545 Migrant Kids Snatched by the U.S. Government Are Still Missing Parents

The Trump administration's family separation policies have left 545 migrant children without traceable parents, according to the American Civil Liberties Union (ACLU). Most of these children were detained during unauthorized border crossings in 2017, during a pilot program to test President Donald Trump's zero-tolerance family separation policy.
"We just reported tonight to the court in #aclu case that we still cannot find parents of 545 kids separated by Trump admin - some just babies when taken years ago. We will not stop till we find EVERY one," tweeted ACLU lawyer Lee Gelernt on Tuesday evening. ("I've been litigating this case since 2018 and each revelation is still shocking," commented Gelernt earlier this month.)
The Trump administration formally instituted its migrant family separation policy in 2018, though the pilot program had already begun.
"Unlike the 2,800 families separated under zero tolerance in 2018, most of whom remained in custody when the policy was ended by executive order, many of the more than 1,000 parents separated from their children under the pilot program had already been deported before a federal judge in California ordered that they be found," notes NBC News.
That judge, Dana Sabraw of the U.S. District Court for the Southern District of California, wrote in a June 2018 decision that "the practice of separating these families was implemented without any effective system or procedure for (1) tracking the children after they were separated from their parents, (2) enabling communication between the parents and their children after separation, and (3) reuniting the parents and children after the parents are returned to immigration custody following completion of their criminal sentence. This is a startling reality."
The ACLU was one of the organizations tasked by the court with trying to track these children's parents down so they could be reunited.

I'm pretty sure that the original Constitution outlined very limited powers to the federal government, all of them almost exclusively geared towards controlling the national borders (with the navy, coast guard, tariffs and foreign trade, immigration after 1808, etc.).

Ah, I knew we would get into that. Article 1, section 9 is a limitation of Congressional power, not an enumeration of powers. It was specific to the slave trade and hasn't been used in any relevant case law on immigration. Look at the court history, Congress's powers to regulate immigration are a good example of judicial activism.
I've already posted the relevant section below, but because you seem to be quite dense, I'm going to spell it out for you:
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
The article 9 carve out for slavery was included specifically because the article 8 power to "establish [a] uniform Rule of Naturalization" covers importation of slaves (or, as the article 9 carve out also mentions, migration).
Naturalization is not immigration. People immigrate to the United States to work with absolutely no intention of becoming a citizen at all.
The plain reading of Naturalization includes immigration. Hence the specific carve out on federal power to allow "The Migration or Importation of such Persons as any of the States now existing shall think proper to admit".
That is the SCOTUS precedent. But I challenge that it is wrong. If Congress needed the power to regulate immigration in order to regulate naturalization then they should have went to the states to gain that power.
It's judicial activism, in my opinion.

They didn't need to go to the states for that power because the already had that power as part of regulating naturalization. Article II (I was saying articles when I should have been saying sections last comment) is written in a way that the powers vested in Congress are bound by what section 8 allows, and nothing more. That is, Congress doesn't have any power that isn't outlined in section 8, and therefore there would be no need for any other section to limit the power of Congress. Section 9 is there because these are specific limits on the powers granted to Congress by section 8. Every single point in section 9 would otherwise be allowed by section 8.
Unless you want to argue that the the first point in section 9 is the only one that doesn't count (similarly to how only the second amendment of the bill of rights doesn't count), then "The Migration or Importation of such Persons as any of the States now existing shall think proper to admit" is a power that would otherwise be granted to the federal government by section 8 if it were not limited by section 9, just as "No Bill of Attainder or ex post facto Law shall be passed" or "No Tax or Duty shall be laid on Articles exported from any State" are needed to ban such practices by the federal government, because they are otherwise valid powers granted by a plain reading of section 8.
I'm not even getting into the fact that it's practically impossible (literally) to enforce uniform rules of naturalization without also controlling immigration. Just legally speaking it's a power already granted to the federal government.

What shouldn't be protected is American corporations that agree to partner with Chinese corporations for market access. Those companies are freely giving up their IP in many cases for market access. When the Spanish moved in to Texas, California, and New Mexico, they initially didn't conduct military conquest--they set up settlements and missions near the existing indigenous tribes. In NM, the Pueblo eventually became sick of their paternalism and restrictions on freedom to practice their own religion, and started a revolt that slaughtered hundreds pushed the Spanish out of the region for several decades.

– Facebook didn’t block the Hunter Biden laptop story. They temporarily reduced circulation of the story while they fact checked it. Facebook does that kind of thing all the time. It wasn’t some one-off special treatment.
– Twitter has responded to criticism and changed their policy already. You can find the Biden story all over Twitter.

The idea that I shouldn't be allowed to do what's in the best interests of me and my family because you care more about the Chinese people than you do about the standard of living of the American people certainly isn't libertarian or capitalist. People will pay a premium for an electric or hybrid car that consumes less gasoline--a premium that's higher than the cost of the gas they save by buying an electric or hybrid car. The reason they do that is because they care more about the cause of global warming (for whatever reason) than they do about the money they'd save by driving a traditional gasoline driven car.
People don't consume veal like they used to. In a lot of places, it's considered socially unacceptable--so unacceptable that consumers seem to shun it regardless of price.
I wish people cared more about the things I care about, but if they don't--and if the market shows they don't, then they don't--the solution isn't to use the coercive power of government to inflict my qualitative preferences on them.
And hurting their standard of living by making them buy things at higher prices than they'd need to pay otherwise suggests, once again, that there are things you value above the standard of living of the American people. In the case of technology transfers, you may even care more about it than the companies that are entering into the Chinese market despite the forced technology transfers.

Furthermore, the email says that the money is being, "held by H for the Big Guy". If it's being held in an account for Joe Biden in an account controlled by Hunter, why would it show up on Joe Biden's taxes?

This is all very reminiscent of Bill Clinton's turn in office.
Bill Clinton brought his scandals to the White House with him, but the Republicans didn't have the House--and hadn't had control of the House for so long it was incredible. That lent a certain amount of leverage to Gingrich's efforts to take control of the House.
If Biden wins in 2020, expect the Republicans to take the House in 2022. If they manage to pass and implement the Green New Deal in 2021, pack the Court, etc., the Republicans will have a super strong year in 2022, and they'll go after Biden for his corruption--ahead of 2024.
If the Democrats have control of both chambers and the White House, this talk of Biden's corruption won't go away. Like Whitewater and Vince Foster, it'll fester. And the people who paid Biden off for influence won't go away either. They'll want a return on their investment--and there's a paper trail of some kind.

I can think of a couple of ways to account for that statement.
1) The money is under the name of a corporation controlled by Hunter Biden and hasn't yet been transferred to Joe Biden and won't be until he's out of office.

The one interpretation I can't find in that explanation is the one that denies that they received money or that it was from influence peddling.

We have tech oligarchs openly sensoring sourced news about a candidate while allowing anything and everything to be written about the other. It's over we had a good run. Regardless who wins it's clear where we are headed everyone's gone insane.

If Trump is reelected, we'll almost certainly be out of Afghanistan completely by the end of April as scheduled, maybe sooner.

It's been a week since Facebook said it was 'reducing [the] distribution' of New York Post Hunter Biden laptop story 'pending fact-checker review.' But Facebook never said definitively that there actually *was* a fact-checker review going on. And nothing since. So what's up?
The Biden campaign had been going with the moniker "unverified" as a shield to suggest that the story was untrue while not being pinned down on any specific denials. That fell apart the other day when a Biden campaign representative went on Fox and when specifically asked for any one detail about the story that was not true was not able to come up with anything.
I also note that the magical phrase "without evidence" has disappeared from the lexicon when covering the denials of this story. People at every level have been claiming that this is Russian disinformation, when there was absolutely zero evidence of any sort that it was in any way tied to Russia or any other foreign entity. but nobody inserted the magical without evidence in front of it. In fact, every news outlet treated this as if it was the truth.
And in the world of backfiring, it appears that Adam Schiff was at the center of pushing out the notion that the intelligence community had come to the conclusion that this was Russian disinformation. This prompted the director of national intelligence to come forward with the assessment that no intelligence agency has any such opinion, and they have no evidence that this has anything to do with any foreign entity. So kind of an own goal on that one.
They are really desperate and panicking. Own goals happen when you are desperate.
As long as The Donald doesn't step on his dick at the debate, he will win the election. Quid Pro Joe is corrupt AF, and the polls are tightening up by the hour.
He is going to go after Biden on the emails. The moderator is going to do something really crazy and desperate to try and save Biden. Biden has no answer. He will either say nothing and just refuse to answer or lose his temper and have a meltdown the likes of which has never been seen in national level politics.

I think that is the worst thing they could do from Biden's perspective. It is admitting that the allegation is so bad that the country isn't allowed to hear about it. I wouldn't be surprised if that is what they did, but I don't think that would work out very well for them.
I'm still at 50/50 about that. I think the polling models are completely off base. The few I've seen that make a genuine effort to get a representative sample that aligns with the likely electorate shows Trump and Biden are either tied or Trump is ahead everywhere it matters.
However, I don't underestimate the ability of the DNC to miraculously come from behind as they keep finding new ballots trickling in that are post-marked election day and somehow break 90-10 Biden.
They usually show up in someone's trunk the Friday after election day.

Here's a question for the HnR crowd.
I was listening to the 5th column podcast yesterday and they were covering the Biden laptop issue. They had what seems to be coalescing as the standard libertarian journalist take. "There is nothing to see here. This is just a kid trafficking on his father's name to make some money.". The secondary take is that it is "gross to go after someone's kid."
So that is the framing. They are attacking his son. And there is nothing to it because there is no proof that Joe Biden was involved.
So here's my question. What am I missing? Biden publicly bragged that he got a prosecutor fired. Moynihan asked we know what the quid is, but where is the quo? Has there been any case in the last, say 25 years, where the US government ordered another country to fire a lower level official like this?
It also seems to ignore the manner in which it was done. Instead of raising some sort of official protest and going through official channels, Biden brags that on the way out the door he told them that if they did not fire the guy before he got on the plane in a few hours, they were not getting their billions in loan guarantees.
Does that sound like normal foreign policy? Aren't these things normally negotiated at multiple levels with multiple contacts and agreements reached before high ranking political officials get involved?
They seemed pretty sanguine about the idea that politicians who are making upper middle class wages become multi-millionaires while in office. They did not seem to think it was a big deal that tens of millions of dollars were flowing to people close to Biden. They turned it "trading off of his name". It seems a very odd way for a bunch of libertarians to be thinking. I don't understand it at all. We certainly don't seem to be nearly as sanguine about anything else That has a whiff of corruption or even incompetence about it.
This all seems very unusual to me. So maybe you guys can explain it to me. Why is the libertarian take that it might be gross for family members to be receiving payoffs like this, but there is really no corruption that touches the actual official?
In fact, moynihan's take was that this is nowhere close to Trump's level of corruption. Which I flat could not figure out. There has not even been an allegation that he has been funneling payoffs to his family members.
Others have said that he engages in nepotism because he keeps his close family members involved in all of his dealings, including the government. This is certainly a legitimate charge. but they certainly are not enriching themselves by that, as these jobs pay much less than the jobs they have before. But they have been digging for any dirt they can find on the guy, and they are so desperate that they have claimed that people staying in Trump hotels amounts to illegal payoffs.
This is how vicious and desperate they have been to find some dirt on Trump. And they have not found anything.

I've heard trump is worse and far more corrupt so many times on that podcast it doesn't even phase me. It is crazy. They can never give any details. This morning I had a otherwise smart and reasonable liberal friend answer this question by linking to the article that Trump has a bank account in China. There is no evidence there is anything wrong with that. But that is all they have. I have never seen so many people act in such unreasonable ways in my life.
What is interesting to me is that TDS seems to be an almost exclusively white thing. I know a significant number of black and Hispanic people. Most of them are not Trump supporters. But, none of them have the kind of deranged hatred of Trump the white Democrats I know have. Some of them even like Trump because he is so plainspoken and entertaining. But none of them hate him or think of him any differently than they think about any other Republican. Why white Democrats have lost their minds over Trump but not minority Democrats is a really interesting question that I can't really answer.
Typically the only minorities I've seen that are obsessed with Trump are the ones who hang around white liberals all the time--basically, the ones who belong to cathedral institutions like mass media or academia, or are part of the upper middle or elite classes. The rest will either clown on him randomly or ignore him entirely.
That is also my experience. Unless their livelihood depends on shucking and jiving for white liberals, minorities seem to have a much more reasonable and nuanced view of Trump than white progs who are to a man deranged.

They're ignoring the part where the emails explicitly talk about "the big guy". They're explicitly stating they wanted to meet with the then VP of the United States, there is no debate to be had about whether Joe Biden was involved or not.
No one has explained why any of these companies would be interested in Hunter Biden as an actual employee. The "conspiracy" theory is that he got hired because he could influence his Dad, and that is the only theory presented that makes any sense. If that isn't what happened, I'd love to know what about Hunter Biden made him an appealing candidate for those jobs. No one has presented a credible theory on that subject.

If you're in Bahrain, UAE, Qatar, Saudi Arabia, Sudan, etc. and you see that, the message is that the United States will stick up for themselves when Iran attacks us, but we're not sticking our necks out for you. If you want security against Iran, then you need to form alliances with all the strong players in the region to guarantee each other's security--and that means Israel, too!
That's why Trump approved the sale of YUGE amounts of military hardware to Saudi Arabia, Qatar, the UAE and others, too. If Trump hadn't been so pragmatic in willingness to use force in the region, they would still be depending on the United States for their security--and wouldn't see the need to make nice with Israel.
Trump deserves all the credit in the world for that.

This is almost certainly a precursor to Sudan normalizing relations with Israel.
President Trump genuinely deserves to win the Nobel Peace Prize. He is literally bringing peace to the Middle East. He negotiated and signed a peace agreement with the Taliban--and we'll be withdrawing our troops completely by the end of April if he's reelected.
What more could he do? What more has anyone else done to bring peace to the world in the last 20 years?

This smells like a lie. Not like it's a lie there are 545 children that we can't tie to a parent, but that the story is way more complicated than the ACLU makes it out to be. Like the child was brought here by a non-parent to use as a human shield, the child was separated from the parent (as is the standard procedure long before Trump), and since the person who brought the child wasn't the parent, then immigration officials have a child on their hands with no identifiable parent.

In short, it looks like Trump is losing support with whites without a college degree, gaining support with whites with a college degree and is picking up support among blacks and Latinos.
It looks like things are reverting to their pre-Trump, pre-Obama norms. The same thing happened during the Reagan administration. Suddenly, blue collar white people flooded into the Republican party to support Reagan, but when he left office, they all went back to voting with the unions again.
Recessions accelerate trends.
The Latino and black uptick is interesting. I suspect that may have to do with a lot of them not buying into the media narratives about the riots in recent months. It certainly seems to be the case that while all blacks believe that black lives matter, Black Lives Matter doesn't speak for all of them. Black voices are apparently as varied as any other kind. Meanwhile, Latinos aren't a homogeneous voting bloc either. Maybe it's just that the real world is more complicated than our preexisting biases.
One other factor I think is that if there is one place in the world where silent Trump voters exist, it is likely in white suburbs. That would explain the drop in support among whites to a significant degree.
I'm not discounting the idea that white Trump supporters in the suburbs just aren't interested in revealing their choices. We've already seen the threatening letters left for Trump supporters, and several Trump supporters have been murdered in cold blood for the grave sin of wearing a red hat. That wasn't true in 2016 so they may have been more vocal then, the last 4 years have taught them to shut up about it.
People move to the suburbs for relative peace and quiet. If revealing their political preferences jeopardizes that, they just won't reveal their preferences.
Also, the whole Biden creepy Joe hair sniffing and feeling up little girls stuff didn't play well at all among Hispanics and blacks. The media did everything they could to cover it up but everyone knows what kind of a creep Biden is. And Hispanics and Blacks are less likely to ignore that than suburban whites, which is ironic when you consider that suburban whites are the ones who are forever seeing child molesters under every bed and around every corner.
Trump seems to be losing with white suburban women without a college degree.
I don't know that they dislike him enough to go out and vote for Biden. They voted for Trump last time. They may just stay home.
That's probably the crux of the election right there: Will enough suburban white women without a college degree who voted for Trump in 2016 stay home in 2020?
That is why the Hunter Biden stuff is potentially so devastating to Biden and why they are so desperate to suppress it. If it gets out and is understood that Biden's son was banging young girls and Biden knew about it and didn't care, those women will be coming out and voting for Trump forget them staying home.
I truly hope Mr. Bannon and Mr. Guiliani have a daily surprise for the next 10 days, with the most damning evidence released on Halloween (or maybe mischief night might be more apropos. 🙂
