The TikTok Ban Is a Blueprint for More Social Media Censorship

China's free speech record is bad, but the federal government's isn't so great either.

TikTok is in trouble: In April, President Joe Biden signed bipartisan legislation that forces ByteDance, the popular social media app's Chinese parent company, to sell its majority stake to a U.S.-based firm. If it fails to do this, the app will be banned in the United States.

Various dubious arguments have been deployed against TikTok, but Congress' stated prime motive to force its divestiture is that the app's Chinese owners are beholden to the Chinese Communist Party (CCP), and thus having their tech on so many Americans' phones is a dire national security risk. The CCP is an authoritarian menace, and there is some evidence the Chinese government pressures TikTok to censor content about Tiananmen Square and the religious sect Falun Gong, and criticism of Chinese President Xi Jinping.

Of course, the U.S. government has also pressured American tech companies to censor content on social media. Thanks to the Twitter Files, the Facebook Files, and other independent investigations, we know that multiple federal agencies instructed social media platforms to take down content relating to Hunter Biden, COVID-19, and other subjects. When 
President Biden decided the companies had been insufficiently deferential to his pandemic-related diktats, he accused them of killing people and threatened to take action against them.

If Congress really wanted to do something about government censorship of content on social media, legislators could rein in the feds. Instead, they are singularly focused on TikTok, which has responded with a lawsuit.

The legislation approved by Biden would apply to any social media company that is designated as a "foreign adversary controlled application." U.S. law currently defines China, North Korea, Russia, and Iran as foreign adversaries. The law further stipulates that an app is deemed to be controlled by a foreign adversary if it satisfies at least one of three different criteria: It is headquartered in one of those countries, the government of one of those countries owns a 20 percent stake in it, or the app is subject to "direction or control" by one of the foreign adversaries.

This law creates a blueprint for taking future action against social media companies beyond just TikTok. In the wake of the 2016 election, Democratic lawmakers, mainstream media pundits, and national security advisers accused Facebook and Twitter of being complicit in Russia's various schemes to sow election-related discord online. The thrust of this argument was that the CEOs of those companies had allowed their platforms to be compromised by Russian misinformation—even though subsequent studies have shown foreign social media influence campaigns had very little impact on the outcome of the election.

Despite the bill's passage, the federal government is not likely to take direct action against Facebook or X tomorrow. But Biden has rubber-stamped language—"direction and control"—that is exceedingly slippery. It is not difficult to imagine a future where vengeful bureaucrats accuse a disfavored app of promoting contrarian views, gin up a connection to a "foreign adversary," and punish it accordingly.

                      The article that references a study that primarily uses homicide CONVICTION rates for undocumented? Oh, that’s going to fucking work.

                      Here's what the fucking study itself says about the rest of it's data:

                      “…data for crimes other than homicide are included, but readers should interpret them with caution because the quality of the data is suspect.”

                      Yeah, so a study of homicide conviction rates for people they largely didn’t know were here during the study’s timeframe, and the rest is junk data by its own admission. Homicides aren’t actually the “violent criminals or scammers or what-have-you” that you promised. You lied.

                      So lets look at your homicide conviction data, what’s the methodology?

                      “This policy analysis relies on data from the Texas DPS obtained through a Public Information Act request.9 The Texas DPS data separately show the number of convictions and arrests of individual legal immigrants, illegal immi­grants, and native‐​born Americans in Texas for the 10 years of 2013–2022. DPS does not explicitly identify the number of native‐​born American individuals arrested or convicted of crimes, but it has a third category: “unknown or other.” The only other category of people left is native‐​born Americans, so the “unknown or other” category is identified herein as native‐​born Americans.”

                      So contrary to your claim, we have no fucking idea if this is showing illegal aliens vs native-born because the data it uses doesn’t actually identify native‐​born Americans.

                      The whole thing is junk and the study itself said its data is mostly junk, and what isn’t is predicated on an assumption.

          The study I cited came from Cato, and it used Texas data - this is significant because Texas is the only state that tracks inmates by immigration status.

          The Lott study is garbage because he deliberately chose a dataset which overcounted the number of illegal immigrants, and then from that he "concluded" that wow, this inflated fake number of illegal immigrants commit more violent crime!

      The simplest combination of these facts is that Reason exists not to serve a libertarian audience, but for a donor class to push their preferred stories onto libertarians. This donor class is substantially more culturally progressive, egalitarian, globalist, and neoliberal than the libertarian base.
      I'm not making a claim that Reason journalists themselves are told to write certain stories, or that Reason journalists are liars. All that needs to happen is the donors pick the right editor, who then goes out and hires journalists with biases preferred by donors.

    Congress’ stated prime motive to force its divestiture is that the app’s Chinese owners are beholden to the Chinese Communist Party (CCP), and thus having their tech on so many Americans’ phones is a dire national security risk.

    There is ZERO chance that that is the real reason why the legislation passed through the House in one week. The only reason for this legislation (which is poorly structured except as a bill of attainder) to pass so quickly – with an overwhelming majority and no discussion – absent a true act of war scenario – is corruption of the highest order.

            There was no legislation until Mar 5 2024. Within two days, all 50 members of subcommittee and committee voted it to go to House. Within a week after that the House voted on it. It then sat for one month until the Senate included it in a 'must-pass' (ie where lobbyists are all over it) bill where it was signed in one day.

            Trump issued an EO banning TikTok (which at least was about China) but that was overturned by a judge within a week or so. Trump said he now OPPOSES a ban on Tik Tok. So much for THAT momentum.

    NEW: Multiple vehicles burst into flames at a 'Street Takeover' event in downtown Los Angeles after 400-500 people blocked off the street.
