A False Remedy for Sex Offenders
Draconian laws offer counterfeit comfort.
At age 14, J.L. impregnated his girlfriend in a consensual encounter. This was bad news on several grounds, the worst being that she was 15 months younger. Convicted of rape for having sex with a 12-year-old, he will have to register as a sex offender—for the rest of his life.
Last month, the South Dakota Supreme Court upheld the verdict, while admitting it made little sense. "Application of the first-degree rape statute to the present facts does not create an unintended absurdity," the justices concluded. The absurdity must have been deliberate.
J.L. isn't the only person to be ensnared by ridiculous interpretations of laws affecting sex offenders. A Michigan man convicted in 1984 of rape was supposed to report his home address to police after getting out of prison in 2002. Being homeless, he tried to comply by providing the address of a homeless shelter where he got his meals.
Not good enough, said the Michigan Supreme Court a few weeks ago. It said he can be sent back to jail for failing to file the address of whatever spot he laid his head each night.
Sex offender registries once sounded like an urgent necessity. They came in reaction to publicized crimes in which children died at the hands of convicted sex offenders. One of the most shocking involved a 7-year-old New Jersey girl, Megan Kanka, who in 1994 was raped and strangled by a paroled child molester living across the street from her home.
New Jersey enacted "Megan's Law," subjecting sex offenders to registration and community notification, so police and citizens would be aware of known risks. Today, all 50 states maintain registries and make at least some of the information available to the public.
But this was a reasonable notion that has been damaged by indiscriminate expansion. It's one thing to notify neighbors when a serial rapist moves in. Many states, however, lump frisky teens in with violent adults. Others, reports Jacob Sullum in Reason magazine, include mopes who were caught trolling for prostitutes or urinating in public.
Some states also put broad curbs on where convicted sex offenders may live.
In Miami, many of them have taken up residence under a causeway for lack of an alternative. This outcome may not warrant sympathy, but it makes it harder for police and citizens to keep tabs on them.
Such flaws would be of minimal consequence if the laws served to prevent crime. The surprising revelation is they don't.
A 2008 report funded by the Justice Department found the original Megan's Law in New Jersey to be a non-event. The policy, researchers documented, "showed no demonstrable effect in reducing sexual re-offenses" and "has no effect on reducing the number of victims involved in sexual offenses." The zero effect had a cost above zero—nearly $4 million annually for the 15 counties included in the study.
A more comprehensive study was undertaken by Amanda Agan, a doctoral candidate in economics at the University of Chicago, and published recently in the Journal of Law and Economics. Analyzing data from across the country, she detected no tangible gains from this approach.
"Rates of sex offense do not decline after the introduction of a registry or public access to a registry via the Internet, nor do sex offenders appear to recidivate less when released into states with registries," she writes. Evidence from Washington, D.C. shows no connection between the number of sex offenders on a block and the rate of sex crimes.
That doesn't mean you and I are crazy to prefer knowing about the pedophile next door. But it suggests the information offers no actual benefit.
After all, most convicted sex offenders do not go on to be arrested for new sex offenses, and more than 90 percent of child victims are assaulted not by strangers but by relatives or other people they know.
Sex offender registries may cause parents to focus on the remote peril while ignoring the more pertinent one. And, as in the examples cited earlier, they can inflict harsh punishment that departs from common sense and does nothing for public safety.
Shielding citizens from vicious predators is unquestionably one of the central functions of any sound government. Megan's Laws were enacted in the sensible pursuit of that goal. What they offer in practice, though, is counterfeit comfort.

Criminal charges could have led the teens involved to be labeled as sex offenders, which would have serious consequences for them as adults trying to find jobs. "

That, of course, was the real intent of Megan's Law. Government officials, who may have wanted sex offenders put down like dogs but were afraid the ACLU might hear about it, decided to make the names and addresses of sex offenders public so as to goad viligantes into doing their dirty work for them.

You know, I really don't have any sympathy for sex offenders. None, nada, zip. Being the mom of a 3 year old and a 5 year old, I want to know when a sex offender moves into the neighborhood. Every couple of months I check the registry online for my area. It lists the crime committed. I have yet to see one that lists solicitation or pandering. They are all for crimes against children under the age of 14, rape, or sexual battery. Sorry, but someone who rapes another or someone who commits a sexual crime against a child should be ostracized and it should follow them through their lives. I don't believe a child sexual predator can be rehabilitated.

There was a case in Oregon where a 21 year old was arrested for sleeping with a 16 year old that he had met in a bar. She had a fake ID. she admitted to the judge that she lied about her age. her mother testified that she has a really bad habit of lying about her age to sleep with older guys. 21 year old sentenced to three years, and has to register as a sex offender everywhere he lives. He's not a rapist. He's not a predator. He's on that list.

No one is asking for shorter sentences etc. for those who can be PROVEN GUILTY. Those are the keywords here, "proven guilty". If se x offenses were tried the same as other crimes it wouldn't even be an issue. All someone has to do is point a finger and "say" someone did something. There is NO BURDEN OF PROOF, when it comes to someone being tried for a s e x offense. It is up to the accused to prove that they are innocent, or they are going to prison and on the registry. How do you prove you didn't do something that never happened? Get my drift? For example I know a young man who met and fell for a young lady when he was 17, she told him she was 16 and he was pretty naive and never questioned what she said. A year later the police were at his door and he was arrested. Turns out she wrote in her diary that they had sex. Mom found 14-year-old's diary and pressed charges. He took a plea bargain because he had no money for a lawyer. Short story, lifetime registry, no job, no school, no home, no future. Stories like this make up at least 20% of those on the registry that translates to hundreds of thousands of young lives ruined, permanently. He was a young man in love who never even touched the girl other than to hold hands or kiss. He was shy then, he stays completely away from women altogether now and pretty much distrusts everyone.
The registry, in order to be effective needs to be returned to its original purpose, to track dangerous offenders who are a threat to society. It was also originally for the eyes of law enforcement officials only. When it became a public registry, it became nothing more than a hit list for vigilantes. What earthly purpose does posting a persons license plate and vehicle description serve other than making that vehicle a target? They require the offender to register every vehicle that they "might possibly" ever ride in. That means that if the offender's wife or even a friend of the family uses that vehicle to drive their children to school, they are subject to any idiot who decides to "rid the earth of the scum". The "public" has proven without a doubt that it is incapable of handling a public registry. In effect, every time an offender is harassed, threatened, ostracized, injured or murdered, the registry is one step closer to being "scrapped"!

There have been cases where sex offenders were let out if they volunteer to be chemically castrated. Might sound harsh and unconstitutional, but in reality is a much better outcome then having to die after being in jail for 60 years.

As with so many other structures intended to protect the public, the sex offender registries lack common sense. As a parent I can search the registry, I can see the sex offenders living near me. I can check on the age of the offender and the level of the crime committed. I can use my best judgment to know who I should be worried about...but I cannot watch my children 24 hours a day. I cannot control whether a sex offender walks past my house. What I CAN do is take steps to educate my children on exactly what they should do if an adult tries to take them from our back yard or the school sidewalk against their will. I can teach them to protect their information online when they're old enough to be playing on the internet. I can make sure I don't let them play in the front yard if I'm back in the barn and can't reasonably see or hear them. There are all kinds of steps I can take.

I can see the point of these registries if they were confined to real no shit sex crimes and were only there for informational purposes. If you start dating a guy and you have kids, I could see where you might want to know that he is a convicted child molester. I think there is a logical and systematic way to determine who is very likely a threat. Pedophiles who go so far as to be caught molesting a child have a very high recidivism rate. Even those who have received medical or surgical remedy still report a struggle not to act out because the impulse to do so is as much mental as it is physical. Therefore, any sexual predator who has indeed taken the step of physically acting out against a child has an extremely high probability of doing so again unless prevented.
My SO disagrees with high penalties, though, as he believes that higher penalties increase the chances that a molester will kidnap and kill to avoid being caught rather than just molest and release. Personally, I believe in the one-bullet remedy.

I think kidnapping and violating and murdering a five year old is worse. It happened in my community last year. The family of the victim imarginally knew who the sick puppet was, so it could make one side or the other of the know/don't know argument.
More importantly, a child has a right to their childhood, and though it may be hard to conceive of in our new, Reasonable state, that does not include sexual activity beyond that which normally occurs in their development, and NO FUCKING ADULTS!
The law has come to lack common sense, but still it is worth it to try and fix the registry to remove the naughty and keep the lice. While it would be better to tie a millstone around their neck and toss them in the sea, at least we should allow the unReasonable keep track of these human fleas, given their unenlightened desire to make sure their kids are not molested by strangers as well as family members.
The BIG problem with that issue is that most child molestations and rape occur in the home by family members or friends of the family, just how does that justify keeping track of 800,000 strangers prevent that? I was a victim of my own father for years and many of my friends were also victims of their own family members. Thousands of children continue to be molested in their own homes on a daily basis and NOTHING is done to help them. Something is SO WRONG with this picture. Stranger Danger is one of the biggest myths in the U.S. today.

I thought the whole rationale behind sex registries was that sex offenders were subhuman deviate monsters who cannot control their urges and inevitably repeat their crimes 100+% of the time. Seriously, that was the argument behind Megan's Law in the first place.
If that is not the case, why are sex offenders any different from other criminals. Why do we not have a violence registry for those who commit assault. A money registry for those who commit fraud? A shoplifter registry so supermarkets can be warned about shoplifters in the neighborhood?

A few states have had the brilliant idea of registries for methamphetamine offenders (though I don't think it ever went anywhere). Which is very handy if you are looking to cook up a batch of meth and want to talk to an expert about it.

I happen to know a dude in Kansas (no, it's not me, really! LOL) who did about 3.5 years hard time for unlawful possession of pseudo. On release, he was required to register every 4 months as a (whatever level it is) offender.
Long story short, he got "evicted" from a house he was renting from a friend, when the friend got the chance to sell. This happened right around the time he was due for registration. Since he didn't have a new address yet, he put his last known address down on the form.
Sheriff's office found out, he was put on the County's "most-wanted" list, and now the DA is trying to nail him for failing to register. Possible penalty, 55 months. Longer than he spent for the original offense.
His lawyer is working on a defense theory based on constitutional grounds.
AFAIK, every state has some form of this, although penalties vary wildly.
But sex is different, and in spite of the studies that have shown many forms of sexual abuse to be much less harmful than most other crimes, we just feel that it's terribly, horrifically worse.
The low recidivism rate is just proof that sex offenders are going to do it again, because they take so much care not to be caught and to leave no evidence behind.

Yes, people who shouldn't be on the sex offender registry are on the registry. Justice is imperfect and needs correction at times.
This ignores the fact that 90+ percent of the people on the list are guilty as hell and will offend again. Draconian laws are in place, because a flawed legal system doesn't allow us to simply execute the real offenders and be done with it.

Complainants lie, children are manipulated by vindictive spouses, juries convict on the word of a child alone, and the innocent are terrified into taking pleas. As for the guilty--the question is, guilty of what? Most are not child molesters. The Economist found "at least five states require registration for people who visit prostitutes, 29 require it for consensual sex between young teenagers and 32 require it for indecent exposure. Some prosecutors are prosecuting teenagers for the 'distributing child pornography' called 'sexting' via their cell phones."
