Don't Appear to Be Clenching Your Buttocks When Pulled Over For Not Coming to a Complete Stop or Be Tortured by Doctors: America, This is Your War on Drugs
From the "folks, this is just wrong" department of our War on Drugs, reported by KOB-TV 4 in New Mexico. They are reporting on a lawsuit that arose from an:
incident [that] began January 2, 2013 after David Eckert finished shopping at the Wal-Mart in Deming. According to a federal lawsuit, Eckert didn't make a complete stop at a stop sign coming out of the parking lot and was immediately stopped by law enforcement.
Eckert's attorney, Shannon Kennedy, said in an interview with KOB that after law enforcement asked him to step out of the vehicle, he appeared to be clenching his buttocks. Law enforcement thought that was probable cause to suspect that Eckert was hiding narcotics in his anal cavity. While officers detained Eckert, they secured a search warrant from a judge that allowed for an anal cavity search.
The lawsuit claims that Deming Police tried taking Eckert to an emergency room in Deming, but a doctor there refused to perform the anal cavity search citing it was "unethical."
But physicians at the Gila Regional Medical Center in Silver City agreed to perform the procedure and a few hours later, Eckert was admitted.
While there…
1. Eckert's abdominal area was x-rayed; no narcotics were found.
2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.
3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.
4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.
7. Doctors then x-rayed Eckert again; no narcotics were found.
8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.
Throughout this ordeal, Eckert protested and never gave doctors at the Gila Regional Medical Center consent to perform any of these medical procedures….
There are major concerns about the way the search warrant was carried out. Kennedy argues that the search warrant was overly broad and lacked probable cause. But beyond that, the warrant was only valid in Luna County, where Deming is located. The Gila Regional Medical Center is in Grant County. That means all of the medical procedures were performed illegally and the doctors who performed the procedures did so with no legal basis and no consent from the patient. ….
The warrant also had expired in time when the "medical procedures" were carried out. Eckert is suing the city of Deming and Deming Police Officers Bobby Orosco, Robert Chavez and Officer Hernandez, as well as three Hidalgo County Deputies and two doctors from the Gila Regional Medical Center.
The petty legalities of time and place of the carrying out of these hideous tortures will, I hope, be sufficient for Eckert to win his suit. But the entire event is an abomination from beginning to end. If only he could just sue for "police being petty officious asshole morons, and doctors violating their professional standards and all human decency by going along."
UPDATE:Eckert's lawsuit. And yes: they are trying to bill him for medical services rendered. From the suit: "Defendant Gila Regional has billed Plaintiff for the "services" it provided at the request of law enforcement….Plaintiff still receives medical bills for thousands of dollars for these illegal, invasive and painful medical procedures."

In other words, at the first sign a cop is going to detain you for a traffic offense, you need to use as much force as necessary to protect yourself from being sexually assaulted or otherwise violated.
After all, it's a matter of person safety. I have a right to go home at the end of my day/night/drive.
I thought the takeaway here was that when stopped, ensure that your butt-clenching is obvious. That way you get a free colonoscopy *and* the opportunity to make a fuck-ton of money from the communities that allow cops and courts to run wild like this.
It would be cool if he could name this fuckhead on the suit also, even cooler if he could sue him personally. But alas, why should judges be responsible for the consequences of their decisions.
Unfortunately everyone is going to end up settling the suit, but I have a feeling a few people will lose their jobs. And it would be nice if the DoJ stepped in to investigate the criminal aspects of assault.

If it was me, no lawyer could talk me into not going to trial. I want these assholes on the record trying to justify their actions. No one would walk away without admitting wrongdoing. Case fucking closed.
That's not going to go forward. Like judges, DA's have absolute immunity when acting within the function of their office. So even if he could show the judge and the DA both knowingly acted unlawfully and did so with malice, he still wouldn't be able to sue them.
I suspect the cops will ultimately have their qualified immunity upheld, and it's just going to be the taxpayers and the hospital paying the bill for the actions of the cops, the doctors, the DA, and the judge.
Reason and other media outlets should name the judge, imo. We need to start publicizing their names, because that's the closest they are going to get to being held accountable when they sign outrageous warrants such as this one.

He's going to end up owning that place, anyway.
Yeah but, when cops do an investigation I don't get charged for the investigators time. When they send drugs to the lab to be verified the lab doesn't send the bill to the defendant. I can't possibly imagine how the hospital could think that the patient has any responsibility to pay for a search.

Yeah, but the way collections and such work in this country, it's ridiculously easy to put someone in collections and start hitting their credit rating regardless of the validity of the charges. I myself have been extorted by companies like this.
A company claimed I had an account for services in a city that I hadn't lived in for over 10 years (they claimed I lived there the previous year. Even after I showed that it wasn't and couldn't have been me, they refused to stop the collections and put a mark on my credit rating. I ended up paying the few hundred dollars because it wouldn't have been worth fighting.
4 On Your Side Investigative Reporter Chris Ramirez cornered Deming Police Chief Brandon Gigante.
"As the police chief what reassurances could you give people when they come through your town that they won't be violated or abused by your police officers?" Ramirez asked Chief Gigante.
"We follow the law in every aspect and we follow policies and protocols that we have in place," Chief Gigante replied.
"Do you think those officers in this particular case did that?" Ramirez asked.
Gigante didn't answer, instead he referred Ramirez to his attorney.
This is a guy who knows his department is in a shitload of trouble.

I hope this story gets some coverage and doesn't disappear too quickly. This is the kind of thing that could really bother a lot of regular people. This could happen literally to anyone at the whim of an asshole cop.
We really need some reform on how warrants are issued. It is incredible enough to me that police can trash your home if they have a warrant and even if you are innocent you have no recourse. But that they can, on some vague suspicion of a cop, force you to undergo invasive bodily penetration (and I'd include forced blood draws for DUIs in the same category) is just outrageous. There needs to be a higher standard for that sort of thing. And consequences for people who abuse it.
The cops, AND the doctors performing the x-rays/surgeries, should all be executed immediately.

So the cops are just convinced this guy's a drug dealer (and who knows, they may be right) and are either harassing him for the sake of it, or the really, really believe they're going to find drugs.

That's the case where he supports restoring the in loco parentis doctrine where schoolchildren are concerned (questionable because the doctrine was originally applied to tutors and schools chosen by the parents, but that was his position). So if a parent can search a child's underclothes, so can a school if that's within the implied scope of the authority delegated by the parents (again, not an obvious point in this case, but that's his argument).
So his views apply to schools searching children, specifically in the educational context where minors are concerned. I don't think he would apply it to searching an adult without having the support of a warrant (as was allegedly true here).
But you know that the cops are professionals who are just doing their jobs protecting us from terrorists and drugs. You should willingly and enthusiastically submit to any anal cavity search that a government official orders you to. It's your civic duty in the name of peace, order, and good government.

"Parking lot sign"? If it isn't on a PUBLIC right of way, the police have NO enforcement authority. The initial stop is bad and all the rest "fruit of the poisoned tree" as we lawyers say.
I got stopped for this once. I was leaving a convenience store, and there was a stop sign where the parking lot exited onto the public street. It was night, and I saw a car coming down the street towards me, but I thought I had enough time and pulled out. In trying to leave the parking lot before the oncoming car got too close I had not come to a complete stop. The car was a state police vehicle and the trooper pulled me over for running a stop sign. This was in Virginia and the sign appeared to be a standard issue that is used on the public streets. (He gave me a warning)
Three things about this story actually give me a lot of hope. First that there was at least one doctor/hospital who refused to assist the thugs with their anal assault of the victim, second that the journalist didn't try to smear the victim or justify the outrageous actions of the police, and third, that the comments following the article were largely of an anti-authoritarian tone, including many folks speaking out against the drug war and rampant police brutality throughout the US.
Another good thing about the response to this horrible story:

If anyone should be on the hook for goods or services rendered it's the person who purchased them. You don't send the bill for an iPad to the person you have the iPad to as a gift, do you?
The police gave him a gift of a colonoscopy. The police are the ones who incurred the bill, the police are the ones who get to pay it.
If nothing else, the abuse of people not being free might deter them from doing it as often.
All in all, I'm kind of surprised they didn't find something. If I had just anally assaulted someone four or five times and found nothing, how hard would it be to find something, just to get yourself off the hook? And, it isn't as though they had to worry about ethics or morals.

Wow! That is such a violation of Mr. Eckhert's rights. The cops and judge should be named and shamed all over the Internet. This is why qualified immunity needs to be curtailed, if not eliminated altogether. Those with unchecked authority will always abuse it and this is a prime example.

They repeated the procedure 8 times? This is 1 case of executing the warrant and 7 cases of rape.

Sue the shit out of the city, the doctors, and the hospital. The Doc's malpractice insurance doesn't cover this but you can sell their Porsche's.
"Parking lot sign"? If it isn't on a PUBLIC right of way, the police have NO enforcement authority. The initial stop is bad and all the rest "fruit of the poisoned tree" as we lawyers say.

I got stopped for this once. I was leaving a convenience store, and there was a stop sign where the parking lot exited onto the public street. It was night, and I saw a car coming down the street towards me, but I thought I had enough time and pulled out. In trying to leave the parking lot before the oncoming car got too close I had not come to a complete stop. The car was a state police vehicle and the trooper pulled me over for running a stop sign. This was in Virginia and the sign appeared to be a standard issue that is used on the public streets. (He gave me a warning)
Three things about this story actually give me a lot of hope. First that there was at least one doctor/hospital who refused to assist the thugs with their anal assault of the victim, second that the journalist didn't try to smear the victim or justify the outrageous actions of the police, and third, that the comments following the article were largely of an anti-authoritarian tone, including many folks speaking out against the drug war and rampant police brutality throughout the US.
Another good thing about the response to this horrible story:
Pretty much everybody - left, right, center, up, down -- is siding with the victim and thinks the cops and doctors are criminals.
Kos - "Absolutely unimaginable this could happen in America"
FreeRepublic - all comments are hostile to cops or sympathetic to victim
Huffington Post - all comments, other than lame and unfunny fart jokes, are hostile to cops or sympathetic to victim

If anyone should be on the hook for goods or services rendered it's the person who purchased them. You don't send the bill for an iPad to the person you have the iPad to as a gift, do you?
The police gave him a gift of a colonoscopy. The police are the ones who incurred the bill, the police are the ones who get to pay it.
If nothing else, the abuse of people not being free might deter them from doing it as often.
All in all, I'm kind of surprised they didn't find something. If I had just anally assaulted someone four or five times and found nothing, how hard would it be to find something, just to get yourself off the hook? And, it isn't as though they had to worry about ethics or morals.
I'm not surprised at this sadly. Each day we seem to be seeing more incidents like this. The doctors should have their licenses revoked I think. You can sign a petition to revoke the doctors' licenses at change.org. We really need to send a message to doctors that it's not ok to participate in things like this. This sounds like a case for Sigmund Freud. All this weird anal obsession by law and order types is very typical for fascist regimes. Look at Hitler, supposedly he was into being pooped on.
Wow! Imagine what the jurors are going to award when they see that the doctors tried to BILL HIM for their anal sexual assault! The punitive damages are going through the roof for that soon-to-be RICH rape victim.
Eckert became as a cadaver to the whims of prying criminality. Dehumanization is the last step into the eerie basement of serial cruelty and evil. Once the human being (however criminal I might add) has been minimized into the station of pure object in the minds of the crowd that holds supreme power the list of what can consciously, justifiably, and rationally be done to the object is endless.
This story encapsulates the macabre. Something tells me this is not the first time this particular set of cops have done this. Evil lurks in Deming, NM.

Wow! That is such a violation of Mr. Eckhert's rights. The cops and judge should be named and shamed all over the Internet. This is why qualified immunity needs to be curtailed, if not eliminated altogether. Those with unchecked authority will always abuse it and this is a prime example.
