Contrary to What Biden Says, Gun Show Sales Aren't Exempt From Background Checks
Plus: GOP gender policing in North Carolina, marijuana legalization mistakes, and more...

Setting the record straight on gun show sales. In announcing new gun control plans yesterday, President Joe Biden commented on alleged loopholes in gun background checks. "Most people don't know, you walk into a store and you buy a gun, you have a background check. But you go to a gun show, you can buy whatever you want and no background check," according to Biden.
Multiple fact-checkers have taken issue with this claim.
The Washington Post fact-check team notes that federally licensed gun show sellers are indeed required to conduct background checks on buyers and to "file substantial paperwork." You can check out the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) guidance for gun show sellers here.
Some people do try to circumvent these rules by pretending they are not actually in the business of selling guns. However, "gun dealers who pretend to be gun hobbyists but actively trade guns at gun shows are prosecuted," point out the Post's Glenn Kessler and Salvador Rizzo. "It's also against federal law to sell a gun to any person you have reasonable cause to believe is a prohibited person, such as a felon."
Politifact also took issue with Biden's statement. Fact-checkers Louis Jacobson and Amy Sherman point out that:
When it comes to background checks for gun purchases, what matters is who sells the guns, not where the guns are sold — and when a federally licensed seller is a vendor at a gun show, they have to run a background check just as they would if they were back at a bricks-and-mortar gun store.
What matters is if the seller is in the business of selling guns—in which case they must be licensed by the feds and must conduct background checks or else they're already running afoul of the law—or a private seller who just happens to be selling a gun. More from Politifact:
Specifically, the law says that a license is required if "a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business with the principal objective of livelihood and profit through the repetitive purchase and resale of firearms."
The law specifically rules out a required license if a person "makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms."
The administration defended Biden's comments by saying that it is possible for someone to buy a gun at a gun show without being subject to a background check. This is true but misleading, since it's possible for someone to buy a gun anywhere from a private seller and not be background checked; gun shows aren't the issue.
"Biden's phrasing can leave the impression that no background checks are required at gun shows," notes the Post. "Our colleagues at PolitiFact labeled Biden's statement as 'mostly false.' We would lean more toward 'half true,' (i.e., Two Pinocchios) given how Biden's statement could be misinterpreted."

As is to be expected, these measures—including new restrictions on the sale of gun kits and the appointment of anti-gun activist David Chipman to lead the ATF—have raised a lot of praise from progressives and a lot of consternation from conservatives and libertarians.
One especially worrying development is Biden's attention to private gun sellers. Biden alone can't do much to change the rules surrounding gun gifting and sales between individuals. But he is throwing support behind legislation that would clamp down on such exchanges.
"Many Democrats and gun control advocates now want almost all sales and transfers to face a mandatory review," including sales and transfers "between friends and extended family," notes the Associated Press. "Connecticut Sen. Chris Murphy, the lead Democratic negotiator on guns, said he's been on the phone with Republican colleagues every day 'making the case, cajoling, asking my friends to keep an open mind'" about this proposal and also told the A.P. that Biden was "ready and willing to get more involved."

Republican gender policing efforts get more extreme. "A handful of Republican lawmakers in North Carolina want to force school officials to monitor kids for signs of any genderbending and to snitch on them to their parents," Reason's Scott Shackford reports:
The bill, sponsored by Sens. Ralph Hise (R–Spruce Pine), Warren Daniels (R–Morganton), and Norman Sanderson (R–Minnesott Beach), orders school officials and child welfare workers to notify parents or guardians in writing whenever a minor under their supervision "has exhibited symptoms of gender dysphoria, gender nonconformity, or otherwise demonstrates a desire to be treated in a manner incongruent with the minor's sex."
In other words, the aim here isn't to "protect" struggling teens who have doubts about their gender identities from making life-changing decisions too soon. The bill sets out to police gender conformity. By its very nature, it will target gays and lesbians as well as trans kids—and opens the door to surveilling boys and girls who are neither gay nor trans but simply don't manifest typical masculine or feminine traits.

I guess the real question here is whether we should have background checks. If there are laws that prohibit some individuals from purchasing firearms then it seem reasonable to have some method of checking. And if people are circumventing that check then laws need to be adjusted to prevent this from happening.
If you can't be trusted with guns (or knives, or cars, or bats, or chains, or gasoline, etc), you shouldn't be walking the streets with the rest of us. There is no problem to circumvent.

That is universal background checks; any and all firearm transfers go through an FFL, whether purchased from a dealer [a person regularly in the business of firearms sales], a store, private parties, or relatives.

The dirty secret is that the federal government doesn't have the constitutional authority to directly require background checks of the buyers, and they know it.
They have the regulatory power to require firearms dealers to have licenses for the interstate commerce of guns. And as a condition of their license, they require FFLs (Federal Firearms License) to obtain a Form 4473 and conduct a background check with each sale. Then as part of the 4473, the buyer gets entangled in the process under penalty of perjury.
There is no such hook for a private sale that does not involve an FFL. Those can only be regulated by the states. That's why so much of Biden's gun agenda involves drafting model legislation for enactment by the states. As if the states didn't already have this.

I haven't read the article yet, but I am guessing that this is a reaction- possibly an overreaction- to the growing power of the state to interfere with parental choices and child rearing; the constant indoctrination of very young children into the identity politics cult, against which parents have very little defense; and the large and growing movement to push harmful transgender "treatments" on children too young to inderstand the consequences of their decisions. Children cannot give informed consent to transgender treatments that may permanently alter their bodies and render them sterile for the rest of their lives, and parents- who are held legally responsible for those children- have a right to know about their child's mental health problems.

I just went and read the relevant section of the bill, and ENB left out the two extremely relevant provisions immediately PRIOR to the one she mentions. It directs state entities that they may not conceal or encourage a minor child to conceal any mental health information from parents, including gender dysphoria, and it also states that parents have a right to withold consent for "treatment, activity, or mental health care services that are 5 designed and intended to form their child's conceptions of sex and gender or to treat gender 6 dysphoria or gender nonconformity," and the state may not infringe upon that right. It requires state employees to report symptoms of gemder dysphoria to parents.
This is basic protection for parental rights to direct the medical care of their children, and to prevent meddling woke teachers and counselors from indoctrinating children too young to know the difference.
I do admit I relied on ENB’s description of the bill rather than going and reading the bill itself. Not sure it’s worth my time to learn all about a bill that is unlikely to pass, in a state I don’t live in.

DES MOINES, Iowa — Black Liberation Movement activists and the Iowa State Patrol clashed at the Capitol Thursday afternoon, resulting in a Norwalk high schooler being dragged to the ground and arrested on the first floor of the rotunda.
According to the Des Moines Black Liberation Movement Collective (DSM BLM), community members gathered at the Iowa State Capitol to protest several bills.
The protest was organized by Advocates for Social Justice, a group based in Cedar Rapids. They deemed several bills in the legislature to be "racist and dangerous."
DSM BLM reported around three dozen community members gathered inside the Capitol building on the first-floor rotunda to protest. The area is a public space, and videos posted on Twitter and Facebook show demonstrators were acting peacefully.

One video posted by Cortez Rice, George Floyd's nephew, shows the demonstrators move from outside the Capitol to inside.
Demonstrators walked through the public entrance at the front of the Capitol, with troopers watching them as they moved their protest inside.
Protestors yelled "Black lives matter" as they walked through the doors and metal detectors with their signs. Rice's phone even goes through the metal detector during the live stream.
Chants changed from "these racist cops have got to go" to "this is what democracy looks like."
Then, protestors laid on the ground for nine minutes and 29 seconds, which is how long Rice's uncle was pinned to the ground before he died last May. Chants continued through this time.
After the time was up, protesters got back up to continue through their protest, chanting "kill those bills."
Over an hour into Rice's live stream is when the arrest of 18-year-old Josie Mulvihill happened. She appears on-camera asking troopers for their badge numbers as chants continued.
Then, a commotion starts near Mulvihill and another unidentified protester. It's not caught on Rice's stream, but this is when Mulvihill allegedly assaulted the trooper, who DSM BLM identified as DJ Hernandez.
The situation escalates quickly in the video, when the officer pulls out a set of handcuffs and brings Mulvihill down to the ground. Other protesters attempt to pull the trooper off of her as other troopers start pushing them away.
Officers pulled her away from the rest of the group as protesters question the troopers why they're arresting her.
In Rice's video, he called out Hernandez's badge number and last name. Protesters crowded around the trooper vehicle where she was detained.
Local 5 reached out to the Iowa State Patrol for comment. Here is their response:
"Josephine Pearl Mulvihill, 18 years old was charged with assault on a peace officer from an incident at the State Capitol today. She was cited and released to parental supervision.
The Complaint and Affidavit will be available once it has been filed with the court."
