Graham Linehan's Speech Must Be Defended

The Irish comedian's arrest by British authorities is an outrage.

Graham Linehan is an Irish comedian, former television writer—he's well-known for creating the sitcoms Father Ted and The IT Crowd—and militant opponent of transgender activism. He was previously banned on Twitter for his strident anti-trans commentary but returned to the platform after Elon Musk acquired it and made the moderation standards more permissive. He openly admits that his involvement in the transgender debate has "consumed my life": He says the backlash to his own activism has led to loss of job opportunities, ruined him financially, and even played a role in ending his marriage.

That's all very sad for him, of course. But people aren't entitled to an audience, or to company in general. If, as a result of Linehan's comedy or political views, nobody wants to hire or be around him, well, them's the breaks.

Linehan does, however, have the right to say such things. Or at least, he ought to have that right. Unfortunately, British authorities arrested and detained Linehan when he arrived in London earlier this week.

At issue were three posts he wrote on X, including one in which he wrote this: "If a trans-identified male is in a female-only space, he is committing a violent, abusive act. Make a scene, call the cops, and if all else fails, punch him in the balls."

Such a statement is almost certainly protected by the First Amendment. For speech to lose First Amendment protection, it must include a call to imminent lawless action or violence against a particular person. That's not what Linehan is doing; he's telling a crude joke based on his conviction that if you lack the relevant genitalia, you are a man rather than a woman. If this sort of speech were unprotected, then similarly charged calls to, for instance, punch nazis—a staple of far-left rhetoric—could also be criminalized.

The U.K. does not have the First Amendment, however. In Britain, the authorities have broadly criminalized threatening, insulting, and abusive language that causes harassment. Linehan's X posts may very well violate the relevant laws: the Communications Act of 2003 and the Online Safety Act of 2023.

And that's a bad thing, as Linehan's case clearly demonstrates. He possesses views on this subject—that trans women are not women and should steer clear of women-only spaces—that are strongly held by millions of people. He ought to be able to make his case, using crude humor and provocative language as he pleases. This is almost a textbook example of how even small and reasonable-sounding exceptions to an overall free speech–maximalist position will end up creating openings for political censorship: Hate is subjective, and when the government has the power to criminalize it, the authorities will almost certainly do so in broad strokes.

U.S. Vice President J.D. Vance recently criticized British Prime Minister Keir Starmer for the U.K.'s more draconian speech policies, as well as European regulators' penchant for pressuring American social media companies to engage in censorship. One can absolutely point to Vance's hypocrisy here—the Trump administration is violating free speech in numerous ways—while still agreeing with his overall point: Europe and the U.K. are too fond of censorship.

In the meantime, the police released Linehan on the condition that he cease posting to X. This is outrageous, and it's heartening to see his treatment attract widespread derision.

    The posts were apparently made while he was in the USA, and Linehan is an Irish citizen, not a UK subject. The UK is therefore asserting that posts made in other countries by non-UK nationals can be criminal under UK law. Anyone who visits the UK from a free country can be subject to arrest under these laws.

    That is not merely a conviction, that is definitional as regards to the words "man" and "woman".

      English also does not have a language regulatory body. That is close to unique among world languages. If you want to change the meaning of a word and most of the English speaking world agrees, it happens.

    Huh, I was waiting on tenterhooks for Reason to cover this story. They're usually slower and later than this, but I have to hand it to them, they caught on a little quicker.

    For the rest of us who are attuned to this free speech thing (I get it, it's not really a libertarian principle any more), we've been on this case for about a week. Anyhoo, good on you Reason, and I'm not surprised it's Reason's recently-out-of-the-closet conservative who covered it.

    Yes, them's the breaks, but this again is a case of Soave and Reason missing the point. It's one thing to point out someone who's remarkably awful for being ostracized out of polite society because he or xe says something that's so far outside the cultural norms that they might lose a job or miss out on financial opportunities. One of the ticks of the free speech movement is to point to awful things that people say and then defend them on principle. However, in Linehan's case, what he said was 100% sane, 100% scientifically correct, 100% normal, and even 100% within the Geneva Convention as a matter of cold fact.

    When someone says, "men shouldn't be in women's prisons" that is quoting the Geneva convention. Linehan also didn't think that men should be admitted into a women's rape crisis center. What happened to Linehan was complete and utter financial ruin based on an utterly sane and widely held belief. Robby's take on this is like watching someone get beating by a brownshirt mob and saying, "Well, he said something in defense of the Jews and they're not super popular right now... so social pressure is going to come to bear..."

    While it was certainly his industry's right to collectively banish him from ever working again in England, it should be a cultural bellwether indicating something might be off.

    And on this: "consumed my life"

    Yes, it's a case of the guy with defensive knife wounds all over his arms becoming obsessed with the fact that he said something in passing as a left-liberal who lived way outside the culture war space, and... after getting viciously attacked for it, losing his entire career, has become entirely focused on the attackers and stupid religious sky-daddy belief they have about trans people.

    And I haven't even gotten to the tweets that got him arrested, I've only vaguely referred to the things that happened long before Nick Gillespie was swiveling his hips and celebrating "promethean transformations".

      Now, as for the tweets, there was only one that even hinted at any violence and even at that, based on US law, that wouldn't get anywhere near a 'true threat' or 'incitement'. Putting aside the gobsmackingly ridiculous circumstances of being arrested by five armed officers in a country that doesn't even arm your police should tell you all you need to know about priorities-- especially in a country that literally has allowed violent firebrand Hamas terrorists to live in council housing on the taxpayer dime-- because zero cost propositions and all that.

      The other issue, of course, is he's not a UK citizen, he's a citizen of Ireland, so just as Nigel Farage pointed out, if you were a citizen of the U.S. and made a mean tweet about guys forcing their way into women's washrooms, you could and likely would be subject to arrest if you landed on UK soil. To repeat myself, you can continuously shrug about people losing their jobs and being ruined financially over culture war slap fights, but when all the fights and consequences go in one direction, and one direction only, that's your moment to stop and think, "This might not stop here".

        Now we are seeing the same thing happen with Democrats in NYC, endorsing Mamdani, who is every bit as bad as Trump. I live in the Bronx and the Bronx Democratic Party just endorsed him earlier this week. The Bronx Borough President skipped the announcement, and (probably after some pressure) basically apologized for that. I went back on Facebook for the purpose of posting a comment that I did not endorse Mamdani and will not vote for him. I may be blackballed from any leadership position for a while, which is fine with me.

      It's a reflex. Reason editors can't wrap their heads around the possibility that on a given issue, one side might be significantly better than the other.

      As to JD Vance's alleged hypocrisy, that's an immigration issue, not a speech issue. Robby actually (unwittingly) touches on why: "But people aren't entitled to an audience, or to company in general." They're also not entitled to stay in a foreign country. Mahmoud Khalil is a Syrian, not an American citizen. That doesn't alter his free speech rights, but when you're a guest, your host can kick you out if he thinks you're being an a**hole.

          Where is it stated as law that a resident alien here on a student visa or even with a green card cannot be deported without "due process"? He is not just "objecting to the government's foreign policy", he is an activist for Hamas, and organizes anti-Israeli activities while he is supposedly here as a student, theoretically studying for some academic achievement. As such, it is not unreasonable to expect him to focus on his school work, not political activities that intimidate populations in the US that are regarded as illegitimate by that student's home country, He is still a guest here and does not have the same rights as a citizen, which I hope he never becomes.

          Khalil is not being deported due to, for example, saying mean things about Trump. This is covered under current law. See: https://www.uscis.gov/laws-and-policy/other-resources/terrorism-related-inadmissibility-grounds-trig .

          Specifically, he's supported Hamas quite openly. This falls under "Endorsed or espoused terrorist activity" (item 5 on the list) in the link. Hamas has been designated as a terrorist organization since 1997. Any non-citizen supporting Hamas (or ISIS or the IRGC or (snerk) the Moro Islamic Liberation Front)) can be deported on that basis alone, and should be.

    The UK is way past saving. This isn't the first time they've done this, its been going on for 20 decades now. Their own government says - like Reason likes - that illegal immigrants deserve greater protection by government than citizens. Not even equal protection but *greater*.

    Its the same on the continent.

    This is the globalized future Reason wants. A permanent underclass that can be exploited for local labor and cheap goods from overseas without any questions about how the people who make them are treated.

    Hence why we get articles about this and not about Uighurs.

    Well, golly, gee, we now have someone at the magazine formerly appropriately styled "Reason" appreciative of a classic liberal value! Who'd 'a thunk, when all y'all have sucked the teat of "Orange Man BAD" dry, and degenerated largely into tediousness (anyone besides me noticed the homophonic relation between "TDS" and "tedious?").

    Still, there was a time this publication could be counted on to include such specifics as the cancellation by "activism" of the planned West End "Father Ted" musical stage production, and the British head of police pleading that his men not be required to perform such humiliating "duties."

    Even more certainly to point up the hypocrisy of allowing such "protest displays" as banners crying, "Decapitate All TERFs!" paired with an actual guillotine, to parade at liberty, while sending 5 officers to arrest a prominent comedian for "mean tweets."

    Reason has come a long way, baby, to the current low level.

    Thanks for a tossing a fishbone to true liberal values, young'un.

    nobody wants to hire or be around him, well, them's the breaks.

    It's not a case of not wanting to be around him because of those views. It's a case of not wanting to be around him because the government and powerful media will destroy them for associating with the man who they have declared to be apsostate. The threat of persecution is a VERY heavy thumb on the scale, here. This is not a fair marketplace of ideas, and if it was there's no way a man with such success, so celebrated until a decade ago, would have "nobody" wanting to associate with him.

    A libertarian writer should know the difference between the ideal market axiom and reality. Otherwise, why the fuck are you getting paid to write? This isn't spherical chickens in a vacuum, it's a heavily affected marketplace where even extremely loose association with the "wrong" idea -- or anyone saying it -- will unleash hell on your life. "Them's the breaks" is bullshit, and a willful misunderstanding. Willful. This dude's not THAT stupid.

      It is like Soave going in for the "it is private company" for social media moderation but bitching heavily when a "The Hill" video ran afoul of YouTube policy because it touched on sensitive subject matter whinging "but we are real journalists!"

        MAGA? I am pretty sure you enjoyed your time on the band wagon attempting to punch down on people calling them deplorable, nazi, racist, a threat to democracy, unvaccinated murderers, uneducated stupid.

        But worse, you supported the government, banks, insurance companies and woke corporations downgrading anyone considered conservative, burying them, their posts, and attacking them financially under everyone's noses.
