DEA Agrees With Me About Medical Marijuana

Today the Drug Enforcement Administration issued a statement suggesting that the Justice Department's new medical marijuana guidelines will not amount to much in practice:

These guidelines do not legalize marijuana. It is not the practice or policy of DEA to target individuals with serious medical conditions who comply with state laws authorizing the use of marijuana for medical purposes. Consistent with the DOJ guidelines, we will continue to identify and investigate any criminal organization or individual who unlawfully grows, markets or distributes marijuana or other dangerous drugs.

You could dismiss this stance as an attempt to save face. But as I argued here last week (and in my syndicated column this week), disagreements about who is allowed to grow and distribute medical marijuana and under what circumstances, especially in California, will continue to provide excuses for DEA raids. It's true that the agency, by and large, has not targeted "individuals with serious medical conditions who comply with state laws authorizing the use of marijuana for medical purposes." Instead it has targeted the people who supply those patients with marijuana (who often are patients themselves). With the possible exception of a "primary caregiver" who grows a few plants for a particular patient and does not charge for the service, it's not clear that the DEA or the Justice Department is prepared to tolerate any method of providing marijuana to patients who are not up to growing it for themselves.

    I’m sure they are capable of finding a clause in any state law that will allow them to continue “business as usual.”

Dear Brandybuck…as a Christian Conservative I fully support medical marijuana; so don’t blame the “liberaltarians” as the only group that wants this issue decided in favor of medical marijuana. You call yourself Brandybuck..so, I guess that you are a male, who supports the good old boys and girls getting drunk and driving home killing someone on the way. Don’t put down the use of medical marijuana until you have tried it yourself. You just don’t know what you don’t know about this subject. God made this world and placed healing herbs to heal the sick and needy. Marijuana oil is the original “Oil of Joy” given to those who mourn. So honor the Lord your God and accept what he gives with joy in our hearts and love for our fellowmen and women who are in ill health.

  5. On the other side of the coin, I don’t believe that there have been DEA raids of medical compassion centers/co-ops in any states other than California.

    California really needs to tax and regulate marijuana or re-write their medical law – their 10 sentence skeleton of a law leaves patients open to abuse from both cops and unscrupulous businessmen. The shit show out there has made reform more difficult to achieve in many other states.

    It’s hard to believe anything the DEA says when they can’t even identify which drugs are dangerous.

  10. The NJ gubernatorial race is close here. Obama staked his reputation on the outcome. The posters here have Obama in the middle and Corzine standing to the side behind him. Expect several speeches from Obama that would appeal to the NJ base from now until election day.

  12. How, exactly, does the DEA get away with non-enforcement of Federal Law? I’m all for repealing drug laws and such, but until that day arrives I don’t see how selective enforcement is effective and survives the test of time. If Obama had any conviction on this (balls, if you will) then they would push to change the law. This is the pussy’s way…

    1. I think that’s part of the point. Obama wants to make sure that marijuana users depend on him being in the White House to avoid arrest.
