Modern policing! Public safety! No amount of snarky irony can prepare you for this tale of police idiocy in the name of the most minor and absurd of laws, reported in Daily Progress out of Virginia:
When a half-dozen men and a woman in street clothes closed in on University of Virginia student Elizabeth Daly, 20, she and two roommates panicked.

That led to Daly spending a night and an afternoon in the Albemarle-Charlottesville Regional Jail. Her initial offense? Walking to her car with bottled water, cookie dough and ice cream just purchased from the Harris Teeter in the Barracks Road Shopping Center for a sorority benefit fundraiser.
A group of state Alcoholic Beverage Control agents clad in plainclothes approached her, suspecting the blue carton of LaCroix sparkling water to be a 12-pack of beer. Police say one of the agents jumped on the hood of her car. She says one drew a gun. Unsure of who they were, Daly tried to flee the darkened parking lot.
"They were showing unidentifiable badges after they approached us, but we became frightened, as they were not in anything close to a uniform," she recalled Thursday in a written account of the April 11 incident.
"I couldn't put my windows down unless I started my car, and when I started my car they began yelling to not move the car, not to start the car. They began trying to break the windows. My roommates and I were … terrified," Daly stated.
The authorities agree with her tale, but, you know, she had pissed the cops off by then.
Charlottesville Commonwealth's Attorney Dave Chapman read Daly's account and said it was factually consistent.
Prosecutors say she apologized profusely when she realized who the agents were. But that wasn't good enough for ABC agents, who charged her with three felonies. Prosecutors withdrew those charges Thursday in Charlottesville General District Court, but Daly still can't understand why she sat in jail….
Agents charged Daly with two counts of assaulting a law enforcement officer and one count of eluding police, all Class 6 felonies carrying a maximum penalty of five years in prison and $2,500 in fines per offense….
Daly incurred the assault charges when she "grazed" two agents with her SUV, according to court records. She drove the SUV past the agents after her front-seat passenger, in a panic, yelled at Daly to "go, go, go" and climbed into the rear of the vehicle to gain space from the men on her side of the car, the records state…
Oh, the irony!
The women dialed 911 as they pulled out of the parking lot to report what was happening and ask whether the agents were police officers. Daly said she was planning to drive to a police station. She stopped the SUV nearby for an agent driving a vehicle with lights and sirens, Chapman said.

you know why they dropped the charges? because one does not lose one's right of self-defense against police use of force where the one exercising self-defense makes a reasonable mistake of fact (these are not cops).
there's no intent to assault a police officer or evade arrest, which MUST exist for these 'crimes'.
it's a false arrest, including on the assault / evading charges, if these officers did not adequately verbally tell her who they were.
According to the totality of the circumstances these brave OFFICERS were justified in responding with the APPROPRIATE level of force based on their department-wide use of force matrix, hth.

Has anyone ever done a study to compare firearm safety habits of warfighters vs. LEOs? Because the average age of a warfighter is much, much lower than that of the average LEO. If not, this study should be done, by Reason, NOW. (Not that either group would agree to participate.)

The thing that pisses me off the most about this is that they expect someone to be immediately compliant when a group of people who are not obviously police attack her in twilight. It's apparent the officer is just fed up like most officers are with people's smug, lack of respect, challenging, and narcissistic attitudes that are now the norm! However, cameras are now the norm and we must act professionally no matter what. Knowledge is power and I find it entertaining to use my knowledge and experience to ensure that the violator always leaves with an invitation to court. I also like to get my camera and record the citizens. It is fun to watch the citizen's reactions as I stick my camera in their face and record them. Most of the time they coward and just want to leave. But no matter what, I am always professional and I always win!

Police in the Eastern Bloc countries (Milicja in Poland) employed some sinister and inhuman tactics, but those were mostly targeted actions against people suspected of anti-state activity, and the officers did display a high level of professionalism and intellect. I've never seen the kind of unrestrained bravado and random intimidation that police here seem to display on a regular basis.
Another article posted here today talks about how the East German agency spying on its people thanks to hardware limitations could only tap 40 phone calls at one time.
Would it be a felony for me to suggest that the pigs who charged Daly with a felony for pissing them off when she responded reasonably to what looked like an attack by armed thugs ought to be beaten to death with lead pipes for being such self-important petty tyrants? The ABC is the poor man's DEA. I remember when I was in grad school at UVA (mid-seventies), the school had "Graduate Happy Hour" which featured free beer. The ABC objected, saying that it was illegal to imply that beer caused or increased happiness. So it was renamed "Graduate Drink Until You Can't Walk Hour".
So in this case we have a gang of plain clothes law enforcement types with nothing to do. Having nothing useful to do they grasped at a mental picture of criminal behavior that was in their heads; since law enforcement types spend almost all of their time thinking everyone is a criminal.

As an identified "public servant," you would think that denotes some type of respect for the daily sacrifices that officers go through to give this D.B. his freedom and keep him safe. The servant part does NOT denote bending over and taking it!

I can surmise with reasonable confidence through my own personal experience that our current situation is worse.
Police in the Eastern Bloc countries (Milicja in Poland) employed some sinister and inhuman tactics, but those were mostly targeted actions against people suspected of anti-state activity, and the officers did display a high level of professionalism and intellect. I've never seen the kind of unrestrained bravado and random intimidation that police here seem to display on a regular basis.
Another article posted here today talks about how the East German agency spying on its people thanks to hardware limitations could only tap 40 phone calls at one time.
This is why I eat my cookie dough and ice cream out of a paper bag when I'm in town.
Would it be a felony for me to suggest that the pigs who charged Daly with a felony for pissing them off when she responded reasonably to what looked like an attack by armed thugs ought to be beaten to death with lead pipes for being such self-important petty tyrants? Then I won't say it. That would be wrong (as Richard Nixon would say).
I'd settle for very long prison terms in fuck-you-up-the-ass prison. Let them try to deal with real threats without the protection of their badge or gun.

The ABC is the poor man's DEA. I remember when I was in grad school at UVA (mid-seventies), the school had "Graduate Happy Hour" which featured free beer. The ABC objected, saying that it was illegal to imply that beer caused or increased happiness. So it was renamed "Graduate Drink Until You Can't Walk Hour".
So in this case we have a gang of plain clothes law enforcement types with nothing to do. Having nothing useful to do they grasped at a mental picture of criminal behavior that was in their heads; since law enforcement types spend almost all of their time thinking everyone is a criminal.
This country really needs to defund the police state before it is too late.
