Why Is This Beer Banned in 15 States?

A special edition Samuel Adams beer is helping to highlight silly state alcohol restrictions. Each fall, Samuel Adams puts out a new "Utopias" beer, with this year's set to be released on October 11. The 2021 Samuel Adams Utopias clocks in at 28 percent alcohol by volume (ABV)—making it illegal in 15 states.
"If you live in Alabama, Arkansas, Georgia, Idaho, Missouri, Mississippi, Montana, North Carolina, New Hampshire, Oklahoma, Oregon, South Carolina, Utah, Vermont and West Virginia, don't even look. Utopias is illegal in those states because of its high alcohol content," according to the Samuel Adams website.
Your typical beer used to clock in around or under 5 percent ABV. But recent years have seen an explosion of craft beers—especially India pale ales—with 6, 7, or even 8 percent ABV, and many companies rolling out even higher-alcohol-content brews. (For comparison, wine tends to have an ABV around 11 or 12 percent, and spirits above 40 percent.)
Many states have ABV-based rules around where alcohol can be sold. For instance, in Mississippi, only beer at 5 percent ABV and under can be sold in grocery and convenience stores, though beer up to 10 percent ABV can be sold in specialty stores. In Ohio, liquor at more than 21 percent ABV can only be sold in liquor stores, though groceries and other stores can sell lower ABV spirits and liqueurs.
In addition, many states outright ban beer above a certain ABV, even though it's perfectly legal to buy wine or spirits at that alcohol level.
"Such laws are largely holdovers from the demise of Prohibition, when states, concerned about the return of legal alcohol, imposed their own piecemeal restrictions as checks on drunkenness and alcoholism," explained The Week a few years ago. "Like many blue laws, they've since sat on the books, growing dusty, outdated, and forgotten. That is, until the recent craft beer explosion."
The good news is that a number of states have been responding to market forces and raising their limits for beer ABV. It's a trend that began in the '00s. "Montana raised its limit to 14 percent in 2008, while Vermont upped its cap to 16 percent," notes The Week. "Alabama and West Virginia followed suit one year later, increasing their ABV limits to 13.9 percent and 12 percent, respectively, from 6 percent."
In recent years, this trend has grown, with more states loosening ABV restrictions by locale or overall and some, like West Virginia, pushing them even higher. In 2019, West Virginia moved its ABV limit up to 15 percent.
Utah in 2019 finally let go of its rule requiring a limit of 4 percent ABV (or 3.2 percent alcohol by weight) for beers sold in grocery and convenience stores—though nonstate stores are still limited to selling 5 percent ABV beer. Kansas dismissed a similar rule back in 2017, allowing beer up to 6 percent ABV to be sold outside specialty stores. Minnesota now remains the only state where such a law is in place.
In 2017, Tennessee raised its overall beer ABV limit from about 6.2 percent to around 10.1 percent.
In 2016, Ohio said beer could go above 12 percent ABV so long as it's labeled "high alcohol beer."
But unlike Ohio, a number of states still cap their beer ABV limits in the mid-teens range no matter what sort of labeling it has.
This is especially true in the South. In Georgia, for instance, the ABV cap for beer is 14 percent. In North Carolina, it's 15 percent and in South Carolina, it's 17.5 percent.

A Texas abortion doctor seems to be inviting lawsuits against him, by very publicly announcing that he performed an abortion in violation of the new state law. The Supreme Court recently declined to block the law, on the grounds that a preenforcement challenge to it didn't fly. So the doc's admission could be a way to spur legal action that would allow the constitutionality of the law to be considered.
"On the morning of Sept. 6, I provided an abortion to a woman who, though still in her first trimester, was beyond the state's new limit," writes Alan Braid in The Washington Post. "I acted because I had a duty of care to this patient, as I do for all patients, and because she has a fundamental right to receive this care. I fully understood that there could be legal consequences — but I wanted to make sure that Texas didn't get away with its bid to prevent this blatantly unconstitutional law from being tested."
"I understand that by providing an abortion beyond the new legal limit, I am taking a personal risk, but it's something I believe in strongly. Represented by the Center for Reproductive Rights, my clinics are among the plaintiffs in an ongoing federal lawsuit to stop S.B. 8," he points out. More here.

Child care worker shortage stems from strict regulations, state sloth. The Washington Post details a disturbing situation in U.S. child care. "The child-care services industry is still down 126,700 workers — more than a 10 percent decline from pre-pandemic levels, Labor Department data shows. While many industries complain they can't find enough workers, the hiring situation is more dire in child-care than in restaurants right now." Workers are quitting, or simply not returning, citing low pay and benefits. ("The pay is absolute crap for what's required for the position," one former child care worker, Tanzie Roberts, told the Post. "I can't afford to live on my own and work the child-care jobs that I am qualified for.")
Unable to find staff, many centers are shutting down or contemplating it. At the root of this conundrum may be the stringent regulations placed on day cares and other child care facilities.
"The reason child-care centers pay less than service sector jobs is tied to their business model. Staffing costs are by far the biggest budget item because many must abide by local laws that mandate one caregiver per three to five kids, depending on their ages and the area of the country," reports the Post. "Child-care labor costs can be as much as 50 to 60 percent of a day care budget, according to a Treasury report. By contrast, restaurant labor costs tend to be about 30 percent of their budgets."
"Another problem that child-care providers cite in hiring is increased difficulty in obtaining the necessary criminal background checks for workers during the pandemic, especially from state government offices," the Post says. "Some states have been especially slow to release background checks during the pandemic, numerous child-care directors and advocates told Post."
Strangely, a lot of the folks cited in the article (and the article itself) call for more government subsidies and involvement in the industry in order to save it. But isn't that only guaranteed to raise regulations, obstacles, and costs?

This isn't just a question of good or bad policy, it is a question of real moral evil. It is morally wrong to force or even demand without force that other people to undergo medical procedure to protect you from a natural pathogen. It is wrong.

This was despite the fact that the NIH had evidence testing on monkeys that suggested that the vaccine still had active viruses in it. If you look back at previous elections, Bush on his second term took a rather large proportion of hispanic votes, and most especially in Texas. You'll note that the same election, one of his planks was immigration reform which was unsuccessful.
If the GOP were to offer a solution to the immigration mess that did not include full open borders but still provided some mechanism for support, they would probably go a long ways in capturing the hispanic vote for a long term. It worked for Bush, and it worked for Reagan before that.
The problem will be a solution that navigates multiple parties. There are nativists who want to protect their culture. There are laborers who want to keep salaries high by centrally controlling the labor supply. There are political strategists who are concerned about how this changes voting dynamics.
I think any solution will only please two out of the three. You could work out a guest worker program that allows cheap labor, but doesn't encourage people to bring families (importing culture) and doesn't get citizenship. Or you could find a route to citizenship that encourages assimilation, but you would still see demographic changes in voting.
It will be tricky either way, and I don't trust the GOP to be successful at anything mildly tricky.

I used to make my own beer, and got pretty good at it. Looked into doing it professionally but the pay averages around $40K. Can't live on that. Looked into it more. Even visited some local breweries. Turns out the job is mostly cleaning. No wonder pays crap.
Anyway, like most homebrewers I naturally tried to make the strongest brew I could. Biggest bang for the time spent. It tasted like crap. My best brews were in the 4-5% range. Session ales and Eastern European lagers.
So I'll definitely pass on this one and recommend others do the same. Especially since the bad alcohols, the headache makers as in methyl and fusel oils, tend to be in higher proportions the longer the yeast works.

Same thing with cidermaking. You may think the hardest part will be keeping the yellow jackets at bay while you run the press, but in fact it's cleaning, cleaning, cleaning. Worse in fact with cider since it relies on multiple rackings to get fermentation to quit before the sugar is all gone. And then there are the bottles.....
But seriously, why all the focus on killer ABV? If one wants alcohol for a painkiller, there are plenty of options, all of which will be cheaper than anything you can produce yourself.

Best batch of anything I ever made was a cider. I used local cider. And in Maine there's no shortage of that. Beefed up the specific gravity with some malt extract to get an expected ABV of 5%, and fermented with lager yeast. When all was done I added some potassium sorbate to stop the honey I added with it from starting a secondary fermentation. Force carbonated it in a corny keg.
Holy fuck that was good.
Know what? That's not true. The absolute best brew I ever made I used maple sap instead of water for the entire process. Mash and sparge. Made a brown ale. Had a wood-like flavor as if it had been aged in barrels. Sublime.
But like the honey cider, the ingredient cost would make it too expensive to sell as a commercial product.
Interesting idea to use sap rather than water for brewing. Cool that you got a woody flavor. I can't taste anything except sweet in raw sap, but my experience has all been with swamp maples - maybe different intensities from sugar maple?
But I'm one of the unlucky ones that can taste sorbate. Of course, since bitter is what hops brings in, why not?
I tried doing mead last year with quality farmstand honey, using apple "cider" (UV treated apple juice from the same place) to dilute it with rather than water. I figured the juice would bring in the nutrients at a low lever, and maybe cause it to stop early. Anyway, it was just wicked hot, like a bad Columbia river white wine; most of the fragrance of the honey was gone. I've got it bottled, and am hoping it will soften over time, but I'm not wasting money on honey for something like again without some more info.

I never had much luck with mead. The sugar ferments out, leaving behind the flavor of whatever the bees visited. So when I made beer and beefed it up with commercial honey, all it did was make it taste like clover stems. And when I made mead with commercial honey it tasted like clover stems. Because the sweet fermented out. The cider was different. I halted fermentation with the potassium sorbate and the honey kept it's sweet. Tasted good.
Same idea with the maple sap. The yeast ate the sweet, and only the maple flavor was left.
Perhaps mead just tastes bad. There is probably a reason that beer almost entirely replaced mead once barley became widely cultivated in northern Europe.

Pound out a chicken cutlet, dredge it in seasoned flour, and drop into a hot pan with some olive oil. Add some artichoke hearts and some roasted red peppers or whatever feels good. When the chicken is mostly cooked, add some fortified wine. Vermouth. Marsala. Whatever. Finish with some stock to make a gravy, then put on pasta. Yum.

I’ve just taken up a different kind of fermenting: making my own sauerkraut. As well as making my own pickles, and whatever you call the pickled carrots/peppers that you get in Mexican restaurants. Almost no learning curve, but delicious results.

Nah. I tried gardening. The birds and snails, etc. would always get to whatever nice stuff I grew before I did.
My problem has always been lack of sun. If I had a snail problem I'd get some chickens. My ex has some. I get a dozen of fresh eggs every other week when my daughter visits. Good stuff. I save them for breakfast eggs instead of using them for baking or whatever.
Kinda like how I'd save them for over easy and over medium, while using the old ones for over hard.

Beers above 15% ABV are mostly undrinkable, and entirely novelty items. One of the few exceptions are icebocks, which start out as good beer but then get ice distilled. But a naturally high ABV means an extremely cloying and syrupy beer. That Sam Adams chooses to make their novelty beers with funky ingredients only adds to the taste abomination.
Sure, go buy one of these oddball beers, and display it in your collection. But by gawd don't drink it!
p.s. Truth in advertising means that I must admit I once made a 13% wee heavy scotch ale. It was primo. Won an award! But it was at the ragged edge of drinkability and rust remover. Yeasts and techniques to bump up the ethanol would only have given it more of those nasty higher alcohols and funky flavor notes.

While I think 28% beer should be allowed, I also think that something that high must be labeled. You can drink and drive after 2 beers, but not 2 of those. Also, the high ABV beers like Belgium Tripels don't taste like beer. I don't think they are anything special.
