Feds to Raided Smoke Shop Owner: Say Your Sister Assaulted a Federal Agent or No Bail For You
Ridiculous miscarriage of justice out of federal court in the western division of Texas, Pecos division.

In a federal/local raid earlier this month on a "smoke shop" called the Purple Zone in Alpine, Texas, two sisters running the place were arrested: Ilana and Arielle Lipsen.
Arielle insists she was hit in the head with a rifle by a DEA agent in what she characterized as an unprovoked assault. The feds, naturally, insist that Ms. Lipsen in fact attacked the agent.
Pictures of Lipsen's head with the alleged gun butt wound were taken and spread on Facebook by Tom Cochran, who runs a screen printing shop whose services the Lipsen sisters used.
The document that Ilana Lipsen had to sign to make bond, which I have seen, included this handwritten demand among some of the more common typeset ones like "maintain or actively seek employment" and "surrender passport":
"will advice media (Kwest9 news) that he [sic] sister, arielle lipsen, was not beaten by agents carrying/using a M16 rifle, and her sister instigated/assaulted agents."
The bond document also demanded she ask Tom Cochran to take his photos of the aftermath of the raid and of Arielle's wounded head off Facebook; Cochran says she did make that request, and he refused to comply. Various people complained to get Facebook to take down the photos, but Cochran says Facebook investigated and decided there was no reason to delete them. Cochran also says that once safely free, Ilana thanked him for not taking them down.
Ilana says this morning that at the advice of her lawyer she can't say much, but did tell me: "I was incarcerated from Tuesday of last week and wasn't released until Monday of this week. That should tell you something."
A NewsWest9 report says Lipsen did, as ordered, recant her original story.
The pictures have now led Cochran to suffer a public call for boycott of his business, Big Bend Screen Printing, from the National Border Patrol Council, an AFL-CIO affiliate union for Border Patrol workers. (Local station NewsWest9 has more on that.) Cochran finds this a weird abuse of federal agency power, to use their name in a union to attack the livelihood of a private citizen not facing any charges. "Their own code of conduct says they should not use anything associated with [the agency] for personal gain or to assert undue influence."
Witness Nick Branson, who lived in a separate apartment with a separate address attached to the raided store, had his home searched as well, and though he's been charged with nothing had some property taken, more property than the feds will admit to in the property list they left him with, he complains. They took a gun and some hard drives and flash drives and some frankincense, which he assumes they think is illegal.
He insists that the incident happened this way: Ms. Lipsen "was talking to another agent, she wasn't yelling as they claim, she was on the sidewalk, wasn't even on the property at the time. She was basically saying things like, 'don't you have better things to do with cartels and kidnapping and human trafficking, we are 100 miles from the border, this is what you are coming up with?'
"That's when the same agent who told me he didn't need a warrant to be inside my house [and who also, Branson says, snapped back with "what are you, a fucking lawyer?" when Branson mentioned the Fourth Amendment] tried to grab her. She backed up, said 'don't touch me.' He said, 'you are resisting arrest' and basically put his leg out, threw her over his leg onto the ground.
"She tried to get back up and he went to shove her face back into the ground. She's flailing at this point, obviously upset, and he says 'you are assaulting me' and used his rifle butt on her neck to pin her to the ground while other agents tackled her."
Branson says he's shown the picture of Lipsen to friends of his from military who confirm that that is what it would likely look like if a rifle butt were pressed into her neck.

Arielle Lipsen was indicted on one count of assault on a federal officer causing bodily injury and Ilana Lipsen was indicted on one count of person under indictment receipt of ammunition.
Purple Zone owners Ilana Lipson, and her mother, Rosa Lipsen, are currently under state indictment for multiple first-degree felony manufacture, deliver, or possession of a controlled substance following four previous raids beginning in November 2012.
They've pleaded not guilty to the charges.

The owner's sister told her agents entered their business and took their guns, two computers, cell phones, cameras and their hard drives. She also says agents disconnected her surveillance cameras then faced them toward the wall. The owner claims nothing she sells is illegal, nor is it classified as a synthetic drug….
NewsWest 9 spoke with the DEA who confirms that this was a state search warrant used in this situation, looking for synthetic controlled substances. They say these allegations are false.
In a statement from Brewster County District Attorney, Rod Ponton, he says, "Numerous items of evidence, including "spice" packages, firearms, and ammunition, were seized pursuant to warrants. When occupants refused entry to agents in possession of a valid warrant, the door was broken down, during which action one agent received an accidental cut, which resulted in the blood at the scene. Ariel Lipsen was arrested for assaulting one of the agents. Neither she nor any person involved was "beaten with the butt of an M-16", or assaulted in any manner."

While Lipsen's lawyer was not available for comment this morning, other criminal defense lawyers told me this is a strangely abusive bail demand. Mark Kuby, who is also a talk show host in New York, considers it a "Texas-sized" violation of rights, "as unprecedented as it is unconstitutional" since bail demands properly should be restricted to furthering two government interests: protecting the community from possible criminal action by defendant, and to make sure the defendant appears for trial.
That said, a third criminal defense lawyer I spoke to said that when it comes to possible co-conspirators, such demands might not be that unusual.

Pretty much all scenes not set in King's Landing have been disappointing. Jon Snow and Danerys continue to be insufferable while the Bran storyline is boring.

Me neither. Our society does not want to believe that this sort of behavior is as commonplace as it is. I am sure that people in places that have gone crazy in the past, such as Nazi Germany, the Soviet Union, etc. must have kept telling themselves that it has to stop somewhere, that this is just abnormal and things will get back to their proper place eventually. But it didn't. America is resistant to that sort of thing, but it is not immune, and it seems that the country is getting sicker and sicker, the ruling class becoming more brazen each passing year. I have now idea if something will happen that will touch off widespread protest against this stuff, but I am not optimistic. The internet and other media has made it more obvious than ever before and yet it keeps going on and on.

This situation is particularly egregious. I mean, they raided the fucking place. This isn't "boycott this business because they won't hire union labor" (which is bad enough), this is "boycott this business for telling the truth about our raid". It's fucked more than usual and is a terrible, terrible precedent.
I agree that this is worse, but unions and violence go together like bacon and eggs. It was only a matter of time before public sector unions (which are among the most utter abominations in the US for my money) felt that they had the power to start behaving in this manner. I mean, when there are no consequences for outright killing people what is to restrain them from doing this? And what politician doesn't want their campaign contributions? The next election is always so critical, ya know?

First thing that I thought when I saw that mark was that she is lucky she wasn't killed or crippled.

I'm not a forensic scientist, but it looks like she wasn't facing the guy who delivered the blow with the rifle butt. I suppose it's possible she was engaged with one agent and another delivered the shot from behind, but I'm pretty skeptical.

It does seem like it would be hard to hit someone at that angle from the front.
A horizontal butt-stroke would land there from the front (more of a hook type blow). But I think the mark would be different from the side of the butt. With a regular M16 there would also be a nasty divot on her neck from the sling loop.

I heard about the Green Lantern theory this morning and this doesn't seem so different than that. He just doesn't have the imagination and competency to do anything. That doesn't pass the smell test to me. It doesn't take imagination or competency to demand that the DoJ cease enforcing drug laws.
It seems unbelievable doesn't it? It is more believable when you consider a couple of things. First, Obama has never worked in government or anywhere outside of community organizing and academia. Those people live in a fucking bubble. Second, you have to remember how big and complex the federal government is. Think about the four Presidents that preceeded Obama. Three of them, Reagan Clinton and Bush II had been governors. The other, Bush I, had spent a life time in federal service and had headed up a major agency, the CIA, and been VP for eight years. And even with all that experience and in the case of Bush I and Clinton, ridiculously high IQs, they barely controlled the government. What chance does President affirmative action have?
Worse, I think after he got in the job and realized how miserable and hard it was, he just checked out. He doesn't even try anymore and hasn't for a long time.
I don't think high IQ or governing experience are necessarily going to lead to a more efficient and well-run bureaucracy.
It's one thing to have a high IQ and another the innate ability to analyze systems. As far as experience in government goes, it's more probable that spending years as a bureaucrat or 'governor' would filter for a special class of narcissists and enablers of the bureaucracy. So while Bush I and Clinton would be in a better place than a low-self esteem loser, community organizer and academic, the chances of actually being able to organize an effective analysis of government and overcome the bureaucracy and also deal with a compliant media and congress are pretty slim. It really is on auto-pilot (or perhaps self-destruct mode.)

I would also say we are getting to the point that we need some kind of national truth and reconciliation commission to deal with DOJ and the abuses of AUSAs. You just have a commission that opens all of the books, takes testimony from the victims and documents every case of abuse going back to say 2000, that way no one can say it is partisan. Then publish a report that names names and describes it all and put it on the internet. Meanwhile fire every attorney involved in such abuse and rewrite the federal criminal code eliminating the laws that they abused to do so.
Nothing short of a complete turnover and change at DOJ is going to stop this. This is the result of decades of the department sanctioning getting convictions by any means necessary and a culture of corruption and abuse. Nothing short of drastic measures will fix it.

My wife is finally coming around to hating cops. She says most are nice, blah, blah, blah.
The other night, she was late for dropping my son off at a dance. One of the lanes was blocked by an officer for a tow truck in order to move a wrecked car.
She kept waiting for the cop to wave her around when no oncoming traffic was there. Finally after about 10 minutes, she just went anyway.
She said the cop gave her the meanest look and she said she gave it right back at him.
Luckily she wasn't shot. /sarc - kind of - maybe not.
Point being, if she can come around to hating cops, anybody can.
My favorite involved making my way home from class by taking the interstate through the heart of the city, which for that time of night is sparsely populated. Unfortunately, three of the four lanes were blocked off. After about twenty minutes of inching along in traffic I pass by the scene of the accident: one vehicle, spun out in the center-right lane, surrounded by two ambulances, a firetruck, and three cruisers. No activity, no visible damage, but a dozen or so personnel hanging out in a semicircle watching traffic crawl through their single-lane funnel.
A few years back, Monkey County police shut down an entire road for over 4 hours, during morning rush hour, so they could investigate an accident that one of their own was responsible for causing.
It must take some time to make change the evidence at the crash site, so the non-cop is blamed and to make sure their stories are straight.
Every day people who for the entire history of this country have supported the police turn on them. I know so many people like your wife who have finally had enough and turned on them.
At some point we are going to reach a tipping point and the cops will have totally lost society. That won't be a good thing for society or the cops. Once you lose trust it is really hard to get back.

When my Vietnam veteran former Marine only didn't vote Republican in a Presidential election once (and that was because he was pissed the party sold out Nixon) turned on the cops, I knew something had gone very wrong in this country. I do think the rise of cameras everywhere are really going to crimp the fun the cops have. If you show the view from 5 cameras of the scene and the area around it, juries may well find it persuasive. And people will be outraged further.
My wife is finally coming around to hating cops.
Just ask anyone who parrots the party line on cops if they are happy or anxious when a cop is behind them in traffic.

I kept my gaze looking forward but nonchalantly held up my left hand and was giving the old middle finger.
When the cop passed me, he stopped, tried to make a U-turn, but couldn't because traffic was in his way. The light turned green and I drove off slowly.
