Texas Grand Jury Won't Indict Man Who Shot Deputy in His Home
Claims he thought burglars had broken in while he was sleeping
A grand jury has declined to charge a Central Texas man for killing a sheriff's deputy who entered his home to carry out a search warrant.
Henry Goedrich Magee was accused of capital murder for the Dec. 19 death of Burleson County Sgt. Adam Sowders. Magee's attorney, Dick DeGuerin, said Thursday the grand jury did not return a capital murder indictment against Magee.
Sheriff's deputies entered Magee's rural home near Somerville to search for guns and marijuana. DeGuerin has said Magee awoke and thought burglars were entering his home about 90 miles northwest of Houston, reached for a gun and opened fire.

Ryan Frederick should have lived in Texas.
I wonder what Cory Maye might have to say about this case?

Chalk another one up to Daryl Gates. So unnecessary.
While it's tragic that anyone had to die, a few more like this and maybe the cop's will think twice before sending in SWAT when it's not needed.
If you were asked to design the most unnecessarily dangerous way to serve a warrant, this is the way you would do it.
If you were asked to design a way to murder someone under the guise of serving a warrant, this is the way you would do it.
indicted for drugs and a gun, will probably do 30 years - would have been better off indicted for murder without the drug charge.
