Trump's Naked Megalomania Continues a Bipartisan Trend
Will his blunt self-aggrandizement reinvigorate concerns about presidents who exceed their powers?

After Donald Trump floated the idea of delaying the presidential election last week, the most striking response came from Federalist Society co-founder Steven Calabresi. "This latest tweet is fascistic," the Northwestern University law professor wrote in The New York Times, "and is itself grounds for the president's immediate impeachment again by the House of Representatives and his removal from office by the Senate."
For Calabresi, who opposed Trump's impeachment for pressuring the Ukrainian government to investigate Joe Biden, the president's suggestion that the election should be rescheduled was a tweet too far. Whether or not you agree, the bipartisan rejection of Trump's suggestion is a hopeful sign that his blunt self-aggrandizement has reinvigorated concerns about presidents who claim powers they were never granted—a problem that extends far beyond this particular president or his party.
"President Trump needs to be told by every Republican in Congress that he cannot postpone the federal election," Calabresi wrote. "Doing so would be illegal, unconstitutional and without precedent in American history."
While Trump did not explicitly assert that he has the unilateral power to postpone the election, he has unambiguously claimed the authority to withhold congressionally appropriated money from states that allow wide use of mail-in ballots. Such extortion "would be a serious threat to both federalism and separation of powers," notes George Mason law professor Ilya Somin.
Trump's assertion of "total" authority over COVID-19 lockdowns was equally dubious. "Some in the Fake News Media are saying that it is the Governors decision to open up the states, not that of the President of the United States & the Federal Government," he tweeted in April.
In fact, Trump averred, "it is the decision of the President." That evening he told reporters "the president of the United States calls the shots."
That was a gross mischaracterization, since states have broad authority to combat communicable diseases under their general "police power," while the federal government is limited to public health measures derived from its power to regulate foreign and interstate commerce. Even if Congress were inclined to cite the Commerce Clause as a justification for lifting state lockdowns, the president would have no authority to act without new legislation.
Illustrating the bipartisan appeal of the imperial presidency, Michigan Gov. Gretchen Whitmer, a Democrat who would be among the first politicians to deny that Trump has the power to override state public health policies, last month urged him to help control COVID-19 transmission by imposing a nationwide mask mandate. She did not even bother to suggest where Trump would get the authority to do that.
In 2017, when Trump suggested that the Federal Communications Commission should yank the licenses of broadcasters who offend him, he got pushback from FCC Chairman Ajit Pai, who promised that "the FCC under my leadership will stand for the First Amendment." Trump's determination to build his "big, beautiful" border wall, notwithstanding the legislative branch's refusal to pay for it, is another example his critics like to cite as evidence of his lawless willfulness.
One presidential power grab Trump's critics tend to overlook, presumably because of their policy preferences, is his capricious ban on bump stocks, which arbitrarily transformed heretofore legal gun accessories into contraband based on a reinterpretation of the law at odds with its plain meaning. Last March, Supreme Court Justice Neil Gorsuch, a Trump appointee, wondered why the courts should "defer to such bureaucratic pirouetting."
Biden promises Americans a return to normal presidential behavior, which unfortunately does not mean a more constrained view of the office's powers. When it comes to waging war, for instance, Biden thinks the president does not need congressional approval for "limited" military operations that serve "important U.S. interests," which amounts to a blank check.
Stylistically, Trump is notably different from his predecessors. But his naked megalomania continues and crystallizes a long-term trend blessed by both major parties.

You forgot about pulling missile defenses out of eastern Europe, pushing through an arms treaty that slashed America's nuclear deterrent while allowing the Russians to expand theirs, doing even more for Russian client Iran than he did for Syria, and propping up the Russian economy by doing everything he could to hinder American domestic production of natural gas.
Obama ran the most objectively pro-Russian foreign policy in U.S. history, with the possible exception of FDR allying with the Soviets to fight World War 2.

Yes, probably. In fact, almost every president since at least Teddy Roosevelt probably should have been impeached but weren't. Instead both parties allowed them to gradually accrue more and more power to the executive branch.
The only reason I hedge and say "almost every president" is to allow for the possibility that there may be a few who were OK. I'm not an expert in presidential history. Coolidge, for example was probably OK, maybe one or two others but that's about it.
William Henry Harrison probably didn't do anything impeachable, dying from pneumonia a month into his term.

I've frequently said that few Presidents haven't done anything to merit being impeached, if we were serious about holding them to their oaths of office. Maybe Carter, he was more of a nebbish than anything.
But the Democrats would never have tried to impeach Trump over something justifiable, it might set a 'bad' precedent.
Trump is asserting that there are no limits on his powers, and he's right. The only check on his power is whatever anybody feels like throwing out there, and it's specifically when Trump wants something, there's no general principle involved. And it's not just Trump - every other Congressman, Senator, Cabinet Secretary, agency head, Governor, Mayor, Council Member and assistant deputy dog-catcher will readily assert the power to do whatever the hell they want.
So much this. It's almost like the Founders knew this about people and set up a structure of government that prevents the innate desires of all people to control others to become to powerful.

The ambitions of politicians like Trump, Biden, Obama etc. are only part of the problem. When a president abuses his executive authority, he does so with the cheering approval of at least half of the electorate. The other half doesn't oppose the abuse; they just oppose the specific action. They want to preserve that power for when one of their boys gets the White House "back" for them.
This will continue so long as most of the American people want the president to be a god-king who magically solves all of their problems.

If the American people have indeed gotten dumber since the founding, it is probably most evident in their understanding of government, both in general and in US law. I can understand how a 5 year old perceives the role of the President, a single figure who is the boss of the government and perhaps of the nation. But when a 25 year old has the same perception, we are in deep, deep trouble.
You say that, but how irrational is it really for the 25+ crowd to believe that the president has all that power when, inch by inch, year by year, that power has actually been granted to them? We live in a country where you cannot step outside your house without a license of some sort. You own no real property which cannot be capriciously taken from you for arbitrary reasons. You can be denied the right to travel, to work, to own property, even to exist in various places all based on a complex web of statutes and regulations all of which can be created or destroyed with the swipe of a pen by one man. The pathway to success and fortune has ceased to be about doing the right thing and become about placating the right people.

We've had a few good one's run on that principle; sadly the American people don't seem to support the Constitution anymore.
The big problem here is a Congress that refuses to act. By abdicating power assigned to Congress they strengthen the President's power. Want to limit the President's power, get Congress to take responsibility and address problems. Congress should limit the President's power to use the military. Congress should address rules for immigration and naturalization. Congress should address health care. Any executive will push the envelope, our founders knew this and set up checks and balances. Congress need to do its part.
And the problem with Congress is structural and much harder to solve. In a federal government that's now highly complex and extremely powerful, seniority in Congress is important: years of experience and years in the pecking order matter greatly. So despite the fact that we hate Congress collectively, we each send our own Representative or Senators back, year after year, because they bring home the bacon and they advance in seniority.
For the Senate, one solution would be repeal of the 17th Amendment.
For the House, all I can think of is enabling at-large voting-- which would solve the problem, but would be politically impossible to pass and operationally impossible to implement.
I think people are dreaming if they think repealing the 17th Amendment would change anything. I suspect 99 out of 100 Senators would be the same people they are now, and Rand Paul would still be an eye doctor in Kentucky.
But getting elected to Congress, and attaining seniority (and power) is highly dependent on party support. And the major parties have long embraced the campaign strategies that leverage the intellect and knowledge of the average voter, who famously cannot name the three branches of federal government (and forget about roles). The average voter seems to treat voting as something between prom queen and a TV talent show, and can really only relate to a single figure head as our "government".

You see, democrats across the country started pushing for all mail elections due to covid... to begin immediately, without debate or authorizing legislation. The fact that it was across the country might reasonably lead one to conclude that this was a coordinated strategy. One might conclude that they believe they gain an advantage by holding the election by mail, now rather than in November.
That being the case, it would be reasonable to surmise that Trump thinks all of this is to his disadvantage. So he points this out in 120 characters.
And he offers an alternative solution. Since the Democrats (disingenuously) claim that covid makes going to the polls too dangerous, he offers an alternative to their proposal of moving the election up by several months..... delaying the election.

Florida has absentee voting by mail, not mail in voting the way the Democrats want it. Absentee voting by mail is far less prone to fraud.

A number of states led by Democrats and led by Republican vote by mail with very minor suspicions of fraud. I think the thing that bugs me the most about presidential power is the lack of support from the public and the media when a president doesn't exert power. Trump is a great example, he's constantly harangued for being a dictator and tyrant, but then when he doesn't do something or doesn't act on something he his lambasted for not doing anything. When he invoked federalism principles in dealing with COVID, he was excoriated for pawning off responsibility to states and governors.
Even to this day he is called a tyrant all in the same breath while being accused of not doing anything about COVID.
At the end of the day, when something happens, the public's and media's natural instinct is to demand that the president do something. It's damn near political suicide for a president to say, "not my job" or "that's beyond the scope of my office." To take such a position is unnatural for people, and it will be completely destructive of a political future as you will be labeled lazy and feckless by a society that demands you do something.

The thing about Trump is that he asks questions in a certain way. He asks, or suggests, something as if now his minions will scuttle around making it happen. In the moment the tweet may have been a legitimate question, but for a guy who's run casinos, millions of dollars of real estate to his name at various points, business all over the world, he doesn't *have* to give orders. He just suggests, or asks, or glances over at the waiter so to speak, and a significant fraction of the room will scramble around making it happen. Actually, by those rules, he should never have to ask and they should already be doing it. He's used to having fixers and that tweet sounded like fixer-speak.
I read Trump's statement and in it he said that maybe CONGRESS SHOULD LOOK INTO DELAYING THE ELECTION. It was nothing like the headlines and democrats have been saying that Trump was going to delay the elections. The only part that Trump would have to do with it is that he would have to sign the bill after congress passed it or if he vetoed it congress could override the veto but I doubt that they could do that. But REALIZE it makes a much better story to say that Trump IS going to delay the elections. But the democrats has also said that if Trump loses the election he will not leave the white house. I doubt that he would say or do that because the republicans and libertarians would be the first in line to escort him out of the WH.
Bullshit! (Is that civil?) Trump is no megalomaniac. His actions show that he intends to give more power to the people, not the government. School choice and gun rights are a good start. Trump represents all of us who desire a smaller less intrusive government.
