90-pound Ohio Woman Who Was Tasered by Police Files Federal Lawsuit
Akron college student Chelsea Garrett, 23, told Fox 8 Cleveland that footage of her reckless driving last November 5 is disturbing. "I would never deny that, I was scared watching the video, seeing myself drive like that, " she said. But Garrett, a diabetic who media describe as 5'2 and 90 pounds, was disoriented (worsened, she says, by some cold medicine) that day. When Stow, Ohio police pulled her over after she caused an accident, left the scene, then almost clipped a police cruiser, Garrett left her car and approached Officer Jesse Reedy. He Tasered her at least twice, after initially knocking her backwards onto the ground. Garrett describes it as Reedy having "punched her in the chest" with the Taser, which may or may not be accurate. However, you can see Reedy knocking her down in dashcam footage that is just slightly out of frame.
Now Garrett, who pled guilty to "reckless operation," is suing the Stow police for brutality in federal court.
According to Patch.com, Reedy, a four and a half year veteran of the Stow police force, and who was cleared of any wrong-doing in December:
told the Use of Force committee (made up of three Stow officers), initially it did not seem like the woman was under the influence of drugs or alcohol or in diabetic shock.
"Yeah, someone that size is not so much really that I think that she is a huge threat, but I realize that she can still hurt me, she can bite me, she can scratch me," said Reedy during an interview with the Use of Force Committee. "She knew what I was saying and she just didn't care … she didn't want to listen to it."
Further description from the official police summary mostly matches the video, Garrett:
"almost immediately opened her driver's side door upon being stopped and sat in her vehicle for 12 seconds. She then exited her vehicle and stood next to the driver's door for 35 seconds. She looked back into her vehicle three separate times."
Before shocking Garrett, who according to the report was "staggering," Reedy drew his weapon out when she got out of the car and then drew out his Taser while giving verbal commands.
The officer said he initially pushed Garrett to the ground instead of shocking her when she approached him because of her size, but after repeatedly not listening to his orders, he used the Taser, it says in the report.
Because Reedy gave verbal commands that were not obeyed and because the woman got out of the car and approached the officer which could be a threat, the committee ruled that Reedy handled the situation properly.
"If an officer perceives a threat through the totality of circumstances, he/she does not have to wait until they are harmed to deploy the Taser," the committee said in its ruling.
Except there's clearly something wrong with Garrett. She doesn't look falling-down inebriated, but she definitely looks hesitant and confused in the dashcam footage. Her movements are odd and when she's on the ground, her struggling with Reedy looks pretty feeble. In her lawsuit, Garrett says she was Tasered a third time while handcuffed. She says police could have just handcuffed her and her goal with filing a lawsuit is to change the policies for Taser usage.
Not very much happened to Garrett and she certainly faired better than Allen Kephart or any of the 500 other people in the U.S. since 2001 whose deaths are associated with Tasers. But Tasers seem to be most likely to go from less-than-lethal to lethal when used on suspects who are drunk, on drugs, or disoriented, (that is to say, not in a state to listen to police commands) so that's all the more reason to be extremely cautious with their usage.

It looks like you're both in agreement you just need to drop the cop hate and dunphy needs to be willing to call out other officers when their actions are obviously in the wrong. Fuck case law and the standards in situations like this. Just because they can get away with using this amount of force doesn't mean they shouldn't be held accountable.
I take issue with the notion that federal laws can supercede state laws but federal rights do not.
states can EXPAND rights beyond those recognized under the federal standard (and most do. mine does substantially) but all states have, as a baseline, the federal set of recognized rights)
States cannot EXPAND rights. The constitution lists certain rights which may not be abridged, everything else from the right to chew gum to the right to fuck sheep falls to the states and the people of the states. The states may ABRIDGE those remaining rights for their citizens, but they cannot EXPAND rights since everything is already a right. Under your concept of rights the people would have NO rights other than those specifically set out for them in the federal or state constitutions, while the opposite is true. In other words the state cannot expand your rights to include chewing gum since you have that right by default, they can however abridge that right.
This is a major problem in the USA, people think that rights are given by government when in truth they may only be taken away by government.

those are all facts and circumstances that warrant extra caution and THEN when she finally stops the car, and THEN disobeys orders to submit to handcuffing AND comes at the officer, she is at first shoved away (even then, she is not tased)
the people who review this case, as well as the finder of fact in the civil trial, if there is one, will be considering all these things, not merely that she disobeyed orders.

If this case suggests anything, it's that diabetics should possibly be required to attach magnetic signs to their cars which read "DIABETIC BEHIND WHEEL". As for her weight (90 lbs! 90 lbs! 90 lbs!), I fail to see why police should calibrate their response to weight, height, or gender.
But the cops are the ones that always crow about "totality of circumstances," so her gender, height and weight should matter. And an unarmed, staggering and disoriented woman who weighs a third what the officer, who is both pointing a gun at her (according to him, he had his weapon drawn when she exited the car) and is wearing a bullet-proof vest, is part of that totality.
Not to mention she is not going at him, but rather she is stumbling around in a daze. He could have just let her fall on her own and then put her in the cruiser. But no! It's all about cuffing someone and straddling them nowadays. Make sure they submit and know they are your prisoner.

mcpherson is a good case. an officers qualified immunity was taken away based on a tasing, and the rules (for the 9th) significantly reigned in.
i'm not sure i agree with the vitiation of the QI in that case, but i DEFINITELY agree that criteria for use of tasers needs to be made more strict, and hopefully mcpherson will become the law of the land federally NATIONWIDE and the case law will be fleshed out further
for example, ex-post mcpherson i don't know if (for example) tasing an assault IV suspect as they run away would be justified. i think it PROBABLY would, but frankly not sure. that kind of thing wasn't addressed even in dicta.
regardless, tasers have been grossly overused, as i have said consistently and repeatedly.

i haven't fired mine , i have used it a few times to gaincompliance without firing it, which is one of the strongest benefits of the taser. people that WOULD fight, often won't if given a 'comply or be tased" order.

the problem is that taser use is preferred in many circs, because if the officers starts doing the wristy-twisty thing and somebody gets hurt (heck, one guy and gal on my squad were both out over 6 months and needed surgery for rotator cuff injuries after such incidents) when a taser would have been justified, the officer is going to be under more scrutiny than if he had tased

I think I may see the problem you and many of the commenters have with each other. You conflate "legal", "justified"(again, in a "legal" sense) "within the guidelines" "according to policy", etc. with "moral", "just", etc. I don't have any easy, definitive answers for all these issues, however, I'm fairly certain legislators and judges are among the worst guides to morality and justice. Sad but true.
I sympathize with your dilemma, as a police officer trying to do his best in an imperfect system, however I think you give WAY too much credit to your fellow officers and the higher ups who craft policy. I think many of them, and the rot gets worse the higher up you go, are evil fucks who seek out law enforcement, politics and the law in order to wield power over their fellow man in order to do him harm. And I'm not being melodramatic here, that's really the impression I get.

It's a fucking joke, and the unions fight outside reviews every time someone brings them up. Of course, when they are reviewed, it almost always results in a bad finding. Most recent examples are Seattle, East Haven and Maricopa County. I haven't seen the DoJ release a study that said a department was doing a great job of upholding civil rights. Let's say I see her pulled over and stop to help, and witness exactly what the cop witnessed. Would I be justified in using any force, at all, in the absence of, oh, I dunno, any kind of weapon whatsoever? Any kind of threatening language or action? Fuck no. If I tackled her or punched her or otherwise nonlethally incapacitated her, I'd be doing time.
And, no, I don't think a defense consisting of "Well, she could have scratched me, or even bitten me" is going to get me off.

I was cuffed, thrown up against a wall and tossed around a little by 3 cops when I was hypoglycemic and accidentally got on the wrong Metro-North train, unable to explain all of this to the ticket taker without sounding belligerent. They had the cops waiting for me at the next station. I told them I needed a soda and I'd be fine (obviously not in as organized a fashion as I've just done) and they decided to just keep me cuffed and go through my pockets and shit instead. Finally I was able to get them to call my wife, who explained the situation that I had already explained. And even though I was totally fine once I'd had a Pepsi they refused to release me and forced me to check into the ER and stay there until my wife took most of the day off work in NYC to come get me in Westchester. I thought that was a pretty unaccomodating experience, but I suppose at least I didn't get tasered.
It's got to be tough being a cop. Especially when you're treated so much more harshly in the eyes of the court. Except, of course, when you're allowed to resign in return for assault charges being dropped.
