Life for Half an Ounce of Medical Marijuana?
A Texas state trooper stops a 1990 Mercedes with an expired registration sticker. The driver says he does not have his driver's license or proof of insurance. After arresting him for "failure to identify," the trooper searches him and his car, finding 14 grams (half an ounce) of marijuana and hashish. Indicted for possession with intent to deliver, he could be sent to prison for the rest of his life.
Does it matter that the defendant is a 20-year-old asthmatic who obtained the cannabis with a doctor's recommendation in California? Not under Texas law, which prohibits the use of marijuana for any purpose. And the situation in which Chris Diaz finds himself would be outrageous even without the medical angle. Senior Trooper Sparky Dean explains how a routine traffic stop turned into a potential life sentence:
The car had an expired registration. That could have been a citation and sent him [Diaz] down the road. He had no license or proof of insurance. Again, that could have been a citation. He had two ounces of marijuana, and that could have been a citation. But he had a controlled substance and he wouldn't identify himself. [Trooper] Martin [Molotsky] had to arrest him.
Seriously? No matter what your view of the war on drugs, the leap from citable offense to first-degree felony is hard to fathom, let alone justify. In Texas, according to Dean, half an ounce of marijuana can get you anything from a ticket to life in prison, depending on factors that have nothing to do with the moral gravity of the offense. Although Diaz's cannabis was still in the bottles used by the medical marijuana dispensary where he obtained it, Brown County prosecutors cite a cell phone "containing text messages referring to drug sales" and a notebook with "drug and law writings" as evidence of intent to deliver. They put the retail value of the cannabis at $2,400, or $171 per gram—more than 10 times the hash prices reported at 420 Magazine and Grass City. Diaz has been held in the Brown County Jail since June 27, with bail set at $40,000.

Addendum: Texas law puts hashish ("resinous extractives of Cannabis") in Penalty Group 2, making possession of four to 400 grams with intent to deliver a first-degree felony, which carries a possible life sentence. Mere possession of four to 400 grams is a second-degree felony with a maximum sentence of 20 years. By contrast, the maximum penalty for delivering a quarter ounce to five pounds of marijuana is two years, while merely possessing two ounces or less is a Class B misdemeanor with a maximum penalty of three months in jail. So according to the state of Texas, cannabis resin is 50 to 80 times as bad as cannabis buds, even though its THC content is 20 times higher at most. That's comparing crappy marijuana to high-quality hash. If you compare high-quality marijuana to crappy hash, the difference in THC content can be small to nonexistent. But in Texas it still can be the difference between a slap on the wrist and a long prison term.

A wise friend once told me: never break more than one law at a time. Another friend, who I told that to, learned the truth of it after being stopped for speeding with pot in the car. This guy's an idiot, but of course he doesn't deserve this.
Reading through the links, it appears that this guy has some mental issues. He's refusing to communicate with his lawyer even - not too bright when facing this kind of trouble. It looks like providing proper identification and working with his lawyer could have made most of this mess go away at any time. He's probably dug himself in deep enough that even if he decides to mount a proper defense at some point he's still going to be boned.
I wonder if he's just some random paranoid case, or if he's trying to create a test case on intra-state medical marijuana. Either way, he's nuts...
Plus, if you want to beat a specious felony drug dealer wrap, it is best not to wear your "I'm a drug dealer" facial hair and coiffure to court...
At this point a clever defense attorney might just get him tagged as "unfit to stand trial" and just call this whole thing a mulligan.

Contrary to what Trooper Dean says, marijuana possession is not a citable offence in Texas. The minimum charge is a Class B misdemeanor punishable by a $2000 fine, confinement in jail not to exceed 180 days, or both. Plus, it's common practice to arrest drivers for traffic violations if they have no means to identify themselves. However, I am surprised that he was charged with intent to deliver as opposed to possession. I live and work in Harris County (the largest county in Texas) and the DA's office never takes intent to deliver on anything less than several pounds of marijuana.

I get your point, but having multiple containers is usually an indicator that one is selling, or being a middleman of sorts. It is something that will get you arrested on distribution and the cops will let the jury figure it out.

Suspecting that I was old and out of date, I did a little googling. It turns out that I was right - I am out of date. And old. A dime bag is just a reference to $10 worth of weed. It is mainly used to refer to swagg or low grade weed, which amounts to around 7.5 grams. It is not typically used for dro, which would be about 0.5 grams, considering a 20 is a gram. This is of course in Texas, prices vary by location 😛
Back in the old days when we HAD dime bags, it was the price that was being referred to, not the quantity. Back then, an ounce of fairly decent stuff was $40, so a dime bag would have been 1/4 OZ. Now, in Colorado, at least, $40 seems to be the going rate for 1/8 OZ, which is just ridiculous.

Ohhh yeah. 10 bucks a gram is still sort of the baseline standard for decent stuff. The most I've ever been charged was 20 bucks a gram, and that was for some headiest-of-heady shit. If you're paying more than 170 bucks a gram you're not buying weed.

I read the information about marijuana for asthma treatment, but it really does seem that the doctor who prescribed it is to blame for creating this situation.
All the (dubious) asthma benefits of pot can be achieved with the legal drug of Marinol, with none of the respiratory distress that comes from smoking. Another benefit--you can't be arrested for carrying prescribed Marinol.
Wrong, wrong, wrong. Marinol is synthetic THC, and THC only. Marijuana has dozens of cannabinoids, of which THC is only one.
This doesn't even address important medical variables like delivery method. Something tells me digesting a pill might be a bit slow-acting when we're talking about asthma relief. It's ok sir, you'll be able to breathe again in 45-60 minutes. Maybe. But they will be legal breaths.

First of all, no -- no doctors are allowed to "prescribe" marijuana for anything, as a prescription is defined technically by the FDA which does not recognize marijuana as valid treatment for anything. So they don't prescribe cannabis even in medical states -- they "recommend" it.
Also, it's not as silly as it may seem. Cannabis is a bronchial dialator. Move from smoking to vaporization, and it becomes a pretty damn safe and effective treatment.

You know, this case is outrageous. There's no arguing that. But at some point, when this entire country is in a very contentious place in the realm of legal marijuana -- ie, it's pretty much illegal everywhere-- at some point, the users of "medical" marijuana who are acquiring it in places where it is legal need to pull their head out and realize this.
For instance, Canada takes a dim view of gun ownership. That's why I don't travel with my perfectly above board and legal firearms when I enter Canada.
It's why I wouldn't try to buy or sell heroin when on a tourist stop in Turkey.
This case has the potential to be a real travesty of justice. But fuck... if you by medical marijuana in California, where even there its legality is dubious, don't travel with it through fucking Texas with expired plates, no proof of insurance and no drivers license.

If the prosecutors of the small towns within these states say things like "This is a small town, everyone knows everyone else, if we had bad cops, we'd know it" avoid these places altogether.

It will carve the guts out of the drug gangs, get the drug cartels out of our communities, put an end to most of the border violence, and reduce illegal immigration.
As the discussion goes forward, I've asked myself, "If my child or grandchild got a little off track and got caught with a little marijuana, would I want him or her to go to jail, lose their college financial aid, spend a few days locked up with the sexual predators...?" Remember, we can't have it both ways. We can't talk about how Marijuana has no seriously addictive properties and no albatross of violent subculture, and then make ourselves believe that legalization will stop "drug violence" dead in its tracks.

And to be clear, when I say this, it will have an impact on crime statistice in that people won't be incarcerated for legally possessing marijuana. But it won't have a negligible impact on acts of crime such as burglary, strong arm robbery, murder, shootings etc.

For the record, government estimates put the marijuana-generated revenue for Mexican cartels at around 60% of their total take. It's a bit hard to argue that removing nearly two thirds of their revenue stream won't have a deleterious effect on these organizations.
Will it make crime disappear overnight? No. But taking away a huge chunk of the money empowering deadly cartels can't be a bad thing for crime either.

It makes sense really -- it's a question of demand. The simple fact is that way, way more people smoke pot than use all other illicit drugs combined. The stunning thing to me is that these days we produce just as much domestically as we smuggle in from Mexico -- and again, that portion from Mexico accounts for 60%, by dollar value, of the narcotics smuggling activity. Gives an indication for exactly how big this market is.
Makes you wonder how much revenue reduction the cartel's have seen with California's ersatz legalization.

The medical laws are pretty shady on the supply side, so they've been able to absorb a lot of it I think. Shit, they're all up in the national forests out there growing crops, so they must be moving something.
That's actually going to be critical with Prop 19 -- some municipalities are going to need to step up and allow a supply side of the market. The market is too big for home grows to suffice.
However, consider it's easier to traffic marijuana for a number of reasons and more people want it than the other stuff. Perhaps the numbers aren't that hard to believe taking that into consideration. Also, remember that marijuana won't be legal in other states just because it may become legal in ours.

Yeah that's what I was saying earlier about the demand -- although I don't really see how it's physically easier to carry. Ever seen a kilo of weed? It takes up a lot of physical space, even when they brick it to shit.
Also, remember that marijuana won't be legal in other states just because it may become legal in ours.

Since it seems that it's the latter, not the former, he should be prosecuted for Stupid in the First Degree, but his sentence should be reduced to time served.

Fortunately, now every pot arrest will drain enough resources to have one cop fired. Are they enforcing any pot laws in Oakland now that they are gutting the numbers of police.
Most cops aren't the smartest tacks in the box which is why most become cops. But they are not so dumb that they all will soon figure out that every vegetable violator they lock up gets one of them fired off the force. Better to have another donut and look the other way.

This sort of stupidity at the hands of our legal system is not peculiar to Texas. You can have your life destroyed by a pack of incompetent lawyers and judges in Clark county, Washington for something you didn't do. The whole thing is getting completely out of control. It happened to me. Completely clean record driving and criminal but that didn't get in their way, they wanted a conviction and they didn't care how they got it. Didn't have the money for a "real" lawyer so I couldn't buy my way out. The crime? Putting a $50 scuff mark on the rear bumper of a ten year old car driven by some lunatic who didn't care for my use of the horn when she cut me off. Yessir! That's justice. F**k the system!

Look...no part of this puzzle was right for this guy. I live in Brown County, I know the law enforcement very well. This is nothing new. With weed being a minor part of the drug problems in the region, they take ALL of these law violations seriously. This area has HUGE drug raids every few months, and they are mainly targeted towards the really bad stuff like meth.
Now, rather it should be legal or not is not even a debate in this case. The fact remains, he broke the law in this state. If he had been caught in any other state, besides California, I am sure the result would have been the same.
As for this specific case, in my opinion, all this publicity is only going to make it worse for him! With a bigger spot light on this case, they(sheriffs office) are going to watch all their P's and Q's and probably the court will make sure he is made an example of. The worst thing that happened in this case is when all his "supporters" started showing up and making noise.

If the cops would have responded maybe these idiot's might have been caught! Instead they waited 7 days to even contact her! Walmart had the video with the thieves face's and license plates clearly visible! Here's the kicker! These guys had raped a girl in Clovis New Mexico, stole a vehicle and drove it threw the town my grandmother lived in. They needed gas and supplies so they stole my grandmothers card went on a shopping spree at her expense . got caught on camera and still was able to leave town and drive another 100 miles before they ditched the car and supposedly stole another one! My grandmother is 80 years old! If anyone need's someone to protect and serve its her! Instead the cops even with the video were not able to catch these guys. Instead they were too busy with the case of Chris Diaz being arrested for 14 grams of cannabis concentrate! Which would you rather have on the street? I've lived in Texas my whole life and yes it's still back woods in most counties, However we are working on turning this around. I am a bible thumping gun totting redneck that beleives Marijuana should be decriminalized especial in medicinal purposes as I myself am a medicinal user, and recreational. The legal use of cannabis on medical grounds is a wonderful idea and something that is still to be implemented in the UK due to the excessive cost. I think a bottle of the drug costs around $21 in the US and $189 for the equivalent in the UK!
