A North Carolina Man Was Jailed for Refusing To Wear a Mask in Court
"I never thought this could happen in this country," Gregory Hahn said.

A North Carolina man was jailed for 24 hours for contempt of court last week. His offense? Refusing to wear a mask in court.
On October 10, Gregory Hahn arrived at a Harnett County, North Carolina, courthouse to report for jury duty. There were no local mask ordinances in place and no mask mandate at the courthouse.
"There were signs saying no masks were required," Hahn later told WRAL, a local news station.
However, Judge Charles Gilchrist had his own rules. After arriving, Hahn and the other 98 potential jurors were informed that masks would be required in Judge Gilchrist's courtroom. "You can go in any district courtroom without a mask, you can come into superior clerk court without a mask and the [district attorney's] office without a mask, but with Judge Gilchrist he has a mandate that you must wear a mask," Clerk of Superior Court Renee Whittenton told WRAL, adding that, of the superior court judges in the county, Gilchrist is the only one with a mask mandate.
When Hahn refused to mask, he found himself behind bars.
While judges have wide latitude to find individuals in contempt of court—including for failing to abide by the personal rules of the judge—this case shows how easily judges can abuse their power to punish people for seemingly innocuous offenses.
According to WRAL, Hahn was sent to speak with Gilchrist directly about his refusal. After Gilchrist asked him again to wear a mask and he again refused, Gilchrist sentenced Hahn to 24 hours in county jail, after which he was swiftly taken into custody and held with no bond.
"The irony of all this whole thing is the judge was talking to me without a mask on," Hahn added.
Hahn, a single father, says Gilchrist denied him the ability to call his son. "I was dumbfounded," Hahn told WRAL. "I never thought this could happen in this country."
While Hahn was shocked by Gilchrist's response, there's nothing illegal about it. In the United States, judges are given broad power to jail, fine, or otherwise punish individuals for contempt of court. "I'm not surprised," Lisa Wayne, the executive director of the National Association of Criminal Defense Lawyers, tells Reason. "The judge has complete jurisdiction to make rules within their courtrooms, as long as it is not inconsistent to any kind of constitutional right that someone might have." Wayne notes that she once "had a judge who would not allow women to wear pants in the courtroom—pantsuits. That was the rule of the court, or we would be found in contempt."
Hahn may not have broken any laws when he refused to wear a mask in Judge Gilchrist's courtroom—but he was jailed nonetheless. While judges should be able to maintain order in their courtrooms, a particularly draconian judge can easily make offending their personal preferences into a jailable offense. Hahn's run-in with such a judge is a perfect example of how this power can be abused—and how easily one can fall victim to an overzealous enforcer.

The real question here is: Is Judge Gilchrist's position elected or appointed? If elected, xe can be recalled or voted out of office at the next election. If appointed I suspect the Governor can un-appoint xim. If neither of those happen in response to this blatant abuse of power, then Hahn is living in the wrong place and should 1) move somewhere else; and 2) file charges against Gilchrist. I suspect any number of attorneys would love to handle that case.

Illinois removed the mask mandate for medical offices/ hospitals today. My wife is quite glad that she no longers has to wear and especially enforce stupid mask requirements. Iowa did this a couple of weeks ago.
I would say don't get too excited too fast on the masks. MEDICARE, yes Medicare, requires masking in certain health care facilities that are Medicare/Medicare providers. Hospitals are on that list so it doesn't matter a whit if all local and state mandates are lifted. Mandates in Texas were long ago lifted but we (and staff) have to wear masks when we visit our doctors and hospitals. All may not be lost as it is being challenged in two different suits but for now....

Got called for jury duty in Maryland at the tail end of the Covid restrictions. Asked if they still wanted me to show up if I wasn’t vaccinated, and the answer was “Of course.” Before going through the metal detectors, I was asked to sign something saying I was fully vaccinated. When I told the guard I wouldn’t sign it, he did not want to let me in, until told I was a prospective juror. Stupid distance requirements and mandatory masking, with only enough of a juror pool for one case on the day.
The courts, judges, and attorneys all seem to have gotten dumber over the last 20 years or so.
Dallas has a loon running the 14th District he has a similar mandate to grace his court.

So then what's the best solution to combating the petty authoritarianism of judges, elected or appointed? My first thought at reading this was that it was at some level a 4th Amendment violation, but that's not the case? My knowledge of the constitutional implications of this sort of thing are greatly lacking, but the amount of discretion that judges have for contempt charges seems a severe overreach and oversight.
Follow the order or say yes sir, then walk out and get a lawyer to fight it, contact your state or county representative, then walk in and put up with that crap until a countermanding order is issued.
Eventually, file a personal lawsuit against the judge for intentional infliction of emotional distress and make a bar complaint.
I have mixed feelings when I read stories like this. On the one hand, control is necessary, but on the other hand, one does not want excesses and abuse of power. This covid crisis has made me more attentive to my health. I got new opportunities to interact with doctors. Take telemedicine for example. Did you use it before covid? I definitely don't. Making an appointment with a doctor online, ordering glasses online here has become a common thing for me. Is it worth arguing about wearing masks now? We must be attentive both to ourselves and to other people around us.
