Lil Wayne, Steve Bannon, and Some Drug War Victims Pardoned, but No Assange, Snowden, or Ulbricht

Trump manages to do a little good on his way out. In his last few weeks in office, outgoing President Donald Trump went on an execution spree and spawned a riot at the U.S. Capitol. So, it's no surprise that he spent his last full day in the White House yesterday further sullying his legacy, taking back an order issued at the start of his presidency—back when he still pretended to care about "draining the swamp"—that bans administration officials from private lobbying within five years of leaving office while (for the second time) pardoning a former campaign chief. This time, the pardon went to Steve Bannon, the architect of some of the worst anti-immigrant policies and alt-right tones in Trump's campaign and early presidential days.

Meanwhile, Trump failed to pardon or commute the sentences of government whistleblowers like Julian Assange, Edward Snowden, and Reality Winner or Silk Road founder Ross Ulbricht, as many had been urging him to.

However, Trump did issue some commendable pardons and commutations yesterday, including to rap star Lil Wayne, who was recently busted on gun charges, and Lavonne Roach, a woman sentenced to 30 years in prison for helping out with her boyfriend's meth operation.

In total, Trump approved 143 clemency petitions, commuting sentences for 70 people and pardoning 73.

At least 10 people serving life sentences for nonviolent drug crimes had their sentences commuted.

These include David Barren, whose life sentence was commuted under Barack Obama… to 30 years in prison. And they include Chris Young, who in 2014—at 26 years old—was sentenced to life in prison for possession with intent to distribute cocaine.

Also among those granted commutations were "Michael Pelletier, who went to prison in 2007 for importing marijuana; Craig Cesal, a first-time offender who was imprisoned in 2003 for repairing trucks that were used to distribute marijuana; and Darrell Frazier, who was sentenced in 1991 for his role in a cocaine trafficking operation," notes Jacob Sullum, who makes a case for celebrating pardons even of Trump cronies. ("The focus on Trump's motivation obscures the crucial question of whether the recipients of commutations received sentences that were grossly disproportionate in light of the conduct that sent them to prison," he writes.)

Sullum points out that while Trump's commutation total doesn't "come near Obama's, which surpassed those of his 13 most recent predecessors combined," Trump "did end up issuing nearly 100 times as many commutations as Obama did in his first term (just one)."

Now it's time for incoming President Joe Biden and Vice President Kamala Harris to prove they've actually changed their crime panic and cop ways by keeping this up. As Matt Welch comments, "Joe Biden and Kamala Harris, who both campaigned on criminal justice reform after having not governed that way in the past, can demonstrate their seriousness by commuting sentences every damned day, not just the last one."

    It's not that hard. The deep state is the more or less permanent cast of civil servants and military and intelligence leaders who actually do most of what the government does. This is not some weird conspiracy theory, it's just the inevitable result of a government being so big that no one can really be in charge. It's a fact of modern government that has been observed for a long time. The BBC even made a whole TV comedy about it.
    That's what it means to me, anyway.

There's a reason that media coverage tends to mimic Democratic press releases, and the reason for that is because these people all know each other and in several cases are even married to one another. They go back and forth between media, lobbying, and government gigs like a fat man at a buffet line. They literally craft their political narratives at the breakfast table, to the point that it's a common feature of political TV shows. And because the Democrats have direct ties to mass media megacorps like Disney, Viacom, and Netflix, through relationships with their CEOs, they also control the medium for pushing their political ideology through popular culture.

        I don't think lockdowns can explain the difference there. Lots of places in Europe had much harsher policies and had much worse outcomes. Some places like Japan never really had anything we'd call a lockdown and still did very well. There are other factors driving the differences between countries.

I've seen some things about serological studies in Japan where they found that close to 50% of the young people they were periodically testing ended up having antibodies.     The Muslim community suffered a tremendous amount of suspicion, undue discrimination, and surveillance, etc., etc. during the War on Terror. If that's what it takes to make someone sensitive to this kind of thing, that's nothing to brag about. Plenty of people, who've never been subjected to surveillance and demonization oppose unduly subjecting others to that--without ever having suffered such a thing themselves. Those people are also worthy of our respect.
    
    Opposing rape shouldn't require any experience as a rape victim. Where's Rashida Tlaib on respecting the rights and liberties of people she hates? That's what libertarians do. We urge society to respect the rights of people we hate--from free speech for Nazis and gun rights for communists to not torturing terrorists.
    
    There is something fundamentally libertarian about this:

The worldwide movement toward "limited authoritarianism," already well under way but dramatically accelerated by the coronavirus, is driven by the elite consensus that ordinary people cannot be trusted with so much freedom.

This is a natural consequence of the progressive ideology, which is inherently authoritarian, although it peddles itself in the early stage with lots of jibber-jabber freedom and liberty. Progressives by definition believe that the growth of the State can never be reversed.

Every time the State grows - taking more money from the private sector, issuing regulations, criminalizing activities that used to be free - it is declaring that the people can no longer be trusted to make certain decisions. This is the inescapable logic of statism.

...The best way to get people to go along with this constant dwindling of their liberty is to make them distrust and fear each other. That way, the State can posture as their loving defenders, keeping them safe from the predations of other free people.

As we move into the era of limited authoritarianism, the previous steady erosion of liberties and theft of money is no longer disguised with gentle maternal language. Now it's time to firmly establish a hard core of power that voters must obey, and can never dream of controlling.

The next steps toward authoritarianism simply can't be disguised as loving, maternal government taking good care of its child-citizens. It requires a level of obedience - the most important resource in a statist system - that simply cannot abide resistance, or even dissent.

...The emerging consensus among the global elite is that "democracy" can only be saved by sharply limiting it. Our mighty global institutions and their accords cannot be subjected to the will of selfish, short-sighted, foolish, voters with nationalistic inclinations.

...The Western world generally has constitutional restrictions on how vigorously the State can suppress dissent, or how much behavior it can compel, because it is still required to pretend the people get to vote on everything and are supreme over their government.

"Limited authoritarianism" gets around this by using corporate power and political activists as instruments of control and obedience. The State has powerful partners in the private sector who will enforce decrees that could not be issued lawfully.

Last night, Kennedy said that Mitch McConnell threatened Trump (this week) with a conviction in an Senate impeachment trial (that would almost certainly violate the US Constitution) if Trump pardoned Assange, Snowden, or Ulbricht.

  Don’t see the need to pardon Assange as I don’t believe he violated any US laws, so let them extradite him. Any competent lawyer would get the charges dropped. As to Snowden, though you might like the results there is no doubt he broke federal law. As to Ulbricht I don’t think most Republican would care that much. My guess is it was more about not pardoning the protesters that breached the capital.

I've lived in the DC area my entire life and I have to say that the optics of this inauguration are legitimately one of the most disturbing things I've ever seen in my entire life. It's like something out of a dystopian movie or you'd see in a third world country. I can’t understand how they aren’t even going to have a crowd of like 100,000 socially distant people on the mall that’s nothing it’s leading me to believe they can’t even get close to that number to show up which is strange seeing how Biden just received the most popular support of anyone in the history of the country by large margins. It's so fucking creepy.

Germany is getting tougher policing its quarantine in the country- so much so, it deemed it necessary to threaten violators with a short stint in special Covid jail. It is understood the facility will be based in Dresden, local police authorities have confirmed.

A spokesperson said access to the ‘pandemic hotel’ pictured here won’t be that easy – you need to get a warning and a fine first. By nominating sexually confused Richard/Rachel Levine to be Assistant Secretary of Health, Biden is not only promoting the mental health pandemic of the 21st century (i.e. transgenderism), but is also signaling that this will be a very Dark Winter indeed.

As for Officer Brian Sicknick, the Capitol policeman and a demonstrated patriot/vet who died soon after the mini-riot, we have no autopsy report and no specific cause of death yet. The family has stated he died from injuries sustained on duty, which if accurate would seem to exclude medical conditions. This is all we know right now. If the implication that someone hurt him is correct, that is shameful. But lawyering for decades has taught me you need to gather all the evidence, dispassionately, before you can be sure of the facts. We need to know the truth, at a minimum to hold anyone who committed a crime accountable, including any misguided individual who might share some of our very general views. No significant number of the 74 million who voted for Trump got in it to hurt cops.

I counsel prudence and a rigorous search for truth, wherever it leads, but the lack of hard facts has not stopped the left and their lackies laying his death at our feet. We hear rumors of Officer Sicknick being hit with a fire extinguisher, and there is video of some idiot hurling one at the cops, but the lack of hard facts raises questions. It’s been a while – if there were facts that showed he was murdered rather than passed away from another cause, you would expect them to come out. It does not mean they don’t exist. It just means that for the first time in memory a story that the bad faith media could spin against Trump was kept, properly, confidential until the investigation was complete.

It is unclear whether Officer Sicknick was the officer struck in that fire extinguisher video, and it appears from the sketchy facts that he collapsed at some point after the fracas. We still don’t know what happened. Was it a traumatic brain injury? Did he have a preexisting condition? All we have is a general statement. Right now, we really do not know what happened. Causation is still a thing even if the media and the pols want to skip over it.

Another social media free speech haven, Wimkin, has been banished from both Apple's and Google's app stores.

    At the very least, this is the result of the antitrust actions pending against them, and logic suggests it's more than that.
    
    The antitrust complaint against Google targets the unfair way Google uses its app store. If this were just about Google being afraid of what the Democrats will do to them with antitrust, they would avoid arbitrarily using their app store this way. They're doing exactly what the antitrust case accuses them of doing!
    
    Doesn't that suggest that someone, somewhere might be telling them to do this?
    
    Maybe the FBI is monitoring these apps or something. The FBI is part of the same Justice Department that's pursuing antitrust against social media companies along with the FTC. Honestly, given the FBI's anti-domestic terror mandate, if they aren't monitoring the activity in these apps, they aren't doing their job.
    
    Whether their job should be that is another question entirely, of course, but I want to know if the Justice Department, the FBI, the NSA, or anyone else in the government or the Democratic party is telling Apple and Google to expel these apps.
    
    They wouldn't keep creating more examples of collusion and using their monopoly status amid an ongoing antitrust action under normal circumstances.
    
    When Gates was facing an antitrust action, he personally gave Apple hundreds of millions of dollars they couldn't get anywhere else at the time--just to keep them afloat so he could tell the judge in the antitrust case that he had a significant competitor. He wouldn't have openly rigged Internet Explorer so that it wouldn't open Apple's website, and that's basically what Google is doing all over the place right now.

Long story short, the only way to sustain a monopoly or duopoly is with government support. That's why cable television still sucks, government franchising.         If Google is doing this because they're afraid of what the government will do to them with their antitrust case, that isn't an excellent example of the free market at work.
        
        If Google is doing this because they've been explicitly told to do so by the FBI, the Justice Department, or because they've been explicitly threatened by the Democrats who control the government, that isn't an excellent example of free markets either.
        
        Meanwhile, if Apple and Google are coordinating their deplatforming activity, that isn't an excellent example of free markets. The legitimate purpose of government is to protect our rights, and that means they need to protect our rights from private parties, as well.

        Who here imagines that Tony believes in freedom of association on private property in any other context? Does Tony support fundamentalist wedding cake makers refusing service to gay couples? Does Tony support private schools that refuse admission on the basis of race, sex, gender, creed, etc,.?

Now it's time for incoming President Joe Biden and Vice President Kamala Harris to prove they've actually changed their crime panic and cop ways by keeping this up.

But vigorous law enforcement is needed to purge this land of all those seditionists and insurrenctionists. By last count, there were about 74 million of them, and they can't all be moved into reeducation camps unless we seriously empower the cops, which fortunately it's now safe to do, since the right people are in charge.

But aren't we worried what the Republicans will do if they get back in power? Weren't you listening? Steps will be taken to ensure that never happens.

Trump's final speech before he got in the helicopter was just like his presidency: unprepared, incoherent, self-serving and offensive to anyone hoping to be inspired by a real statesman. He petulantly refused to mention the incoming president's name. When he optimistically opened the mike up to his wife, she awkwardly had nothing to say.

There was one tidbit in there that deserves mention. He poked China in the eye by calling COVID the Chinavirus. And he warned that China created a very dangerous situation and that it continues to be very dangerous. Then he hesitated in a way that made it seem like he wanted to tell us more about that, but couldn't. Trump was never playing 4-D chess. What you see is what you get, and he seemed more like a kid with a secret he really wanted to tell, rather than someone holding back another insult. I don't think he is capable of the latter.

A claim that China released an engineered virus, even accidentally, would have world changing ramifications, potentially forcing their hand to militarily secure vital resources in the face of severe sanctions. Even Trump could be convinced that the information not be released, especially if the disclosure would be used in his impeachment.

  Intelligent people have speculated that it’s possible the virus was found in nature but escaped from a lab. Hard to know the truth with China.
  
  But if we care more about poking the bad man in the eye than fixing the problem, we’re falling victim to our chimp brains again instead of using our human ones. There’s no logical reason to assume China would start a pandemic on purpose. They’re extremely paranoid authoritarians. A pandemic is the opposite of having control.
