Lawsuits Keep Rolling Back Unconstitutional Vegan 'Meat' Bans
No one is confused about whether Tofurky is turkey.
Tofurky is a food that may be best known as, say, the meat-free entrée your cousin's vegan boyfriend insists on eating at the Thanksgiving table, potentially perturbing your cousin's carnivorous dad—the one who killed, gutted, scalded, plucked, brined, seasoned, stuffed, and roasted the actual turkey on the table.
One thing Tofurky and similar meat alternatives are not known for? Kicking ass. But that may be changing.
Last month, a federal court ruled an Arkansas law that banned makers of meat alternatives such as Tofurky from using commonly understood words to describe their products was unconstitutional.
"The law prohibited the labeling of any food product as 'meat' unless that food product was derived from livestock, and it banned such terms as 'veggie sausage' and 'veggie burger' from food labeling in Arkansas," the Northwest Arkansas Democrat-Gazette reported in the wake of the court's ruling. The same court had in 2019 granted Tofurky an injunction preventing the state from enforcing the law shortly after it took effect and the suit was filed.
The Arkansas law, U.S. District Court Judge Kristine Baker explained in her ruling, unconstitutionally barred Tofurky from "convey[ing] meaningful, helpful information to consumers about the products they are purchasing, and Tofurky's repeated indications that the food products contained in these packages contain no animal-based meat dispel consumer confusion."
The Arkansas suit is one of several filed by Tofurky and others—including other vegan-food producers and the American Civil Liberties Union, Good Food Institute, Animal Legal Defense Fund, Plant-Based Foods Association, and Institute for Justice—against several states that have adopted laws similar to that in Arkansas.
Last year, another lawsuit—this one filed by Upton's Naturals—forced Mississippi's agriculture department, which adopted rules similar to those in Arkansas at the behest of the state's powerful beef lobby, to backtrack and amend those rules.
"Under the new regulation, which officially took effect today, plant-based foods will not be considered to be labeled as a 'meat' or 'meat food product' if their label also describes the food as: 'meat-free,' 'meatless,' 'plant-based,' 'vegetarian,' 'vegan' or uses any other comparable terms," the Plant-Based Foods Association, which was also a plaintiff in the case, reported last year.
Also last year, Tofurky challenged a similar Oklahoma law. And earlier this year, a federal judge in Louisiana overturned that state's don't-say-meat-meat-alternative ban.
Why the sudden clamor to adopt rules against using some words to describe meat alternatives? Supporters of such laws typically claim they want to help consumers avoid confusion. But that argument's all hat and no cattle. Such laws sow confusion rather than mitigating it. Research and common sense suggest consumers aren't confused by terms such as "veggie burger" or the like. Worse, linguistic bans generally prohibit accurate and honest labeling even if—as the federal court in Arkansas found was the case with Tofurky's labeling—"the product [in question] also states on the label that it's 100% vegan, plant-based or meatless," Bloomberg News reported in 2019.
Ultimately, the basis of such laws can be tied to simple and pure protectionism. Indeed, the protectionist urge is strong, historically, among the powerful producers of animal products—including meat and dairy. For example, as I've discussed in my book Biting the Hands that Feed Us: How Fewer, Smarter Laws Would Make Our Food System More Sustainable and elsewhere, rent-seeking dairy interests have, over generations, leaned on lawmakers to force competitors to change the name and even the appearance of their foods. In Wisconsin, the state long forced makers of margarine—who compete with the dairy state's butter makers—to color their products pink. In New York, the state forced makers of non-dairy creamers to label those foods as "melloream"—whatever the hell that is.
Notably, though, this type of protectionism isn't wholly limited to meat-industry-led attacks on vegan competitors. As I explained in a 2019 column, Arkansas has sought to protect its dominant rice industry against competition from makers of riced cauliflower (a law I characterized at the time as "veg-on-veg crime").
The single most important fact to remember about these laws is that they seek to undermine the First Amendment to prop up sales for certain elements of the food industry. That's as unconstitutional as it is unwise. Such laws don't' serve the interests of consumers. After all, neither your hypothetical cousin's boyfriend nor your uncle was confused in the least by the differences between Tofurky and turkey. Indeed, it was those differences that drew them to choose those respective favored foods in the first place.

I will say that people who don’t read well, or people who have have English as a second language will likely be confused by the ‘meat’ advertising. The tofurky is worse, the claims on taste, lies about health benefits are unethical. But, the important matter is vegan ‘meat’ manufacturer’s 1A rights to falsely advertise their product. If the product was worthwhile, it would sell well w/o being marketed as meat.
If they buy, like it, and buy it again, what’s the harm? If they buy it, don’t like it, and don’t buy it again, the harm is tiny—just the price of one package.

It should be possible to distinguish between “sly” labeling and false labeling. The latter should be prohibited. Calling a vegetarian product that is labeled as such “sausage” is not deceptive or even sly. Prohibiting such terms is retarded and transparently protectionist.

So in this sense, the right to free speech is only really valid if the benefits outweigh the costs. By this analysis, if unrestricted free speech leads to disinformation and lies overwhelming the truth, then the ‘solution’, to them, is to restrict the speech so that only “accurate” speech remains.
They are of course wrong in their proposed ‘solution’, but they are right to point out one of the costs of unrestricted free speech, which is, it becomes much more difficult to have collective decision-making, such as with an election or votes in a legislature, resting upon an accurate factual basis. It behooves us, who stand for free speech on its own merits, to address this very valid concern.
Jeffy, you should know better by now. Team D loves liberty only when it suits them, such as bodily autonomy for abortions, but not vaccines, masks, or much else. If it’s not speech they approve of, it’s hate speech or misinformation, never just free speech that disagrees with their speech and platform.
And their tribe would say that Team R only supports liberty if it suits them. Both are dishonest self-serving narratives.
In reality, it is as I said: broadly, they are in favor of robust dialogue and disagreement, but only if it passes a cost/benefit analysis. If they cannot see a beneficial purpose to the speech, then it’s not really “free speech”.

It seems to me, that there have been four big “waves” of libertarians.
There was the original wave of libertarianism, originating from the founding of the Libertarian Party. They tended to be more radical, borne out of the spirit of the 60s. That is how you got LP candidates who boasted that they didn’t even have a driver’s license because they were so opposed to public ownership of roads. My hunch is that this is the Nick Gillespie era of libertarianism (although he is mellower than that now).
Then there was the wave of libertarianism in the 90s that came as a response to Clinton’s win in 1992 and the Republican Congressional win in 1994. This was more tech-oriented, not quite so radical, definitely paranoid, but still very clearly on the cause of liberty. They could see the awful things that both Team Red and Team Blue were doing at the time and they rejected both. They could clearly state that they rejected the Team Blue “let government run everything” view and the Team Red “let the Bible determine our laws” view and forge a genuine third way based on liberty. (That is where I count myself as developing my libertarian views.)
Then there was the wave of libertarianism that originated due to Ron Paul in the late 00’s/early 10’s. It was more social media oriented, and it was basically just “anti-war/pro-pot Republicans”. Also tended to be a lot crazier and fringier in their paranoid beliefs. I think that is where most of the current libertarians come from. The problem is that they still tend to accept the right-wing assumptions when it comes to liberty, i.e., that liberty is a blessing that only the morally righteous deserve, and not a birthright of every human being on the planet, at least not to the same extent. They are just willing to expand liberty just a teeensy weensy bit further than a Republican would, and so based on that teensy difference between bog-standard Republicanism, they call themselves libertarians. So they don’t hate the gays as much as Republicans do. And of course they hate Democrats just the same as a Republican would. There really isn’t that much difference between them and your typical Republican (at least from the mid-10’s or so).
And then we have the current wave of “Trump libertarians”, who are not really libertarian but instead nationalists who are presenting dishonest arguments against the entire libertarian rationale of preserving liberty for its own sake, in favor of adopting a xenophobic nationalistic view of ‘liberty’ in which only they are the privileged ones entitled to have liberty and everyone else in the universe can fuck off. They’re also emboldened by the unfiltered nature of Trump to push for what they really want, the liberty to be racist bigoted assholes to their heart’s content. These ‘libertarians’ are a blot on the movement and really ought to just get on with their transit on the so-called ‘libertarian to alt-right pipeline’ and just go away.
So of these four groups, I would qualitatively rank their presence on this site as about 10%/20%/50%/20%.
That last 20% can fuck right off. And a lot of that 50% of Ron Paul Republican-Libertarians can, I hope at least, be persuaded to adopt a less right-wing-centric view of liberty, and be shown that e.g. even illegal immigrants have liberty even if they aren’t citizens.
So I have hope that there can be a genuine liberty movement dedicated to preserving liberty for its own sake, but it will take work.
Firstly, I’m curious to know who you think would be in that last 20%.
Secondly, arguing that people with a right-center view of liberty (like people who were brought in by the Ron Paul movement) are wrong and just need to be persuaded to fall in line with YOUR view of liberty seems a little counterproductive.
Thirdly, shrike doesn’t give two shits about liberty or freedom, so you’re barking up the wrong tree there (and really, you should know better after posting here for so long).

Basically: The voters passed a constitutional amendment that outlawed gerrymandering and set conditions for how congressional districts and state legislature districts were to be drawn. When the commission that was supposed to draw those maps met, they totally undermined the entire amendment process and still produced a gerrymandered map. The map was struck down by the Ohio Supreme Court but the commission just defied the court until time ran out, and so the Ohio elections are going to be run using a technically illegal district map.
I think there is an opportunity here for the Libertarian Party to adopt a ‘good government’ position and push for ending abuses to the electoral process itself. They are already fighting restrictive ballot access laws which is good, but not good enough. They could also push for independent redistricting commissions, expanding the size of the House of Representatives, ranked choice voting, other innovations that allow more voices to be heard in the democratic process.
