The Most Popular Police Reforms Can't Stop the Next Tyre Nichols From Being Killed. Here's What Might.

On Friday, the city of Memphis, Tennessee, released footage of five cops killing Tyre Nichols. The video is as appalling and heartbreaking as expected. (You know it's outrageous when even the National Fraternal Order of Police couldn't muster a defense.) The video shows the officers senselessly beating Nichols, who was ostensibly pulled over on a traffic stop, as the 29-year-old is utterly defenseless and compliant with their demands (at least, when these demands weren't completely impossible or contradictory).
Now comes the part of the cycle where everyone calls for reforms.
It's hard to look at a situation like this and think that anything could make a difference. Many popular reform ideas—hire more black cops, make police wear body cameras, give them better gun training, ban the use of chokeholds—aren't applicable. (The cops were black, they were wearing cameras, and they killed Nichols without using a chokehold or firing a bullet.) Perhaps policing just attracts psychopaths. Perhaps the culture of policing is just so bad that it turns ordinary men into monsters. Neither of those options seems like a problem fixable through mild reforms.
But there are a few specific changes that could make a difference.
Get rid of secretive "elite" policing units like the SCORPION squad. The officers who killed Nichols were part of Memphis' "Street Crimes Operation to Restore Peace in Our Neighborhoods" (SCORPION) squad, which was tasked with swarming crime "hot spots" and making pretextual traffic stops in order to try and stop or investigate serious crimes. "The SCORPION program has all the markings of similar 'elite' police teams around the country, assembled for the broad purpose of fighting crime, which operate with far more leeway and less oversight than do regular police officers," writes Radley Balko:
Some of these units have touted impressive records of arrests and gun confiscations, though those statistics don't always correlate with a decrease in crime. But they all rest on the idea that to be effective, police officers need less oversight. That is a fundamental misconception. In city after city, these units have proven that putting officers in street clothes and unmarked cars, then giving them less supervision, an open mandate and an intimidating name shatters the community trust that police forces require to keep people safe.
Units like these don't just suffer from a lack of transparency and use tactics likely to spawn violence. Their rhetoric attracts "police officers who enjoy being feared," Balko notes, and it positions these officers as both elite and beyond the normal rules. There are all sorts of horror stories about similar units, such as Detroit's STRESS unit ("Over a two-year period, the units killed at least 22 people, almost all of them Black") or Los Angeles' CRASH unit ("More than 70 officers were implicated in planting guns and drug evidence, selling narcotics themselves and shooting and beating people without provocation").
Memphis has now disbanded the SCORPION squad. Let's hope it stays disbanded. And let's hope other cities follow suit.
Reduce the role of policing. The group DeCarcerate Memphis is calling for not just disbanding units like the SCORPION squad but getting cops out of traffic management in the first place and ending the use of unmarked cop cars. "These non-reformist reforms reduce the role and power of policing, rather than simply changing the colors of the people committing the harm," writes Guardian columnist Derecka Purnell.
Stop buying police propaganda. The initial Memphis Police Department statement about Nichols' death bears little resemblance to the horror and brutality that five officers actually visited upon him. Here's how the department described the situation at first: "a confrontation occurred," and "afterward, the suspect complained of having a shortness of breath."

This is far from the first time that police have drastically misrepresented the way things went down before surveillance footage or body camera videos showed that they weren't telling the truth. To distill this to its essence: Police lie. They lie to protect themselves. They like to give their activities a more noble sheen. They lie to dehumanize those they arrest or aggress against. And yet members of the media often take cops at their word and move on.
Reporters routinely cite information from police press conferences or statements as the simple reality of a situation, with no questions asked, no corroboration, and no outside voices quoted. We see this not just in cases of police brutality, but in reporting on routine police stings and operations. (One area where I frequently see this is with "human trafficking stings.")
People in general, and especially media, really need to stop taking police officers at their word. That doesn't mean members of law enforcement are never telling the truth. But there's no reason to believe they are more truthful than your average self-motivated individual. If people would stop placing a premium on police versions of events, it could, in some small way, help dismantle the conditions under which police feel they can get away with whatever they want.
End qualified immunity. Another big thing empowering police to do what they want without fearing consequence is the doctrine of qualified immunity. Police need to know that they will face legal consequences when they do wrong.

Minnesota to enshrine reproductive freedom in state law. Minnesota's Protect Reproductive Options (PRO) Act has been passed by both legislative chambers and is on its way to the state's Democratic governor for a signature.
The measure stipulates that "reproductive freedom" is included in the Minnesota Constitution's protection of individual liberty, personal privacy, and equality, and it states that "every individual who becomes pregnant has a fundamental right to continue the pregnancy and give birth, or obtain an abortion, and to make autonomous decisions about how to exercise this fundamental right." It also prohibits any local governments in Minnesota from "regulat[ing] an individual's ability to freely exercise the fundamental rights set forth in this section in a manner that is more restrictive than that set forth in this section."
"California, Vermont and Washington also guarantee the right to a broader spectrum of reproductive health care options," notes Minnesota Public Radio.

The war on "accessory dwelling units" (ADUs). Small living quarters built behind or near existing houses can help keep aging loved ones near, among other benefits. "Accessory dwelling units—also known as in-law suites, granny flats, casitas or guest cottages—come in many forms," reports The New York Times.
They can be free-standing or attached to the main house on the property they share; they can be apartments in basements or atop garages. An A.D.U., which is typically 600 to 1,000 square feet, has a bathroom, a kitchen or kitchenette, and, usually, a separate entrance.
Its function can change over the decades. A rental that generates income for young homeowners might later become a refuge for returning young adults, then become a way for older homeowners to defray housing costs and remain in their neighborhoods.
In an aging nation, an A.D.U. makes particular sense for people in their 60s and up who don't want to move and will need nearby caregivers, either family members or hired aides.
But zoning rules and other laws in many cities make these sorts of arrangements difficult to impossible. More here.

Yes police officers need to be transparent and accountable. What ENB proposes removes that as well as most accountability to criminals as well. Cashless bail, as an example, continues to release violent offenders that continue to commit violence.

Police reform needs to happen. ‘Violations’ of all sorts of stuff needs to be taken out of the realm of being enforced by police (which would mean dramatically changing police academy training since identifying violations that lead to arrest and using force are almost the only subjects taught there).
So does the dispatching 911 function. It didn’t apply in this case but it has in so many others. Karens and other incoming 911 callers lie through their fucking teeth. They create a false escalated threat and a racialized tension BEFORE police even gets dispatched. And there is almost never any follow up or punishment of false dispatches – which only makes those Karens even more entitled to be their neighborhoods paperwork snitch/watch. Likewise, dispatchers need more options on their decision tree of who to send – a mental health unit (armed or not), a DV unit, etc – and the training to know which one (along with police, fire, ambulance, etc) so that police aren't the ‘none of the above’ option for which they aren’t trained.

Black people have significantly more encounters as they commit crime (specifically violent crime) at a rate of 4-5x more than whites.

Being that there was a white man who died in almost identical circumstances not too far in the past, and it was never mentioned. Okay, so I read in the abstract that this comparison is about shooting deaths and the finding is there is no bias. But what I see as a problem here is the numbers game. If only one white person is contacted by police and he is killed, the percentage is 100%; yet if 100 minorities are contacted by police and 10 are killed it is only 10%. To compare only percentage tells the wrong story that only 10% the number of minorities are killed instead of 100% of whites contacted , when in real numbers 10x the number of minorities were killed.
It also leaves out the possibility that the contact was improper in the first place as was proven in the New York Stop & Frisk which the paper uses as one of several sources. I'm not saying that it's outright wrong... I'm saying that statistics play a strange word game .

When comparing disparate populations you always have to normalize the data. Comparisons of two populations un normalized is an incorrect comparison.
And that would be explained if the murder/violent crime rate was 10x higher for minorities.
Currently the big discrepancy in the numbers is completely explained by crime rates.
Whites are killed a lot, but they are the largest demo.
Blacks are killed a lot, their demo is much smaller, but their violent crime rate is many fold higher than any other race, so they have a police encounter rate many fold higher
Asians rarely commit violent crime, rarely encounter the cops, and have a predicatably low rate of being killed by cops.

The reasons for contact are very different. And that will skew the statistics. Resident-initiated (about 35 million encounters per year) tend to be much more in white neighborhoods (black neighborhoods do not trust cops as much as white neighborhoods) and the one stopped will tend to be whiter than average but blacker than the neighborhood. iow – yes a lot of Karens on Next Door DO call the cops for ‘strange n%^&$% in my neighborhood and I think I saw a gun’ as well as ‘neighbor is trespassing on my property to chop down their tree’. Traffic-related (about 20 million encounters per year) and police-initiated tend to be for very different reasons. The traffic ones that are a moving violation tend to have no difference by race beyond the differences in vehicle ownership. The traffic ones that are parking/paperwork (eg broken headlight, etc) are overwhelmingly black – even if the reason may not be ‘driving while black’ as much as it is ‘driving while poor’. But in both those subsets, it is the search of the vehicle that results in encounters that go bad.

The few times I’ve dealt with multiple cops there were usually multiple departments. One took the lead while the rest assisted. There were no takedowns. Nobody was tackled. No force was used.
Of course none of those interactions involved cops swarming like wasps. I doubt yours were either.
When they swarm then different rules apply. They’ve already decided there is going to be a fight. Conflicting commands serve to disorientate the victim while giving an excuse to punch them. If Officer Jumpy shoots them then oh well.
I don’t doubt that it happens. And perhaps sometimes intentionally. It seems like poor training for the times I have seen it watching badgecam videos. Maybe a couple hundred total videos viewed.

Back when I had cable (at least five years ago) I watched this reality show about airplane repo-men. Basically they'd record themselves stealing airplanes.
In one episode there was a paperwork snafu, and the repo man was met with police officers when he landed. As they swarmed around him with his film crew off to the side, they shouted conflicting comments. Dude actually laughed and said "What do you want me to do? Lay down or get on my knees? I can't do both! Make up your mind!"
Lucky for him he lived through it. Others aren't so lucky. But they were acting as they are trained to do.

Dozens of migrants stood their ground outside the Watson Hotel in Hell’s Kitchen on Sunday night and refused to leave for a new shelter at the Brooklyn Cruise Terminal.
Cops had mobilized around the hotel around 10 p.m. as more than 50 migrants were standing outside with activists assisting with food, water and translations.
Single men were supposed to be brought to the new shelter over the weekend that would provide the same services they’ve been receiving, city officials said.

The #1 thing which one can do to avoid being killed by the police is to avoid non-compliance. Once a person fails to comply, the police get excited, sometimes to the point of criminal behavior.
Why would it make sense to avoid antagonizing some random dude with an attitude in the subway but not avoid it if he’s wearing a police uniform?
All good suggestions, but it’s missing what for me is the elephant in the room — the complete lack of professionalism. There doesn’t seem to be any training; training in response, training in situational awareness, training in de-escalation, training in values and ethics. And these things, where they're present, produce good results, and where they're absent, it means general thuggery. Watch a British cop reality show for a point of reference. The situations involving armed officers and criminals or a risk of armed criminals are especially illuminating. It’s remarkable how much calmer and organized they are over there than here. If we’re going to make policing more attractive as a career to good candidates and less attractive to psychopaths, we need to start with professionalism and what goes with it.
DEI makes that impossible. If they hire only candidates with the intellectual capacity and personal discipline for that level of training and professionalism, then most police departments would go back to being nearly all white.

-end qualified immunity. It's basically just complete immunity.
-make officers carry their own insurance for abuse cases. Make it illegal for payments for cops' screw-ups to come out of the township.
-Mandate statutory, required payments to victims for specific abuses of police power. No more arresting people for filming, no more failing to know the law (on the cops' part). You abuse power, you have to pay.
-Make NDAs illegal for settlements in police abuse cases.
-Make it illegal for cops to deliberately turn off recording or fail to provide FOIA'ed recordings. I tend to like the idea that any gap in recording be mandated to contain actions by the police of whatever the prosecution says, and it be accepted as fact in court. Obviously the lawyers of the police abuse victim will come up with the worst scenarios that could reasonably have happened, damning the cops. In that situation I dare the cops to shut off their cameras.
-similar to above, mandate maximum prices for FOIA'ed video, and ban the blurring out of video, perhaps with the rule mentioned above. Also ban evidence-bombing. The cops can give a whole day's video but only if there's an actual timestamp matching the actual date and time of recording.
-Want police to police themselves? Make it impossible for police to advance in rank unless they rat out other cops for bad behavior. They will write reports of what other officers did wrong, and if they get their understanding of the law right then and only then do they qualify for advancement. This would require the creation of some sort of legal board to oversee this and make judgements, and this board cannot be connected to cops in any way.
-Make criminal prosecution of cops something that any lawyer can take up on behalf of "The People", just like the ADA. Perhaps even allow a commision.
-There has been a huge issue of lower-ranking officers not being in a good position to stop other cops' abuses. Make the cop advancement much more stratified. Now in each interaction only one officer is in charge but he's the only one liable, but also he can fire other officers on the spot. So again, it's sink or swim, understand the law right and get rid of shitty officers, or else get fired or potentially prosecuted for police abuse.
