Conservative Florida Lawmakers Want To Expand LGBT Censorship to Charter Schools
New bill makes a mockery of parents’ rights, school choice, and educational freedom.

A bill making its way through Florida's Legislature would expand the state's censorship of discussion of sexual orientation and gender identity all the way up through eighth grade and, in addition, would specify that charter schools are included in the ban.
This attack on educational freedom comes just days after Gov. Ron DeSantis signed into law H.B. 1, which expanded school choice to all Florida students. It's a reminder that when some (but not all) conservatives and Republicans talk about "school choice" and "parents' rights," they have a limited view of what those choices should be and which parents should have rights.
H.B. 1069, which passed the state's House on Friday, would staple some new rules onto H.B. 1557, the law passed in 2022 that censored any discussion of sexual orientation and gender identity in kindergarten through third grade and restricted it in other grades. H.B. 1069 expands the censorship from pre-K all the way up to eighth grade. And while proponents of this type of legislation have insisted that this is all about giving parents control over their children's education, one simple line of text will undermine that entire argument if this bill is signed into law: "This subparagraph applies to charter schools."
All of this is in addition to the latest move by the state's Department of Education to implement regulations that apply a greater level of censorship to all discussions of sexual orientation and gender identity in all grades.
What makes charter schools so valuable is that they give families the freedom to pursue education that meets their children's needs and is free from overly restrictive, one-size-fits-all lesson plans. Families can find charter schools that cater to special needs children or that only focus on certain subjects. There are also a small number of charter schools designed for families with LGBT parents or children.
H.B. 1069 essentially declares that certain types of families will be denied the educational freedom offered by charter schools by censoring which topics can be taught. Politicians who actually believe in "parents' rights" and school choice should be very much opposed to this ban. If parents want their children to learn about LGBT issues in schools, it should not be for a group of conservatives in Tallahassee to tell them no.
In a similar vein, another part of H.B. 1069 undermines the educational choices of families by amending the process of objecting to and removing books from schools. The bill requires that any book or material that is the subject of a removal request by a parent be removed and unavailable to students within five days for an investigation. This means the allegedly objectionable material will be unavailable to all students, not just those of the parents who object. The bill also adds a lengthy appeals process that involves bringing in a special magistrate that the school district has to pay for if a parent continues to object. As Reason has pointed out before, these aren't "parents' rights" bills at all. These are "parents' veto" laws that allow some parents to control what other parents' kids have access to. And since the school district will have to pay to bring in a magistrate to fight against these objections, it doesn't take a genius to figure out that the easiest thing for a school district to do is just remove anything any parent objects to.
H.B. 1069 passed the House easily Friday by a vote of 77–35, and the Senate version is currently being reviewed by the Fiscal Policy Committee. If the bill passes, it will be a test of DeSantis' actual commitment to school choice. If he signs it into law, he's giving credence to any Democratic or progressive critic that says "school choice" is really a conservative plot to undermine public schools and school unions as a mechanism of control, not freedom. It is taking power away from parents and concentrating it in the hands of conservative lawmakers.

What "private schools" are you referring to? Charter schools are still public schools and receive funding from the State.
In a perfect world, perhaps (at least when it comes to private schools - but most schools aren't private). But there's little market forces in education and practically none when it comes to state funded schools.

Regardless, Shackford is exactly right that this particular law violates parents' rights. You and I may disagree with what these parents are choosing to teach their children (either directly or through their chosen proxies) but I stand firmly in the corner of a parent's right to make that mistake.
Charter schools are a social 'good' because they take government out of the equation. Don't subvert that good by reinserting government just for one social policy that parents are perfectly capable of addressing on their own.

Shackford has consistently demonstrated himself to be about as unConstitutional a scholar as there could ever be and this is no exception. States set public education guidelines all the time, even for home schooling. You can't teach your kids Klingon and say it meets foreign language or humanities requirements or teach Scientology and say it meets history requirements all without informing the parents and *then* insist they accredit you as an educational institution. You're free to pick from the languages they approve, you're free to let parents know the educational curriculum up front, that non-traditional educational topics will be addressed outside dedicated classes, but you can't teach them the tenets of Nationalized Socialism in study hall without parents' knowledge/consent.
The only way to avoid it would be to wholly extract education from State regulation at all levels and Scott doesn't want to do that because he systematically wants to have other peoples' kids in school and sexualize them too. If that means handing schools over to unelected admins and public sector unions... well, he pretty flatly supports that.
I imagine there are laws against doctors amputating kids' arms and legs just for grins, that any parents who tried to push doctors to do that would also run afoul of the legal system, and that any teachers who tried to encourage such choices in children would be similarly charged with child endangerment and lose their jobs and teaching credentials.

Keeping certain material out of the school library does not violate any parent's right to teach their third-grader about transgenderism and how to sodomize. I thought the whole appeal of the charter school system was that parents get to take the money that would have been allocated for their kids to go to public school and get to spend it on whatever kind of education they want, that the charter schools form a (kind of) open market for education. Charter schools are not independent. They are still public schools under the authority of the school boards.

The law, even the expanded version, lays out that sex education discussion can be had in sex ed. What is being forbidden is the presentation of Tinto Brass’ and Bob Guccione’s Caligula as some sort of historical, educational documentary AND SPECIFICALLY WITHOUT PARENTS' KNOWLEDGE/CONSENT.
This updated process/procedure is ripe for being abused, and quite quickly they will find that there are objections from so many different directions that they might as well just close the library and stop any teaching other than quietly sitting there for eight hours because it is all "banned until further review". Then they'll decide that the politicians/bureaucrats can make all of the decisions because they don't like some of the objections that have been raised, and the whole idea of "parent's rights" will disappear into a "government diktat".

In an ideal world there wouldn't be. Just like in an ideal world no one would openly be supporting communism anymore. But this is a prime example of cutting down all the laws to get to the devil. Sometimes the consequences of stopping something are worse than just letting them happen.

If parents want their 10 and 11 year olds to go to a health class which teaches that there is such a thing as menstruation, then I think they should be allowed to do that without the government forbidding it because one parent in the school is squeamish. What I wonder is why the mass exodus from public schools hasn't begun yet? I know withdrawals increased during the COVID Insanity, but I would hope to see public schools at least half empty in September.

A little of this is Scott's obfuscation but the general notion is bullshit. Scouts and The Catholic Church are private organizations. They can teach their own laws and lessons without the State incurring any obligation to treat them as educational institutions. All members of both organizations and several more all undergo training and have a duty to report while public school systems frequently shuffle teachers around or even endorse their activities.

This article isn't exactly clear about something. Does the State of Florida have educational standards that schools have to meet? Are charter schools absolved of these standards generally? Or, if somebody wants to can they open The Fourth Reich Charter Academy, where they teach all about the need for national liebensraum, the glories of National Socialism and the similarities of Jews and vermin? This is not to equate gender theory with Nazism. But, I'm trying to figure out if there really is some new extension of state power the Florida GOP is initiating, or if Mr. Shackford is just upset that it's his preferred ox getting gored.

Yes. My understanding is that these laws limiting discussion of sexual orientation, gender identity, and so on, state that schools are still responsible for teaching state standards. Whatever science and health standards touch on these topics is now all that schools can say about them. I haven't looked closely enough at the standards to know what they say about them. (There may be standards on hygiene for health classes, and certainly on human sexual reproduction in the science standards for biology classes, for instance.)
With the universal vouchers, this becomes one of the two main differences between charter schools and private schools. Charters are much more free to structure their discipline systems as they want, hire, evaluate, and fire teachers as they want, and are not bound by most of a school district's mandates. (In Florida, oversight of charters by school boards is mostly limited to financials/accounting, I believe.)
But, they still have to give their students the same tests that are required of regular public schools students designed to assess progress on the state education standards. Private schools accepting vouchers in Florida do not. Instead, they can choose from among several nationally recognized tests, and they report the results to a small research group at FSU that then compiles a report for the legislature. The individual school results are available, if you know where to look, but they are not really valid to compare between each other or with public schools, since you don't know which school gave which tests. Nor are the results broken down by subgroups at the school level. And I don't think they have to give students standardized science tests at all, unlike public schools.
That last part seems fairly convenient for the religious private schools that follow creationist science curricula (which are popular among homeschoolers). Of course, I would guess that most religious private schools do not, but there is no doubt that there are many voucher schools that do. And being able to weave religion throughout a school's mission is the other main difference between private schools and charters. Charters, which cannot turn down students eligible to attend other than due to lack of space (in theory, at least), are still bound by restrictions on government endorsement of religion. They cannot impose religious moral codes upon their students the way that a religious private school can, lead students in mandatory prayer sessions, and the like.
I find it completely unsurprising that some conservatives will rail against what they call indoctrination in public schools that run off of taxpayer money, while they support sending taxpayer money to religious schools that are literally indoctrinating students in religious dogma. I am also completely unsurprised that some Florida conservatives are eager to limit parent choice by restricting what charter schools can teach.

You act as if it's some hypocrisy/contradiction that a parent (read: taxpayer) be allowed to have those tax dollars go toward a private institution for their kid. Why? If they're the taxpayer, why shouldn't the parent get to decide how their kid is taught?

Charter schools are public schools. Public schools are funded with public dollars (via coercion and threats of violence/imprisonment). The public schools are not entitled to any of my money, but insofar as they have it, their purview should be to teach in the most politically neutral way possible (i.e. teach about math, science, literacy and physical exercise) rather than encouraging young males to cut off their weiners and feel guilty about stuff their ancestors may or may not have done to people who are no longer alive who may have done similar things to other people generations prior. Opposing the sexual indoctrination of children in schools funded by the force of government is not an un-libertarian position.
An easy solution is to pass school choice, which would make it far easier for parents to get their kids away from this aforementioned sexual indoctrination. Follow that up by defunding public schooling.
