customs Enforcement (ICE) policy that required international students in the United States on F-1 visas to depart the country if they would not be attending in-person classes during the COVID-19 pandemic. Judge Burroughs announced that the Trump administration had agreed to reverse the policy during a July 14, 2020, hearing in her Boston courtroom.[11]

    In December 2020, Burroughs presided over a lawsuit brought by five Republicans who lost state and federal legislative races in Massachusetts and sought to overturn the election results. Judge Burroughs stated during a December 2020 hearing that she viewed the lawsuit's requested relief of invalidating the votes of millions of Massachusetts resident as “too late,” “misplaced,” and “terribly unfair.” [12]
    In April 2025, Burroughs issued a temporary restraining order blocking the Department of Energy's 15% cap on indirect costs for higher education grants, citing "immediate and irreparable injury" to universities. The policy, which aimed to reduce federal spending by $405 million annually, was challenged by a coalition of academic institutions and associations, leading to the court's intervention.[20]

    On May 23, 2025, Burroughs issued a temporary restraining order blocking the United States Department of Homeland Security's revocation of Harvard University's use of the Student and Exchange Visitor Program, which facilitates enrollment of international students.[21][22]

      Nothing matters until it gets to the circuit and/or SCOTUS court. The only thing interesting thing that might come out of this judgement is whether the judge rules on the law or uses her platform to indulge in judicial political lawfare. A lot of these judges came through ivy League law schools so they're already on the same team.

    Mamdani lives in one of the most expensive most gentrified areas of NYC. He is stupid enough to think that there is a shortage of grocery stores in poor neighborhoods. I mapped them in the Bronx and there isn't a single neighborhood other than one that is full of multimilliondollar mansions where there isn't a grocery store within a 20 minute walk of every residence. Most either deliver themselves, or through Instacart, Ubereats, or DoorDash, so everyone has multiple grocery options. He thinks big corporations are driving up prices; most grocery stores in poor neighborhoods are owned by individual businessmen and belong to ether a cooperative or a franchiser that handles distribution for them. And profit margins in the grocery industry are famously tiny. Oh and yes, most of the independently owned grocery stores have unionized staff. I know that that that last fact will cause most commenters here to contribute to Mamdani because his city owned stores will cause them to lose their jobs. 🙁

      Not really. Nobody claimed Russia hacked election machines directly. Everybody knows they hacked both the RNC and DNC but only selectively released DNC emails. And the bi partisan senate hearings on Russian interference resulted in a large report documenting Russian online propaganda and other means to influence the election generally and more specifically to cast doubt among the general public on the election's integrity. All of this is known.

      Gabbard is running interference. Obama, thanks to the US SUP CT granting Trump (and all presidents) presidential immunity, cannot even be investigated for actions he took (or refrained from taking) as president so that is a non-starter from jump. Even if his motive was to f over Trump. (may want to read Sotomayer's disssent on that one). But Gabbard made a nice headline and likely preserved her job a little longer. Perhaps the house judiciary committee holds some hearings that waste lots of time and result in nobody going to jail or nothing of substance happening.

      Like I said in another thread, it's incredible that Obama would go out of his way to help his biggest political rival in Hillary with something this cuckoo. I don't mind painting him as a conspirator, but like Comey, it's apparent that all this bullshit was being coordinated primarily by Brennan and Clapper the whole time, and Obama was primarily a spectator to the whole thing. "Just trust us and sign off on this so we can secure the information flow." And this was after the agencies' assigned personnel had already gone on record as having low confidence in the veracity of the dossier and everything else Brennan was claiming.

      The whole thing smelled like rotten fish from the get-go, and apparently the files were buried under nine years of ERM folders and their presence forgotten because everyone assumed Trump was going to end up in prison.

      I'd actually be willing to leave Obama completely the fuck alone on this if it meant Brennan got thrown in Leavenworth and put on hard labor until he dropped dead.
