Utah Lawmakers Want To Give Parents Access to Their Kids' Social Media Accounts
Plus: Sex workers in popular media, stadium subsidies still don't work, and more...
A pair of bills in Utah would impose draconian requirements on social media platforms in the name of protecting children. Under Senate Bill 152, social media companies would be required to verify the ages of all users from Utah, get parental consent before allowing someone under age 18 to open or maintain an account, provide parents or guardians of minors with "access to the content and interactions" of accounts maintained by their children, and "limit hours of access [for minors], subject to parental or guardian direction," per a summary of the bill. Minors would be prohibited from using social media between the hours of 10:30 p.m. and 6:30 a.m.
SB 152—sponsored by state Sen. Michael K. McKell (R–Spanish Fork)—would also prohibit platforms from displaying advertising to minors or suggesting any sort of content or accounts to them, among other provisions.
Utah's Division of Consumer Protection would be authorized to investigate allegations that a social media company was running afoul of this law, and to "seek enforcement through an injunction, civil penalties, and other relief."
The bill would also authorize a private right to sue social media companies for violations.
Meanwhile, House Bill 311 would also require age verification. All Utah residents wishing to maintain or open social media accounts would have to show their driver's license, birth certificate, passport, or state identification card.
Additionally, HB 311—from state Rep. Jordan D. Teuscher (R–South Jordan)—would entirely ban people under age 16 from having social media accounts and require parental consent for 16- and 17-year-olds. Enforcement would likewise be delegated to the Utah Division of Consumer Protection and to private lawsuits.
Not only would both bills violate the privacy of Utah social media users and require an insane amount of additional work for social media companies, but they would also open platforms up to all sorts of liability—including for violations of vague prohibitions that are open to interpretation.
For instance, HB 311 would prohibit social media companies from using any "practice, design, or feature" which could cause "a Utah minor account holder to become addicted to the social media platform."
Bills like these should concern folks outside of Utah. They're part of a trend of anti-tech legislation sweeping the states (see, for instance, in Florida and Texas), pushed by lawmakers with no regard for free markets or free speech.
Complying with any one of these state laws would be difficult for social media companies. Complying with them all would be nearly impossible, at least not without some serious changes to their business models that would burden users everywhere. And the more states start considering and passing their own rules, the more likely that tech companies are to jump on board with national regulations as a lesser evil.
Either way, it means less autonomy for social media companies and less privacy and free speech for users across the country.
In Utah, SB 152 passed out of the Senate Business and Labor Committee yesterday.
At a hearing on the bill, the Libertas Institute's Caden Rosenbaum raised concerns about the personal information SB 152 would force companies to collect. "That kind of data in the hands of any company really is dangerous, because it's not a matter of if it will be breached; it's a matter of when," said Rosenbaum.
Khara Boender, state policy director at the Computer and Communications Industry Association, suggested that decisions about social media use should be left up to families. "Every family has a different approach to how they use technology and the internet," Boender testified, "and children and families have the ability to learn, explore interests, and maintain connections with family and friends."
Boender was then scolded by Sen. Dan McCay (R–Riverton), according to KUTV. "You are selling a product that is addicting in nature, and you build algorithms with a primary purpose of institutionalizing that addiction," he said.

These and several other recent films and TV shows "have represented sex work as ordinary work, and sex workers as complex characters, not singularly defined by the way they make money," writes Abby Moss. In addition, these sex worker characters "are not only among the most likeable (or, in the case of The White Lotus and The Menu arguably the only likeable) characters, they are not caricatures of 'fallen women' or exploited men. They have genuine agency and their choices are front and centre in the narratives."

We're headed for a wave of pricey and pointless new stadium subsidies, suggests a paper from economists John Charles Bradbury (Kennesaw State University), Dennis Coates (University of Maryland), and Brad R. Humphreys (West Virginia University). "We identify a regular replacement cycle of venues at intervals of 30 years," explained Bradbury in a Twitter thread. "If you look at when the last wave peaked (2000), you may notice the problem. We're entering a new wave of stadium construction that should peak around 2030."
Government subsidies for the construction of these new stadiums are likely to be bigger than before, since "median government subsidies of sports venues are increasing," noted Bradbury. "The share is falling bc venues are growing more expensive. Total public outlays (the relevant metric) continue to grow. At current funding levels, replacements will result in $20 billion in new public funding by 2030."
But the justification for these subsidies is just as empty as ever. "Recall that subsidizing stadiums is terrible public policy that goes against all evidence and policy advice," tweets Bradbury. "Most stadium spending is reallocated local spending. We also review recent designs that supposedly overcome the dismal economics of stadiums and demonstrate that they do not improve outcomes."

Having an ability is not the same as requiring verification of age. The two are mutually exclusive. Parents have the ability to buy booze for their kids or let them access the liquor cabinet; if a kid wants to buy booze or see a PG 17 movie, they have to verify their age or go with a parent.
They are not mutually exclusive, the ability is created by the age verification gatekeeping. If a 10 year old can buy booze with or without parental involvement then they have no role, forbid the purchase somehow and the parent has some input to access to booze.
Not just the ability, but the authority (and responsibility).

I think this is a good example of acceptable ideas that become ridiculous when you try to enforce them.
I agree wholeheartedly that parents have the right of raising their children, and should be allowed to police every bit of content and service that their children consume. And so, at first blush, government protecting that right sounds like a good idea.
However, government is creating an intrusive system that invades other, equally important rights to private property and free association in order to protect a parent's right.
There is a legitimate question of whether or not Parents can force private individuals (and the companies they start) to help them exercise the right of control over their children. A maximally libertarian view would be that parents do not get to do this, and that would render many things like prohibition on alcohol sales immoral and void.
But we *do* live in a non-libertarian world, where we have accepted that society does have a responsibility to help parents exercise their parenting rights. *If* we are going to accept age verification for alcohol sales, I don't think there is any reason to object to age verification for *any* other activity that society as a whole agrees is ubiquitous and dangerous enough to be restricted.
The obvious problem this creates (to my initial point) is that we now have every person in the state (if not the country, depending on how this bill is written) required to show Official Papers (TM) in order to consume online services. That strikes me as a pretty hefty price for everyone to pay in order to help some parent exercise their rights of control over their kid.
Beyond that, this bill goes way too far in it's restrictions. I could potentially be convinced on a compromise for age verification, parental consent and parental access to accounts. But mandating that the service become their babysitter with mandatory rules about enforced usage times and the like goes too far. If the parent is ok with the child consuming a service that doesn't have certain restrictions, then that is the parent's decision. The government should not be micro-managing that effort.

Flashing an id to someone at a counter is one thing. Making a permanent record (photo) of it and sending it to be stored on some unknown third party out of your control is another. So while I agree that the motivation and theory is the same, as it must necessarily be practiced, they are different.

Sounds fine in theory. In practice it becomes more onerous, no? How do we know that the image was checked? How do we know that the image was subsequently deleted? Maybe we need audit records? Third party verification?
As with forced vaccinations, you take an arguably-benign and -reasonable decision[*] that becomes draconian if you want to enforce it. It isn't just getting the jab, it is about proving you got the jab, and proving that proof isn't a forgery, and punishing people who don't comply in that growing chain of indignities.
The same is true here. In practice, we are now carding people to use facebook (!!!), and have to ensure that identities are protected and all the other nonsense along the way. A seemingly innocuous item is compounded by the ripple effects of bullshit.

I've seen the fallout of the writer's strike blamed for a lot of this, but I honestly don't buy it. What happened was that Hollywood has become increasingly radicalized in the last 20-odd years as the far more hard left Millennials and Zoomers have come to dominate the workforce within the industry. These are the people whose view of society was defined by the Harry Potter novels, so they aren't really capable of thinking in very sophisticated terms about humanity or the march of civilization in general. They only know what they can look up on their smartphone.
Some of the older Boomer and Xer bosses have taken that as a green light to indulge their worst ideological impulses. That lack of self-control doesn't make for good writing or culture-defining entertainment; it's just disposable, recycled pablum, the entertainment equivalent of a Happy Meal.
These are people who screech "fascism" about anyone who resists their political agenda. That kind of childish, reductive mindset isn't going to lend itself to mature, insightful studies of humanity and its contradictions, or creating even a left-wing critique that even conservatives can enjoy. A satire of Reagan-era America like "Robocop" or "They Live" looks like fucking Shakespeare compared to the ham-fisted crap Hollywood's been spewing out the last 15 years or so.
The Harry Potter novels have a teenage boy fighting against oppression and unjust authority (even creating their own little militia) with his friends and classmates, all of whom walk around with a WMD in their pockets.
Right, I think Harry Potter is a relatively GOOD example of modern writing.
People aren't just evil or good caricatures. Harry is constantly learning that people aren't who they seem to be, and he is constantly realizing that his snap judgements are biased and wrong. Almost everything that he FEEEELZZZZ is ultimately to his detriment.
And there are real consequences. People die a lot. Choices actually matter.
The problem is that isn't the lesson they took from it. Hell, when you really read the Harry Potter novels, the wizarding world is run by a wholly risk-averse, short-sighted bureaucracy (although, admittedly, not wholly corrupt, as the head of the Ministry did condemn his own son to prison), and the adults are completely fucking incompetent at protecting the kids in their charge from harm. At the end of the novels, the status quo has been restored and Harry is part of the bureaucracy.
The lesson these dingdongs took from it is that there's good (Harry) and bad (Voldemort), and government/real marxism would work fine if only the right people were in charge.

Members of the SUNY Board of Trustees called for the new DEISJ course for all freshmen in the 64-campus college system starting in the fall of 2023.
While the course is touted by the college as a means to promote diversity and equity, some SUNY professors have slammed it as pandering to woke ideology.
Generally speaking, this isn't new because colleges have required students to take a "diversity"-related class to graduate for at least 30 years, if not longer.
The main reason for this is because the schools know that these classes would never attract enough students to justify the expense of keeping these neo-marxist departments active, so they force the students to keep them afloat by making them take a course to graduate (to be fair, a lot of college departments would dry up and blow away if students didn't need to take a bunch of shit that wasn't necessary to their major).
I like the model set by Colorado School of Mines, where my son got undergrad degrees. Departments, teaching, and research is 90% STEM, with one department to cover English, art, and other humanities topics.

Sure, but Mines is a deliberately specialized university and has been since its inception. Most of the colleges are still crippled by the liberal arts mindset that you need to show proficiency in several subjects, as opposed to being just really good at one. They also don't want to lost out on all the money they make from tuition costs of these extraneous courses, even though more kids would be motivated to go to college if they thought they could get a BA or BS in half the time it takes to accomplish that now.
And of course, the Big Tech companies will "help" write the laws and regulations so as to ensure that the regulations become just another barrier to entry for any would be competitors. I think I've seen this movie several times already.

I consider myself fairly libertarian-leaning, but I am 100% for bills that create and protect parental involvement on social media sites. The idea that children (and, yes, even 16 year olds are children) should have the same rights as adults is frankly a little absurd and would seem to me only to come from someone who is overtly political or, more likely, doesn't have kids.
While I can agree that some parts of the bill are troubling and could use modification, overall allowing parents to opt-in to the amount of social media use by their children seems like a good idea to me. And to the people saying 'that's called parenting' - while I don't disagree with you in theory, in practice it's way more than that.

Parents don’t need the state to be a surrogate nanny to protect their kids from doing things they don’t want them to. If a child disobeys there parent and makes a facebook or other social media account they don’t want them to, they can force them to delete it or punish them. No need for the government to get involved in de facto parenting for what they (the state) believe each parent wants or doesn't for their children.
