Ted Cruz Plans To Restore Confidence in the Election System by Lending Credence to the Wild Fraud Claims of a 'Pathological Liar'

To alleviate "deep distrust of our democratic processes," the Texas senator is leading a doomed challenge to Joe Biden's electoral votes.

Sen. Ted Cruz (R–Texas) and 10 other Republican senators say they are trying to restore faith in the integrity of the U.S. electoral system. They are doing that by joining the doomed effort to reject electoral votes for Joe Biden when Congress officially tallies the results on Wednesday, based on the unsubstantiated claims of a president Cruz himself has described as "a pathological liar" who "doesn't know the difference between truth and lies."

Like Sen. Josh Hawley (R–Mo.), who on Wednesday became the first senator to back electoral-vote objections, Cruz and his allies do not explicitly endorse the claim that Biden stole the election, which the Trump campaign and its supporters have failed to support with credible evidence in the scores of lawsuits they have filed since the election. But in a joint statement issued yesterday, Cruz et al. cite the doubts sown by the president's reckless allegations as a reason to challenge the results from "disputed states." In a Reuters/Ipsos poll conducted last month, they note, 39 percent of respondents, including 67 percent of Republicans and 17 percent of Democrats, said they were concerned that the election was "rigged."

Was the election actually rigged? Cruz et al., unlike their allies in the House, won't hazard an opinion.

"Some Members of Congress disagree with that assessment, as do many members of the media," the 11 senators note. "Whether or not our elected officials or journalists believe it, that deep distrust of our democratic processes will not magically disappear. It should concern us all. And it poses an ongoing threat to the legitimacy of any subsequent administrations."

Rather than evaluate the merits of Trump's fraud claims, which have made no headway in state or federal courts, the senators say the fact that many people believe them is reason enough for Congress to "immediately appoint an Electoral Commission, with full investigatory and fact-finding authority, to conduct an emergency 10-day audit of the election returns in the disputed states." They plan to "reject the electors from disputed states as not 'regularly given' and 'lawfully certified' (the statutory requisite), unless and until that emergency 10-day audit is completed."

Do Cruz et al. have any specific reason to believe the audits and recounts that states have conducted since the election, all of which validated Biden's victory, were deficient? They don't say. Yet they imply that the certification of electoral votes in "disputed states" cannot be trusted, based on allegations by the same man Cruz has said lies almost every time he opens his mouth.

Despite his history of questioning Trump's honesty, Cruz was eager to represent the Trump campaign in two lawsuits that sought to prevent Biden from taking office.  "Ideally, the courts would have heard evidence and resolved these claims of serious election fraud," he and the other senators say. "Twice, the Supreme Court had the opportunity to do so; twice, the Court declined."

Yet neither of those lawsuits, which focused on election procedures in swing states, alleged actual fraud. In that respect, they resembled most of the Trump campaign's post-election lawsuits. Again and again, the claims Trump's lawyers made in court fell far short of the allegations they have made in press conferences and TV appearances. Seeking to intervene in one of the cases the Supreme Court declined to hear, Trump conceded that he could not back up the claims of massive fraud he has been pushing for two months.

"Despite the chaos of election night and the days which followed, the media has consistently proclaimed that no widespread voter fraud has been proven," Trump lawyer John Eastman wrote. "But this observation misses the point. The constitutional issue is not whether voters committed fraud but whether state officials violated the law by systematically loosening the measures for ballot integrity so that fraud becomes undetectable."

That position contradicts everything Trump and his representatives have been saying since the election. Trump lawyer Rudy Giuliani said the purported plot to steal the election is "easily provable." Former Trump campaign lawyer Sidney Powell likened the evidence to a "Kraken" and a "fire hose." Trump himself insists he has "absolute PROOF" of "massive Election Fraud." Yet according to Eastman, it was "not necessary" for Trump to "prove that fraud occurred." In fact, he said, such evidence cannot be produced, because the procedures Trump challenged made any manipulation of the election "undetectable."

State and federal courts have been almost uniformly unimpressed by Trump's arguments that certain election practices were illegal or unconstitutional. And in the relatively few cases where the Trump campaign or its allies alleged actual fraud, the courts have found the evidence unpersuasive.

At a December 16 hearing on election "irregularities," Sen. Ron Johnson (R–Wis.) acknowledged Trump's repeated failure to make the case that Biden did not really win the election. "We will hear testimony on how election laws in some cases were not enforced and how fraudulent voting did occur, as it always does," Johnson said. "The question that follows is whether the level of fraud would alter the outcome of the election this year. In dozens of court cases, through the certification process in each state and by the Electoral College vote, the conclusion has collectively been reached that it would not." Johnson nevertheless has joined Cruz and the other senators in claiming that decisive electoral votes for Biden cannot be trusted.

During the same hearing, Trump campaign lawyer Jesse Binnall, based on evidence that had been decisively rejected by state courts, claimed more than 130,000 people voted illegally in Nevada, including "42,000 people who voted more than once." Sen. James Lankford (R–Okla.) said double voting is rare in his home state, which sees such cases "about 50 times a year," and he noted that "we prosecute individuals that vote twice." Lankford asked Binnall how many people had been prosecuted for the allegedly rampant voting fraud in Nevada. The answer was zero. Yet here is Lankford, joining Cruz, Johnson, and the other senators in implying that systematic fraud denied Trump his rightful victory.

Cruz et al., like Hawley, say they are merely following the example set by Democrats who challenged electoral votes from certain states in past presidential elections. But leaving aside a controversy over a "faithless" elector who voted for George Wallace instead of Richard Nixon in 1968, such protests have attracted a senator's support just once in the 133 years since Congress approved the Electoral Count Act, which established the process that Trump's supporters plan to use.

In 2005, Sen. Barbara Boxer (D–Calif.) joined Rep. Stephanie Tubbs Jones (D–Ohio) in objecting to electoral votes from Ohio, which they claimed had disqualified or discouraged voters through various improper policies and practices. Under the Electoral Count Act, that forced the joint session of Congress to adjourn for separate debates and votes. The challenge—which was not supported by 2004 Democratic presidential nominee John Kerry, then a Massachusetts senator—failed by a vote of 267–31 in the House and 74–1 in the Senate.

Republicans vociferously objected to that maneuver, depicting Democrats as sore losers looking for excuses. Yet now Republicans are adopting the same tactic, with the support of at least a dozen senators and the enthusiastic backing of their defeated candidate. "Our Country will love them for it!" Trump declared on Twitter yesterday.

Other Republicans are not so sure. Senate Majority Leader Mitch McConnell (R–Ky.), who belatedly acknowledged Biden's victory on December 15, urged his colleagues not to do what Cruz et al. are doing. McConnell thinks a divisive vote with a foregone conclusion can only hurt the Republican Party. Senate Majority Whip John Thune (R–S.D.) likewise warned that any challenge to electoral votes on January 6 will "go down like a shot dog" in the Senate.

Under the Electoral Count Act, challenges to electoral votes can succeed only if they are backed by majorities in both the House and the Senate. The House is controlled by Democrats. In the Senate, the combination of Democrats and Republicans who are on record as opposing challenges to Biden's electoral votes is enough to defeat any objections. "We are not naïve," Cruz et al. say. "We fully expect most if not all Democrats, and perhaps more than a few Republicans, to vote [against us]."

According to a federal lawsuit that Rep. Louis Gohmert (R–Texas) filed last week against Vice President Mike Pence, that should not be the end of the matter. Gohmert argues that the Electoral Count Act conflicts with the 12th Amendment, which he implausibly claims gives Pence the sole authority to decide which electoral votes should be counted. On Friday, a Trump-appointed judge dismissed Gohmert's lawsuit, ruling that he did not have standing to file it. Yesterday the U.S. Court of Appeals for the 5th Circuit upheld that decision.

Pence, who argued that Gohmert had sued the wrong defendant, nevertheless supports Cruz et al.'s plan. Last night Marc Short, the vice president's chief of staff, said Pence "shares the concerns of millions of Americans about voter fraud and irregularities in the last election." Short added that Pence "welcomes the efforts of members of the House and Senate to use the authority they have under the law to raise objections and bring forward evidence before the Congress and the American people on Jan. 6th."

Since that "evidence" has not persuaded the courts and those objections are bound to fail, forcing these votes can serve only to further undermine confidence in the election system by lending credence to Trump's wild claims. Pence, like Cruz and the other senators, does not have the courage to reject those claims or to endorse them.

"When we talk in private, I haven't heard a single Congressional Republican allege that the election results were fraudulent," Sen. Ben Sasse (R–Neb.) said in a statement he posted on Facebook last week. "Instead, I hear them talk about their worries about how they will 'look' to President Trump's most ardent supporters….Let's be clear what is happening here: We have a bunch of ambitious politicians who think there's a quick way to tap into the president's populist base without doing any real, long-term damage. But they're wrong—and this issue is bigger than anyone's personal ambitions. Adults don't point a loaded gun at the heart of legitimate self-government."

Now, that’s not physically possible, you know, which we can prove mathematically but, at the same time, if you adjudicate 105,000 votes, you have to understand from a technological perspective, as we’ve delved into all the different aspects of how the vote moves along, when you adjudicate a ballot, that old reference, the image that you saw or anything like that, is completely destroyed.   11. There isn’t anything wrong with elected representatives . . . um . . . representing the views of their constituents–not in this case. By objecting to the certification of the results, and insisting on a ten day audit of the votes, they aren’t doing anything illegal or unconstitutional.

    Ultimately, their effort to overturn the election results will fail. The most they’ll be able to do is delay the certification for a few hours.

    What we gain from this exercise is something like legitimacy in the technical sense. By the last polls I saw, there are vast numbers of Republican voters out there who truly believe that the election was stolen.

    Regardless of whether they should believe what they believe, their representatives in congress delaying the certification of the vote for a few hours as a symbolic gesture isn’t anywhere near as scary as showing the American people that there isn’t anyone in Washington who represents them, what they care about, and what they think anymore. When we’re in the proper purview of democracy, our representatives are not wrong to show some deference to the opinions of those who voted for them–even if and when the voters are wrong.

        When democracy is limited to its proper purview, as described in this post, it is not in opposition to libertarianism. Rather, when democracy is limited to its proper purview, democracy is a prerequisite for having both a libertarian society and a society of free people.

        Step 5: Use the existence of these investigations as justification for discarding the official results and installing Trump back for a second term.

          Voter fraud became the cause of the right when they realized that it was easier to manipulate who gets to vote, what districts to place each voter in, and how to set up polling locations than it was to actually try and appeal to a broad majority of the electorate. The South was highly effective at disenfranchising Blacks until the VRA started to put an end to their suppression tactics. But with Shelby County, the Roberts Court gave a green light to the GOP to find ways to limit the power of Democrat voters while putting a fig leaf of “election security” over their real intentions. No longer did jurisdictions with a history of voter suppression have to justify their changes in advance to the DoJ. Instead, voters in affected areas had to go to court themselves and spend all the time and money and discovery and other hurdles to prove what was already obvious.

          I’m not the one being dishonest. Admit it. The right gave up on trying to persuade a real governing majority of the country to vote for them decades ago. Instead, they rely on structural advantages to how our elected leaders are selected to try and govern from a extremely loyal 30-40% instead. The equal representation of states in the Senate (a compromise that Hamilton, Madison, and others absolutely hated, but the small states stood their ground and wouldn’t budge), the plurality-take-all nature of 48 states’ EC votes, and gerrymandering with House seats and within state legislatures (which is easier to favor conservative, rural areas with solid, but medium-sized majorities while concentrating Democrats into their urban strongholds).

          All of this has meant that Republicans don’t have to compromise in order to win. They can try and rule as an almost strictly conservative party despite only around a third of the country subscribing to that ideology.

          The persuadable middle of the political spectrum is forced to choose between the solid right of the GOP and a mix of the solid left and center-left of the Democrats. That the Democrats do try and appeal to a real majority shows up clearly in the fact that only once in the last 30 years has the GOP Presidential candidate gotten more votes than the Democrat.

        The question of whether people should think something else, for whatever reason, isn’t the issue. The fact is that this is what they think regardless of whether they should. Persuasion may be an appropriate response to a lack of legitimacy. Respecting the opinions of average people, meanwhile, is a way to avoid the loss of legitimacy.

        Bad things happen when governments lose their legitimacy. Some examples are the LA riots of 1992, the American Civil War, Egyptian Islamic Jihad, and the militia movement that rose in prominence in the United State during the Clinton administration–right up until the Oklahoma City bombing. It should be noted that the negative consequences of a government losing its legitimacy are negative regardless of whether we like or share the goals of the people who are not longer willing to accept the power and authority of the government.

        Here are the facts:

        86% of Trump voters said that the media reported the election results inaccurately, and 49% of Trump voters in that poll said that Trump should refuse to concede.

        In regards to whether Cruz and a handful of Republicans in congress should delay the certification of the results for a few hours in a legal and constitutional act of protest, the question isn’t whether their Republican constituents should think something else. The fact is that this is what they think.

        If the voters’ opinions are treated with nothing but contempt by their representatives in the government, on this issue or a number of others, the force for the negative consequences of illegitimacy would build. Refusing to believe in the negative consequences of lost legitimacy is willful stupidity, much like refusing to believe in the negative consequences of bad economic choices. That’s another example of something that’s dumber than creationism.

        Cruz’s objection is a symbolic but ultimately empty gesture that may serve to undermine those who say that the American government has no legitimacy left at all because there is no one left in the government who cares about the opinions of people like them.

        If you disagree with almost half of Trump voters, that’s not a good reason to show contempt for their right to have representation of their opinions in congress–on a question that is well within the proper purview of democracy. Support for showing contempt for the right of the people to have their views represented in congress is support for the negative consequences of illegitimacy. Being ignorant of what legitimacy is and the negative consequences of losing it is probably better than foolishly arguing for illegitimacy and its negative consequences with eyes wide open.

          Politicians aren’t just proxies for what voters want, that would be the “mob rule” that the Founders most decidedly did not want to see become of their new country. Our Representatives, Senators, the President, and other political leaders have a duty to lead public opinion as much as they respond to it.       The Republican base is in a feedback loop with the right-wing media that started with conservative talk radio in the 80’s. Any GOP politician, past or present, that still has some integrity and sincere belief in public service is simply too squishy. They won’t “fight” like Trump will. After all of these years of conservative commentators in these outlets hammering away at the left as being too dangerous to allow power, for them to bow to reality and acknowledge that Trump lost is seen as a betrayal by their consumers.

When I went to vote (here in Pittsburgh) a decade ago, an election worker refused to accept my signature (because I signed it Bill Godshall instead of William Godshall, which is the name and signature that I registered to vote). She told me I had to resign my name using William instead of Bill (to be eligible to cast a vote), even though eleven letters in my signature matched those my original voter registration signature.

      Perhaps Jacob Sullum can reveal how many mail in ballots in PA were rejected (according to PA law) because:
      – the signature on the ballot didn’t perfectly match the signature on the voter registration,
      – there was no signature on the ballot,
      – there was no postmark on the mail in ballot,
      – the ballot wasn’t mailed in before 8PM on election day,
      – the ballot wasn’t inserted in the envelope that was provided to the voter.

      According to Sullum, all of these illegal mail in ballot votes for Biden in PA (which exceeded Biden’s so-called margin of victory) were legit.

      Seems like Sullum and Reason have such severe cases of TDS that they are now defending and promoting voter fraud (by falsely claiming it didn’t and doesn’t happen).

    But, if an electoral commission is NOT appointed, won’t the damage to the electoral system be worse? That’s what Cruz et al. claim:

    “support of election integrity should not be a partisan issue. A fair and credible audit-conducted expeditiously and completed well before January 20 would dramatically improve Americans’ faith in our electoral process and would significantly enhance the legitimacy of whoever becomes our next President. We owe that to the People.”

    The credibility of this claim depends on how many Americans are already suspicious or worse that Biden won fairly. If it were only 3%, then giving a hearing their crank claims would worsen the situation. But, since 33% or more believe the election was stolen, examining and (presumably) debunking those claims will mollify them.

    NOT doing so will look suspicious (“what do they have to hide?”) and anti-American, and will provide some on the fringe with a point of rebellion. It is very unstatesmanlike of the current nothing-to-see-here consensus not to appreciate the riskiness of their course.

    RE: “those objections are bound to fail”—but that’s only because Democrats in the House will not accept a Commission report that endorses Trump’s claims. It’s not because Trump’s case is prima facie preposterous, despite the claims of the Consensus. His claims must be given a fair hearing.     However, if the combined 37 electoral votes from these three states were switched from Biden to Trump, after a Congressional-ordered audit of legal and illegal votes, the electoral count would be tied at 269.

    Indeed, Biden’s anomalous turnout is 30% higher than Clinton’s, and this increase ranks fourth among those of the 15 crucial states analyzed in this article:

    Then, if Nevada were to follow Arizona, Georgia and Wisconsin, in flipping from Biden to Trump, the president would be re-elected with 275 electoral votes, to Biden’s 263.

    In 2016, Trump got about 63 million popular votes; in 2020 he got around 74 million. But even that is not as staggering as Biden getting about 18 million more votes than Hillary.
