Florida's Social Media Bill Was Supposed To Protect 'Free Speech.' A Judge Says It Violates the First Amendment.

First Amendment protects right of social media companies to boot politicians. Florida's controversial and authoritarian new social media law has been temporarily blocked by a federal court. The measure—championed and signed into law by Florida Gov. Ron DeSantis in May—bans large social media providers from deplatforming political candidates, beginning July 1.
It also prohibits social media providers from suppressing or prioritizing any information "posted by or about a user" who is a candidate for political office, and from suppressing or adding addendums to posts by a "journalistic enterprise" based on the outlet's content. Those that violate this directive would face fines of up to $250,000 per day (though some of Florida's favored companies, like Disney, are exempted from the law).
On Wednesday, Judge Robert L. Hinkle of the U.S. District Court for the Northern District of Florida ruled that the law violated the First Amendment.
Florida's assertion that it is on the side of the First Amendment "is perhaps a nice sound bite," wrote Hinkle. "But the assertion is wholly at odds with accepted constitutional principles."
"The legislation compels providers to host speech that violates their standards—speech they otherwise would not host—and forbids providers from speaking as they otherwise would," noted Hinkle in his decision. Moreover, "the Governor's signing statement and numerous remarks of legislators show rather clearly that the legislation is viewpoint-based."
The social media measure also runs up against provisions of the federal communications law Section 230, which—as Hinkle points out—"expressly prohibits imposition of liability on an interactive computer service—this includes a social-media provider—for action taken in good faith to restrict access to material the service finds objectionable."
The judge granted a preliminary injunction against the law, as requested by tech industry associations NetChoice and the Computer & Communications Industry Association, and ordered the state to "take no steps to enforce" the portions of the law that violate the First Amendment or are preempted by Section 230.
"The legislation now at issue was an effort to rein in social-media providers deemed too large and too liberal," concluded Hinkle. But "balancing the exchange of ideas among private speakers is not a legitimate governmental interest."

How Trump lost 2020. An interesting and detailed new report from Pew Research Center dissects the demographics of the 2020 election. "A number of factors determined the composition of the 2020 electorate and explain how it delivered Biden a victory," notes Pew. "Among those who voted for Clinton and Trump in 2016, similar shares of each – about nine-in-ten – also turned out in 2020, and the vast majority remained loyal to the same party in the 2020 presidential contest."
Trump did gain in 2020 among women and among Hispanics. But this was offset by Biden's gains among men, suburban voters, and white non-college-educated voters.
The juxtaposition saw a significant narrowing last year of the voting gender gap seen in 2016:
Biden made gains with men, while Trump improved among women, narrowing the gender gap. The gender gap in the 2020 election was narrower than it had been in 2016, both because of gains that Biden made among men and because of gains Trump made among women. In 2020, men were almost evenly divided between Trump and Biden, unlike in 2016 when Trump won men by 11 points. Trump won a slightly larger share of women's votes in 2020 than in 2016 (44% vs. 39%), while Biden's share among women was nearly identical to Clinton's (55% vs. 54%).
Last year's election also saw boomers and older voters become a minority:
After decades of constituting the majority of voters, Baby Boomers and members of the Silent Generation made up less than half of the electorate in 2020 (44%), falling below the 52% they constituted in both 2016 and 2018. Gen Z and Millennial voters favored Biden over Trump by margins of about 20 points, while Gen Xers and Boomers were more evenly split in their preferences. Gen Z voters, those ages 23 and younger, constituted 8% of the electorate, while Millennials and Gen Xers made up 47% of 2020 voters.

Amazon wants Federal Trade Commission (FTC) Chair Lina Khan recused. The new FTC head has been a very vocal critic of Amazon in the past, including publicly opining that the company is "guilty of antitrust violations and should be broken up." In a motion filed Wednesday, Amazon suggests there's no way Khan can or will be impartial in any antitrust probes into the company.
An Amazon spokesperson, Jack Evans, told CNBC that while "Amazon should be scrutinized along with all large organizations," it still has "the right to an impartial investigation," and "Khan's body of work and public statements demonstrate that she has prejudged the outcome of matters the FTC may examine during her term and, under established law, preclude her from participating in such matters."

If anti-racism is acceptable racism to counter perceived racism (but certainly isn't critical race theory, just looks, sounds, and acts like it), I posit a 'controversial and authoritarian' law is acceptable to counter authoritarian practices by publishers and platforms. The irony factor is a plus. That said, I am not for government regulation or interference, although it seems that it may be the only option in some cases recently.

Also, wealthy donors gave millions upon millions of dollars to 5 major cities in battleground states, ensuring that every single potential democrat voter was able to get their vote in. You don't need fraud when a billionaire can pay $50,000 per democrat voter to ensure their ballot gets counted, while rural voters are left without similar services.
I was saying this at the end of last year: if conservatives were smart, they would realize that they will lose every national election going forward if they do not correct this. State by state laws that require equitable financing of election commissions (you must fund rural and urban districts equally, for example) will do more to ensure electoral competitiveness than any of their obsessing over fraud. But I suppose it is much easier to gripe.

It's pretty easy to come up with a scenario where heading back to work is a net-negative strictly due to the cost of daycare. But that predates the pandemic and so is part of the baseline unemployment level, not the stubborn uptick in place since restrictions have started to recede.

Rather, it's an example of rank intimidation by the Democratic party and the government--worthy of Vladimir Putin.
Property rights and association rights are important and should be protected, but that isn't what's happening here. Defending rank intimidation by a one party government as property rights and association rights might be the worst thing you could do to reinforce the importance of protecting those rights in the minds of average people. Rather, we need to denounce rank intimidation by government as the violation of free speech it is. Libertarians will someday look back at this era like the Red Scare, and the time for us to start denouncing the Democrats' objectives and tactics is now.
P.S. Before Lina Khan was nominated by Biden to be commissioner at the FTC, she was the lead author in the House Democrats' report--released in October of 2020--detailing how she and the Democrats would break up Amazon and why. Being the lead author of that report is the reason why Biden appointed her to commissioner at the FTC. Anyone being subjected to legal action by a regulatory authority that is already biased against the defendant--before arguments are even presented--is wrong. This commissioner has not only already reached a verdict but also pronounced sentence--before she was even commissioner!
It's unlikely that the other commissioners will vote to recuse an appointee in the Amazon case. That isn't what they did in these situations in the past. There is precedent, however, for the courts to set aside a judgement as the result of a case brought by the FTC because the commissioner was already biased against the company in question before he or she became a commissioner. Suffice it to say, if Lina Khan isn't recused, the FTC risks the courts setting aside any judgements reached in a case in which she was already biased.

This is exactly what Lina Khan has done. As a congressional staffer, she was the lead author on a detailed report listing all the reasons Amazon should be broken up and why--with specific remedies already spelled out in detail. She apparently published articles that reached similar conclusions as a graduate student. So, don't expect that if Amazon loses its case, the judgement will necessarily stand.
And, incidentally, in that same report Khan prepared for the House Democrats, she also argued that Facebook should be broken up for tolerating "misinformation"--among other crimes against humanity. IF IF IF the FTC's case against Facebook is allowed to proceed, any judgements Facebook is subjected to may be vacated for the same reasons. She may be both a holy terror for big tech companies and a liability to the FTC.
There may be a point that we are targeting the wrong entity for punishment in going after Amazon.

Is the only option available, in order to hold the federal government in check, to penalize their tools at the state government level? A convention of states is perhaps the only recourse that exists to put down the thoroughly corrupted and totalitarian federal government, from judges to senators and everything in between.
I've been advocating a convention of states to implement a balanced budget amendment for a long time. Republican currently control the legislatures of 30 states outright. They may control more in 2022 and 2024. Running a contract with America kind of campaign nationally, on the basis of a promise to hold a convention of states and vote on a slate of Amendments, could really bring about some positive change in this country--and might get people jazzed up about giving the Republicans more state legislatures to control.
I love this country and the Constitution, and I still want to believe that the American people are fully capable of taking control of their government again, and a convention of states is a thoroughly constitutional and legitimate way to accomplish that. I fear the other ways to reestablish the people's control of our government may be constitutional and legitimate but messy and destructive. You can consider me a supporter for the idea of a convention of states. There are real solutions to be found in such a strategy.

If it isn't big enough for Bernie, you're not getting it. If you want an infrastructure bill, he and another progressive in the Senate is all that's needed to stop it.
The primary threat to Biden's $1.2 trillion infrastructure bill and his $3 trillion budget reconciliation bill is not the Republicans in the Senate. It's the progressives in the Democratic party--like AOC and Bernie Sanders. AOC was on TV earlier this week explaining that the $6 trillion she wants to spend on climate change isn't all in one year. It's over ten years--so, it's not really all that much!
Whether we're talking about Biden spending $3 trillion on climate change to eliminate fossil fuels from power generation in 15 years or AOC's bill to spend $6 trillion fighting climate change in 10 years, we're talking about the Green New Deal. She's even calling for the creation of a New Deal program like the Civilian Conservation Corps for climate change. Don't get lost in the accusations of "bipartisanship" for this spending (no Republicans have actually voted for this spending yet). It's a distraction.
The fight is between progressives in the House (where the Democrats only have a nine vote majority) and the progressives in the Senate--on one side--and the more pragmatic Democrat leadership--with Biden, Pelosi, and Schumer--on the other. How sorry is it if Biden, Pelosi, and Schumer are what passes for moderate Democrats these days?!
Anyway, the Democrats don't need any Republicans to vote for any of this spending to get it passed, and nothing the Republican do can stop it from happening. If Biden wants any of this spending at all, however, they will probably need to capitulate to AOC, Bernie Sanders, and the progressives Democrats. It isn't about the Republicans, and it won't be until after the midterms in 2022. It's a fight between progressives and establishment Democrats.

No, they are choosing _not_ to engage in speech. Which is one half of what the First Amendment guarantees: no compelled speech.
If social media posts are the speech of the user not the company, then the company is not engaging in speech by being forced to allow social media posts they disagree with. The user would be the only one engaging in speech, but that's not what the judge just said. He said that a company is engaging in speech when a third party posts on their platform.
Fine, they are being compelled to facilitate someone else’s speech. Pretty sure that violates First Amendment protections, too.

What is the point of writing a negative article about one of the few politicians who didn't go full blown totalitarian during covidcon? Seems wrong to do if you value freedom or liberty at all. I don't think trying to regulate facebook or google is worth the effort plus it won't work... They have too much money and power. I would just advise republicans not to use their platforms, services, and products. Granted it isn't easy but I quit facebook. I do still use some google crap but I try to limit it as much as I can and always look for other options. Death by 1000000 small cuts.
