Breaking: Cop Who Killed Tamir Rice Should Face Murder Charges, Judge Rules
Legal hurdle cleared


A judge determined that Timothy Loehmann—the officer who killed 12-year-old Tamir Rice at a Cleveland-area park late last year—should face murder charges. His ruling was released Thursday afternoon, according to cleveland.com.
Civil rights activists fed-up with the slow progress in the case had used an obscure Ohio law to bypass prosecutors. CNN explains how this is possible:
The Ohio law allows "a private citizen" to file an affidavit with a municipal judge making an accusation of a crime. If it alleges a felony, a judge can "issue a warrant for the arrest of the person charged in the affidavit" if the judge deems it was filed in good faith and is meritorious. The law went into effect in 1960 and was amended in 1973.
The Cuyahoga County Sheriff's Department has completed an investigation into how police killed the boy. The results were handed over to prosecutors last week.
Cleveland Police Patrolmen's Association President Steve Loomis called the activists' effort "mob rule." The association is the union for patrol officers.
"It is very sad how miserable the lives of these self-appointed 'activists, civil right leaders and clergy' must be," Loomis said in a statement. "I can't imagine being so very consumed with anger and hatred."
The activists have every reason to be angry. Video surveillance established beyond any doubt that Loehmann's shooting of Rice was "the crulest thing I've ever seen," as the attorney for the Rice family put it. And given Loehmann's history of mental instability and incompetence with firearms, the notion that the Cleveland police department is partly responsible should not be easily dismissed.

I am one of "those seeking justice" and I am a libertarian. Every libertarian should be invested in the rule of law. Its hard to imagine a case that could be more important to those who advocate small, rational government than the murder of a child by an out of control police officer.

That the rookie was just along for the ride, doing what he was told, as his training officer barrelled into a tactically absurd position where young Tamir inexplicably reached for a weapon he'd already been warned looked too real (by the friend who gave it to him).
This is a horrible case, and the driving offier was beyond negligent, but it was not murder.

I don't think the police union rep understands the definition of a mob. The last time I checked a private citizen doesn't equal a mob. Also, I'm pretty sure his job is to enforce the law. This provision is part of the law, so I'm not sure why he's upset. No doubt it's my lack of expert police training.

i don't know about this one. a "justified shooting" defense really only works with two conditions: the jury believes the officer feared for his life, and the deceased did something to justify that fear. i can see the jury debating the first condition - it's hard to know what's in someone's mind, and officers will likely get the benefit of the doubt.
but as for Tamir doing something to instill that fear? the cops were the ones who created the deadly situation by flying up to a 12 year old without warning. if they, from 20-30 yards away, yelled at him to drop the gun and he raised his arms then sure, it's probably justified. but the way this played out there was likely nothing Tamir could have done to NOT get shot. it's not murder in the 1st, but the officers created a situation where Tamir's fate was sealed regardless of how he reacted. negligent homicide at the least.
If there are cops in the courtroom it'll be a hung jury or an acquittal. The jurors have families, they don't want their wives and/or daughters raped, their husbands and/or sons beaten within an inch of their lives, killed or framed.

Believe me, when I say that if Tamir Rice had a real weapon and meant to use it he'd be alive today, I am in no way advocating that people shoot out-of-control police if necessary for self-defense, even if such an act has been upheld as legal in several different cases.
If Tamir Rice had had a real weapon and looked like a credible threat-- as was demonstrated in other cases where cops were in ACTUAL fear for their lives (Chris Dorner, Malissa Williams and Timothy Russell), rather than CYA "fear for their lives"-- they would have hung back, summoned dozens more cops to the scene and sprayed hundreds of rounds at anything that moved.

I was talking to cop the other day who was absolutely adamant that the Tamir Rice murder was "a good shoot, but bad tactics". Translated; 'the officer was right to kill the kid, the only problem is that he didn't kill the kid even more betterer than he did.'

One thing I haven't seen mentioned in this story is that Ohio is an open carry state. Those defending the cops are going to great lengths to make sure the public believes the police thought it was a real gun. But... I repeat... it is an open carry state. Even if the gun had been real, it's not illegal to carry it.
