It's Not Clear Why Trump Thinks Disclosing the Mar-a-Lago Search Warrant Affidavit Would Help His Case
Reinforcing the FBI's suspicions was the whole point of that document, which is likely to remain sealed.

The search warrant that authorized the FBI to seize purloined government documents from former President Donald Trump's home at his Palm Beach resort sheds some light on the justification for that unprecedented and politically explosive step. So does the inventory of the items that the FBI seized, which was unsealed last week along with the warrant. But the affidavit that the FBI submitted to obtain the warrant, which explained why the bureau thought it had probable cause to believe it would discover evidence of criminal conduct, includes a lot more detail that would help answer lingering questions about the FBI's investigation.
That is why several news organizations are asking U.S. Magistrate Judge Bruce Reinhart, who approved the warrant, to unseal the affidavit. It is also why the Justice Department argues that the affidavit should be kept under wraps. Reinhart, who is hearing the arguments of both sides today, is apt to agree with the government. But the Justice Department's case for keeping the affidavit sealed, which it laid out in a brief filed this week, is itself revealing in several ways.
Juan Antonio Gonzalez, the U.S. attorney for the Southern District of Florida, begins by noting the reasons for unsealing the warrant and the inventory. "Given the circumstances presented in this matter and the public interest in transparency, and in the wake of the former President's public confirmation of the search and his representatives' public characterizations of the materials sought," Gonzalez writes, "the government moved to unseal the search warrant, its attachments, and the Property Receipt summarizing materials seized, which motion this Court granted." But he adds that "the affidavit supporting the search warrant presents a very different set of considerations."
Gonzalez warns that "disclosure of the search warrant affidavit would irreparably harm the government's ongoing criminal investigation." In case there was any doubt, that argument confirms that the Mar-a-Lago search was not aimed merely at securing classified material and recovering documents that belonged in the National Archives under the Presidential Records Act. It was also aimed at finding evidence that could support criminal charges against Trump and/or his underlings.
Gonzalez says the affidavit contains "highly sensitive information" about "specific investigative techniques" and "witnesses interviewed by the government." If it were disclosed, he says, "the affidavit would serve as a roadmap to the government's
ongoing investigation, providing specific details about its direction and likely course, in a manner that is highly likely to compromise future investigative steps." He adds that "information about witnesses is particularly sensitive given the high-profile nature of this matter and the risk that the revelation of witness identities would impact their willingness to cooperate with the investigation."
That argument confirms that the FBI relied on inside sources not only to show that Trump improperly took government documents with him when he left office—which was already clear from the 15 boxes of material that his representatives surrendered to the National Archives and Records Administration in January and the additional documents that the Justice Department obtained under a grand jury subpoena in June—but also to show that unrecovered items remained at Mar-a-Lago. That point would have been crucial in obtaining the warrant, which was based on the likelihood that the search would find records "possessed in violation of" three federal laws: 18 USC 793, which deals with mishandling of "defense information"; 18 USC 2071, which applies to someone who "conceals, removes, mutilates, obliterates, or destroys" U.S. government documents; and 18 USC 1519, which makes it a felony to conceal "any record, document, or tangible object" with the intent to "impede, obstruct, or influence" a federal investigation.
"Disclosure of the government's affidavit at this stage would also likely chill future cooperation by witnesses whose assistance may be sought as this investigation progresses, as well as in other high-profile investigations," Gonzalez says. In other words, the FBI is still seeking informants who could help build a criminal case. Given the potential for felony charges under the statutes cited in the warrant, not to mention the law that makes lying to the FBI a crime punishable by up to five years in prison, the bureau probably will find more insiders who are willing to cooperate.
"The fact that this investigation implicates highly classified materials," Gonzalez says, "further underscores the need to protect the integrity of the investigation and exacerbates the potential for harm if information is disclosed to the public prematurely or improperly." That argument highlights how little we know about the documents that the FBI seized.
According to the search warrant inventory, the FBI recovered 11 sets of classified documents with markings ranging from "confidential" to "top secret." The top-secret documents include some labeled "SCI," or "sensitive compartmented information," an especially restricted category. But without knowing, even in general terms, what sorts of information those documents contain, it is hard to assess the FBI's claim that leaving them at Mar-a-Lago, or waiting for Trump to finally turn them over, posed an intolerable threat to national security. The affidavit presumably would illuminate that issue, which is one reason news outlets are keen to see it. But it is also one reason the government says they can't.
After the Justice Department sought to unseal the search warrant and the inventory, Trump welcomed that prospect. "Not only will I not oppose the release of documents related to the unAmerican, unwarranted, and unnecessary raid and break-in of my home in Palm Beach," he said, "I am going a step further by ENCOURAGING the immediate release of those documents, even though they have been drawn up by radical left Democrats and possible future political opponents, who have a strong and powerful vested interest in attacking me, much as they have done for the last 6 years."
That position was a bit puzzling, since Trump could have shared those documents immediately after the search but chose not to do so. But now he is all in favor of more transparency.
"There is no way to justify the unannounced RAID of Mar-A-Lago, the home of the 45th President of the United States (who got more votes, by far, than any sitting President in the history of our Country!), by a very large number of gun toting FBI Agents, and the Department of 'Justice,'" Trump wrote on Truth Social this week. "But, in the interest of TRANSPARENCY, I call for the immediate release of the completely unredacted affidavit pertaining to this horrible and shocking BREAK-IN."
The idea that Trump would benefit from the affidavit's disclosure seems more than a little dubious. Such documents, by their very nature, present a one-sided narrative aimed at persuading a judge that a search is apt to find evidence of one or more crimes. They do not include potentially exculpatory information, which would undermine that argument.
Trump seems to think more details about the FBI's investigation will energize his supporters by reinforcing his reflexive claim that he is once again a victim of a partisan "witch hunt." More likely, that information would give pause to at least some people who otherwise would be inclined to accept Trump's take.
Right after the Mar-a-Lago search, Fox News host Laura Ingraham, a longtime Trump buddy, amplified his claim that it was the product of a partisan vendetta. "As images of Trump supporters waving flags and holding signs saying, 'In Trump I Trust,' played," The Washington Post noted, Ingraham "demanded that Republicans purge the federal government if they retake power in Congress." She said federal officials who "have abused their power" must be "held accountable."
After the search warrant and inventory were unsealed, however, Ingraham was singing a different tune. "People conflate Trump with people's overall sense of happiness in the country," she said during a podcast interview. "Donald Trump's been a friend of mine for 25 years, and I'm always very open about this on my show. But you know, we'll see whether that's what the country wants….The country, I think, is so exhausted. They're [so] exhausted by the battle, the constant battle, that they may believe that, well, maybe it's time to turn the page if we can get someone who has all Trump's policies [but] who's not Trump."
The Post reports that "some within Trump's circle believe that releasing the [affidavit] would give him additional ammunition to attack the integrity of the Justice Department's inquiry," while "others fear that such a move could backfire because they do not know exactly what it contains." That fear seems well-grounded.
"It's an advocacy document," a "former senior Justice Department official who has closely watched the case unfold" told the Post. While "everything needs to be true, " this unnamed source said, "there's no exculpatory information. It's never a good story for the defendant."
Trump insists that the classified documents cited by the FBI, contrary to their markings, were not really classified. He says he had "a standing order" as president that automatically declassified anything he happened to remove from the Oval Office. Because of that purported decree, he says, it is absurd to claim that he violated 18 U.S. 793 by mishandling "defense information" that "could be used to the injury of the United States or to the advantage of any foreign nation."
Depending partly on whether there actually was such a "standing order," that argument may or may not hold water. Furthermore, it does not address the viability of charging Trump with obstruction or with improperly retaining government documents, although it probably would be difficult for the government to meet the mens rea requirements for convicting Trump under those laws. But whatever the legal merits of his defense, Trump does not claim the FBI is framing him for a crime that someone else committed. He claims there is no crime to investigate. It seems unlikely that the affidavit would help him make that case.

Trump has been criminally investigated by teams of investigators and prosecutors in NY, in the FBI, in congress, over and over and over and the only two consistent things have been fabrication of evidence by the "good guys" and repeated exoneration of Trump. It would take some serious gall to go on this particular fishing expedition. It's possible that is the case but seems incredibly unlikely. Seems more likely that Trump is being goaded into playing their game on their terms.
Or perhaps he thinks that release of a warrant will help him politically. If it is of such wide and broad scope as to be a fishing expedition with a paper-thin basis, then he can justifiably point to it being a witch-hunt.
On the other hand, by showing that they took his passport, despite not inventorying it, and (if my suspicion is correct), against the terms of the warrant, it would reinforce the narrative that they are ignoring law in order to get him. It would actually surprise me if there were not more violations to point out.
Either way, it's clear that Trump wants it as public as possible because he quite reasonably does not trust anyone in government to report honestly. At this point, keeping his cards close like in a normal legal battle is counterproductive. Maximum transparency is Trump's best defense against getting railroaded or Epsteined.

And THIS is why DOJ don't want the ffidavit unsealed. In that document MUST be details on what is to be found and why, and who says what and where it is and why.
Even if we were to see the affidavit there is no reason to believe the affidavit base on past fake FBI affidavits to get false FISAs

The government itself is admitting it made the warrant as broad and sweeping as possible so they could fish through everything, not just recover supposed classified documents. That's kind of burying the lede, isn't it, that they used the pretense of just recovering the documents as an excuse to search for evidence of criminality? The purpose of a warrant is supposed to require probable cause of a specific thing, except the alleged crime seems absent from the warrant.
That position was a bit puzzling, since Trump could have shared those documents immediately after the search but chose not to do so. But now he is all in favor of more transparency.
You're assuming his attorneys or representatives were given a copy of the warrant, even though it was executed while Trump was not present. And it was apparently sealed-I don't know why it would be sealed if there's a copy out there in the hands of a private individual. I assumed Trump didn't even have access to something he could share, which is why he moved to have it unsealed. But once Trump sees what it is, he actually start to present counter-evidence to the public who wants to hear things. You can't really respond to the affidavit when it's hidden, and he wants to respond.
While "everything needs to be true, " this unnamed source said, "there's no exculpatory information. It's never a good story for the defendant."
There's also a documented history of people at the FBI perjuring themselves on affidavits aimed at Trump. It's actually happened, people have served time as a result. It wouldn't be shocking, or it shouldn't be, if it turned out it happened again.
Sullum seems to ignore the FBI/DOJ are already leaking their side of the story to friendly media. So why is he worried about the affidavit stating the story already out there?
All the quibbling over classified/unclassified processes and what should/shouldn't got to NARA is just a distraction from the real issues and questions only the affidavit could shed some light on.
1. What was the actual criminal activity alleged that necessitated an overbroad warrant instead of one narrowly tailored to specific documents under contention?
2. What was the urgency and necessity behind a warrant in the first place vs. a less intrusive method. Why sit on it for weeks?
3. How credible was the source and how severe was the alleged crime that a reasonable person would not fear this is a case of the party in power going after it's political enemies?
Seriously, at this point if there isn't a picture of Trump in a three-way with Putin and Kim Jong Un on top of a map of nuclear silos I think that last one will be impossible to overcome.

I think I might need to explain to some of the libertarian writers here why so many of us who don't even like Trump assume this is dirty partisanship and not a legitimate interest in justice. It's true that we recognize the principle that nobody is above the law. We can all agree with the concept that pure fame, wealth, or political power should not absolve someone from paying for their crimes.
The problem is that prominent political figures in this country are representatives. They carry weight that goes beyond themselves because they represent a constituency who agrees with their politics. This makes them a target as well because they're a symbol of the politics that others will disagree with. And when this political figure is popular and holding themselves in opposition to the current administration, it makes it tempting to just declare that politician a criminal in order to delegitimize the entire movement. "You're wrong for supporting this person! He's a criminal!" It silences the voices of people who support him by connecting them to that accusation of criminality.
If this was a rare thing and the power of the state was greatly restrained, we could perhaps tolerate it. If we knew that the laws were restricted, narrowly, and weren't applied arbitrarily, we could believe in them. But we're libertarians-we KNOW that the criminal is so expansive and intrusive that most people probably commit a criminal offense every single week. We've seen it, and we fear the powerful apparatus of the state and it's ability to arbitrarily prosecute certain people. Even if it was arbitrary but rare, we might accept it.
But this is not rare. Moreover, even if I don't like Trump (which I don't-I have not voted for him and will never vote for him), he represents valid and widely-held political positions of the populace, and the people ARE the governing authority of the United States. The government's repeated attempts to criminalize him because they don't like his politics or the politics of his supporters is a violation of the principles of the country. It's an attempt to silence people by delegitimizing the symbol of their voices in politics. "You can't have these politics because it's all criminal."
And if you're really libertarians, you should be much more skeptical of the power of the government used to shut down a voice critical of the government, even if you disagree with that voice.

It is virtually undeniable that this is a political prosecution. Years ago a book was written about the federal abuse of power. "Three Felonies a Day" showed that the Feds have been abusing power by producing an ever increasing body of laws and regulations that no one understands and that often contradict each other. If they want to get you, this is their tool.
They "justify" using these illicit means by going after real criminals. You'll constantly hear about Al Capone who went to jail for tax evasion, not beating a man to death with a baseball bat. You never hear that Roosevelt loosed the Treasury Department on his political enemies. Andrew Mellon beat the tax evasion charge by having impeccable books and a slew of lawyers and accountants. Mellon's real crime was opposing Roosevelt's insane economic policies.

(1) As narcissistic Histrionic with paranoid features, Trump is simplistic. He wants to know who squealed. That's why he wants it unredacted. Unless this judge, who is the same one who issued the subpoena has zero foresight, he had to know that it was likely he would have to deal with this issue when he signed the warrant. This leads me to my second point.
(2) Exculpatory facts should be in the affidavit. Prosecutors who withhold material exculpatory facts from the judge are requesting a subpoena in a false light. While the integrity of the US judiciary has long been in the toilet, especially in California and Florida, a prosecutor has owes duties to the court and to the defendant. A prosecutor, who takes the position that he does not have to divulge all material facts, has committed fraud on the court and has violated the defendant's rights. When a prosecutor has contrary facts to provide the court, he also has the right to explain why the subpoena should nonetheless be issued.
Prosecutors who withhold material exculpatory facts from the judge are requesting a subpoena in a false light.
You're either not a very good attorney, psychologist, or both. Gonzalez practically lays out that the warrant was attained under false pretenses. The informant didn't say, "The missing documents A, B, and C are in the safe.", they clearly said something far more vague that Gonzalez openly hopes to catch or get more people wrapped up in.
That said, regardless of whether Trump is a paranoid narcissist, he's still owed equal protection under the law and if he or his lawyers can reasonably surmise the above, then they aren't really paranoid. It wouldn't take a genius especially if the FBI is coming in and seizing everything down to the cocktail napkins with scribbles on the back to know that the warrant, affidavit, or both are full of shit.

They have been caught fabricating crimes, framing people associated with Amy and even going so far as to lie in court and to try to keep people in jail for crimes that they were framed for after the frame-up is revealed and documented.

First you need to get your facts correct. The Russian narrative was of Trumps own making. He had numerus deals with Russian and his son Eric has admitted that these Russians provided loans to Trump. It is also a fact that many in his campaign had close ties to Russia. Paul Manafort's in his recent book admitted to giving internal polling data to a Russian intelligence officer. It is also the case that the whole special prosecutor case was a result of Trump firing Comey. The smart thing would simple have been to allow the investigation to quietly come to a conclusion. Trump made a bigger deal of what was a small investigation.
Finally in was a German bank, Deutsche Bank, that had a history of money laundering for Russians, not a Russian bank.

Apparently, there is no written protocol for presidential declassification. Some other laws may apply.
As noted above, he issued a memorandum while in office and has published it online. Whether there are written protocols is irrelevant at this point. He directed the DOJ to declassify and publish the Hurricane documents. The fact that they refused to do so is also irrelevant. He was well within his authority.

Trump never removed anything. His staff did it and he has no idea what they took. It takes time and motivation to look through a bajillion boxes of stuff. He was waitinjg for his second term when his staff would sort it all out. In any case he had been cooperating and in touch witht eh FBI all along. this was utterly unnecessary except to look for personal communications the FBI hoped would show he knew the election was not rigged. they won';t find it. What the majority of individuals watching the media and following pendants don't understand, is that the Mar a Lago raid was a play against the rogue Biden administration officials.
Garland and Ray did something which is not allowed and has never been done (Raiding a former US Presidents Home). Further, its highly likely the move, signed off by Garland is illegal. Trump knew their white hot rage could be used against them, and he was correct.
Now, Garland and Ray are in a complete crap storm, what ever the agents took from Mar-a-Lago is likely inadmissible as evidence. Further, its planted and manufactured, just like the Russian hoax dossier.
Gullible Garland and Ray were lead to believe through subverted informants, that (X), the burning hot evidence was at Mar-a-Lago. It was a trail of bred crumbs, both followed, however it was complete disinformation. This is why Garland was soo angry when he gave his little speech a few days after the raid. Garland knew he got played and Biden had come out and stepped away from all responsibility (I didn't know anything about the raid... Biden stated)... So what is the end game?
Garland has a choice to make... he either resigns before the November election and walks away with his government pension and other benefits .... or.... he waits until after November and faces impeachment by a Republican House and Senate in 2023.
Impeachment will eliminate all of his benefits. Therefore....
My guess is he will quietly resign, just after the election results are tallied, sighting some medical excuse, especially if the Republicans acquire a majority house and senate.
