Trump Administration Justifies Federal Police Surge With Fake News

Plus: "learning pods" are an unfair target, COVID-19 reinfections are unlikely, and more...

"Operation Legend" will fight "classic crime," says Trump. With Portland protesters and militarized federal cops still clashing, the Trump administration announced on Thursday that it will be sending in a surge of federal agents to other U.S. cities and doling out $61 million for local police forces in these cities. Trump is calling this effort to occupy American downtowns "Operation Legend," and Attorney General Bill Barr justified it yesterday by touting the Justice Department's supposed success in Kansas City, Missouri.

"Just to give you an idea of what's possible," said Barr, "the FBI went in very strong into Kansas City and within two weeks we've had 200 arrests."

Barr's claim is, as the president likes to say, fake news. "Neither the U.S. attorney's office in Kansas City, nor the Department of Justice could immediately provide information to substantiate Barr's claim," noted The Kansas City Star yesterday. A spokesperson for the U.S. Attorney for the Western District of Missouri told the paper that "he was not aware of any additional arrests after his office announced an illegal firearm charge against a Kansas City man earlier this week."

A Justice Department official later offered a correction to Barr's arrest claim, noting that the "200 arrests" Barr mentioned dated back to last year and also included arrests made by state police.

The official said these arrests had been made since the administration's launch of "Operation Relentless Pursuit" in December 2019 and described "Operation Legend" as "essentially a continuation of that."

The New York Times has more on what this may entail, noting that the surge of federal law enforcement will include agents "reassigned from other tasks at Justice Department agencies like the F.B.I., the Drug Enforcement Administration, the United States Marshals Service, and the Bureau of Alcohol, Tobacco, Firearms and Explosives, as will law enforcement officials from the Department of Homeland Security."

In addition to the extra feds, "the Department of Justice will provide more than $61 million in grants to hire hundreds of new police officers in cities that are the focus" of the operation, Trump said.

"Operation Legend" is supposedly geared at stopping general crime, unlike the force of federal agents sent to Portland, which were sent as part of Trump's executive order on dealing with threats to public monuments. ("The operations we are discussing today are very different — they are classic crime fighting," Trump said yesterday.) But both can be understood as efforts to distract from the president's poor handling of COVID-19 and boost his election-season credentials as someone who's tough on both crime and liberals.

(In a particularly bizarre choice, a new Trump 2020 campaign ad features footage of protests and mayhem currently happening in U.S. city streets and warning that what we're all getting right now under Trump is what you will get "in Joe Biden's America.")

Meanwhile, federal police action in Oregon has been named Operation Diligent Valor.

"On the morning of July 4th, the [Department of Homeland Security] Rapid Deployment Force implemented tactics intended to positively identify and arrest serious offenders for crimes such as assault, while protecting the rights of individuals engaged in protected free speech activity," Federal Protective Services (FPS) regional director Gabriel Russell wrote of the operation.

But under the guise of Operation Diligent Valor, federal agents have been arresting and attacking media, protesters, and even local officials. Last night, they tear-gassed Portland Mayor Ted Wheeler…right before local cops turned around and tear-gas protesters, too.

"There are currently 114 federal law enforcement officers in Portland to patrol federal buildings, including personnel from the FPS, Immigration and Customs Enforcement, U.S. Marshals Service and U.S. Customs and Border Protection," Reuters reports.

Discord over the reopening of U.S. schools continues. The latest target of progressive anger on this front is the fact that some parents are banding together to teach their children themselves in small groups, or "learning pods."

"At face value, learning pods seem a necessary solution to the current crisis," writes Clara Totenberg Green, a social and emotional learning specialist with Atlanta Public Schools, in The New York Times. "But in practice, they will exacerbate inequities, racial segregation, and the opportunity gap within schools. Children whose parents have the means to participate in learning pods will most likely return to school academically ahead, while many low-income children will struggle at home without computers or reliable internet for online learning."

So, to combat theoretical disparities in learning-pod access, U.S. parents should…what? Send their kids to potentially pandemic-plagued schools? Keep shouldering the burden of home-based education alone? Green doesn't actually say (her piece is all grand complaints and no practical solutions), nor does she offer anything other than conjecture for her claims that only rich kids' parents will pool their resources and form learning pods. Nonetheless—people are outraged! How dare families try to make the best of bad times!

        Nobody should clean up a goddamn thing. San Francisco apparently hasn't been enough of a cautionary tail about what happens when progressives and socialist don't face enough opposition. Let them have Portland and Seattle. Any and every policy they want - absolute carte blanche. I can't imagine a better strategy for winning back the hearts and minds of the rest of the populace than seeing what this totalitarian ideology actually looks like in practice.

        Of course, you'll still have have the ENB's of the world that will absolutely refuse to believe their lying eyes, but you don't have to win them all. Just the ones that are ever so slightly capable of reason.

      It's also a complete load of shit. Wheeler had his security detail put him up by the fence surrounding the courthouse while the mob was trying to break into it. When the feds responded with the inevitable tear gas, Wheeler got his little dose right before the detail whisked him into his car while the rioters were banging on the vehicle as he drove off.

      The whole thing was a total LARP so Wheeler could get a photo-op to say, "See, I'm one of you guys and Trump just gassed me!" And of course, ENB fell for it hook, line, and sinker. Hilariously, before this all went down, they made him go through what was essentially a giant struggle session, accompanied by some black dude doing a hype about Trump to redirect some of the Two Minutes Hate from Wheeler's weak ass.

            Woody was a socialist on some issues when it suited him, for sure. But I really think he was smart enough not to swallow everything they were pushing, which is why he wrote columns for The Daily Worker, yet he never actually joined the party. He seemed mostly concerned with the plight of "workers," Given the world in which he both lived and operated in, it's pretty easy to see how that happened. In the end, however, I really don't care about his politics -- his music is what matters.

        To heck with the view, the bigger issue is the crime they bring with them. Dallas tried this with their suburbs and the crime levels soared. In Houston this “experiment” was done with the oil boom of the late 70’s early 80’s, Alief was a middle to upper middle class neighborhood with good schools at the time. To accommodate all the influx of workers as the economy boomed massive numbers of, at the time nice family units, apartments were built. Ten years later Alief became a cesspool of crime and the schools are gang central for the city.

    Mark and Patricia McCloskey, a St. Louis couple who pointed guns at protesters, have each been charged with one count of unlawful use of a weapon.

    They tanked it already. Prosecutors made her previously non-functioning firearm operational so that they can charge her.

      It was handed over by the couple's attorney. Not hard to argue that somewhere between the incident and surrendering the weapon into police custody, the pistol was reassembled into a nonfunctioning configuration. That the couple used the pistol as a prop in court, makes more sense about why they'd have such a jamomatic piece of shit like a Jennings or Jimenez. Further, if they did use it in court, there's a paper trail of them submitting it to court personnel to determine that it actually was nonfunctioning. (Courts frown on people---counsel counts---taking firearms into the courthouse) Which will help the couple's case.

          My favorite incident in that vein, was BATFE monkeying with a guy's AR and the ammunition it had, to produce an AR that could fire repeatedly with one pull of the trigger. Then nailing the guy for unlicensed manufacture of a machine gun. I think they pulled it off, IIRC.

                  It is close to the DUI laws where a guy is sleeping in the back seat but because he had his keys he could have started it.

          Nope. I've shot a Jennings before, but I've never field stripped one. If it's anything like other pistols I've owned, getting to the firing pin spring is non-trivial. I don't even like manual safeties on a defensive handgun. I'd find a requirement that the handgun be stored in the condition that their attorney surrendered it to the cops in, would be totally laughable.

          I imagine it was required by the court the attorneys were practicing before, in order for it to be allowed in their courtroom. Which implies a witness, probably a bailiff, who's able to testify to same.

          Good thing the crowd didn't rush her. Though I bet he had a loaded mag for that AR at hand. Whether he could seat it, and put the rifle into battery under stress...is another question entirely.

            I'd imagine it was just laziness on their part. They clearly aren't gun people, and I'd wager they've never been to the range. If they did that to the gun to bring it to court, they just forgot or didn't have the skills to fix the gun once they got home.

            And yeah, confronting that crowd with an AR-15 with no ammo and a non-functioning pistol is ballsy, too ballsy. If you're going to pull a gun on someone you should consider the possibility that they choose "fight" instead of "flight", and they might be armed when they make that choice.

          Seriously, for you first-time handgun buyers--if you must get a semi-auto, practice taking it apart and putting it back together several times right after you buy it so you get proficient at doing so. If you can't be bothered to understand how your gun mechanism operates, then buy a damn revolver, which are dead-ass simple to use right out of the case.

          OK. Call the firearms tech to the stand. Qualify them as an expert on that particular firearm. Have them testify eventually to the exact sequence of steps they went through to make the pistol operational. Detail the time it took, any special skills or tools needed, etc... Have them give their professional opinion that an ordinary user would be able to replicate the procedure.

          In opening statement, lay the groundwork for the jury to think she was scared for her life, and 'the evidence will show that despite being scared for her life, she decided to try and use a fake gun to scare the crowd?' At closing, remind the jury of the tech's testimony of how easy it was to change whatever spring was wrongly installed, and let the jury put 2+2 together. Is it more likely she had an operating gun at the time, switched it up before surrendering it, and this lawyer is now lying her ass off about it being nonoperational... OR is it more likely that she decided to try and aggravate a mob with a fake gun? Argue that the latter situation isn't a reasonable doubt.

          All academic, but I don't think the 'prove it' part would be as tough for a prosecutor as you two seem to think. IANAL, but I do talk to them.

        I absolutely agree that there need to be negative consequences for misbehavior, and not just on justice issues but also on economic issues. And using the government to try to help people avoid the negative consequences of their bad choices is the cause of so many problems.

        If I wanted to criticize what President Trump is doing here, I might even do it in those terms. In a way, President Trump is saving the city government of Portland from their own terrible choices, and he's saving the voters of Portland from the negative consequences of voting for social justice warriors to run their government.

        If you want to avoid the negative consequences of voting for a city council that is devoted to defending social justice warriors no matter how silly or violent they get because of what they might do or say when protests erupt during times of economic distress, there's an easy way to do that. You vote for more reasonable people to run your government--and people from other parties, as well. If you don't do that, how will you learn your lesson if you don't suffer the consequences of your bad choices?

        Good parenting doesn't even depend on shielding your children from the negative consequences of their bad choices. Sometimes it's about inflicting negative consequences on your children when they might escape the negative consequences of their bad choices if you didn't intervene. That's basically what Trump is doing here.

        The meanest thing he could do to Portland right now might be nothing, and if he did nothing, maybe they might learn something from the negative consequences of their choices.

      That's basically what I was trying to say upthread. if the violence and lawlessness evaporated to the point that the number of arrests went down after the feds arrived, then that suggests that sending in the feds restored the peace.

      I suspect the idea that sending in the feds only makes things more violent is a legacy specific to the Iraq War. Maybe it needs to be said explicitly, if sending troops into Iraq made things more violent, that doesn't necessarily mean that sending federal agents into Kansas City or Portland will make those places more violent.

      I was in Los Angeles during the Rodney King riots, and I can tell you from experience that sending in the National Guard did not created more violence. It restored order.

      I have no illusions that is always the case or always will be the case, but the assumption that sending federal agents in to put down violence and lawlessness can only make things worse is an assumption that invited scrutiny.

          To expand on the LA riots, the first day or so, the riots weren't particularly widespread. Things didn't really take off until the news started showing people looting stores in front of the police and the police doing nothing. Once it became clear that Daryl Gates must have ordered the LAPD to stand down unless the police were attacked directly, the looting and lawlessness spread like wildfire.

          Regardless of whether sending in the feds creates more violence in any particular situation, there needs to be negative consequences for lawlessness in all situations.

          I really think they believe that stuff about, you know, the Iraq War bringing hell on earth where things were relatively peaceful before and the Drug War being the ultimate cause of the rise and militarization of street gangs.

          I suspect this thinking has become instinctive for some of them, and before you know it, they're effectively arguing that the police are the cause of burglaries,--so they shouldn't come to your house if an intruder breaks into your home and we definitely shouldn't prosecute burglaries.

                Applying the principle to situations where it doesn't apply shows that they don't really understand the principle.

                Gravity makes everything fall at the same rate of acceleration, 9.81 meters per second squared. This means that two objects that are the same shape and same size will hit the ground at the exact same time--even if one weighs much more than the other.

                That does not mean they will hit the ground with the same amount of force!

                One good reason to oppose the drug war is because when you inflict a law that people are unwilling to abide by on an unwilling population, the amount of police presence and the severity of laws necessary to keep the peace rises dramatically.

                The lesson to learn from that is not that increasing the number of police won't reduce the amount of lawlessness.

                It's just like with F = ma. Increasing the number of police per capita will reduce the lawlessness, even if people are starving to death like in Venezuela or North Korea. Libertarians generally have a qualitative preference for not using police to make us do things against our will, but that's no reason to pretend that increasing the police presence isn't effective.

                The reason Somalia isn't a libertarian paradise is because the purpose of government there isn't to protect people's rights. It's like they imagine that Portland would be a libertarian paradise if only President Trump weren't trying to protect our rights from vandals and arsonists. I posted the statistics yesterday--arson in Portland was up 280% in June 2020 compared to a year ago. The solution to that problem is not President Trump pulling out of Portland. President Trump wasn't in Portland when the arson rate jumped 280%.

          I can see where it causes more disorder in the short term as the rioters finally face some pushback and any escalation will be blamed on the Feds rather than be looked at for actual instigating party (why not riot more if you're not to blame).         If the number of arrests goes down after the feds move in, then we might conclude that their presence deters violence and makes the protesters behave more peacefully.

        The idea that a police presence promotes peace is baked into the whole idea of political legitimacy. The rule of thumb for political legitimacy used to be the number of police per capita required to maintain order.

        That supposition may no longer be politically correct, but the fact remains that the less political legitimacy we have in our society, the more effort the government needs to put in to maintain order.

        If Iraq under Saddam Hussein or Libya under Qaddafi required an army of police and/or the army itself to maintain order, then those governments are relatively illegitimate compared to say Switzerland, where the police per capita number of fairly low.

        The government in Los Angeles lost its legitimacy in the wake of the Rodney King verdict, and do in order to restore order, President George H. W. Bush had to increase the number of police per capita by bringing in the National Guard. That's basically what President Trump is doing.

        To deny that increasing the number of police per capita restores order is to deny everything we used to know about the police presence and keeping the peace. It's one thing to suggest that an illegitimate law like the drug war requires an enormous policing apparatus to maintain order. Quite another for them to cling to the delusional belief that increasing the police presence itself actually increases the disorder.

But, dealing with an illegal gun charge is better than being dead at the hands of a criminal.                 As for being a deputy meaning that you can't have your gun confiscated by state police, one might notice the current trend of stripping law enforcement of those specific protections. State police generally supersede county officials even without that going on.

                Not that it matters, since the Sheriff has stated themselves that they'll be giving away these special status waivers to people they like, not everyone who owns a gun. Hardly a great workaround by any measure, nor is it terribly consistent with the 2nd.

                The reason I assumed that they must not be writing it down is because if they write it down, they have a list that the state will have access to one way or another. And it's a list of gun owners.

                So, therefore, they must not be making a list. Because if they make a list, they can use that list for whatever purpose they so choose. That purpose could be protecting the rights of a minority of people who own guns, or that purpose could be disarming that minority of vetted gun owners.

                It doesn't matter one iota if it happens to be a deputy, or Joe Schmoe off the street. Notice that beat cops in Britain don't carry guns? The State can allow or disallow this or that to the agents under their command even more directly than they can the average individual.

                Making gun owners technically part of the state just puts them even more under it's thumb.

    It really is bizarre. Such campaigns are understandable when you're the outsider. "We can't have another four years like this!". But it makes literally no sense for the incumbent president to be pointing to mayhem occurring under his own watch. The lack of self awareness is telling.

    But then again, I don't play five dimensional chess! Perhaps he's pointing out that the mayhem is happening under Democrat run cities. Maybe. And maybe that will play to his base. But he can't win the election without votes from the middle third of voters. His supporters are his safe votes, he'll never get the Democrat votes, so he need to campaign to the in-betweens. And this message that stuff was shit during his watch is not a good way to do it.

    Because a vote for an incumbent is a vote for more of the same. And the more of the same that Trump is emphasizing is protests and mayhem.

      No what is telling is that you are so stupid or dishonest you either don't know or don't understand that law enforcement is a state and local issue and the lawlessness is being allowed to happen by the Democrats.       Yet, somehow, you think this happened on Trump's watch, as if he is responsible for it.       On November 2, 1938, the Australian newspaper The Age characterized the incident as "mass hysteria" and stated that "never in the history of the United States had such a wave of terror and panic swept the continent". Unnamed observers quoted by The Age commented that "the panic could have only happened in America."[55]

      Editorialists chastised the radio industry for allowing that to happen. The response may have reflected newspaper publishers' fears that radio, to which they had lost some of the advertising revenue that was scarce enough during the Great Depression, would render them obsolete. In "The War of the Worlds," they saw an opportunity to cast aspersions on the newer medium: "The nation as a whole continues to face the danger of incomplete, misunderstood news over a medium which has yet to prove that it is competent to perform the news job," wrote Editor & Publisher, the newspaper industry's trade journal.[2][56]

      William Randolph Hearst's papers called on broadcasters to police themselves, lest the government step in, as Iowa Senator Clyde L. Herring proposed a bill that would have required all programming to be reviewed by the FCC prior to broadcast (he never actually introduced it). Others blamed the radio audience for its credulity. Noting that any intelligent listener would have realized the broadcast was fictional, the Chicago Tribune opined, "it would be more tactful to say that some members of the radio audience are a trifle retarded mentally, and that many a program is prepared for their consumption." Other newspapers took pains to note that anxious listeners had called their offices to learn whether Martians were really attacking.[39]

      Few contemporary accounts exist outside newspaper coverage of the mass panic and hysteria supposedly induced by the broadcast. Justin Levine, a producer at KFI in Los Angeles, wrote in a 2000 history of the FCC's response to hoax broadcasts that "the anecdotal nature of such reporting makes it difficult to objectively assess the true extent and intensity of the panic.[57] Bartholomew sees this as yet more evidence that the panic was predominantly a creation of the newspaper industry.[58]
