Eric Holder Orders End to DOJ Program that Shares Seized Assets with Police
System was rife with abuse, encouraging law enforcement agencies to take people's property without charging them with crimes.


Big, huge news on the civil asset forfeiture front: Eric Holder is ordering an end to most of the Department of Justice's Equitable Sharing Program. This is the program where the DOJ works with local law enforcement agencies for busts, and then the law enforcement agencies are permitted to keep 80 percent of the assets seized. It has been an incubator of the worst police abuses, as some agencies looked for any possible reason to take people's property without ever actually accusing them with a crime.
The Washington Post has the scoop:
"With this new policy, effective immediately, the Justice Department is taking an important step to prohibit federal agency adoptions of state and local seizures, except for public safety reasons," Holder said in a statement.
Holder's decision allows some limited exceptions, including illegal firearms, ammunition, explosives and property associated with child pornography, a small fraction of the total. This would eliminate virtually all cash and vehicle seizures made by local and state police from the program.
While police can continue to make seizures under their own state laws, the federal program was easy to use and required most of the proceeds from the seizures to go to local and state police departments. Many states require seized proceeds to go into the general fund.
That difference between how the state and federal programs operate is important. The federal program is what encouraged the police abuse because the agencies got to keep the money (and cars, and whatever else they snatched). When the money goes into the general fund, not directly to the police, there goes the incentive for police to grab whatever they can get their hands on.

Very true. Here in Maine, it all goes to the general fund. Seized assets, fines and all. Since the cops don't profit from stealing shit and issuing tickets, they don't do it nearly as much. With one exception: when they work with the feds.

False, it just changes the incentive structure. When it goes into the general fund, it incentivises the politicians to pressure the cops to seize shit. I just spreads the incentive further.

When local municipalities profit from tickets and the stuff cops steal, then they absolutely put pressure on the cops to loot the citizens. But the state government is far enough removed that such pressure is not felt as much, if at all.
Yeah, the local structures do affect how well the incentives work. It's all a matter of how direct the kick-backs are. A significant number of places have some kick-back mechanism installed.
The little PDs in STL county (like Ferguson) are fucked up because of these structures.
The city of St Ann has 12K people and covers 3 sq miles. From their website, "The St. Ann Police Department is a progressive agency of 38 sworn officers and 13 civilians." That, right there, is what you call a self-licking ice cream cone.
It's a step in the right direction. Now it's up to all of us to push force asset seizure reform legislation in our respective states.

It's "shall share" but the decision whether to pursue a forfeiture or not is a decision to be made by the prosecution and they have wide discretion to do that or not.
Great. Seriously, this is by far the greatest victory for civil liberties in ages. However, this repeal should be codified in an Act of Congress. An expansive equitable sharing program can just be restarted again by a new administration/AG.

The bad news is that, once you formalize a "joint task force" you're gonna use it at least as much as you did the old informal coordination. By incentivizing joint task forces, this probably makes the problem worse, not better.

They were mad until I showed them I had the title to the car and then got real cool with me about they car. They wrote me a ticket and let me go. I never paid it so I can nenver drive to St. Louis from Houston again since I don't remember which State I was in.

Eric Holder actually did a good thing today. I'm not sure I have ever had cause to use those words in that order in a sentence before.
Now if the Feds could only give back the unfairly seized Liberty Dollar rounds that they took as "evidence" in Bernard von Nothaus's kangaroo court trial. They need to do two things: 1) redeem existing paper warehouse certificates for seized precious-metal rounds; 2) look over seized LD computers for "electronic" warehouse receipt records, so that those may be redeemed as well. Although I think it is a travesty of justice that the rounds were seized at all, not to mention kept by the Feds for so long (and, likely forfeited to them), I would be grudgingly accept the government making an honest effort to make LD owners whole with the rounds they legitimately owned, paying for the administration of that effort by selling off unclaimed rounds, and, if they must, keeping the rest. That would be a way of mitigating the injustice inherent in this sorry episode.

The "order" excludes joint task forces and joint federal-state actions. It also excludes federal subpoenas. So like every other loudly-trumpeted Eric Holder "directive," the fine print contradicts the headline and effectively changes nothing. These "exceptions" mean that equitable sharing has not ended.
