The Biden Administration Can't Make Up Its Mind About Alcohol
Do you want to brag about America’s alcohol industry, or do you want to crack down on it?
This administration can't make up its mind about alcohol. Sometimes it brags that the industry is thriving. Sometimes it acts like the business needs a government intervention.
Last year President Joe Biden issued a far-reaching executive order that, among other things, ordered the Alcohol and Tobacco Tax and Trade Bureau to investigate anti-competitive issues in alcohol markets. When the report came out earlier this year, it was a complete muddle. It laid out in excruciating detail the diversity and dynamism of American alcohol markets—a result of the craft alcohol boom of the past few decades—but then urged more robust antitrust scrutiny of mergers involving large brewers.
Since then, the administration's position on alcohol has grown only more convoluted. To hear the administration tell it, alcohol markets are flourishing. If only other industries could be so healthy, it argues; if only every industry was so competitive and flush with vibrant businesses. And that, it then declares, is why the industry might need more regulation.
Tim Wu, the administration's point man on competition and antitrust issues, recently spoke at the annual Craft Brewers Conference. He described America's craft beer industry as "the envy of the world" and "a model for how the U.S. economy should be." Given that the industry has gone from less than 100 breweries nationwide several decades ago to over 6,000 today—data that Wu himself has previously cited—it is heartening that the administration seems to recognize this reality.
But in the next portion of his remarks, Wu turned around and shared the administration's "concerns" about consolidation. He also asked brewers to report any illegal anticompetitive activities they observe, claiming that the administration is not interested in pursuing "small technical violations" but wants "to take on the big cases against the entities that have market power."
To be clear: There have been allegations in recent years of so-called pay-to-play schemes in which some alcohol producers or distributors attempt to lock out competitors by securing better product placement at bars or stores. Certain small producers have also complained about other exclusionary conduct, such as distributors being interested only in selling alcohol from big-ticket producers rather than smaller independent operations.
To the extent the administration is genuinely interested in addressing these issues—instead of simply making splashy headlines going after "Big Beer"—it should be encouraging state governments to reduce the regulatory red tape that prevents alcohol makers from selling their products directly to retailers and consumers. In many states, alcohol distributors act as the real regional monopolies in the supply chain—and, unlike other industries, alcohol makers are often required by law to use distributors to sell their products.
For instance, many states prohibit self-distribution of alcohol, meaning craft brewers and distillers have to work through distributors to get grocery stores and bars to sell their brews and spirits. If these brewers and distillers could simply walk down the street to the local watering hole to pitch their products, they would no longer be beholden to distributors engaged in pay-to-play schemes.
Similarly, most states forbid distilleries and breweries from mailing their products right to their consumers' doorsteps. The mail-order economy has boomed since COVID-19, but the alcohol industry remains largely sidelined due to those restrictions. Allowing direct-to-consumer shipments would further empower craft beverage makers and reduce the influence of recalcitrant distributors.
The story of the past few decades of America's craft beverage explosion is that consumers want, and even demand, a seemingly infinite variety of choice when it comes to their beers, spirits, and wine. As a result, craft alcohol producers dot the American landscape. If you want them to flourish even more, the right recipe is not more regulation but less.

That is just me, There are too many producers and consolidation will happen. And how many "cute" names for bad beer are there? There's a microbrewery in my town that does a lot of German lagers, but yes also a few IPAs because that's what the hipsters want.

I thank Jarrett for listing the government interventions in the market for alcohol. He might have added that the dead John McCain's wife has had the government created monopoly on alcohol distribution in Arizona forever it seems.
Meanwhile to sum up his article, it's no surprise Biden can't make up his mind, even though his default choice is always more government (like Reagan said, government looks and "if it moves tax it") and to extract more wealth from a growing industry. People with dementia are afraid to make decisions, so many of them them turn out to be bad decisions resulting in disasters.
It's this kind of market intervention (of which there are tens of thousands in US) that makes us poorer and makes the political class richer.

I think with breweries, and actually a lot of new businesses, there's a weird problem where they're actively focused on being local. I actually have no issue with that, and have some fondness for the ideas of Distributism (though I don't know how you actually bring about the stated ends of it except deregulation). If you then do statistical analysis of the whole country though, it's not surprising that larger companies focused on broad distribution have large markets.
I really, really don't think there is a problem here, or at least any major ones where the solutions are anything other than wonky narrow policy shifts.
Or, I should clarify, I'm not aware of any major issues.
Prior to the 1970’s America had some of the worst beer in the world until Jimmy Carter created a very libertarian home-brewing policy.
Carter’s actions help create today’s craft beer industry and mushroomed small business owned breweries. Many consumers pay more for beer to promote small business.
Today in 2022, the United States has some of the best beer in the entire world as world class as many European beers.
Carter deregulated air lines, trains, trucking, and lending. Before his presidency home brewing was illegal. Some might argue that he was the most libertarian president ever!

Just pointing out that all presidents support some conservative, liberal and libertarian policies. None are Puritans!
For example: Eisenhower had a 70% top tax rate. JFK was socially-liberal but fiscally-conservative. Nixon supported a Universal Healthcare plan more liberal than Obamacare. Clinton left office with a balanced budget.
George W. Bush was socially-conservative but fiscally-liberal, along with his GOP controlled Congress. Bush created tax cuts for the richest Americans without paying for the loss in revenue. Even if you deduct war spending Bush was arguably the most fiscally-liberal president in the 21st Century. Bush who inherited a balanced budget handed his credit card bill to Obama. Obama brought the deficit slightly improved from what he inherited from Bush.
So yes Carter wasn’t libertarian on every issue but no president in American history ever has been.

Hi Guys. Small-scale wine producer here. 3,500 cases per year. Not a lot. We have one outlet and we ship to only a few specific states that I can 1) afford their license fees, and 2) are easy to manage excise tax and sales tax reporting.

Pick a state. Look at the rules. 50 States, 5 are felonies to ship to. New Jersey is the worst in the union for license fees.
It is a well-known fact that the state legislatures define the rules, license fees, excise taxes and sales taxes. It is up to the distributors in these states to pay off their legislatures and Governors to get these bills signed into law to raise the bar into a states market. It's just yet another form of greenmail grift that politicians love.
I disagree that the feds should get more involved. It should be up to the citizens of the state to encourage their legislatures to change.
