USPS Gets Hit With Lawsuit Over Social Media Snooping

Lawsuit filed over USPS surveillance. The nonprofit Electronic Frontier Foundation (EFF) is suing over a secretive social media surveillance program conducted by the U.S. Postal Service (USPS).
As Reason noted in the August/September 2021 issue, USPS has been running an Internet Covert Operations Program (iCOP), in which U.S. Postal Inspection Service (USPIS) agents are tasked with monitoring the likes of Facebook, Parler, Twitter, and Telegram for information about protests and more. Agents with iCOP "assume fake identities online, use sophisticated intelligence tools and employ facial recognition software," Yahoo News revealed last April.
But not a lot is known about the iCOP program—which is where EFF comes in. For now, the group is simply seeking more information about the program. After USPIS ignored EFF's requests for this information, the group filed a Freedom of Information Act (FOIA) lawsuit, seeking more on the iCOP program's creation, operation, and policies, including what it does with the data collected and how it shares this information with other agencies.
"We're filing this FOIA lawsuit to shine a light on why and how the Postal Service is monitoring online speech," Houston Davidson, EFF public interest legal fellow, said in a statement. "This lawsuit aims to protect the right to protest. The government has never explained the legal justifications for this surveillance. We're asking a court to order the USPIS to disclose details about this speech-monitoring program, which threatens constitutional guarantees of free expression and privacy."
"People self-censor when they think their speech is being monitored and could be used to target them. A government effort to scour people's social media accounts is a threat to our civil liberties," added EFF senior staff attorney Aaron Mackey.

Prison time for whistleblower on drone killings. Daniel Hale told the truth about America's secret drone assassinations in Afghanistan, Yemen, and Somalia. For that, he's been sentenced to federal prison. A former U.S. Air Force intelligence analyst, Hale was "sentenced to 45 months in prison after he previously pleaded guilty to passing along classified documents to a reporter that were subsequently published in 2015," as Reason's Scott Shackford notes:
Hale's leaks were intended to show that the drone assassinations under President Barack Obama were not what the American public believed them to be. The government insisted that its secret "kill list" of terrorists was carefully vetted, and the drone strikes were only deployed to kill those the government and military believed it was unfeasible to arrest.
The reality, Hale revealed, was the drone strikes regularly resulted in the death of innocents, and the government covered it up by automatically classifying anybody killed as "militants" even when they weren't the targets of the strikes. This allowed the government to insist that civilian casualties were being kept to a minimum.

Today, President Joe Biden will give a speech about new "Buy American" rules, reportedly raising the minimum amount of a product that must be made in the U.S. (from 55 percent to 75 percent) in order to be considered American-made. Biden will give the speech at a Pennsylvania plant of Mack Trucks—a foreign-owned company (it belongs to the Swedish Volvo Group) that relies on imported steel from Europe to make its trucks.

"'Buy American' rules are just another form of protectionism: they've been found, for example, to act as a barrier to entering the U.S. market and to raise domestic prices in the same way that a tariff does," writes Scott Lincicome at the Cato Institute.
Special provisions in the rules, moreover, make them a particularly‐generous handout for the U.S. steel industry (to steel consumers' clear detriment). The restrictions also encourage foreign retaliation against U.S. exporters, and, far from improving federal projects, routinely confound them (via higher prices, more paperwork, project delays, etc.). Indeed, according to one recent (and quite relevant for today's purposes) study, "Buy American" restrictions tied to federal transportation subsidies raised the price of domestically‐produced transit buses and discouraged the purchase of more efficient foreign‐made buses, thus lowering the quality and use of public transit (frequency and coverage), increasing traffic congestion, and harming the environment.
The Biden administration is also carrying on many of former President Donald Trump's bad immigration policies. Last week, it announced that it would process 100,000 fewer green card applications this year than are allowed to be processed.
"Without drastic revisions in the glacial processing times, President Biden will have presided over one of the largest cuts to legal immigration in U.S. history — and almost no one is talking about it," notes the Cato Institute's David J. Bier in The Washington Post:
While Biden will own this unwelcome distinction, former president Donald Trump staged this disaster last year by barring most immigrants sponsored by their family members from entering the United States. This caused 120,000 family green card slots to go unused.
Green cards permit holders to permanently live and work in the United States, and immigration law provides two primary routes to obtain them — sponsorship by family members or by employers. If fewer family-based green cards are issued than are allotted, the law requires that the unused family-based number from one year be added to the cap for employment-based green cards in the following year — in this case, an additional 120,000 slots (on top of the annual 140,000).
But here's the problem: If those additional employment-based slots aren't used by Sept. 30, the end of the fiscal year, they are lost forever. And the administration is now saying that most won't be, largely because of bureaucracy and a lack of preparation by the federal government.

It depends on the drug, and it also depends on when you were doing this. In the last 10 years, the federal government has cracked down pretty hard on any drug remotely addictive or habit forming. So Queen is correct here that the government has meddled pretty heavily here.

At some point after or during the New Deal, they figured out that they could subvert any law or capture any regulation to work in their benefit. If nothing else, government regulation creates compliance costs that large corporations are able to absorb the costs of compliance better than their smaller competitors. Government regulations act as a enormous barrier to entry and thus always work to the benefit of large, established companies.

Let's say you work for a company that sells nice stuff, and someone asks you to steal a bunch of shit for them. And you do. Who is at fault? Is the person who asked you to be a thief to blame, or you for being a thief? You could have said "No." You had all the power. I'd say you get 100% of the blame.

Right to Repair is a fraud. As is usual with government mandates, faux-libertarians think it just grand, that government knows best, and never consider the root causes or the consequences.
The consequences are more expensive items which are bulkier and less capable. Adding sockets for chips, for instance, requires extra height, making phones thicker; takes up more area, making phones larger; adds weight; requires more solder; is another point of failure; and takes longer to assemble. No one wants phone which weigh twice as much and take up more space in pockets, so manufacturers will compensate by reducing features. People have already chosen, if you will notice how few phones have removable batteries; people are not willing to pay more for less battery.
The causes of the "demand" for right-to-repair are that government laws allow companies to forbid customers from trying to repair products they have purchased. You try to repair that John Deere tractor you bought, you need parts, and John Deere will find out and either sue you or get the government to arrest you. Instead of just not allowing that any more, instead of fixing the problem by repealing bad laws, their solution is to pass new laws, mandating products that most people don't want, as shown by what they demand.
I think that is about right. Everything can be repaired or rebuilt. If it was built in the first place, it is possible to build it again or repair it. It is just a question of how hard that is.
If I own something, I should always have the right to tear it apart and rebuild it if I want to. The maker of that something certainly has a right to cancel the warrenty on it and refuse to repair it to fix my bad work. And they are under no obligation to sell me replacement parts. I don't think selling products and then not bothering with selling replacement parts so that people are forced to buy new things when they break should be an illegal business model. I would prefer they sell parts but I can see why some people wouldn't care and are fine just buying a new one. But my trying to repair it should not be a civil tort or a breach of contract much less a crime. Any contract that prohibits a buyer from working on a product they have purchased is against the public interest and should never be enforced by a court.
That said, the solution is what you advocate for. I don't see how forcing every company to make their products possible to repair accomplishes anything.

It doesn't void any warrantees or grant anyone the ability to fuck up their product and then demand the manufacturer repair their fuckup for free. It's explicitly intended to reinforce property rights so that when (e.g.) Apple sells you a phone, they actually sell you a phone rather than just locking you into a lease/parts/service agreement.
As I said below, Apple has sued people up the repair chain to the point of pulling parts out of old Apple products and selling them in good faith as used/reclaimed Apple parts. Pretty clearly a case of Apple exerting not just ownership, but broad property rights, three and four owners down the line. The pattern of behavior is explicit so that if your phone or laptop breaks, you have to do what Apple says to remedy the problem even though, supposedly, you *own* the laptop. Even if that means paying $1200 for a new laptop just because a $30 battery "got wet". It's old-school land barons bullying legitimate smaller business through digital/intellectual property and Right to Repair doesn't prevent them from buying land, it prevents them from suing to create a trespass to chattels.
Seriously, read up on it. There are cases of 10 and 20-yr.-old (read: out of waranty) recreational boat engines being repaired (and I don't mean like, rebuilt, I mean like replacing the fuel lines) by people who were engine repair technicians for 20+ yrs. before retiring. The argument manufacturers are making isn't that they might be held liable for defects/faulty repairs, they are seriously arguing that if just anyone can repair a boat motor, there's a risk of fuel leakage and fire/explosion (I'm not joking).
It's the licensing requirements iteration of regulatory capture that, like FB moderation, seems to be libertarians' Achilles Heel. Where manufacturers insisting that everyone who touches their product be licensed by them under penalty of lawsuit is OK because it's not the government creating and enforcing the licenses... directly.

It doesn't stop Apple from making a zero-port, single-board phone (market economics, logistics, and price stratification does that). It stops Apple from suing me if I, for instance, buy two broken iPhones off eBay, combine the pieces into one working phone, and sell it as a refurbished iPhone.
And, to be clear, this is being generous to Apple. There have been repair shops that did what I said and Apple sued saying they weren't officially-licensed Apple parts. When the repair person 'advertised' they were used, unlicensed Apple parts, Apple sued saying the repair person wasn't an officially licensed Apple repair technician. When the repair person 'advertised' they were unlicensed parts and an unlicensed repair, Apple sued saying they couldn't perform the repair because they were unlicensed *and then proceeded to sue the sellers of "unlicensed" products*.
It's a clear corrosion of property rights/informed consent where Apple sells you a phone or parts under a contract that says you own the parts when, in reality, they're renting you a phone or parts and/or leasing *their* parts to you.

If they're producing a product for people to use, but not own, then they're not selling the phone but providing a service, a service that would/should/has been confined to the terms of the warranty/service contract. If Apple says "We won't support this product after 1 yr." then they've terminated their portion of the service agreement and the product, and its reputation, are no longer held by Apple.

That is a huge drop in Independent voters over a very short period of time, and it's likely to have an outsized effect in swing districts and swing states.
The president's party typically loses seats in the House in a new president's first midterm, with the median number of House seats lost being in the mid-twenties. Whatever it is that the American people don't like about Joe Biden, if you're a Democrat in the House, you probably shouldn't make any big real estate investments in the greater Washington D.C. area between now and November of 2022.
It's hard to put your finger on why Biden is losing support among so many people so quickly. Maybe it's because of cognitive decline. Maybe it's because of his bizarre speech comparing January 6, unfavorably, to the Civil War. Looking at another poll, which I'll link below, it may be that people are disgusted with the Democrats in Congress, as well as Biden's push for policies there, and it's spilling over onto Biden personally. The median is -26 House seats lost.
Down towards the bottom, there are issues where the progressives and the Republicans were divided against each other. Apart from that, the overwhelming trend is that the more controversial the agenda in, the bigger the loss. The exceptions seem to have to do with rare events that aren't blamed on the president in question. George W. Bush's midterm was after 9/11, when Americans everywhere were flying flags from their cars, and before we invaded and occupied Iraq.
Unless there's another 9/11 event for Biden between now and November of 2022, we should probably expect to see the House Democrats perform somewhere below the median in 2022. As I've said before, I think this is probably the reason why Pelosi promised to not seek the Speaker's chair after the 2022 election. She doesn't expect the Democrats to control the House after 2022, so she's not really giving up anything.

The question the poll asked was whether Americans were optimistic or pessimistic about "the direction of the country", and., again, between May of 2021 and July of 2021, optimism dropped a whopping 26 percent among Independents.

"Direction of the country" encompasses not only the President but also Congress, and the Republicans aren't in charge of any of it. Whatever it is the Democrats are doing and promising to do, it looks like the American people are against it.

They say Americans approve of things like the Afghanistan withdrawal. I'm not sure how many of them realize that was a Trump thing.
The way they label some of the issue may be confusing to the people being polled. They say Biden is unpopular on immigration, gun violence, and crime.
It's hard to interpret anything about immigration as being about anything other than the situation at the border. What do they mean by gun violence? If you're unpopular on gun violence, does that mean you don't like Biden's stance on gun rights? Does that mean you want Biden to do gun control? And I don't know how you see Biden being unpopular on crime as being about anything other than what it is. Crime is out of control, and the Democrats have morphed from being about being pro-BLM and defunding the police to being incapable of even talking about crime as if it were a bad thing.
I think the most interesting part of that issues poll--the part that screams the loudest--is the issues that aren't there. Biden's agenda has mostly been about H.R.1, the Green New Deal, and expanding entitlements. He's up there screaming about how it's worse now than it was in the Civil War, and he wants to spend $3.5 trillion on climate change, expanding Medicare, etc. Why aren't people clamoring for that stuff in the polls if they're so popular?

Prosecutors said that, in fact, the prototypes that had been unveiled didn’t function and were Frankenstein monsters cobbled together from parts from other vehicles. At public events, the vehicles were towed into position and were powered by plugs leading from hidden wall sockets.
In one instance, in which the vehicle was filmed for a promotional film, tape was used to keep the doors of a truck prototype from opening, prosecutors said. To make it appear the truck was driving, it was towed to the top of a hill and then rolled down to the bottom, according to the indictment.

So, yeah, um . . . I still say the future is electric, but this stuff is best left to investors and entrepreneurs using their own money. Letting the government force us to sacrifice our standard of living based on the promise of technologies that are still half baked and aren't yet economically efficient enough to maintain our quality of life is a foolish thing to do. The future will get here when it gets here. In the meantime, Tesla is hitting record profits, and the demand for their cars is still strong.
This is SOP for Silicon Valley. Produce an idea with no real concrete plan about how it will work, *somehow* convince people to throw wads of cash at you, then spend the next few years spending that cash, pretending to produce the idea until the whole thing collapses, then move on to the next idea.

After having multiple discussions with Ken about how, while electric vehicles may be the future, they aren't the future *right now* (and he disagreed with me), I found this post (or set of them) confusing/contradictory.
I think the Rivian will be amazing, and just because this Nikola company was a joke doesn't mean all of them will be.
And this really was my point:

It's hard enough for private investors and funds to know which of these companies should be invested in and which ones shouldn't. If you're like me, and you want to see auto industry evolve, you want them to do so through competition, technology, and market driven demand.
That really is my point. This company was able to get a lot of money from investors, and they were exposed and shut down. What chance do government bureaucrats have of making the right call?
The money the Biden administration is "investing" in the green space is likely to be squandered on projects like this. Part of the infrastructure deal spends billions building a national network of charging stations. What a stupid thing to do!
If the demand for those charging stations were already there, someone would already be funding it privately, and the chances of those chagrining stations doing what the market demands, where the market demands it, are extremely unlikely--because they're being built by government fiat rather than investors chasing profits.

I read a couple of articles in the last couple weeks that pointed out that the upper estimates of the world's lithium reserves doesn't account for every car in America today going electric. And, being clear, that doesn't address every car in the world, population/car sale growth, grid-scale requirements, and ancillary lithium-powered products like tools, electronics, and appliances.
Now, I freely acknowledge the idiocy of peak oil and the Club of Rome but, at the same time, Henry Ford wasn't advancing ICE technology in every home in the world to save the world from the mortal evils of coal and whale oil and, like the Club of Rome we aren't talking about the demise of the ICE 6 decades after its widespread adoption. They are and for the forseeable future, will be an unsustainable luxury/status purchase and to advertise them as threading the needle of mankind's energy needs into the future is disingenuous. I don't have a problem with them intrinsically. As I've said before, if I could afford an electric motorcycle at a 1:1 price point with an ICE motorcycle (rather than 3 or more:1), I'd absolutely buy one, and I'd freely admit that I did it because of the convenience and lower maintenance costs/requirements rather than the "fact" that the lack of emissions was saving the planet or that electric vehicles were the key to mankind's sustainable future.
Circling back to your point, do you think the Nikola company was more able to raise money because Biden likes electric cars or because Elon Musk likes Tesla or because you (both literal and metaphorically) like to say you'll buy a Rivian (revealed preferences to be discussed after you actually purchase a Rivian). I'm much more inclined to believe that while the former has an effect, the latter (you, metaphorically) were more responsible for the majority of the hype.

Rivian is a going concern because they have the full backing of Ford and Amazon. Amazon wants to build their own home delivery service fleet, and they're using Rivian's technology to do it. And, yes, Ford is all in on that project. They know stuff about building trucks that Americans want to buy, and they see Tesla's stock commanding a multiple on their earnings that values them more than Ford--so they want to emulate that model and attract that kind of multiple for their stock, too. You can't buy into Rivian. You can only buy Ford's stock.
I think Nikola was mostly about someone taking advantage of speculators in the market, who wanted to get in on the next Tesla before it took off. It was like the dot-com bubble or Elizabeth Holmes and Theranos. When the world's investors are willing to throw their money at businesses based on technology they don't really understand, people will come along and take advantage of that. I bet there were a lot of retail investors in Nikola.
I suspect Biden and company are more victims of this kind of thinking rather than progenitors. It's Tulip mania, and when the smartest people in the room are doing something stupid, Biden and company don't have the character or the wisdom to see what's happening. When Buffet says he won't buy technology companies because he doesn't understand the technology behind them, he's avoiding that common mistake. And really smart people make plenty of dumb mistakes.
Bear Stearns and Lehman went belly up buying New Century's subprime portfolio when they went into bankruptcy circa July of 2007. Those were some of the smartest, most well motivated guys on the planet--far more so than the politicians, bureaucrats, and regulators of the time. When Bear and Lehman went bankrupt in 2008, almost a year later, because of those CMOs they were holding, everyone panicked--especially the government. Moral of the story is that even the best of the private investors are prone to making huge mistakes, and Wall Street has the discipline of playing with their own money. What chance does Biden have to see through all the lemmings and the hype?
Biden follows their lead on Wall Street and Silicon Valley. Silicon Valley tells him that automated cars will be here by 2020, and he believes them and acts accordingly. There are companies out there right now trying to make a legitimate business out of charging stations and pre-charged battery trading stations, who may be driven out of business by Biden's stupid infrastructure spending. And the only reason their new competitors will be in business is to get those government funds. It's sure to happen. It always happens.
Professional hedge fund managers with staffs of technology experts and financial analysts--who get to keep 20% of what the fund earns--have a hard time making the right investment decisions, and Joe Biden and his merry band of green new world believers don't know shit about what makes a company like Tesla successful. There's no way they'll be able to target the right companies or even industries. The ones they should invest in and the infrastructure they should build doesn't even require their financing.
Biden is a lemming that's rushing in where really, really smart angels fear to tread.

Assuming this was in response to my 'revealed preferences' comment, I meant buy the actual product, not ownership in the company. My understanding is that you can currently buy, or at least pre-order, a Rivian just not at a dealership. If you spend all day preaching the virtues about Rivian and EV trucks, and then climb into an ICE F-150 when a Rivian is available, as you know, it speaks louder than your preaching.
Hard to read Ford or Amazon's tea leaves. Amazon is pretty clearly all in on dumping their emissions onto the grid and claiming any/all credits for being emission-free (they already advertise as such). There is also is a bit of protectionism going on if any upstart competitors have to invest in an all-electric fleet (with Tesla or Amazon in control of the charging stations) first. Ford, who knows? A hybrid pickup or semi certainly has the potential to be absolutely fucking awesome. Like driving a diesel-electric freight train down the road.
The point was that the truck was vaporware.
The people who promoted it back in 2016 are being indicted for fraud, and they're probably going to jail.

Amazon and Ford are neck deep in Rivian. They're not publicly traded (I don't think). Amazon is ordering their platforms like crazy as delivery trucks, and Ford will use their platform to make F150s eventually.
They're really just making the platform--you can slap anything on top of it that you want. The motors are in the wheels. I'll be interested to see how it does in water and mud. It'll be torquey as all get out. Should be great off road--so long as it can handle water and mud down in those wheels.
I’d be skeptical about submerging motors that will see on and offroad shock. IP69K is nice but the seals will take a beating.
I'd love one, but up here their range will drop to 50 yards for six months of the year. Canadian winters aren't kind to batteries.
Not to mention that, at least to start, the price of a Rivian will be 2X the cost of a base model F-150 (and ~1.5X the price of a Wrangler). And, all the off-roading I've seen and done, the fact that the Rivian's base curb weight is the F-150s ceiling (and, again, that the F-150s curb weight floor is well above the Wrangler's curb weight ceiling) doesn't bode well for its off-road performance (unless you're one of those soccer moms that enjoys driving your kids to practice in an off road vehicle).
Of course, Ken and EV fanboys are going to hype Rivian's trucks/SUVs as a great off-road vehicle when, in reality, it's more of a downsized Expedition, Escalade, or King Ranch F-150 at a similar-to-higher price.

You realize you played the exact gambit that I pointed out? An additional 250 ft. lbs. of torque is great, unless it comes at the cost of an additional 500 lbs. of curb weight. Better both cost and weight-wise to soup up the ICE.
Say, for whatever reason, I need 800 hp or 1,000 ft. lbs. of torque, there's nothing like turbo chargers I can bolt onto the EV motors and I have to (and can? Sounds like we're not even sure we can switch out batteries.) replace all 4 motors on the Rivian, right? Continuing this along the lines of what I said above, I can drop in a couple of relatively cheap turbos, get the hp/torque I need and practically ignore the additional weight, right?
I remain unconvinced of the transcendental "this is the future" aspect of EVs (as long as 100% of us live on this planet and nuclear is a minority power source anyway). The potential for distributed power is interesting but, as I indicated above, not nearly as interesting at the potential for something like distributed hybrid power.
