Democrats Will Go Forward With Barr Contempt Vote Despite DOJ Threat to Deny Them All Access to the Mueller Report

Partisan posturing around the Mueller report continues to suck up all the air in Washington. The House Judiciary Committee was planning to vote this morning on whether Attorney General William Barr should be held in contempt for not yet giving them the full, unredacted Trump-Russia report prepared by Special Counsel Robert Mueller and his team.
Then the Department of Justice (DOJ) pulled its own power move. In a letter to the committee last night, Assistant Attorney General Stephen Boyd said DOJ would ask President Donald Trump to invoke executive privilege over the full report if the representatives go through with the vote.
Boyd called lawmakers' actions "a transparent attempt to short-circuit the constitutionally mandated accommodation process and provoke an unnecessary conflict between our branches of government. They are also counterproductive."
Citing "unreasonable demands" about access to the report and "the Committee's precipitous threat to hold the Attorney General in contempt, Boyd said that"the Attorney General will be compelled to request that the President invoke executive privilege with respect to the materials subject to the subpoena"
"It's a sharp escalation of the ongoing dispute between the committee and the Justice Department, which spent the day Tuesday negotiating over the House Judiciary Committee's subpoena for the entire Mueller report and underlying materials," writes Rebecca Kaplan at CBS News.
Judiciary Committee Chairman Jerrold Nadler said the vote will proceed as planned.

The numbers show that in 1985, Mr. Trump reported losses of $46.1 million from his core businesses — largely casinos, hotels and retail space in apartment buildings. They continued to lose money every year, totaling $1.17 billion in losses for the decade.
In fact, year after year, Mr. Trump appears to have lost more money than nearly any other individual American taxpayer, The Times found when it compared his results with detailed information the I.R.S. compiles on an annual sampling of high-income earners. His core business losses in 1990 and 1991 — more than $250 million each year — were more than double those of the nearest taxpayers in the I.R.S. information for those years.
Over all, Mr. Trump lost so much money that he was able to avoid paying income taxes for eight of the 10 years. It is not known whether the I.R.S. later required changes after audits.

The Justice Department's Inspector General is investigating possible criminal activity by the FBI in its applications to the FISA court to do surveillance on the Trump campaign. New information became available yesterday about how that investigation is progressing. Of particular interest is the applications to renew those FISA court applications.
"In the last application, the FBI said it didn’t believe that Mr. Steele directly provided the information in the Yahoo News article, even though Mr. Steele had admitted in U.K. proceedings in spring 2017 that he had briefed the reporter.

"In the last renewal application, dated June 2017, the FBI continued to state that it believed Mr. Steele’s information “credible,” given that his “previous reporting” had been “corroborated and used in criminal proceedings.”

This is interesting for a couple of reasons.
1) The FBI stated in an application to the FISA Court that Steele wasn't the source of a public leak to a journalist--even after Steele Steele admitted that he was the source.
2) The FBI stated in a an application to the FISA Court that Steele was a credible source--even after the FBI severed their relationship with Steele because he had lost all credibility.
For those of you who can't put two and two together, the FBI doing surveillance on a political campaign is serious business, and it appears that the FBI's justification for doing so was utter bullshit.
I would be utter surprised if any FBI heads roll. The smart ones who participated and have enough time for retirement, will.
Nothing will happen to the FISA judges who allow the government to run all over the Constitution. To be fair, evidently their was some push back by a judge or two on granting the warrants.
I suspect the reason the Democrats in the House are trying to go after Barr is because they want to discredit him in the court of public opinion ahead of the findings he reports when the Inspector General's report on this is done--in addition to other ongoing investigations into what the FBI was doing and why.
I might have agreed with you about the likelihood of anybody at the FBI being held accountable for this, but now that the Democrats in the House are smearing Barr's personal reputation, he has an incentive to vindicate himself by holding the responsible parties accountable. The Democrats in the House are making it personal.
Sounds like something Democrats would do.

Comey already publicly admitted that he knew the Steele Dossier had been financed by opposition research when the FBI submitted the applications.
Though I question that. I was discussing this a bit with John yesterday, but the idea that this is a single point of failure, i.e. Comey, is largely a means for the FBI to protect it's own ass by creating a scapegoat.
A scapegoat is often thought of as a patsy, someone who isn't necessarily the person who perpetrated the crime. If Comey is guilty of doing whatever he's accused of, he won't be a scapegoat.

A recent ruling from a California judge that prevented the Trump administration from returning asylum seekers to Mexico to wait for the hearing to approve their asylum status has been overturned.
This ruling only applies while the merits of the case itself are awaiting a ruling, but until they get a ruling on the merits of whether returning asylum seekers to Mexico while they await trial is kosher, the Trump administration can continue to do so.
I see no reason why making asylum seekers who present themselves at our border with Mexico wait for their trial in Mexico should be unconstitutional if the country from which they're supposedly fleeing persecution is not Mexico.
