Cop T-Bones Passing Car, Driver Charged With DUI After Being Honest
Last February Joseph Quilles, a deputy sheriff with the Milwaukee Sheriff's Department, T-boned 25-year-old Tanya Weyker's car while he was turning at a stop sign, breaking her neck.
Cops who arrived at the scene started questioning Weyker about whether she had been drinking (she admitted to having a couple of sips from a friend's drink earlier in the day) and whether she was on prescription pills (she admitted being prescribed Vicodin after having her wisdom teeth pulled out but said she hadn't taken any in a week).
The injuries precluded Weyker from blowing a breathalyzer or taking a field sobriety test. One deputy said he could smell alcohol and that her speech was slurred and her eyes were red. Weyker explained she was crying. Results from a blood test came back less than a month after the crash and showed Weyker to have been sober. A few months later a drug test came back clean as well. Nevertheless it took nearly a year for prosecutors to decline to press charges, while the county spent the time sending letters to Weyker pressuring her to pay for the damage caused in the accident, for which the county blamed her.
Cops may have kept trying to pin the accident on Weyker despite the overwhelming evidence she was completely sober during the crash were it not for a video. But it didn't come from the dashcam. Fox 6 in Milwaukee explains:
In his official report, Deputy Quiles wrote that he stopped at the stop sign and looked both ways before pulling out. He told a Milwaukee police officer that he never saw any headlights, even though Weyker's Camry had lights that come on automatically.
"I knew I was innocent this whole time," Weyker declared.
The truth might never have surfaced were it not for video from a nearby airport surveillance camera. It shows what investigators say is Deputy Quiles' squad car traveling west on Hutsteiner Avenue, then continuing onto Howell without making a complete stop, as Quiles claimed in his report. The Sheriff's Office knew about the video just two days after the crash. But no one told Weyker.
After being informed that this video existed, Quilles admitted to internal affairs investigators that his original report was wrong and that he rolled through the stop sign. He was suspended for nine days for the traffic violations but has actually not returned to work since. He's maxed out injury pay and is seeking permanent disability from his injuries in the crash. Weyker, meanwhile, is still waiting for the county to pay her medical bills, which could pass $1 million. Wisconsin state law caps claims against government to $250,000, and Quilles reportedly eventually admitted fault in the crash. Weyker is also suing the deputy who arrested her.

Can an ordinary peasant get disability payments for injuries that they suffered while committing a crime? I doubt it, but this lying goon is going to get an early retirement for something mere peasants would go to jail for.
He was on duty at the time. There are never charges for what cops do while on duty. They might get charged for shit they pull while off duty, but it’s pretty much impossible for them to be charged for something they did while on the clock.
And the pig is filing for medical retirement for “injuries” suffered at the time of the accident. Despite the fact that he was treated on scene and released.

This reminds me of a very sad incident that occurred in Ohio circa 1999.
A trio of elderly women were in a car. They either rolled trhough a stop sign or started out without looking. Their car was T-Boned and destroyed by a truck carrying a full load. The women were killed instantly.
The truck driver was terribly despondent and blaming himself for the accident, even though every witness on record was adamant that he had no chance to stop or avoid them and that he had done nothing wrong.
The pastor at the driver’s church arranged to have relatives of the women go to a service, where they publicly and personally told the driver that they forgave him and they knew their mothers/aunts would not have wanted him to suffer. Apparently it made a big difference.
It’s an interesting contrast to the animals-in-human-skin that persecuted Miss Weyker.

I don’t understand how this is legal. Florida’s is even stranger. The State is the underwriter of other entities, who are capped at $100k. After that the Legislature must draft and approve a relief bill for the difference in settlement/jury awards.

What really gets me about cases like this is that it doesn’t fucking matter if she had been drinking. She could have been plastered off her ass and high as a kite and the accident is still the cop’s fault.

Exactly. If someone has been drinking and they are stopped at a red light, and are rear-ended, they are at fault and it’s an “alcohol related accident.”
Hell, if someone has been drinking and is walking home, and a speeder jumps the curb and runs him down on the sidewalk, it’s an “alcohol-related accident.”
What amazes me is that this doesn’t happen more often. Maybe it does. But these fucks can blatantly lie about this stuff and get away with it. Why wouldn’t they? It’s like the officers who get awards from MADD for the most DUI arrests and then turn out to be lying and framing people. Of course this is going to happen. Because they can.
It happens all the time. Especially because people accused of DUI don’t get public pretenders. If they don’t have five grand sitting around for an attorney, they’re as good as guilty. If they can afford an attorney, there’s a very good chance the prosecution will just fold rather than try the case.
Guilt or innocence in a DUI case is determined by how much money the accused has in the bank.

Not siding with Quiles at all but the deputy that arrested her did his job. This was an injury crash that requires investigation. Weyker stated she drank alcohol from a friend’s drink prior to operating a motor vehicle. She also admitted she utilizes a prescription narcotic. Based on those statements alone, the investigating deputy was correct in this procedure to determine the levels of these substances in her system which both, by themselves, cause impairment. Mixed together, will definitely impair one’s ability to operate anything. As an officer, he cannot determine those levels until the results come back from the labs. Upon finding there was insufficient levels to cause impairment, the case should be found improbable to try and charges dropped. The reason for the delays falls on the DA’s office which is ridiculous in this county to begin with? Suing the deputy whom arrested her for doing his job as part of this investigation is even more ludicrous. F’n lawyers? Good luck Weyker, and with all your negativity toward law-enforcement, I hope you never really need them? I’m sure they will just come running to help you?

Correct. But her only fault in all of this is telling the officer anything about her condition prior to this accident. 1 beer is not enough to intoxicate someone, and taking a prescription vicodin a week before would not cause her to be under the influence at the time of the accident.
If shitbag Quilles wants permanent disability, he’s better earn it via a massive beatdown by the victim’s family… broken back, neck, ribs, and as many bones as possible without killing him. The only reason to arrest her was if they assumed she was lying about the drinking and/or vicodin. By that reasoning, you can just arrest every victim of a car accident, just in case they didn’t tell you they were drunk or on drugs.

And, why, if he’s just one bad cop- should she expect to get anything but stellar civil servant service, if she does call? Because all you fat fucks stick together, you lie for each other, you cheat for each other and you have zero regard for the people of the civilian community. So, here’s a question-why is there no news service that will go to police departments/prosecutors around the country and ask police officials and D.A.s why the officers aren’t being criminally charged for wrong-doing?
I mean, I get that local news won’t in order to keep access (is that even still a thing?), but something on a national scale would presumably work.
Just flat out ask why charges aren’t being brought against officers who falsify/lie, assault, arrest under false pretenses, etc. Contrast it with questions like, “Wouldn’t a civilian be charged for doing the same thing? Why is the burden less for the officers?” Try to get officials on the record with any kind of answer. If they don’t, play up the fact that they were unwilling to answer.

For a national-level news outlet? I’m not saying it’s not correct, but…well, do most journalists fear retaliation from police? Plus, it seems likely that retaliation would be easy to spot and broadcast.
Don’t get me wrong-I’m not intentionally being obtuse with this. And, of course, there are the more confrontational people like Cop Watch that will kinda-sorta do what I’m talking about. But, I doubt they’d get anywhere based on their style.
Maybe a FOIA project across the nation that looks at all known reports like this one and compiles the data for what the outcome is on each involved officer…let other people ask the questions in an open setting (like HnR)…

In addition to what other people said, police departments are really good at giving non-answers when convenient. “Procedures were followed”, “ongoing investigation”, “privacy concerns”, shit like that.
You know what I don’t see? Any indication that the cop was tested for drugs or alcohol. Which is totally routine for any peasant involved in an injury accident. Not saying it didn’t happen, but I sure don’t see it.
Excellent point. Businesses that deal have vehicles (and are smart enough) usually do mandatory drug screens after accidents. I think this is especially true with train companies.

Ok, so lets say the cops story is true. Lets say that he stopped at the stop sign and she didnt. Lets say that this caused him to hit her.
We can already tell that this is nonsense. If he stopped, that would have been a very low speed collision that wouldnt have caused the massive damage to the side of her car. Even if she was going fast, it wouldnt have factored in to the damage on her car from his.
True. Also, it doesn’t say whether she had a stop sign. If not, the cop was responsible for the accident whether he stopped at the stop sign or not.
If I t-bone a passing car that is proceeding legally, it doesn’t matter whether I stopped at a stop sign or not.
