Jeb Bush: 'It is not [immigration] law enforcement but the law itself that is broken'
Former Florida Gov. Jeb Bush and Goldwater Institute Vice President Clint Bolick have a new book out, called Immigration Wars: Forging an American Solution. An excerpt in today's Wall Street Journal contains a point that somehow goes missing in most of our emotion-choked discourse on the issue: "The best way to prevent illegal immigration is to make sure that we have a fair and workable system of legal immigration." Who'da thunk?

It is not law enforcement but the law itself that is broken. The nation has changed dramatically since the Immigration and Nationality Act of 1952, and that legislation has not held up well. It has been patched over so many times that it is hopelessly complex and incoherent. We need to start from scratch. […]
There is no "line." Critics of comprehensive reform often argue that illegal immigrants should return to their native countries and wait in line like everyone else who wants to come to America. But unless they have relatives in the U.S. or can fit within the limited number of work-based visas, no line exists for such individuals.
For most aspiring immigrants, the only means of legal admission to this country is an annual "diversity lottery" that randomly awards visas to 55,000 foreigners. There are roughly 250 applicants for each visa every year. The absence of a meaningful avenue of access increases the pressure for illegal immigration.
Sadly, the always-timely observation that over-criminalization breeds lawbreakers and thus should occasion re-writing the law, does not, for Bush/Bolick, extend to the Drug War:
The far greater border-security threat is paramilitaristic drug cartels that often are also involved in human smuggling, increasingly from Central American countries. The U.S. needs to coordinate closely with Mexico and focus its resources on defeating the cartels.
The cartels are indeed terrible, but organized crime always flourishes wherever the law forbids millions of humans from pursuing happiness how they see fit.

But that is the malarkey that has been pushed by the xenophobic "conservatives" and nativists - that if people just got in line like everybody else, then they will get their chance.
I know what that "line" looks like, and it looks like just another protectionist scheme created by cronies and people unfamiliar with even the most basic of economics. It's nothing more than a thinly-disguised barrier of entry, but one so cruel, so ridiculously out of touch with reality and so rights-violating, it ends up being olympically ignored.
The fact is that immigration greatly increases the productive machine that is the Division of Labor; most immigrants come for the sole purpose to work and prosper, and work they find precisely because in between all the protectionist schemes created by the U.S. government, the most pervasive and destructive to the right of contract and property rights is the so-called Minimum Wage. Add to the stinking pile FICA, FUTA, labor laws and other impediments to production and you will wonder no more why there's such a demand for more affordable labor.
But, but, but... Living wage! Corporate profits! Trade deficits!
Letting (for example) mexicans cross freely back and forth for work, commerce,tourism,etc would do more to boost our economy than anything else Washington could do.

I won't disagree with you, because you make strong points. But the problem is compounded by an establishment Left that has no interest in fixing the basic flaws in the law. I don't KNOW why this is so, but I have strong suspicions; I think it is because the Left is institutionally inclined to a body of Law that basically forbids everything, combined with a State that has the authority to make exceptions on a case by case basis. This is the Government run by Experts that the Western Intellectual Left has lusted for since at least 1815.
So we have one Establishment that promotes an unfair law because sit is to their advantage and another Establishment that has no interest in making the law fair because they want all 'fairness' to emanate from their wonderful selves. And the illegal immigrant population trapped in the middle.

No quotas, easy to get work visa that lasts for 330 days. Any time up to that, you can leave, turn it in, and can get another after 30 days.
I could see most H1B visa holders getting it instead, isnt tied to any job or other limits, its a wide open "come work legally in America without any permanence or citizenship path" visa.
It'd be useless without a way to enforce it, and we lack that currently, not because we can't do it but because it wouldn't be "humane" or something.

Three things are needed to get most of benefit of open borders and a closed welfare system:
1. The welfare reform act of 1996.
2. Children, even citizen children, are on the welfare schedule of their parents.
3. Lax enforcement of immigration law against peaceable illegals.
Prior to 9/11, we pretty much had #1 and #3. Yes, it would be better if the US handed out unlimited visas for unlimited residence under the constraints of no welfare for you and your children and no path to citizenship. But, barring that, the addition of #2 and the return to #3 would give you open borders and a closed welfare system.

OK, here's my idea for an immigration policy. Foreigner goes into an office at the US embassy or consulate, blood is drawn for a contagious disease test, name is run through the crime databases (FBI, Interpol, etc.) Assuming clean bill of health and no warrants, he gets a photo ID and gets a SS number so he can pay taxes once he starts working. No time limits, no other restrictions. He pays the same taxes we all do, has the same rights and responsibilities. Except he cannot vote or hold political office.
Maybe throw in an entry fee of a not insignificant sum. Might as well add to the Treasury.
