Nearly 200 School Districts Are Suing Social Media Platforms

Plus: court strikes down Arizona law against filming cops, GOP candidates want to cut Social Security for young people, and more...

Lawyers seek to cash in on tech panic by enlisting school districts to sue. The number of school districts suing social media companies for allegedly harming children is multiplying quickly. "Nearly 200 school districts so far have joined the litigation against the parent companies of Facebook, TikTok, Snapchat and YouTube," reports The Wall Street Journal. "The suits have been consolidated in the U.S. District Court in Oakland, Calif., along with hundreds of suits by families alleging harms to their children from social media."

The lawsuits come as part of a growing movement to childproof the internet. In Congress and in states across the country, lawmakers are proposing measures to make websites verify visitor ages, block minors from having accounts, and more.

But the school district lawsuits also represent a novel strategy in the war on social media.

So far, this war has largely taken the form of state prosecutors and federal agencies suing tech companies, alleging antitrust violations. Or it's come in the form of (unconstitutional) laws restricting editorial discretion exercised by social media platforms.

We've also seen civil lawsuits filed by individuals and families who say social media companies contributed to terrorist attacks, sex trafficking ventures, or kids and teens engaging in risky behavior; most of these have been thrown out because Section 230 immunizes platforms against civil suits based on third-party speech. School districts suing, however, is relatively new.

"School districts say teachers and administrators waste valuable time responding to cyberbullying and other disciplinary problems, adding new training and school policies around social-media use, and counseling youths whose addiction to online apps is leading to anxiety, depression or suicidal thoughts," reports the Journal.

The schools' reasoning seems flimsy. Evidence that social media causes widespread mental health issues in minors is scarce. Bullying among teens is an issue with or without social media. And—like it or not—responding to behavioral, mental health, and interpersonal issues among students is simply part of running an educational institution. School administrators might like some special payout from tech companies to help them do their jobs, but there's no real practical, moral, or legal justification for granting this.

The schools argue that Section 230 doesn't apply here because "social-media companies have created an addictive product that pushes destructive content to youth—and that a product, unlike content, doesn't enjoy Section 230 protections," notes the Journal.

This is just the latest version of an argument that's been made in courts many times: that it's the way social media companies are set up—their product design, their functionality, their algorithms, etc.—that causes harm, not the third-party speech they transmit per se. But this argument doesn't pass the common sense test: if the underlying content is not an issue—if it's speech that is perfectly benign and unlikely to trigger any ill feelings or fixating or "addiction" in teens—then how can the way it's being presented be an issue?

It's also an argument that doesn't pass legal muster, with judge after judge throwing out lawsuits that try to circumvent Section 230 by saying their claims are about product design or functionality and not speech. The tech companies are correct when they wrote in a joint brief last month that "the alleged defects" in their products "are inescapably linked to the publication of third-party content."

Each new trend in civil suits against tech companies seems driven by enterprising lawyers seeking a payout. And, as the Journal article makes clear, this one is no exception:

"Plaintiffs' lawyers are pitching school boards throughout the country to file lawsuits against social-media companies on allegations that their apps cause classroom disciplinary problems and mental-health issues, diverting resources from education," notes the Journal. "William Shinoff, a lawyer with California firm Frantz Law Group, said he has personally presented to more than 100 board meetings and that his firm has 500 school districts signed up to sue. … His firm and others typically sign agreements giving the lawyers 25% of any recovery."

A federal court has struck down an Arizona law that limited the filming of cops. The rule in question—signed into law by former Gov. Doug Ducey last year—made it illegal to film police officers from a distance of 8 feet or closer if the police told the person filming to stop. U.S. District Judge John J. Tuchi temporarily halted enforcement of the law in a ruling last year. On Friday, he permanently blocked its enforcement. "The law prohibits or chills a substantial amount of First Amendment protected activity and is unnecessary to prevent interference with police officers given other Arizona laws in effect," Tuchi wrote in his decision.

Republican candidates let some Social Security realism creep in. Republicans are often just as loathe to discuss Social Security cuts as their Democratic counterparts. So it's refreshing to see some 2024 GOP presidential candidates admit that the old-age benefits program can't continue on its current trajectory forever. Ron DeSantis, Mike Pence, and Nikki Haley "are pushing for cuts to Social Security benefits that would only affect younger Americans," The Washington Post reports:

In comments on Sunday as well as in interviews earlier this year, Florida Gov. Ron DeSantis (R) said Social Security will need to be revamped — but not for people who are near or in retirement.

Former vice president Mike Pence and former South Carolina governor Nikki Haley have taken similar positions since launching their presidential campaigns. From the earliest days of his 2016 run, Trump has vowed not to touch either Social Security or Medicare — a break from GOP orthodoxy that has shifted the party's views — and has more recently hammered DeSantis for wanting to cut the program.

"When people say that we're going to somehow cut seniors, that is totally not true," DeSantis said on Fox News. "Talking about making changes for people in their 30s and their 40s so the program's viable — that's a much different thing, and something I think there's going to need to be discussion on."

On Monday, Pence told Fox Business: "I'm glad to see another candidate in this primary has been willing to step up and talk about that."

Of course, as Howard Gleckman of the Urban-Brookings Tax Policy Center told the Post,  focusing on cuts in the distant future "clearly would not address the shortfall, or the short- to medium-term problem we're going to have in 10 years or less."

        The plan for social security for those currently receiving benefits is to do nothing.
        That will result in a 20% cut in benefits when the program becomes insolvent.
        Taking younger people out of the program and putting the tax money into an IRA or annuity will guarantee a much larger check for those who retire after 20 to 30 years of investing in the s and p index.

      The odd thing about the law is a police officer requested that everyone step back eight feet, not mentioning cameras at all, it would likely be upheld as legitimately within his discretionary law enforcement power.

Heck, they could probably get everyone back 10 yards without any constitutional issues. 8 feet is really damned close if you are performing an arrest on a potentially violent suspect and do not know who the other folks might be in relation to the suspect. That is like 1 step and a lunge away from jumping on your back.

        There was a time, not all that long ago, when there were still public schools who worked with the folks they actually served — the parents in the neighborhood — with help in creating/adopting curricula and materials, and even the hiring of new teachers. I remember sitting in on the hiring interviews with both.

        Public education needs to be changed — the funding needs to follow the student — hence ensuring the parents have a voice.

        And returning a good deal of the control to the folks of the neighborhood they actually serve would go a long way to keeping the public schools from being the cesspools they have become. It just might keep the state-level idiots in Florida and California from determining what was best for every kid in every neighborhood in every situation with their “mandates.”

            Yeppers. Funding should start and end on the district level, with the States only intervening where there are serious fiscal gaps (very poor neighborhoods, etc), and such funding should not involve the feds at all. Until recently the feds (the “Office of Ed,” vs the Dept of Ed, made under Carter) were only involved in researching “best practices” and the like, and, given the information age, that role is obsolete.

                Yep. Exactly. It’s called “mission creep” or something. The “stimulus,” if you will, was Prop 14, which pretty-much froze property taxes for long-term homeowners, and over the years, the State made up the difference — and the money came with all sorts of “strings.”

                  When I ran for California state senator as a Libertarian, my biggest “plank” was school choice, and I was fortunate to have a couple of consultants from a libertarian school choice policy center assisting as consultants to my campaign. I remember how they went on for hours filling me in on the funding rules — and the cozy relationship between a certain building contractor and the local school boards.

          My only knowledge is the movie and a couple of interviews in which he talks about rescuing young children. They seem to think he is talking about rescuing 18-24 year old women by arresting them and sending them to jail for prostitution.

        Why would anyone conflate adult sex worker rights with a story about stopping children from being trafficked for sex? That makes no fucking sense. I supposed the charitable explanation is that the person who wrote that article was just jumping onto the bandwagon of a popular movie and using it to awkwardly push their own hobby-horse, but really, it makes no sense.             At Totten Tomatoes only 3 “Top Critics” had reviewed the movie a week after it opened. 2 were negative reviews that only focused on partisan politics and conspiracy theories and not the movie.

            After the second week, three more reviewers posted their take… Also 2-1 against.

            So 33% from the few top critics who deigned to write about it.

            Meanwhile, tens of thousands of verified ticket buyers reviewed the movie. It has vacillated between 100% and 99% on the audience score.

            There is unquestionably a conspiracy afoot, based on that evidence. It was the number 2 movie in the country during 2 major blockbuster releases. 6 reviews of a hundred million dollar 2 week movie is not normal.

            I posted about that here, both weeks. So it stuck out like a sore thumb.

                Also of note.... It has yet to have an international release. That $124 million is all domestic. Most movies are getting 30% of their take from the US market and 70% from overseas.

                So Indiana Jones is at $160 million domestic... Barely any more than Sound of Freedom, despite a budget of $300 million.

      Buttplug cites The Mary Sue, who cites a Twitter post, who cites a WFLA article, who cites another Facebook post by a man called Ivan Tuttle. Mr. Tuttle says "DO NOT TAKE YOUR CHILD TO THE NEW BARBIE FILM! It is full of Demonic influences".

      The Mary Sue and WFLA warn us that "The Facebook post reached a lot of people". Looking at Tuttle's page it says he has 3,400 likes... not just for that post but for the 10 years he's been up. I think my mom's liked my Facebook posts more than that.

      So Buttplug's "Conservative Christians" turns out to be a Facebook post by a guy who's political affiliation remains unknown.
      As usual, this was just another attempt by Buttplug and his proggy coreligionists to lazily smear the proles and defend a shitty movie.

      Oh, and remember, always read a Buttplug link, because he rarely gets past the opening paragraph and is usually self refuting.

      Having been to Chaco, that buffer is massive for what they're supposedly trying to protect. They could easily get away with a five-mile buffer and still not have the impact they're worried about.

      It's a cool place to visit and camp at, just go in the late spring when the weather isn't shitty. There's a cool remote hiking trail called Valley of Dreams just to the north of there that has some amazing views, too, although the trailhead and the the valley itself are kind of a pain in the ass to find.

        This law doesn't just prohibit getting within 8 feet of the action with a camera, but within 8 feet of any cop standing around the scene. If they seriously don't want anyone documenting what they are doing, under this law they can just flood the area with cops and push all cameras back a hundred feet.

        I don't know if the legislators that wrote this intended that, or just didn't think it through - but neither ignorance nor incompetence is an excuse!

    Forthcoming research from nonprofit conservative watchdog Judicial Watch indicates Illinois has close to 800,000 inactive registered voters.

    Judicial Watch announced Friday a federal judge ordered the Illinois State Board of Elections to turn over voter roll data to the Illinois Conservative Union and three registered voters. The state had allowed review in person in Springfield during limited hours, but that was 200 miles from where the plaintiffs live.

    Judicial Watch also announced forthcoming research it plans to release based on recent census data and information Illinois reported to the federal Election Assistance Commission that shows 14% of Illinois’ counties have more registered voters than citizens over 18, indicating the state has close to 800,000 inactive registrants.

    “These 40 day, prior to election day, vote by mail, early voting, ballots can be counted up to 14 days, the potential with rank-choice voting on the horizon, all of this stuff is not good for clean and fair elections and has to be reformed,” Halbrook said.

    Judicial Watch has a pending lawsuit challenging Illinois’ weeks-long election process, arguing federal elections should be decided on election day, not weeks after.

It often means someone who moved out or died but has not been removed from the rolls - if not a fake registration in the first place. Every one of these is an opening to election fraud.

      Most of these are people who moved out of the precinct, updated their driver's license with the new address, and allowed the DMV to register them as voters at the new address. That is supposed to automatically send a notice to the voting registrar at their old address to remove them from the rolls. SOMEONE FOULED UP AND SHOULD BE FIRED - but that's not going to happen anywhere under the influence of Chicago.

          It's "smooth" if you're using a scale where Mount Everest is beneath notice. That's only 5 miles added to a diameter of 8,000 miles, or 0.0625%.

          But we don't live on that scale. By our scale, a fifty foot hill is pretty noticeable - it's 8 - 9 men or 2 - 3 houses tall. It is even more noticeable when I pedal a bicycle up it.

          By that scale, flat land is uncommon - there are mountains, there are rolling hills, and sometimes there are hundreds of miles of almost flat land, but it's cut up by river valleys, so you have to carefully pick the spot for a larger building to avoid one corner hanging over a cliff.       As many of the comments to his video show, Legal Eagle fucked up, because he's saying Trump in the audio was "referring to a document he had in his hand", but nobody is referring to any document in the audio, as Trump claimed and the DoJ later admitted.
      Trump is telling his interlocutor that what he is talking about is classified, and isn't referring to any document.

      Now Legal Eagle is a fairly balanced and impartial legal analyst, so I don't think his mistake is deliberate. Rather he's been misinformed by a lot of the much-mocked early news stories and the initial DoJ statements that referred to "rustling papers", inferring that classified documents may have been present.

      If sarcasmic wasn't a brain damaged retard, he'd remember that even Sullum eventually accepted that there probably weren't any documents present when Trump was talking.

    One relative in particular is a diehard Trump fan. Completely and totally in favor of the man. So of course I asked her of his recent legal troubles. Of course she thinks he is totally innocent and only being prosecuted for political reasons. I asked her what was her opinion of the specific charges against him. She didn't even know what the specific charges were. I asked her if she had read the indictment, she said no. So I asked how could she know he was innocent if she didn't know what the charges were and she hadn't read the indictment, and she said - and this is a quote, to the best of my recollection:

    "Well I don't have all the facts but I just know he is innocent."

    There is Trump's base for you.

    You can guess the types of media sources she consumes on a daily basis.

    She of course also believes that there was massive cheating in the 2020 election. (To her mild credit she didn't use the word "fraud", only the softer term "cheating".) I asked her over and over again specifically what was the cheating that she thinks happened. Her strongest case for the "cheating" was: (1) Biden ran a terrible campaign and (2) Biden got more votes than Obama, and that is totally impossible. And very vague suggestions of vans moving ballots around in Democrat cities. That's it. But like her previous statement, she has no facts, but she completely believes there was massive cheating.

    It is just so sad to watch.

          A while back some college professor gave his students a list of political stances paired with politicians, and asked the students what they favored. Each position was attributed to either Obama or Bush. Not surprisingly Democrats agreed with everything attributed to Obama, and Republicans agreed with everything attributed to Bush. The kicker was that the professor had switched everything. So the Republicans who agreed with position A were agreeing with Obama, and the Democrats who agreed with position B were agreeing with Bush.

          I probably have some of the details wrong, but the lesson remains. Agreement was decided not on the policy, but on the party of the man who supposedly supported it.

          Principles shminciples. Tribal loyalty is what matters.

          This is the argument we made in the 80s and 90s. We lost.

          The only 2 options are printing money and inflation until a currency collapse..... Or moving benefits out until there are enough workers per retiree. That age would be very close to 80. 65 was chosen because it was the average life expectancy, and we had a rapidly growing population dominated by young people.

          Now we have an aging population dominated by old people, we are not reproducing at replacement rates and the average life expectancy is like 82 or something.

          Of course it is not sustainable.

            No those aren’t the only options. Or even the most likely option. The most likely option is Japanese deflation. That is precisely what favors the old and retired who depend on making sure that public debt is serviceable and can be expanded. It is really the most likely demographic/financial future for most countries and certainly the ones that are aging the fastest.

            The cost is no real economic growth for a few generations and debt that becomes enslaving in its burdens. But old voters are perfectly happy to throw their grandkids into that meatgrinder.

              Japan's central bank wants inflation. Even if the economy is shrinking, because who wants kids? They have been pressing the countries face hard into the QE meat grinder trying to devalue the retired populations spending power. Which in itself is deflationary, because if a greater share of your population is already retired they ain't getting any more money to spend. Japan's central bank has caused 90% of that country's economic problems.

                They may want inflation but they aren’t getting it.

                With the biggest inflation tailwinds the world has seen for 40+ years – pushed into Japan via skyrocketing import/commodity prices and exchange rates, price inflation in Japan is 3-4% yr-over-yr and 2.5% expectations going forward. Which is the highest they’ve had since their bank/real estate bubble popped in 1990. With interest rates (short term and up to 10 yr govt) still at zero – 0.5 % (still lower than at any time before 2013).

                If inflation WERE to happen in Japan – sufficient to raise interest rates above zero (which yes the CBoJ desperately wants), then those interest rates would immediately strangle growth.

                People really don't understand structural deflation at all.
