Democrats Scuttle Marijuana Decriminalization Vote Over Fears of Not Being Deferential Enough to Cop Lobbyists
If Congress is too afraid to vote on marijuana reform, how the hell are they ever going to pass policing reform?

A planned House vote on a bill to decriminalize the possession of marijuana was canceled on Thursday under pressure from law enforcement lobbyists and other pro-prohibition special interests.
The expected floor vote on the Marijuana Opportunity Reinvestment and Expungement (MORE) Act would have been the biggest accomplishment yet for cannabis reformers, but the effort has been postponed until after Election Day, Politico reports. Democrats have gotten weak-kneed about a bill that they once saw as a major criminal justice reform.
Indeed, it would have been. The MORE Act, sponsored by Rep. Jerry Nadler (D–N.Y.), would remove cannabis from the schedules of the Controlled Substances Act and make that change retroactive, effectively expunging any federal marijuana offenses and convictions. The bill also orders federal courts to lift all sentences for people currently locked up due to a marijuana conviction.
As Reason's Jacob Sullum explained when the bill was introduced last year, the MORE Act was in many ways superior to other marijuana legislation, because it "completely deschedules marijuana rather than moving it to a lower schedule or making exceptions to the ban for state-legal conduct, and it seeks to lift the burdens that prohibition has imposed on people caught growing, distributing, or possessing cannabis, a vital project that too often has been treated as an afterthought."
This year, the bill had collected more than 100 co-sponsorships in the House—it even had support from three Republicans—and appeared on track to pass the lower chamber. Even though the bill was expected to die in the Senate, that House vote would have been historic.
Unfortunately, cop lobbyists seem to have convinced House Democratic leaders that it would also be a liability. A coalition of law enforcement special interests and other proponents of the drug war sent a letter to congressional leaders last week warning about the potential dangers associated with legalizing and "commercializing" marijuana.
That, combined with vague fears about how Republicans might weaponize the legalization vote for negative ads in swing districts, was apparently enough to convince Democrats to scuttle the vote.
That isn't just disappointing: It's pretty pathetic. Democrats were right to position the MORE Act as a vehicle for racial justice and a key step toward addressing the problems of America's criminal justice system. The war on drugs is deliberately racist, and it always has been. Decriminalizing marijuana would a pretty good first step towards righting those wrongs.
But even after everything that happened this summer to put criminal justice in the foreground of the national conversation, and even with polls showing that most Americans (and a larger share of Democrats) support the legalization of marijuana, Democratic leaders were still too spooked to take an important and historic vote. That's just sad.

I agree, but I remember that many people think they're not advancing in their career because they're being discriminated against, when yeah, they're being discriminated against due to their inferior work product, and not their sex, race or religion. Courts in New York have long ruled if a car smells like marijuana smoke, the police can search it — and, according to some judges, even the occupants — without a warrant.
But in late July, a judge in the Bronx said in a scathing opinion that officers claim to smell marijuana so often that it strains credulity, and she called on judges across the state to stop letting police officers get away with lying about it.
“The time has come to reject the canard of marijuana emanating from nearly every vehicle subject to a traffic stop,” Judge April Newbauer wrote in a decision in a case involving a gun the police discovered in car they had searched after claiming to have smelled marijuana.
She added, “So ubiquitous has police testimony about odors from cars become that it should be subject to a heightened level of scrutiny if it is to supply the grounds for a search.”
In recent years, at least five other judges have concluded in individual cases that officers likely lied about smelling marijuana to justify searches that turned up an unlicensed firearm, according to court documents. These judges came to doubt the police testimony for a range of reasons, such as discrepancies within an officer’s account or among officers, according to a review of the five decisions.
These judges have generally questioned only the credibility of individual officers in individual cases. Judge Newbauer’s claim was much broader: that there is widespread lying.
The case that led Judge Newbauer — who was a Legal Aid Society lawyer before ascending to the bench — to make this claim involved a car stop in the Bronx on March 24, 2017. A plainclothes officer, Daniel Nunez, testified that “he noticed a strong odor of burning marijuana” while approaching the vehicle, according to the decision. Officer Nunez testified that he observed three small bags of marijuana perched atop the center console — which the police photographed, according to the decision.
While searching the trunk, Officer Nunez discovered a gun.
Judge Newbauer concluded that Officer Nunez’s account was riddled with falsehoods. She decided the photograph of the bags of marijuana neatly arranged was likely staged. She noted that one of the two defendants, Jesse Hill, had testified that the marijuana had been discovered when officers searched the pockets of the other man who had been in the car with him.
Gaynor Cunningham, a Legal Aid lawyer who represented Mr. Hill’s co-defendant, said the ruling “recognizes an all-too-common practice of dishonesty that police officers employ to circumvent the law to manufacture a ‘legal search.’”
Barry Kamins, a former New York City judge and an authority on search and seizure law in New York, said Judge Newbauer was “the first judge to really express an opinion about this type of scenario.” He said the opinion brought to mind a court decision from 1970, in which a judge accused New York City police officers of lying in a similar fashion.
That case dealt with “dropsy” testimony, in which officers testified they had seen the defendant throw down a small bag of drugs in an attempt to ditch the evidence as the police approached.
Such testimony spiked after a landmark Supreme Court decision required courts to suppress evidence gained from an illegal search. Officers no doubt did catch people trying to discard evidence. But there was widespread suspicion that officers sometimes made up “dropsy” testimony rather than admit they had searched someone unlawfully.

The commonality? They all appear to get government money for investigating, capturing, indicting, imprisoning, rehabilitating, lobbying, and educating people about illegal drugs. Legal pot would put many of these people out of work. Think of the money taxpayers contribute to the war on pot.

I've been predicting this all along. The push to deschedule is a recipe for stalemate. The solution is to reschedule from class I -> IV. When I say this I am met with vitriolic fury: people demand decriminalization or nothing. Why? Because they are police state shills and they know it will result in continued paralysis.

Expanding on your idea, wouldn't Schedule V be better? I know that for many years, certain Schedule V drugs (e.g., cough syrups with a minimal amount of codeine) could be purchased OTC from the pharmacy without a Rx. All you had to do was sign for them and your purchases were limited to a certain number every six months or so, IIRC.
Schedule IV drugs require a Rx and contains drugs like the vast majority of the Benzodiazepines. They can be extremely addictive and cause lethal withdrawal syndrome that is essentially Delirium Tremens. Cannabis clearly doesn't belong in that schedule. Only problem is, either schedule would still give the state and its enforcers ample leeway to molest and imprison the citizenry.
I'm definitely NOT a 'police state shill,' nor do I smoke Cannabis. Even so ultimately full legalization is the only solution truly compatible with the Constitution, liberty and individual responsibility. In fact, non-criminalization of drugs IS the status quo when you consider most 'drugs of concern' were legal for far longer than they've been illegal. So the Democratic party wants to keep cops shooting kids over plant leaves for the faith-based asset-forfeiture sharing to be looted from their belongings. This makes me doubly glad to have sent a donation to the Dallas County LP, and absolutely thrilled to cast my usual vote for the LP ticket.

How about the federal government stay out of passing anything for police reform? How about the states, you know, the entities charged with local law enforcement authority, be the ones to implement police reform? Well, the 14th amendment does give the feds some obligation and power to protect the privileges and immunities of citizens against the states.
Invoking the 14th to tread into local law enforcement decisions starts cross a significant line. Not sure outside of horrendous LEO action on the part of a state or states does the 14th allow the feds such power. And for as bad as police conduct is, saying that there is a systemic action on the part of local law enforcement to deprive citizens of constitutional rights, thus demanding federal action is a bit thin.
