Rubio Bill Would Make Tech Companies Disclose Government Interference

Proposal would mandate more transparency. A lot of what people mistake as tech-company ideology creeping into their business practices actually stems from attempts to comply with government demands. The feds put pressure on digital companies to suppress or block certain types of content and transactions in ways that are both overt (for instance, FOSTA, the 2018 law criminalizing content that promotes prostitution) and unseen (i.e., Operation Choke Point, a once-secretive program that encouraged financial services to target porn stars, gun sellers, and other entrepreneurs politicians don't like), wielding appeals to stopping everything from crime and violence to disinformation and foreign propaganda. Many of these asks are of dubious effect and seem more politically motivated than anything else.

A new bill in the Senate would demand digital companies disclose such government pressure and dictates. It was introduced by Sen. Marco Rubio (R–Fla.)—who paints the proposal in the most ludicrously partisan terms possible.

"Through campaign contributions, censorship, and woke nonsense, it's perfectly clear that Silicon Valley giants are working together with the Left to destroy conservative values in America," writes Rubio in introducing the bill, called the PRESERVE Online Speech Act.

The left certainly has no monopoly on trying to use the government to shape and censor the internet and, in turn, the world it reflects and shapes. But despite Rubio's paranoid partisan shtick, his idea might not be a bad one.

"There are a host of legal and philosophical problems with the idea that the federal government should regulate the internal deliberations of privately owned companies such as Facebook and Twitter. But there is absolutely nothing wrong with Americans demanding to know to what extent their own government is engaging in that process," suggests Charles C.W. Cooke at National Review. "At the moment, we are wholly reliant upon the executive branch's willingness to disclose its own dealings. Under Senator Rubio's arrangement, Americans would have a statutory right to know the nature of those dealings — including which requests are being made, how frequently, in what language, to what end, and with what partisan hue."

Under the PRESERVE Online Speech Act, tech companies would be required to quickly and publicly disclose "any requests from governments to moderate, censor or otherwise limit speech," as Rubio describes it. Businesses would turn this information over to the Federal Communications Commission, which would release it in an annual report.

I see several potential snags, however. First, there would be exceptions for government censorship requests related to "certain law enforcement activities, including terrorism and human trafficking," says Rubio. But the government does a lot of snooping and censoring under the pretense of stopping these things.

Exceptions for anything the feds deem related to terrorism, trafficking, or crime could make the requirement effectively useless.

Second, relying on the same administrations making these requests to release evidence of these requests doesn't necessarily inspire confidence.

Third, with businesses being fined $50,000 per day for failure to disclose the requested information, companies could potentially be punished for failing to turn over information on requests that other branches of government have told them to keep secret, or that exist only in the conspiracy-theorizing minds of politicians whose brains have been melted by tribalism and/or ego.

Cooke suggests "it might also be a good idea to demand that the government also disclose any communications; that way, an auditor could compare and contrast the two filings."

The Congressional Budget Office estimates that over the 2021-2031 period, enacting Senate Amendment 2137 to H.R. 3684 would decrease direct spending by $110 billion, increase revenues by $50 billion, and increase discretionary spending by $415 billion.     The national outrage at Cuomo’s handsiness and bullying—from feminists, Democratic officials, and others who have ignored Joe and Hunter’s actual criminal sexual depravity—and the expiation of sin to follow as he leaves the scene, has made it unlikely that Cuomo will ever face justice for the deliberate murder of roughly 15,000 seniors in New York nursing homes. That is a far more serious charge. Were that case to be unraveled, with evidence, in a court of law or even in a real newspaper, many people besides Cuomo would be in deep trouble. Particularly hard hit would be those for whom he acted in pursuit of unseating Donald Trump in the coming election. So that could not be allowed to happen.

    Why do I think those deaths of elderly people in nursing homes were deliberate, and not just incompetence or lack of preparedness, as he has argued? Timing. In March, 2020, as COVID became an issue, the biggest problem associated with it was the lines at New York City-funded hospitals, and the start of a rising death toll. But most states still had zero or only a handful of cases. There were far too few deaths to justify shutting down businesses or schools.

    To use the crisis as a means to unseat Donald Trump, as the Democrats were hell-bent on doing, required drama, and action. Then, as the first rounds of COVID patients began emerging from crowded hospitals, recovering but still clearly contagious, Cuomo instituted the unprecedented requirement that they be sent to (state-funded) nursing homes “to recover.”

    Cuomo was warned about the likely consequences of doing this by, among others, worried nursing home owners, who knew that if they had to house still contagious, recovering patients, COVID would spread like wildfire through their facilities. And, he had good alternatives: President Trump had sent the Naval hospital ship USS Comfort, which remained empty throughout the pandemic, as did the Javits Center, as the elderly and vulnerable were forced to share rooms with known COVID carriers. It is hard to imagine that this was an accident. Even as the death toll began skyrocketing, Cuomo refused to reconsider the policy.

    Four other Democratic governors followed suit, using the same tactic, and thousands more in New Jersey, Pennsylvania, Michigan, and California subsequently died, allowing Democrats to ramp up the fear that justified a year-long shutdown of work, schools, the economy, and allowed for election practices that enabled mass cheating.

    What this moratorium will actually do is hurt small-time landlords. It seems like Democrats think all landlords are wealthy fat cats who don’t need the money. Essentially, they view the artists in “Rent” as the good guys (which is how the musical portrays them, even though they’re squatters who just refuse to earn money to pay their bills).

    But not all landlords can afford to not get paid for a year-and-a-half. Many of them earn less than their tenants and need the rental income to pay their own bills. It’s like everyone forgot about that big Atlantic story explaining how Wall Street investors became landlords by creating big investment companies to manage homes and then stiffed renters.

    Well, this eviction moratorium pretty much guarantees that only corporations like these can afford to be landlords.

    Just like when the government decided who was an “essential” worker versus who was not, it is again picking winners and losers in the market based on some cartoonish idea about one side versus the other. In the end, they make new victims while continuing to claim the moral high ground.

      I'm convinced it is also so banks and the rich can scoop up rental properties cheap from small landlords who owe back mortgage and just want out now. Lowers the prices for their investments. I've considered offloading some of mine due to the shit happening. Luckily no dead beat renters. Sister wasn't so lucky.

        Some landlords are starting to require 8-12 months rent up front because of this (which is smart, considering we're being led by a government and media class now that has the emotional development of a bunch of nursery school kids). Parents are having to loan their kids money just to get an apartment.

        I’m convinced it is also so banks and the rich can scoop up rental properties cheap from small landlords who owe back mortgage and just want out now.

        I'm sure that's a side benefit, although I don't think it's what the oligarchs initially had in mind. But they're seeing an opportunity now to ramp up the cost of living across the country so the average person can't buy a home.

        I gave up on rentals a few years back. I now just invest in REITs. There are some semi-private ones out there that diversify across 20 - 30 properties of different kinds (some focused on retail, some focused on residential, some on income via rent, and others focused on growth via short term 'flips'). The upside is lower, but I do not miss looking for tenants, or getting that call about replacing a hot water heater.

        Take a look at Streitwise and Fundrise. They are less liquid (usually you have to commit to 5 year investments) much like regular real estate, but give you more options.

      I disagree on one point. Democrats don't think all landlords are evil, rich fatcats. Democrats know many, many landlords are individuals who own a couple of multifamily properties, or are owner-occupiers. Democrats are actually in favor of large, corporate landlords because they can work through them to enact their preferred social engineering.

      Progressive useful idiots like Cori Bush think landlords are all evil, rich fatcats. And the democrats are using that to their advantage here. By the time the Coris get wise, it'll be too fucking late.

      My landlord is a single guy who owns 2 rental properties with 6 total tenants, and works a full time job, with a couple of side gigs.

      Having 2 out of those 6 units not paying rent for the better part of the year is like having them vacant, but worse, because there are still costs associated with having a tenant in your building, above and beyond the mortgage.

      He's a nice guy, and lets me do my own thing - pretty much never bothers me about anything. It would suck to have our building sold to a more corporate rental company, but I wouldn't buy his properties right now, with 1/3 of the units not producing any revenue, and no ability to change that. Why would any individual want to do that?

    "This is an important ????. Please read it. It's amazing how for all the talk of being "tough on big tech," there are so many policy positions taken by the WH and Congress that actually serve to lock in big tech.

    Maybe because Zuck and Pichai payed for the election "fortification", and the rest pitched in to suppress dissent? The boardrooms and upper echelons of big tech are the Democratic Party. Almost everyone there has worked for the party in some capacity before.
    All talk about cracking down on them by the Klain Biden Administration is performance theatre.

        The Democratic party wants to control speech, for instance, the way Xi does through their social media platforms, but Xi isn't doing this to try to control these companies. He already controls them. He's doing it because he genuinely doesn't want the country to deindustrialize. He wants that financing, those resources, and that effort that would go into technology and service industries going to manufacturing instead.

        The Republicans are interested in controlling big tech, too, and to some extent, they're genuinely interested in free speech, too--if only the free speech of the conservatives who support them in the digital town square, but Xi doesn't give a shit about free speech.

        The other day, they tabulated that publicly traded Chinese tech companies had lost $400 billion in market capitalization due to the comments and decisions of Chinese government over the last several months. The other day, one of the official organs of the CCP posted a story that said that online games were "the opiate of the mind", and Chinese gaming companies lost 20% of their value.

        They did that on purpose.

        If Joe Biden said something stupid that rattled markets today, he'd be back tomorrow to tell us he didn't really mean it. China is fucking its own technology markets and destroying their market capitalization on purpose--because they don't want them to be such a big part of the economy. This is practically unthinkable outside the logic of a fascist state.

        I think a lot of people are having a hard time understanding this because it just doesn't seem to make sense. What Democrats wants to do would hurt silicon valley, but they aren't trying to destroy economic growth for the sake of destroying economic growth. The Democrats are parasites, and if the parasites kill the host, they're probably not very successful. Xi is chopping the legs out from under the growth of the consumer technology because he doesn't want it to grow.

      In the past, fascist regimes were often obliterated through military means, but those that weren't (like Franco, and Pinochet) 1) tended to liberalize their economies over time and 2) their fascist movements more or less died when they died. While Xi's flavor of Chinese fascism probably won't die until he dies, his economic policies will cripple China's standard of living at some point in time unless he abandons them. When he dies, there's no telling what might replace him, but Fascist dictators have a really hard time with succession.

      Our trade interests with China remain what they are because they're in the best interests of American consumers, regardless of whether China is a fascist state, but we should also continue to see trade with China through the lens of military defense. As China's forced industrialization policies continue, they will continue to manufacture far more than their internal economy consumes. This means that to the extent they force their economy to be based on manufacturing more than it should, their economy will remain overly dependent on exporting their surplus manufactured goods to the U.S. and Europe

      Inexpensive products from China are good for the American standard of living, especially for people at the lower end of the income scale. However, even from a strategic defense perspective, Americans who want to curb trade with China are insane. They're like progressives who don't care about the consequences of their policies so long as those policies are couched in terms of social justice. Who cares if we're hurting our own standard of living and inviting a military conflict without any advantages for the U.S.--so long as we're not trading with icky China?

      America first means a foreign policy that advances the economic and strategic defense interests of Americans. Everyone who thinks the legitimate purpose of government is to force American consumers to make sacrifices for the benefit of people in other countries, or even sacrifice American strategic defense interests, should probably campaign for Joe Biden and the Democrats come 2022. That's what the progressives are all about.

If most American consumers don't care about China's awful policies, the manufacturers seem to be worried about the consumers who do.

          And it should always been emphasized by libertarian capitalists, that if Walmart shoppers in the United States care more about their own standard of living and that of their family than they do about Hong Kong protesters, the people of Xinjiang, or their fellow Americans in the Midwest who lost their jobs in the factory, then they should be free to make that choice--even if we disagree with their choices.

          American consumers shouldn't be forced by the government to sacrifice their standard of living for the benefit of other people--elsewhere in the world.     I question taking the perspective that the feds want to "regulate the internal deliberations of privately owned companies" because as I see it, the Democrats want to control businesses, including stopping media businesses from allowing users to see certain stories.

    Imagine you're the CEO of Facebook and you were just approached by a high level government official to censor certain stories, like Biden's laptop. Meanwhile, your employees are dealing with a lot of government officials regarding projects and such. And there may be some lawsuits ongoing. You are just being given an offer you can't refuse as the Mafia would say. This is about power and control, not about internal company deliberations.

    ENB might have suggested that if government didn't have so much control over business, then this wouldn't be an issue. The company can just publish the request and tell us who delivered it. Imagine that.
