Lou Dobbs Is the Main Obstacle to Fox's Defamation Defense
The Fox Business host stood out as a champion of the baroque conspiracy theory that implicated Dominion Voting Systems in election fraud.

After the 2020 presidential election, Fox News helped promote what Rupert Murdoch, chairman of its parent company, privately called "really crazy stuff." It was a baroque conspiracy theory that claimed Joe Biden had stolen the election through a "massive fraud" involving Dominion Voting Systems, tricky Smartmatic software, phony ballots, election officials across the country, George Soros, the Clinton Foundation, and "communist money through Venezuela, Cuba, and likely China."
In dueling summary judgment briefs published last week, Dominion argues that Fox defamed it, while Fox argues that it merely reported what then-President Donald Trump and his representatives were saying. The main obstacle to Fox's defense can be summed up in two words: Lou Dobbs.
Other Fox hosts conducted softball interviews with Trump lawyers Rudy Giuliani and Sidney Powell, allowing them to lay out their unsubstantiated election-fraud claims and sometimes lending credence to them. But the host of the Fox Business show Lou Dobbs Tonight stood out as a champion of the view that "the election was stolen," a position he maintains to this day.
During a November 12 interview with Giuliani, Dobbs described the alleged election conspiracy as "the endgame to a four-and-a-half-year-long effort to overthrow the President of the United States." Dobbs repeatedly reiterated that allegation on his show the next day.
If you "read all about Dominion and Smartmatic voting companies," Dobbs declared in a November 14 tweet, "you'll soon understand how pervasive this Democrat electoral fraud is, and why there's no way in the world the 2020 Presidential election was either free or fair." During his November 16 show, Dobbs referred to "what the Trump legal team and others are discovering about Dominion," which he said provided "probable cause for a complete and thorough investigation."
Two days later, Dobbs again endorsed what he described as "President Trump's fight for a free and fair election." When Giuliani repeated his baseless charges against Dominion and Smartmatic, Dobbs agreed that "it's outrageous."
On November 19, the day that Giuliani and Powell held a bizarre press conference in which they laid out their claims, Dobbs described their presentation as "powerful" and an affidavit they cited as "stunning." He said Powell would be "providing more details on how Dominion vote machines and Smartmatic software were used to help Joe Biden."
During a November 24 interview with Powell, Dobbs referred matter-of-factly to "the electoral fraud that's been perpetrated this year." He worried that "Americans have given no thought to electoral fraud that would be perpetrated through electronic voting," which he said involved Dominion, "at least in the suspicions of a lot of Americans."
In a December 10 tweet promoting another Powell appearance, Dobbs echoed her claim that "the 2020 Election is a cyber Pearl Harbor." During that interview, Dobbs told Powell "we will gladly put forward your evidence that supports your claim that this was a cyber Pearl Harbor," adding that "we have tremendous evidence already." Afterward, Dobbs said Powell had presented "groundbreaking new evidence indicating our Presidential election came under massive cyber-attack orchestrated with the help of Dominion, Smartmatic, and foreign adversaries."
In reality, Powell had no such evidence, as Fox News reporters and Fox News host Tucker Carlson had pointed out. Those objections, which Fox presents as evidence that it was appropriately skeptical of Powell's tall tale, should have given Dobbs pause.
So should the conclusions of Republican election officials and Trump's own attorney general—not to mention the text conversations in which John Fawcett, one of Dobbs' producers, described Powell's election lawsuits as "complete bs" and speculated that she "could be losing her mind." Noting that Powell's story "doesn't make sense," Fawcett warned that "I just don't think she is verifying anything she is saying."
Dominion has to prove by "clear and convincing evidence" that Fox either knowingly or recklessly made false statements that implicated the company in election fraud. That's a high bar, but Dominion may be able to clear it with a strong assist from Dobbs.

Part of this is the focus on the most outlandish claims to dismiss the known claims. The thousands of double voters as an example. Many of the double voters were likely ballot mail in fraud. As people showed up on election day and told they had already voted by mail. It is more likely someone voted as them due to mismailed boxes. Thousands of people forgetting they voted doesn't make sense. In Georgia this was in the thousands. Same with Arizona. But in both states the AGs declined to investigate how so many double voters existed.
Audit trails and breaks in chain of command are known. Not investigated.
More than a dozen courts have ruled on illegal election changes.
Signature matching was reduced to laughable levels and we have images of this from arizona.
It all points to a destruction of ballot integrity through mail ballots. But this is inconvenient for reason and others because of their no fraud narratives.
So it is important for reason to attack the claims against Dominion, even if true, to save their own open discussions. Dozens of sullum articles. They have never discussed the KNOWN issues that are clear and can be seen.
It is a protection of Reasons own narratives.
I thought the Dominion stuff was probably the weakest instance of possible election malfeasance and also the easiest to disprove. I didn't really follow how that went, but Dominion should have shown the machine data and have the code reviewed to prove the software/hardware worked correctly. Speculation into impropriety is fine, but if Dobbs made specific fact claims that were proven wrong in court then defamation seems appropriate.

Trump winning on a procedural matter is not the same as Trump winning on fraud allegations. My guess is you're too fucking stupid to have realised this, or perhaps too fucking lazy/gullible actually to have checked out what RothStaat linked to.
Now look at "Election Integrity Cases with GOP, et al as Plaintiffs". A lot of cases were victories, and the ones that were dismissed were largely dismissed as "moot" or "lack of standing" or "lack ripeness".
US elections are a joke and have been for decades. And that has nothing to do with Trump.
The question is in how many of those cases was fraud alleged or involved. GOP won some procedural cases, sure. But when it came to overturning results owing to fraud or other action - how many did the GOP or Trump?

Yes, it is pretty much impossible for citizens to provide proof of election fraud given the way the system works. All they can do is raise suspicion. Election officials ought to be required to provide proof that no fraud occurred. If they cannot do that, the election needs to be redone.

Election officials ought to be required to provide proof that no fraud occurred. If they cannot do that, the election needs to be redone.
Aside from the difficulty of proving a negative, every single independent audit - and even the occasional partisan pro-Trump audit - found that the results were consistent and did not indicate fraud. Of course, these findings weren't accepted either.
It is generally pretty easy to prove that no fraud occurred in an election, provided your election procedures are set up properly. The problem is with bad US election procedures.
All these "audits" did was confirm that there were certain numbers of slips of papers in certain boxes that added up to totals similar to what was reported. They could not confirm that those were actually valid votes.
Your comments, like many others, shows that you have no idea about how elections votes are processed and counted. There are plenty of checks and audits built in and you should learn this.
None of the ones I have seen prevent fraud by election officials, and none can be verified by citizens.

I have a better idea, why don't you sign up at as a poll worker and see first hand. Take the training and participate in the vote counting. Remember that the poll workers, often you own neighbors are citizens doing the work to ensure a fair election.
The way votes are counted in most places, being a poll worker doesn't allow you to identify fraud by other poll workers.
I'm not concerned with the poll workers in my neighborhood, I'm concerned with the poll workers in a few key Democrat-run cities. And based on what we know about the people in those cities, I wouldn't trust them with anything.

Fox is the most watched cable news, not the most watched news. The recent viewership numbers show ABC news leading at 8,338,000 nightly viewers on average; NBC at 7,059,000, and CBS at 5,004,000. Fox News viewers are 2,300,000.
So it's not simply that CNN and MSNBC split the other viewers: viewers who live in the real world still tend to watch the traditional network news at a rate of nearly 10 times the viewership of Fox News.
Is it really fair to compare network news, which runs local stories, weather, and sports, with the bobble headed opinionist on cable news? Seems like that’s two different markets.

That is the key here and what I was most interested in learning. I doubted the Dominion conspiracy theory, but when they started fighting an audit of the machines and coding it certainly looked suspicious. If they want to prove defamation then that data would be the most conclusive means to do so.

The use of closed source software in US elections is an outrage and makes US elections untrustworthy, regardless of whether any actual misuse or fraud occurred in any particular election.
"Giving pause" isn't a sufficient legal standard for defamation. The standard is that there was negligence or malice. As long as Dobb's statements were phrased as suspicions and as long as he couldn't verify them as clearly false, they weren't defamation.

Notice that Jacob Sullum (and all others who claim the 2024 election wasn't rigged or stolen) failed to explain (or even mention) how/why Trump was winning big (according to CNN, NBC, ABC, CBS and FOX News) until around 2 AM the morning after the election.
Then all vote counts mysteriously stopped for the next hour (on every television news channel), and when the vote count resumed Biden suddenly had a lead in all 6 swing states.
Unless/until someone can explain how/why that occurred, many/most voters will continue to believe that the 2024 election was stolen (in addition to being rigged by the FBI, DOJ, DNC, left wing media propagandists, and other Hunter laptop deniers).

I have to admit I'm a bit confused here. I thought Reason thought that subjecting publishers (or in this case broadcasters) to liability for what individuals say on their platform was totally and utterly unacceptable? There were clear and present vote tally discrepancies that cannot simply be swept away. Dominion has a lot to answer for here and I'm wondering why they are engaging in a defamation lawsuit other than to cover up their own tracks and bury any inkling their machines were used with or without their consent for their code to be altered to allow for fraud to occur. They have the higher bar here and I think they will lose or seek to settle. The problem is, the tables are going to be turned on them in a countersuit.
