Immigrants Are Less Likely To Commit Homicide, Sex Crimes, and Larceny Than Native-Born Americans

A new study finds that both legal and undocumented immigrants are more law-abiding than native-born U.S. citizens.

Nativist politicians love to draw a connection between crime and immigration. If we could just remove as many undocumented immigrants as possible, they promise, we'd see violent crime plunge. But that isn't what the data say. In fact, both legal and undocumented immigrants are significantly less likely to commit "just about every type of crime," including homicide, sexual offenses, and larceny, according to a new study by the Cato Institute.

It's the latest entry in a burgeoning collection of analyses that throw cold water on the notion that immigrants pollute communities with crime.

In the latest study, Alex Nowrasteh, Cato's director of immigration studies, combed through data from Texas, the lone state in the U.S. to note immigration status when recording arrests and convictions. In order to calculate the estimated undocumented immigrant population, Nowrasteh leveraged a methodology similar to—but more conservative than—the one used by the Department of Homeland Security, so his results might slightly overstate the conviction rate for the undocumented.

"Texas is an ideal state to study criminality by immigration status for multiple reasons," writes Nowrasteh. "It borders Mexico; it has the second‐​largest illegal immigrant population of any state; it is a politically conservative state governed by Republicans; it did not have jurisdictions in 2019 that limited its cooperation with federal immigration enforcement; and it has a reputation for severely and strictly enforcing its criminal laws."

His results: "1,190 natives were convicted for every 100,000 natives, 749 illegal immigrants for every 100,000 illegal immigrants, and 510 legal immigrants for every 100,000 legal immigrants." Conviction rates were 57.2 percent lower for legal immigrants and 37.1 percent lower for undocumented immigrants, when compared to the native-born population.

The study also breaks the data down by crime. As Nowrasteh notes, murders committed by undocumented immigrants receive a great deal of media attention. According to the data from the Texas Department of Public Safety, legal immigrants are 57.1 percent less likely to commit homicide, while undocumented immigrants are 27.7 percent less likely.

What's more, legal immigrants are 53.3 percent less likely to have a conviction for sexual assault, commercial sex, or miscellaneous sexual offenses, while the undocumented are 16.1 percent less likely. On larceny, conviction rates are 68.7 percent lower for the former, 77.6 percent for the latter.

Convictions are one thing, but what about arrests? It's a similar story: The arrest rate for legal immigrants is 50.5 percent lower than for the native-born, while the undocumented rate sits 32.7 percent lower.

Meanwhile, 72 percent of Americans believe that immigrants come here not for government aid but for the opportunities, and 55 percent want a pathway to citizenship for the undocumented. In other words, current immigration policy reflects neither what citizens want nor what the data demand.

    Legal immigrants are often pre-screened for criminal pasts as well as required to have a work history. A comparison of that set of immigrants to similar situated american citizens would lead to similar statistics.

    The statistics are sampling two different sets of populations: one set prescreened for crimes/work and the other not.

    Libertarians don’t look intelligent repeating the same biased studies over and over.

    1. Again, the argument is taken completely out of anything resembling appropriate context. Nationwide, violent crime clearance rates are like 55% of violent crimes and 15% of property crimes. So, the best conclusion that can be drawn, in context, is “When police catch the perpetrator, they’re more likely to catch native perpetrators than non-native/undocumented.” which, unless you’ve got theories about the magical crime-preventing properties of foreign soil, duh. People who only do 15% of the job generally do the easiest 15% first.

    A: When illegal alien advocates present IAs as victims they stress that IAs underreport crime because of the potential for deportation. Naturally this unreported crime does not result in arrests and thus this analysis is flawed by omitting this. [Lie all groups IAs tend to commit crime within their own group.] Thus we get a false sense of the crime level among and by IAs. Rather than the numbers being slightly overstated they are in fact significantly understated.

    The only question is whether the II advocate understands this and is lying or simply regurgitates IA advocacy group press releases because they align ideologically. It’s disappointing how often Reason fails the standard they apply to other news and opinion publishers – and for the exact same reason.

    How does your control group compare to the control group other people are talking about when they oppose immigration?

    They aren’t interested in hearing that illegal aliens commit less violent crime than the nastiest neighborhood in Texas, where the native born Americans live at the same income level of illegal immigrants. They want to know whether illegal aliens are perpetrating more crime than what they experience in the affluent suburbs. They don’t want their affluent suburbs overrun with all the crime that poverty brings–even if the illegal immigrant poor bring less crime than native born American poor.

    This is silly way of looking at things. If black youth is 5 times more likely to commit crimes than a Latino immigrant, that’s not an argument for more immigration, since you’re just adding more crimes on top of existing crimes. If southern migration is an annual thing and only 1% of that group is a criminal, then we’d still be admitting hundreds of criminals into our society. Native borns may have lived in this country all their lives and are counted in the system when they commit crimes. Illegals not as much.

    “But their economic contribution offsets the small risk” is something that made more sense in 2017. People aren’t going back to work now, including those immigrants for obvious reasons. America’s suicidal crusade against the police has already led to rise in homicide and I wouldn’t be surprise if there an uptick in Latino crimes in the near future.

    Most importantly, if a citizen of this country suffered at the hands of an illegal criminal, then he or she has a legitimate gripe. Because the criminal was not allowed to be in this country, and did not go through proper screening and background checks like law abiding legal immigrants. The immigrant crime rate is a moot point. A tiny speck of gun owners go on shooting sprees, but they go through background checks anyways. You can argue for less restrictive immigration, not open borders.

If black youth is 5 times more likely to commit crimes than a Latino immigrant, that’s not an argument for more immigration, since you’re just adding more crimes on top of existing crimes. If southern migration is an annual thing and only 1% of that group is a criminal, then we’d still be admitting hundreds of criminals into our society.

If they let in 50 immigrants and only 5 of them were criminals, then there would be 15 criminals. “But most immigrants are criminals” is a moot point, because you got more criminals.

        Since most immigrants do contribute to the economy, we won’t let the small criminal element in that group from totally closing our borders. But even according to the CDC, they end up being a slight negative on state budgets. SS and medicare will pay out 3 times what people put in. If we let in and legalize a few thousand 48 year olds from South America, within 15 years they start to take more from the government than they can ever put in.

        The pandemic will also wipe out a ton of jobs that sustained lower middle class immigrants. So yes, we shouldn’t fear crimes from immigrants, they’re not violent as a whole. That doesn’t mean we should ignore the downside of having massive, unchecked immigration in a nation on the brink.

    1) screened for law-abidingness, or
    2) face deportation if they manage to get arrested (because Texas runs all arrests through the immigration databases)
    are more law-abiding than the native-born.

    However, it is also absolutely true that the US-born children of refugees and illegal immigrants are substantially more likely to commit crimes than native-born non-Hispanic whites.

    Thus, cracking down on illegal aliens reduces crime, both by increasing the risk of criminal activity to the illegal aliens themselves and by reducing the number of born-to-illegal-alien criminals in the US. On the other hand, leniency toward illegal aliens increases crime, both by reducing the risk of criminal activity to the illegal aliens themselves and by increasing the number of born-to-illegal-alien criminals.

    Now, if you want to argue for refugee and illegal alien rights on the basis of fundamental libertarian principle, that’s a perfectly fine thing. But you should acknowledge that you are advocating a policy that will result in increased crime thanks to the incentive and second-generation effects.

      1. Criminals commit multiple crimes before ever getting caught for the first time. A criminal with 20+ years have more time to be convicted, and therefore be added to the numerator of the ratio (crimes convicted out of %).
        Logically, this would have to negatively affect convictions among illegal immigrants.

    Setting aside that unethical argument, context matters. Illegals from Mexico and Central America largely prey on those around them, who aren’t as likely to involve the police. No witnesses will come forward. If they do, how do the police locate and investigate someone without a local social network or personal records, credit cards, social security number, school/criminal records, etc…
    Convictions and crimes committed aren’t equal.

  32. The importance of crime through immigration/immigrants is arithmetic, not geometric. Who cares what the relative rates are? To use easy numbers (incorrect but for illustration), if 1/100 illegal immigrants commit violent crimes in 2022, versus 2/100 of all others in the US, and there are 2,000,000 illegal immigrants in the US, that means there are 20,000 violent crimes committed in the US that should not have been, if we had a 100% effective border. What is the relevance of “but there are lots of other violent crimes”?

    1. Not according to this study. Admittedly, there are problems both with estimating the denominator (the illegal immigrant population) and with unreported crimes. I expect that the rate of unreported crimes is much higher when the victims are illegal immigrants, and that, like all crimes, the perpetrators are more likely to come from the same community. So it’s likely that the rate of illegal immigrant on illegal immigrant crimes is very high.

      But you’re not worried about what they do to each other. You’re afraid of what they might do to you. And as a law-abiding native-born American, you _would_ report a crime committed on you by a brown-skinned person with a foreign accent, so those crimes are not being under-reported – and you clearly have more to fear from other native-born Americans [1] than from legal or illegal immigrants.

      [1] Note that I didn’t say “law-abiding native-born Americans” – with the possible exception of college girls who get drunk at frat parties, upper-middle-class Americans rarely assault, rob, or murder each other. But what you should worry about far more than immigrants is poor (white and other colors) trash Americans – and that includes the children of immigrants that did better in the USA than they could have in their country of birth, but not as well as most people with the good fortune to be born into middle-class America.

  36. So, what do the native numbers look like if you exclude everyone with a prior felony criminal record? Immigrants, particularly illegal aliens, get deported after getting convicted of felonies while natives get lots of training and networking opportunities in the criminal arts before getting dumped back onto the street in a couple of years.

    It is hard to tell if we are looking at a reduced propensity for crime, or a much lower ricividism rate as a result of sending criminal immigrants back to their home countries.

  38. One other thought: many (perhaps the majority) of illegal aliens are here by overstaying their visa. It is not like a bunch of kids on college visas are going to start a giant crime wave after they graduate. That is a bit different from the sneak across the border types that most think of when they talk about illegal aliens.
