Internet Archive Loses Lawsuit Over National Emergency Library, Will Appeal
Plus: "Sensitivity readers" rewrite Agatha Christie, a Little Free Library battle, and more...

As Americans coped with lockdowns and isolation in the early days of the COVID-19 pandemic, the Internet Archive—a platform devoted to preserving digital history—hit on a novel way to help people stay sane. The company temporarily lent out free digital copies of books, calling the service the National Emergency Library. The service operated from March 24 through mid-June 2020.
The four biggest U.S. publishers—Hachette Book Group, HarperCollins, John Wiley & Sons, and Penguin Random House—sued, calling this "mass copyright infringement." The companies pointed to 127 books digitized and loaned out as part of the National Emergency Library, declaring that they owned the rights to them and had not granted the Internet Archive permission to lend them.
The Internet Archive claimed fair use, a doctrine that allows unlicensed use of copyrighted works in certain circumstances, such as when it's being used as part of criticism, commentary, news reporting, or research purposes.
On Friday, a federal court sided with the publishers.
The Internet Archive's "fair use defense rests on the notion that lawfully acquiring a copyrighted print book entitles the recipient to make an unauthorized copy and distribute it in place of the print book, so long as it does not simultaneously lend the print book," wrote Judge John G. Koeltl of the U.S. District Court for the Southern District of New York in his opinion. "But no case or legal principle supports that notion. Every authority points the other direction."
"We are thrilled by the decision in the Internet Archive/Open Library lawsuit. As we have long argued, scanning & lending books w/out permission or compensation is NOT fair use—it is theft & it devalues authors' works," the Authors Guild tweeted.
The Internet Archive says it will appeal Koeltl's decision, calling it "a blow to all libraries & the communities we serve."
"Libraries are more than the customer service departments for corporate database products," Internet Archive founder Brewster Kahle said in a blog post. "For democracy to thrive at global scale, libraries must be able to sustain their historic role in society—owning, preserving, and lending books."

Agatha Christie is the latest deceased author to fall victim to "sensitivity readers," who were tasked by publisher HarperCollins with removing potentially offensive language from the great mystery writer's Poirot and Miss Marple novels.
The edits—which will appear in all new editions of the books—are supposedly meant "to preserve their relevance to modern readers," reports The Guardian, giving the news a positive spin. But sensitivity readers can also be accused of warping an author's intentions, rewriting and sugarcoating history, and depriving modern readers of a chance to ponder how language and thinking has changed. They also seem to ignore the fact that some characters are meant to use offensive words or have offensive thoughts—that these may be functions of the story, rather than simply offhanded descriptions.
In the case of the Poirot and Miss Marple mysteries, some of the changes seem downright arbitrary. In the 1964 book A Caribbean Mystery, for instance, a description of someone having "such lovely white teeth" was removed.

San Francisco versus a Little Free Library. Little Free Libraries are a lovely phenomenon in which homeowners or communities install a very small outdoor structure where people can leave or take books for free. The city of San Francisco has given Susan and Joe Meyer 30 days to either remove the little library outside their home or pay the city $1,402 for a "Minor Sidewalk Encroachment Permit."
The Wall Street Journal—and a number of San Francisco residents—questions the city's priorities, noting that perhaps the city's streets have bigger problems than unpermitted lending libraries. "The fact that we live in a city where they would rather fight someone that is doing something positive is what I find so disheartening," the Meyers' neighbor, Geoff Claus, told the paper.
The problem goes beyond the Meyers' library and beyond San Francisco:
Encroachment permits are common in California, where cities require them for everything from mailboxes to vegetation planting along public roadways. San Francisco officials say they average 893 minor-encroachment complaints a year, and that their policies give them no choice but to act on the complaints, which often are filed anonymously via the city's 311 call line.
San Francisco's call line, reviled by many local residents, can tangle the most simple facet of neighborhood life in bureaucracy. A few weeks before Operation Little Free Library, the city, also acting on anonymous 311 complaints, distributed at least three similar notices on a quiet street in the Bernal Heights neighborhood.
Outrage over the attack on the Meyers' Little Free Library may be prompting some positive change:
The Board of Supervisors is now working on a plan to let all the free libraries and benches get low-cost permits—"like $5 maximum"—with little hassle, said supervisor Hillary Ronen. She said the encroachment rule was intended to make sure no one puts up anything that can impede public access on a sidewalk, but she added these neighborhood amenities don't.
"This is a situation of a well-intentioned rule gone wrong," Ms. Ronen said.

First of all, why am I bothering to even argue about this? Because there are several conservative commenters who persist in stating, as if it were factual, that minors in the US (the nation-state most of us live in, and therefore the nation-state most of us are most concerned about) are having gender-affirming genital surgery done. If you broke fair use as part of a free educational seminar or video where you offered commentary or critique of the work itself, that's an educational purpose. Just making something free for people to use is not suddenly making it educational. That would make it impossible to copyright almost any nonfiction work, especially historical works, because they have inherent educational value.
The 4 factors used are 1. fiction vs nonfiction - fiction has more copyright protection, 2. the amount of the sourced used 3. Education and Research purposes and 4. the effect on the market. My point was just looking at one factor won't necessarily get you to whether something was fair use.

Odd what this is coming to. A Disney film about Ruby Bridges has been banned in one Tampa elementary school because of a complaint by one parent. Who said it's 'not appropriate for second graders' (Ruby was 6 then) because it contained scenes that might lead a child to believe that whites were once hostile to blacks.
I'm not a fan of school choice. But I really do despise curriculum decisions being made subject to politics - whether by bureaucrats or parents. We need to imo separate facilities from curriculum/teaching.

Leaving a construction site unsecured, for example, such that kids come play in it and hurt themselves will leave you liable for the their injuries because construction sites are known attractions for young kids.
If those kids had to force their way through security measures to get into your site, you don't have liability for that.
If you left a loaded gun sitting on the sidewalk in a neighborhood and a kid played with it and shot another kid, you're now in an "attractive nuisance" situation where your negligence is potentially criminal.

Negligence would come into discussion if the owner did something egregious that a reasonable person would consider likely to lead to the misuse of the gun. For example, if Chemjeff gave the gun to a kid or a person he had reason to believe would misuse it, a plausible case of negligence could be made.
But leaving your gun locked in your car is not negligent, any more than leaving it locked in your house. If someone broke into a car and stole a jar of mayo out of a cooler- warmed it up and used it to poison a church picnic, would you consider the car owner to be culpable? Then why is a gun somehow different?

Okay then - suppose I leave a loaded gun on the kitchen table, and a child picks it up and shoots himself. Is the act of leaving a loaded gun on the table "egregious"? Does it depend on whether or not there are children in the house? By your strict standard, no one would be liable for harm to that child.
Furthermore, in a more libertarian society, all of us would be more responsible for our own actions, as there would be fewer regulations pre-emptively restricting our actions. Right now it is illegal for someone to serve food to the public in a filthy restaurant. But in a libertarian society with much fewer regulations, would that be the case? Probably not. It would then be up to the restaurant owner not just to follow the terms of a regulation, but to make choices as to how he/she would like to run the restaurant. And if a patron is harmed by the restauranteur's poor choices, the restauranteur had better be held accountable. Otherwise, why get rid of the regulations in the first place? For the "liberty" of making people sick in a filthy restaurant without accountability?
That's why we have seatbelt laws. They protect people in that very situation from falling out of the driver's seat and getting bruised.
Looks like we need to sue, along with gun manufacturers, car makers and maybe even manufacturers of auto glass.
Let me once again say, the US Constitution gives you the right to own a firearm, it does not say that it is a good for you to do so.

In totally unrelated traffic news – I really like roundabouts. Done right, they have self-enforcing speed limits because of the reverse bank of the road. There are some good video examples of the principle at work online

On the other hand, there's a pair of tight roundabouts by me that are right off of a highway, with nowhere near enough space to slow down.

My personal favorite is going through a roundabout at a T-intersection in the middle of nowhere and then getting caught in multiple stoplights in 3, triangular, four-way intersections or at a stoplight at a 5+ way intersection.
Being Cook County, I'm a bit surprised the municipalities involved haven't installed any red light cameras there yet.
I will raise you a 6-way intersection not far from where I live. Same road has multiples of those consecutive triangle intersections too.

Roundabouts can and do work. They're not for every situation. But in many cases they're a lot better than stopping at a stop sign or waiting at a light when they're nobody else around.
A lot of times they're placed in really odd locations, like in low traffic and residential areas, and designed with far too small of a radius, because big ones take up more real estate. Or opposite the crest of a hill, invisible to drivers from one direction.
Then you end up with people hopping the curbs and breaking axles and worse.
And other times they facilitate the movement of traffic. Looks like we're in agreement.
Sometimes they have some nice shrubbery and whatnot in the middle.
The shrubbery is not great especially when you are promoting cars and bicyclists entering at will you need visibility to make it more than a hope and prayer you don't get hit when you are in (Happened to me two times now because they couldn't see clearly in the circle and tried to jam in) or to not hit someone most likely a bicyclist that has been obscured by the greenery.
Only thing worse than that is political signs. Every four years you can't see shit.
The problem with peds/bikes near intersections is not shrubbery. It is parked SUV's with tinted windows. My solution for the parking is eliminate all car parking near intersections. That should be bike parking.
Or all right-turn-on-red situations. Where drivers no longer even look right - or stop. So - raise the crossings to sidewalk level so they at least slow down a lot.

Well the best way to create self-enforcing speed limits for pedestrians is to raise the crossing to the level of the sidewalk rather than lower the crossing to the level of the street.
I prefer them to any stop sign situation in residential neighborhoods. There were a few places in rural colorado near loveland that were a lot of fun, too- these were areas where the neighborhood had not been built yet, but the streets (and roundabouts) were all in place. Drifting around those circles I'm sure was much fun to the many teenage boys- and totally not myself, a man in his 40s who knows better.
Not easy to retrofit though.
My favorite is the put two roundabouts on Highway 2 going through Poplar, MT. The cattle and seed trucks have a hell of a time going through them, as the back to back, and wide loads can't negotiate them at all. I wonder what geniuses came up with that traffic plan. Heavily travelled trucking route, in the middle of wheat and cattle country, let's put in back to back round about, that'll fix the traffic congestion.
There's one near the shipyard in Bath, ME and trucks carrying large loads for the ships just roll right over the thing. Smash it to bits. And they keep rebuilding it.

I don't know. Roundabouts seem like about the most anarchistic of traffic control tech. Everyone makes their own judgements and it generally works out. Lights are central planning. Stop signs are too rigidly authoritarian. There are a lot of stupidly located roundabouts and useless ones, but where they are effective, I think they are pretty good.
As long as the speeds are low, spontaneous order works for traffic control.
