Josh Blackman: Sam Alito, Roe v. Wade, and Libertarians
Does returning decisions about abortion to the states increase liberty or shrink it?

The leaked draft of a Supreme Court opinion by Associate Justice Samuel Alito overturning Roe v. Wade (1973) and Planned Parenthood v. Casey (1992) has sent shock waves throughout America, with pro-choice and pro-life advocates scrambling to figure out what happens next if the right to an abortion is withdrawn at the federal level. "Roe was egregiously wrong from the start," wrote Alito in February. "We hold that Roe and Casey must be overruled."
While there's no question whether the document is authentic (Chief Justice John Roberts says it is), many questions remain. First and foremost among them: Does the draft, written up in response to Dobbs v. Jackson Women's Health Organization, a case challenging Mississippi's ban on abortions after 15 weeks, represent the current thinking of the Court's majority? We won't know for sure until a ruling is released sometime before the end of June.
What's the best way to think about abortion rights, Roe v. Wade, and Alito's arguments from a libertarian perspective? I spoke with constitutional scholar Josh Blackman, a professor at South Texas College of Law Houston, an adjunct scholar at the Cato Institute, and a blogger at The Volokh Conspiracy. Blackman is an unabashed admirer of Alito's draft, writing that it "meticulously dissects, and forcefully responds to, every conceivable position in favor of retaining Roe and Casey."
I'm not convinced about that at all and, in a wide-ranging conversation about the history of abortion and "fundamental rights," the changing nature of the Supreme Court, federalism, and partisan politics, we go deep on whether returning decisions about abortion to the states will increase or decrease individual liberty. This is an important discussion about a topic that will likely dominate politics for months to come.

What people don't seem to be able to accept is that the First Amendment doesn't only protect speech that is true. It protects speech, with a small number of exceptions, regardless of source, viewpoint, accuracy, or motivation of the speaker.
The First Amendment and free speech have been broadened by partisans to claim that it applies to private companies as well as the government. That is a debate that will continue to rage on as long as grievance politics exists (so forever). But it is indisputable that the government cannot limit free speech due to accuracy. Nor for most other reasons, for that matter.

In the sense that it allows democratic involvement in deciding the rules rather than edicts from unelected priesthood, it is an increase in overall liberty. Will the rules, as written and implemented, increase individual liberty? It will depend, usually on locale, which people are free to leave. So, generally, I think it will increase it there as well.
The secondary effects, though, is it will accelerate the Red / Blue sorting. That may not be ideal.

Do laws against killing other humans increase liberty or decrease it?
Not allowing one human to kill another is surely a decrease in liberty for the human desiring to kill. On the other hand, being killed is arguably greater decrease in liberty for his potential victim, as all the victim's choices are foreclosed. The only way making killing illegal is a decrease in liberty is if you assign no value to the victim's loss.

The beginning, not the end. More than 50% of zygotes never become humans. You have to get much further into the process (at the bare minimum 20 weeks, the earliest a premature baby has survived outside the womb) before there is more than a 0% chance of becoming an actual human being.
The lie anti-abortionists tell is that abortion is the only thing stopping a zygote from becoming a baby. In fact, there are a myriad of other reasons for a zygote not ending up as a living, breathing human being.
If you want to have a discussion about when a fetus becomes a viable human and what that means for abortion restrictions, great. If you want to claim your personal belief, based in mysticism and propaganda, is a universal, indisputable truth, you are choosing to be a dishonest person.

While it may be acceptable to look at the way Justice Alito crafted his draft to reverse Roe, it not acceptable to dismiss the consequences of this action. First it undermines the courts because a number of the justices stated that Roe was settled law, it was a strong decision 7 to 2, it had survived challenges and been reaffirmed and now that there are five votes for reversal it is unsettled. It also could thrust this country into a great social experiment where a right for 50 years is suddenly erased.
