FEC Finds Google Isn't Deliberately Biased Against Republicans
Plus: DEI trainings don't work, a case for compensating organ donors, and more...

"No reason to believe" Google tried to use spam filters to benefit Democrats. The Federal Election Commission (FEC) has cleared Google of allegations of deliberate bias against Republican campaign emails that amounted to campaign contributions to Democratic candidates.
These allegations surfaced in 2022 in response to a study from North Carolina State University. Researchers there looked at the automatic spam filters—algorithms that attempt to ferret out spam and send it to a separate folder—used by Gmail, Microsoft Outlook, and Yahoo! Mail. To do so, they created accounts on all three and used these accounts to sign up for a slew of Republican and Democratic campaign emails.
Initially, "Gmail marked 59.3% more emails from the right candidates as spam compared to the left candidates, whereas Outlook and Yahoo marked 20.4% and 14.2% more emails from left candidates as spam." But once the researchers intervened a little—marking campaign emails as not spam, opening and reading emails, etc.—"the biases in Gmail almost disappeared, but in Outlook and Yahoo they did not," as lead researcher Muhammad Shahzad told The Washington Post.
A Google spokesperson told the Post the study "has major flaws," including "an exceedingly small sample size, [an] outdated two-year-old data" and failing to account "for whether candidates optimized their domains to send bulk emails." Meanwhile, Republican strategist Erick Erickson suggested the study findings could be attributed to Republican campaigns sending out spam-like emails. "Republican consultants are blaming Google and Apple for blocking their emails. But when you have a sense of the daily volume, you realize Google and Apple are helping their users while GOP consultants are abusing their email lists," he tweeted last August.
Many Republican politicians seized on the study as "proof" that a big tech company was biased against them, perhaps even intentionally so. Sen. Steve Daines (R–Mont.) opined that the study "unmistakably exposed Big Tech's most egregious attempt to tilt the scale toward left-wing candidates."
A group of Republican senators even introduced a bill to ban any email service from using algorithms to automatically apply spam labels to any political campaign emails.
Republicans also filed a complaint with the FEC. More from the Wall Street Journal:
The Republican National Committee and others contended that the alleged benefit amounted to unreported campaign contributions to Democrats. But in a letter to Google last week, the FEC said it "found no reason to believe" that Google made prohibited in-kind corporate contributions, and that any skewed results from its spam-filter algorithms were inadvertent.
"Google has credibly supported its claim that its spam filter is in place for commercial reasons and thus did not constitute a contribution" within the meaning of federal campaign laws, according to an FEC analysis reviewed by The Wall Street Journal.
The FEC said it has now closed its file on the issue.
"The Commission's bipartisan decision to dismiss this complaint reaffirms that Gmail does not filter emails for political purposes," Google spokesman José Castañeda said. "We'll continue to invest in our Gmail industry-leading spam filters because, as the FEC notes, they're important to protecting people's inboxes from receiving unwanted, unsolicited, or dangerous messages."

Diversity, equity, and inclusion (DEI) trainings don't work, writes Jesse Singal. Not only is there little evidence to suggest they have a positive impact but "the specific type of diversity training that is currently in vogue—mandatory trainings that blame dominant groups for D.E.I. problems—may well have a net-negative effect on the outcomes managers claim to care about," he writes in the New York Times:
Over the years, social scientists who have conducted careful reviews of the evidence base for diversity trainings have frequently come to discouraging conclusions. Though diversity trainings have been around in one form or another since at least the 1960s, few of them are ever subjected to rigorous evaluation, and those that are mostly appear to have little or no positive long-term effects. The lack of evidence is "disappointing," wrote Elizabeth Levy Paluck of Princeton and her co-authors in a 2021 Annual Review of Psychology article, "considering the frequency with which calls for diversity training emerge in the wake of widely publicized instances of discriminatory conduct." …
If diversity trainings have no impact whatsoever, that would mean that perhaps billions of dollars are being wasted annually in the United States on these efforts. But there's a darker possibility: Some diversity initiatives might actually worsen the D.E.I. climates of the organizations that pay for them.
So what can be done?
Robert Livingston, a lecturer at the Harvard Kennedy School who works as both a bias researcher and a diversity consultant, has a simple proposal: "Focus on actions and behaviors rather than hearts and minds."
Dr. Livingston suggests that it's more important to accurately diagnose an organization's specific problems with D.E.I. and to come up with concrete strategies for solving them than it is to attempt to change the attitudes of individual employees. And D.E.I. challenges vary widely from organization to organization: Sometimes the problem has to do with the relationship between white and nonwhite employees, sometimes it has to do with the recruitment or retention of new employees and sometimes it has to do with disparate treatment of customers (think of Black patients prescribed less pain medication than white ones).

It's time to change the rules for organ donors. In Washington Monthly, Sally Satel makes a case for compensating organ donors. Satel starts off by advocating for states and/or the federal government to reimburse organ donors for their time off work and their medical costs, on the grounds that not only could this save lives but also save "hundreds of millions in Medicare costs."
But this isn't enough, Satel continues:
It is time to change the 1984 National Organ Transplant Act, which forbids donor compensation of any kind, because our long-standing reliance on altruism—and I say this as a shining exemplar of its virtues—is just not enough.
Polls, like this recent one, reveal the public favors rewarding people, especially those willing to save a stranger's life. Many loved ones are already highly motivated to begin with, but in some cases the promise of compensation might nudge them to donate.
One possible reward could be a refundable tax credit valuing $50,000 (others suggest a higher value, which is acceptable to us.) My colleague at AEI, Alan Viard, and I devised such a plan. This is a large number but with a logic behind it.
Under our plan, once prospective donors have been medically cleared, they would enter a waiting period of at least six months to ensure that they did not act impulsively and that they had offered fully informed consent. As an additional safeguard against ill-considered donations by financially desperate individuals, the first disbursement of the credit would be only $5,000. It would occur in the tax year following the year in which the organ donation occurred. Finally, the government would allow $5,000 in each of the next four years, with the remaining $25,000 allowed in the following year. For any out-of-pocket expenses related to the transplant, we also propose a 100 percent refundable credit to taxes for the year they donated.
That would be better than the current regime—but seems both unnecessarily complicated and unlikely to yield the most benefit for either would-be organ donors or those seeking donations. If we want to truly save lives and fairly compensate donors, we should allow private compensation to organ donors, as well.

I don’t think Repubs are that strategic. The Repub party right now seems to be the party of political victims. From stolen election claims, to complaining about the establishment being agaisnt them, to complaining that a candidate is too much a RINO or Dem Lite, Repubs have strangely embraced losing. And the only thing they do in response to that is to ferret up some “pure” conservative who is a “fighter” who can’t garner majority support because they tend to be a terrible candidate, then the person loses, and Repubs then start the victim cycle all over again.
Pure conservative candidates? Seemed like they just picked celebrities and hoped voters wouldn't notice their lack of qualifications or philosophical consistency.

You can’t really blame people for losing faith in the system when there are suspect things in every election. The Establishment is absolutely against your average Republican voter (honestly it’s probably against your average Democrat voter too). And don’t even get me started on the party being full of RINO’s.
I can when the losing faith is mostly a false narrative and just a political tool used by both sides to avoid addressing reality.
Every time someone loses, they now claim some type of rigging, stealing, fortifying, or other form of nefarious reason they lost. All this does is relieve the person of responsibility for their loss and for the political team to claim "they would have won but for the nefarious actions." This means parties and candidates don't learn and adjust, rather they simply double down on the same losing formulas and go on to lose again and again and again knowing that they can always claim a "stolen election" or some garbage.
Yes, the system isn't perfect, and it's never going to be. But it actually works really well in a flawed world. Thus, the claims that destroy morale are based on hyperbole and hysterics created by the same people trying to gain power who refuse to take responsibility.
So, I blame people for losing faith based on selfish claims by politicians and media figures and false narratives meant to shield people's psyche from the reality of their loss.

Maybe to some degree, but between those time periods the US population increased by around 30 million people. Couple that with the fact that Trump could never achieve majority support, I would still say there is argument that Trump lacked sufficient popularity.
Of course we'll never know for sure, but I strongly suspect if the Presidential 2 term maximum rule didn't exist, and Obama ran for a 3rd term against Trump in 2016, Obama would have crushed him.

Comparing total votes cast in different years is dumb when Clinton dead-enders do it ("She got more votes than any white male in history!") and equally dumb when Trump dead-enders do it.
Trump lost to a dementia patient in 2020. He lost both the popular vote and Electoral College. Trying to put a positive spin on that performance reeks of desperation.
Trump lost to 80 million ballots in a fortified election. He or DeSantis will lose in 24 no matter who the democrats run.

A better way to compare would be by percentage of the vote received in each election.
Voter turnout 2008: 131,407,000
Voter turbout 2020: 159,690,457
So, total voter turnout in 2020 increased by about 22% of the total voter turnout in 2008.
Getting 5 million more votes is getting about 4% more from a pool of voters that grew by 22%.

Well, Trump's lack of popularity was pretty helpful in his losing the election.
What lack of popularity? He gained 10 million votes. You may say the anti trump sentiment was popular, but trump was also popular.
But what again is being missed is the numerous changes to the 2020 election. Many of them found to be illegal. The same changes attempted to be made legal in 2022.
And Biden beat him by over 7 million votes. Seems Biden was the most popular. And Trump never once broke into majority support either in polls or in votes in either election. This is a sign of lack of popularity. And the fact that Repubs did well in 2020, except for Trump, shows he lacked popularity.
And yes, voting changes were improperly done. This allowed extra time for valid voters to vote. Not really an awful thing. Moreover, you can't claim that he was popular, but such popularity was predicated on people not voting, otherwise he wasn't going to be the popular choice. That's trying to have your cake and eat it too.
I know there is an amazing an bizarre amount of Trump defense and Trump sycophancy here in the Reason comments, but at the end of the day, Trump's loss was on Trump. It was completely in his power to control. It was in his power to adjust his behavior ever so slightly and he could have been successful. It was in his power to have been a better candidate, but he chose not to be. That's on Trump.
This constant complaining about the election being stolen, or rigged, or fortified, or whatever excuse adjective is now popular, to relieve Trump of his role in being a terrible candidate is just getting old and tired.
Hopefully more candidates will follow his winning formula: hide in a bunker 23.5 hours a day, then release a 30-minute previously-recorded speech. It will cut down on the wasted effort of visiting various states and save money on political consultants. I'm surprised no one tried it previously. I guess Warren Harding did in the 1920 election. Yup, there were improper actions that occurred. Yet, winning or losing the election falls on Trump, not on esoteric rule changes that allowed valid voters to vote.
I'm tired of this line of argument when it comes to Trump. Trump is responsible for his own behavior, actions, and campaign. Trump is responsible for being one of the most hated people ever to run for office. You can't in one breath complain that Biden takes no responsibly for his actions and decisions and then turn around and relieve Trump of all responsibility for his poor election performance.
Sure, there was impact. It gave voters who lean towards Biden more time to vote, which pumped up the numbers for Biden.
You know how Trump could have countered that, stop tweeting. Behave better. Work harder at voter outreach. Stop being his own worst enemy.
At the end of the day, it was in Trump’s control and he failed. Blaming the fact that valid voters were improperly given more time to vote is never going to sway voters away from one side to another. Thus, constantly focusing and complaining about elections and basically telling your supporters “don’t bother cause it’s all rigged” is not how you are ever going to fix the situation.
Taking a hyper-flawed candidate who could never garner majority support like Trump and using his loss as an example that Repubs can’t win even in an election where all other Repubs were successful (even in those “rigged” districts) is so terribly absurd and just downright defeatist that it needs to stop.
It worked for the Governor of Arizona and the Senator from New Jersey, it's a winning strategy.

Eh, to a certain extent. Democrats are notorious for running their latest political crushes for 2-3 cycles, during which time they either have to win at least something, and if they don't, they get kicked to the curb. Stacey Abrams, Wendy Davis, John Ossoff (who won his second attempt), and Robert O'Rourke all come to mind here.
Hillary wasn't any different in that regard. She won her Senate seat after Giuliani submarined his own chances and got replaced by an empty suit, but lost both her Presidential chances and no one really wants her to run again--even though, admittedly, she wouldn't need a staff of handlers to keep her on task like Biden does.

I think most people already agree with this fact here.
The problem is the recognition of the floor due to election changes that makes the gap between DeSantis and trump not as large as people would like to pretend it is, when considering results.
