In the two cases, brought against Harvard and the University of North Carolina, anti-affirmative action group Students for Fair Admissions argues that race-conscious admissions violate the Civil Rights Act

Race-based affirmative action in college admissions is likely on its way out, as the Supreme Court began hearing arguments in two cases challenging the policy.
On Monday, the Supreme Court began hearing arguments on two cases brought by Students for Fair Admissions (SFFA), an anti-affirmative action group, seeking to challenge the University of North Carolina (UNC) and Harvard University's race-conscious admissions policies. While the Court has sided in favor of colleges seeking to use race-based affirmative action policies in the past, most recently in 2016, the Court's current conservative majority leads legal experts to believe that the policy will most likely be ruled unconstitutional.
The cases against the schools were filed separately, with the case against UNC filed in 2014 and the case against Harvard filed in 2015. The Supreme Court combined the cases in January of this year but separated them again so that Justice Ketanji Brown Jackson, a former member of the Harvard Board of Overseers who had recused herself from the case against Harvard, could participate in the UNC case. Arguments in both cases began on Monday.
In the case against UNC, SFFA argues that the school's race-based affirmative action policies violate the Constitution's equal protection clause and Title VI of the Civil Rights Act. As Harvard is a private university, SFFA is only arguing that Harvard's policies violate the Civil Rights Act.
In both cases, SFFA alleges that race-conscious admissions procedures amount to illegal racial discrimination against white and particularly Asian applicants. The case against UNC sticks to attacking the school's affirmative action policy, but the case against Harvard is more complex. SFFA argues that Harvard's consideration of race in admissions includes both affirmative action policies and an attempt to penalize Asian students in particular by encouraging interviewers to rank them lower than other groups on a "personal rating"—a score from 1–6 (with 1 being the highest score) that measures traits like "courage," "likability," and "kindness." SFFA argues that Harvard ranks Asian applicants much lower on this subjective metric to justify rejecting them at higher rates than other racial groups—despite the demographic having the highest average test scores of any racial group.
"According to an unrebutted model of the personal rating, Asian Americans receive the lowest personal ratings among all races," wrote SFFA attorneys in their petition for a writ of certiorari in the Harvard case. "Harvard concedes that Asian Americans suffer a penalty on the personal rating—that changing an applicant's race from white to Asian lowers the personal rating to a statistically significant degree."
SFFA argues that in both circumstances, UNC and Harvard can achieve racial diversity by favoring economically disadvantaged students rather than students from certain racial backgrounds.
In response, both Harvard and UNC argue that their practices are legal and protected under current precedent, which supports race-conscious admissions because it is a narrowly tailored practice used to achieve the compelling state interest of attaining a diverse student body. Harvard believes that "a diverse student body is central to fulfilling our educational mission, that diversity enhances education for all, and that Harvard does not discriminate against any group in its admissions practices," Harvard President Lawrence Bacow wrote in a July statement. "We remain steadfast in our belief that every college and university must retain the freedom and flexibility to create the diverse educational communities that will prepare their students for the opportunities and challenges they will confront in an increasingly diverse society."
If the Supreme Court decides to end affirmative action in college admissions, the decision will likely be greeted with support by most Americans, including majorities of the very racial groups affirmative action policies are designed to benefit.
According to 2022 polling from Pew Research, 74 percent of Americans believe that race or ethnicity should not be a factor in college admissions decisions, while only 7 percent believe it should be a "major" factor. A majority of all racial groups polled believed that race should not be a factor in college admissions, including 59 percent of black respondents and 68 percent of Hispanic respondents.
Affirmative action policies in college admissions are likely nearing their final days. While the Supreme Court has twice defended the use of race-conscious admissions in recent years, the Court's conservative majority is very likely to overturn precedent and rule that race-based affirmative action policies are unconstitutional.

Everything I know about Asian character I learned from watching Squid Game and I'm thinking Harvard might be onto something here.
According to the article, “character” is courage, kindness, and likeability. Harvard’s interviewers have no way to judge courage or kindness, so this is merely a way to exclude Asians because they don’t like them.
The only way to discourage discrimination on the basis of race is to discriminate on the basis of race.

Some friends took me to a 3-D screening of Avatar, and I was astonished to find the same theme -- that these gentle intelligent aliens were incapable of asserting their rights or defending themselves, and were only saved by the brave heroic human taking their side and leading them to safety and freedom. Or something like that. Poisoned the whole film for me.
My friends did not see it. Couldn't even comprehend that I saw it. And yes, they are progressives.

That's not really what I got out of it since the white savior was one of the most passive protagonists I've ever seen. He mostly just goes along and reacts without ever having thought about anything he was doing at most any point.
There's a lot about that movie I actually liked, but the plot was nonsense. Space-faring civilizations have no incentive to fight tribal societies on a level playing field. The final battle was fought in the skies when they could have just taken their aircraft to such a high altitude that no creature could breathe without a personal air supply, drop their bombs, and then call it a day. When the Zulus defeated the British, they outnumbered them over 10-1, and the British basically split their forces so it was closer to 20-1 involved in the actual fighting, and many of them ran out of ammunition.
What I saw was that the "Resources Development Administration" was a group of utter idiots who couldn't figure out orbital kinetic bombardment.
The lesson of the movie, accordingly, was "Don't send an idiot government agency to do private industry's job."

the problem is that the extremes on both sides agree on too many details of the caricatures and stereotypes they have created around race. poor, downtrodden, living in high crime areas, lower ability to get further education, etc., etc....... those who want to hate minorities and those that want to "help" them paint the same incomplete picture. when the racists and the woke agree on something..... they are probably both wrong. they both seek to paint race as directly related to socioeconomic conditions. this ignores the fact that those conditions are not unique to minorities and that the disparities have been naturally declining for many years.

Additionally, why is diversity only about skin color? Diversity encompasses far more than skin color? It can be socio-economic, blue collar and white collar, rural, suburban, urban, political and religious beliefs etc. Thomas also made similar points.

Private colleges can discriminate on whatever basis they choose, but if they do so, they have to forego any taxpayer funding, and their students aren't eligible for taxpayer-guaranteed loans.
Harvard gets a lot of tax money every year, so they have to comply with the equal protection clause.

I suspect if the Asians win this case ( I'm assuming it's Asians) then their cut will come out of the white applicants particularly white males and I suspect the courts will not even hear those cases. We are going on sixty years of affirmative action, why hasn't anything improved?

Through Students for Fair Admissions, Blum recruited “members” and filed his challenge to college admissions against Harvard with a twist. This time, Blum claims that the consideration of race discriminates against Asian-Americans.

In federal government contracting, we had the work arounds dictated for us. We had to discriminate in favor of government designated groups one way or another. We got to chose whether it was "race based" or "race neutral". But either way, we had to have a policy and show how we complied.
It was actually pretty easy for the contractors to appear to qualify either way. Without actually being the minority or woman owned business they claimed to be.
Just marry the right tribal member and put the business in her name was one. Even though she never had anything to do with the business other than showing up for get togethers.
This would only be a start. Needs to be declared unconstitutional for government contracts, loans, hiring practices and the rest. You can't end racism until you end racism.

Anything else is institutional racism. The current policy is not fair to minorities to be subjected to the belief that they were only accepted due to their race. It is not fair to individuals who were not admitted even though they were more qualified.
There are many highly qualified students from all races and all deserve to have an equal opportunity for admission. Elevating a unqualified student into a difficult college puts the student in a disadvantaged position and more apt to fail. Students should go to colleges than match their aptitude to give them a fighting chance of success.
Better yet, get over our obsession with college as the ticket to a better meal ticket. It's seriously oversold. Just ask the Kardashians.

Negroes’ often violent demands for “equity” and “social justice” serve as ammunition in the effecting that deterioration, which is not, however, the primary consequence of Negroes’ actions. Using Negroes as a stalking horse, powerful interests dedicated to the destruction of the remnants of the vision of our Founding Father are replacing it with tyrannical, socialistic Fascism. The primary consequence derives from the actions of these evil interests. The deterioration in service at the hotel described is but one example of deterioration of the nation as a whole. Sad! When I was growing up, mail was delivered to the house twice a day, milk was on the porch at 6 AM.
My dad could call the car dealer and a guy would come pick up the car, take it to have the oil changed, and bring it back.
When we went downtown (yes, we had those) shopping, all packages were delivered to the house later that day.
Now what they call a service economy is more like the bull and the cow.
Mail is (maybe) placed in the centralized drop box out in the weather.
You place the order, you make the payment, you go get the product, and maybe never even see a human.
You want milk you go get it and hope they have some in the store.
You take your car to a drive through oil change place.
If you want to try to shop in person, you first have to get to the store alive, then go through security, then look at stuff locked up in cases, and have to bribe an employee to actually unlock something so you can pay for it, and take it home if you can keep it away from the crooks.
Of course, at that time, fifty cents an hour was a good wage.

Although I am skeptical that government can enforce laws against discrimination adequately, it doesn't change the fact that there is one - and ONLY one - possible justification for a federal law concerning discrimination for private individuals and organizations: the government would have to prove beyond a reasonable doubt that an individual or company is actively discriminating against a protected group according to a clearly defined (legally) protected class of people. For example, if the Fourteenth Amendment is applied to the states and citizens of those states in protecting against discrimation based on a persons' gender, sexual preferences, race, color, religion, national origin or creed; then the definition of discrimination must be clear and the definition of the protected classes must be easily understood and unambiguous. No, employment and recruiting quotas need not apply!

I wonder how my middle eastern ancestors who came to San Francisco in the late 1800s and early 1900s would feel about this? By their nature, they were shop keepers and thus, opened small shops in the city as a way to make a living in their new land. We should have started a serious AA program back then to "equalize" the ownership of small grocers and haberdashers back then, while we had a chance. ?

I believe that based on previous court case losses, the universities have done exactly that. You're going to get a racist admission policy, and the colleges aren't backing away from that. You can't build your entire administrative process around racial equity and then just go, "Nope, not doing that any more". This was decades in the making, it'll be decades in the unmaking.
I was at UC Davis when the Bakke decision came down. It wasn't pretty.
Sadly, it was contested and decided on the basis of race. When in fact, it was really about age discrimination. And, it didn't even touch the special placements programs that got lesser qualified but, well connected applicants into medical school.
Actually, the easiest solution would have been to authorize larger medical school classes in the first place and get more doctors out there. Might have even mitigated our "high cost of health care" that is so debated today. Supply might have come up to demand without such high costs.
