Supreme Court Ends Pandemic Permission To Prescribe Abortion Pills Remotely

Trump admin gets its way on abortion pills. U.S. women seeking first-trimester, non-surgical abortions must once again undergo an unnecessary—and, in pandemic times, risky—visit to the doctor, clinic, or hospital. The Supreme Court has sided with the Trump administration in a fight over whether abortion drugs may be prescribed remotely and shipped via mail.
Like so many arbitrary rules around health care, the Food and Drug Administration (FDA) requirement that abortion pills must be dispensed in person by a physician was challenged when the COVID-19 pandemic started. The American College of Obstetricians and Gynecologists (ACOG), the American Civil Liberties Union (ACLU), and others argued that the expanded telemedicine options being allowed in other arenas should apply to the prescribing of abortion pills, too. And, last July, a federal court agreed, with U.S. District Judge Theodore Chuang writing that "in-person requirements" during a pandemic could be a "substantial obstacle" to patients and therefore represent an unconstitutional infringement on their access to abortion. For the duration of the pandemic, the requirement was suspended, Chuang ruled.
But the Trump administration challenged the court's decision, prompting the Supreme Court to rule in early October that Chuang must "promptly consider a motion by the Government to dissolve, modify, or stay the injunction," since "relevant circumstances" may have changed.
The most relevant circumstance—is the coronavirus pandemic still raging?—has not changed it at all. The virus may have been (or looked like it was) in a lull in the early fall, when Supreme Court justices first weighed in. But that certainly hasn't been the case in recent months. Currently, "coronavirus infections remain at record highs in many U.S. states," points out Reuters. "Nearly 130,000 Americans were hospitalized with COVID-19 as of midnight on Monday and the country had reported 22.5 million infections and 376,188 deaths."
Nonetheless, the Supreme Court ruled on Tuesday to grant the Trump administration's request and stay the lower court's injunction on enforcing the in-person rule for abortion pills, pending the U.S. Court of Appeals for the 4th Circuit's decision on the matter.
Chief Justice John Roberts wrote that "the question before us is not whether the requirements for dispensing mifepristone impose an undue burden on a woman's right to an abortion as a general matter. The question is instead whether the District Court properly ordered the Food and Drug Administration to lift those established requirements because of the court's own evaluation of the impact of the COVID–19 pandemic. In light of those considerations, I do not see a sufficient basis here for the District Court to compel the FDA to alter the regimen for medical abortion."
Justices Sonia Sotomayor, Elena Kagan, and Stephen Breyer dissented.
"We are disappointed and dismayed by the Supreme Court decision upholding the Trump Administration's arbitrary and non-scientific decision to continue to force patients to travel during a dangerous pandemic in order to obtain the medication they need," said Hugh Taylor, president of the American Society for Reproductive Medicine, in a statement. "To be clear, requiring patients to obtain their medications in person serves no clinical purpose and is not based on any rational scientific evidence or clinical judgement. It serves one purpose, to place an obstacle between a woman and the medication her physician has prescribed for her. We call on the incoming Biden administration to end this policy immediately upon taking office next week."

After a temporary stay of execution yesterday, the federal government killed 52-year-old Lisa Montgomery by lethal injection on early Wednesday morning. "The Supreme Court denied a last-ditch effort late Tuesday by her defense attorneys who argued that she should have been given a competency hearing to prove her severe mental illness, which would have made her ineligible for the death penalty," reports CNN. "She was the 11th federal death row inmate to be executed by the Trump administration after a 17-year hiatus in federal executions."

McConnell (and all other honest Americans who understand the Constitution) knows that a House impeachment cannot remove the president, and that Trump's term will expire before the Senate could even schedule a trial.
But even today's WSJ contained articles, columns and letters to the editor that falsely implied the Senate could/should impeach Trump.
How can you falsely imply that the Senate should impeach Trump? "Should" implies they are expressing their editorial opinion; an opinion cannot be a lie.
The Senate doesn't impeach anyone. Impeachment is up to the House. The Senate just holds the trial.

Just noticed that CDC is allowing some people who are already immune (if the can prove they recovered from covid, which could require a positive test and then a negative tested for an active covid case.
If CDC was/is competent, they also exempt people who have ever contracted the virus (which requires a different test that aren't widely available), including asymptomatic carriers who no longer have active cases (as asymptomatic carriers are also recoverers).

However, anyone defending what happened to Parler, and big banks withdrawing any business from Trump supporters, after the government made it extremely difficult for small banks to operate and new banks to start, can't do so by arguing that you can just start your own business, because that is increasingly becoming an unrealistic approach. A true libertarian realizes that this is no longer a viable option and thus these actions need to be denounced and punished. I argue for removing the regulations and creating competition but that isn't going to happen under the Democrats. In fact they are promising more regulations. And at least some of the regulations they are proposing will actually force companies to do what these companies are doing supposedly voluntarily.
Yes Trump didn't deregulate as much as he promised or bragged about, and Republicans have used regulations also, but we are entering a whole new phase, where people like AOC (who has called for literal re-education camps under a different name) are driving much of the policies of the Democrats.

If the American public decides it wants more Democratic than Republican solutions to our perceived problems (or vice versa) it is usually just a 'lesser of two evils' consideration for me. Some ideas on both sides are good, most are bad, but as long as there is the ability to lobby for or against, I'm okay with it.
My moral line is crossed when it is socially acceptable, to not only push those with unfavored view points out of the public square but also to discriminate, marginalize, and impoverish them. It is a very short jump from that to it being okay to imprison or even execute them.

2) WaPo faces significant criticism from the people posting on Parler, and so this could be seen as using Amazon's status as cloud provider as punishing Parler for this criticism.
3) Indeed, I would check in Washington Posts' previous opinion posts to see if the editorial board previously came out against Parler, indicating that they are sending signals to their co-owned company.
While, from a libertarian perspective, there is nothing outright wrong with this, it is definitely strong circumstantial evidence for Parler vis a vis existing anti-collusion law. Probably enough for Parler to get a discovery order from a judge.

The people who are voting to impeach President Trump today aren't doing it because of anything he said. If they were using any power of the government other than impeachment, they would be violating his First Amendment right to free speech. You're allowed to question the validity of an election and encourage peaceful protest--even if you're the president of the United States.

Hell, history seems to state that in many cases it doesn't even make you unpopular for a little while in a number of cases. I, as anyone who read my posts on Wednesday last week saw, was fully pissed off with Trump supporters and ready to be done with them all together. My mother, a Trump supporter was also ready to denounce her Trump support after last Wednesday. Now we are in agreement that what has happened since then is far, far worse in the long term. Fuck, I have even entertained the thought, though dismissed it, that maybe I wished Trump had been successful. Mainly because I don't think it would make things better, but at this point, in regards to liberty, I am not certain it would have made things worse than they are becoming. We are next, I promise you that, history shows this is what happens in every single case. And I am increasingly, (so from 0% to about 10% now) convinced Nardz et al may have been on to something when they stated that there won't be another fair election that we will be California the nation over, one party rule where we can only 'choose between two flavors of prograsiveism' or face the consequences.

And the idea that the crowd was attempting to overthrow the government is absurd. They'd have brought guns if that was their intent, it's not like they don't have them or don't know what they're for. They were attempting to delay Congress making a decision, which many previous crowds have protesters have also done for various issues. Some of this crowd committed crimes in the process, and they should face prosecution for those crimes (mostly property crime), but charging any of them with treason or the like is ridiculous.
Trouble is, Trump was a big fat liar. He didn't walk down to the Capitol with his supporters like he promised in his speech! Perhaps if he had, the crazies in the protest wouldn't have pushed into the building.

Also, as others have pointed out, the breach of the Capitol occurred while Trump was still speaking, the crowd he was talking to was not the crowd that started the violence at the Capitol. Were they following via livestream? Maybe, but Trump walking down there wouldn't have done a damn thing because they had broken in before he had a chance to get down there.

All I can find is the presumably biased media's report that the Trump speech started shortly before noon, lasted about an hour, and the breach of the capitol was about 2pm. There were certainly protestors at the capitol before noon, but when did the "storming" happen?

He didn't walk down there because of the riots, which occurred before his speech ended and the Secret Service doesn't let Presidents walk into active riots. It isn't proof that he lied so much as proof the situation had changed after he made the promise. It is like promising last fall to take my kids ice fishing this winter, but it's been so warm that I don't trust the ice so we haven't gone. He didn't say anything that was actionable by any means other than impeachment. Any other action by the government would violate the First Amendment.

Yes, while I think it was a stupid thing to believe, it is his Constitutional right to believe that, and for his supporters to believe it. And the vote on certification is not supposed to be a symbolic thing but is supposed to be a deliberative act and a final check and balance. So even what he was asking the legislatures to do wasn't unconstitutional, even if undesirable.
Now the ones who called for Pence, including Trump, to choose which votes to count, does seem from my interpretation of the constitution to be contrary to what it says, but even then them asking him to do that is protected if stupid speech. He chose not to do it, which I applaud, but voting against certification is any legislatures right, and it is also their right to say they believe the election wasn't kosher.

There won't be impeachment proceedings past Jan 20th. Virtually every constitutional scholar agrees you can't impeach someone who is out of office. Every mention of impeachment refers to removal from office.
If Rasmussen Polls are close to being accurate, and they have been consistently one of the most accurate this year, then most people find this process stupid.

Strongly agree. House GOP members who vote to impeach (without allowing Trump any due process rights during the process) will regret their votes when they run for their primary reelection in 2022, as Trump will very likely appear at rallies for GOP challengers, and Trump supporters will NEVER forget the GOP House members who vote to impeach.
An impeachment vote will ensure that Trump remains the head of the GOP for at least the next two years (not the neocons, never Trumpers and other RINOs who have condemned Trump).
Trump's term ends next week, before McConnell could even schedule a trial.

I'm very pro-life. So I see these drugs as the most realistic way to reduce the violence. The solution is not the Oppressive State imprisoning mothers or their physicians, the ultimate solution is voluntary suasion. In the meantime these safe abortifacient prevent the desperation that causes the violence. It's not ideal, but it's a reasonable compromise. We don't want to go down the Romania route.

Oddly enough, before he proposed it, these same people had promoted making birth control available over the counter, and claimed those "safety and health concerns" were not prevalent in countries that did actually provide over-the-counter birth control pills.

I believe he also tried to open up Plan B options as well, due to it being relatively expensive as the FDA has only approved one version of Plan B, but that went nowhere.

Each week, you will be told to line your household up at the door, one at a time, so they can be counted; this will inform the number of food boxes dropped of at your house. An armed escort will accompany the delivery person to ensure that no one opens their doors while the delivery person is within 20 feet of the door. Don't do that, because you could get shot. The delivery personnel and their guards will be in full MOPP gear.
If someone in your house needs medical care, call 911 and an ambulance will be dispatched. People in full MOPP gear will pick up your sick loved one and take them away for treatment. If they live, maybe you'll see them again.
The ONLY “essential” personnel will be those involved with treating COVID and for producing and delivering the food. These people will obviously be issued uniforms and ID lanyards. So there’s no reason for anyone one else to ever venture outside of their house and anyone on the streets who is not in uniform obviously has no business being there, and will be subject to immediate detention in physical quarantine facilities, or worse.
