Trump's Judicial Humiliation Is Nearly Complete
The president and his allies keep losing election cases.

"We will be INTERVENING in the Texas…case," outgoing President Donald Trump tweeted today. "This is the big one."
Trump was referring to Texas v. Pennsylvania, a lawsuit filed directly at the U.S. Supreme Court this week by Texas Attorney General Ken Paxton, who wants SCOTUS to overturn the election results in four states—Pennsylvania, Georgia, Michigan, Wisconsin—that went for President-elect Joe Biden. Texas "is acting to protect the interests of its respective citizens in the fair and constitutional conduct of elections used to appoint presidential electors," the lawsuit declared.
As far as legal filings go, this one is not exactly a model of careful argumentation. For example, Texas told the Supreme Court that it is specifically targeting Pennsylvania, Georgia, Michigan, and Wisconsin because "Defendant States' combined 72 electoral votes…will determine the outcome of the election." But as the veteran Supreme Court reporter Lyle Denniston quickly pointed out, "those 4 only have 62." Indeed, Pennsylvania has 20 electoral votes, Georgia has 16, Michigan has 16, and Wisconsin has 10. You do the math. "Did Texas proofread the massive documents it filed in SCt to block Biden victory?" Denniston asked. It would appear not.
Under Article III, Section 2 of the Constitution, the Supreme Court has "original Jurisdiction" in certain matters, including "Controversies between two or more States." In plain English, this means that a state may try to sue another state directly at SCOTUS without first hitting up the lower courts. But original jurisdiction cases are rare and, when they involve one state suing another, they typically center on disputes over things like borders or water rights. No state has ever pulled off a stunt even remotely like overturning the results of a presidential election by going straight to SCOTUS to challenge the results in another state.
"With all due respect," said a spokeswoman for Georgia's Republican Attorney General Chris Carr, "the Texas attorney general is constitutionally, legally and factually wrong about Georgia."
That pattern of wrongness has certainly been evident in the other big election cases that Trump and his allies have been touting in recent weeks.
Take Trump for President v. Pennsylvania, a case that sought to have that state's election results overturned. "The Campaign's claims have no merit," ruled Judge Stephanos Bibas of the U.S. Court of Appeals for the 3rd Circuit. "Calling an election unfair does not make it so," Bibas wrote. "Charges require specific allegations and then proof. We have neither here." For those of you keeping score at home, Bibas is a respected legal conservative who was appointed to the 3rd Circuit in 2017 by none other than Trump himself. Bibas' "blistering opinion," as Reason's Jacob Sullum put it, "is a reality check for Republicans who still think Biden stole the election."
Meanwhile, in the span of just a few hours yesterday, Trump and his allies suffered two more embarrassing defeats. First, in a one-sentence order with no dissents, the U.S. Supreme Court declined to intervene in another Pennsylvania case, this one brought by Rep. Mike Kelly (R–Pa.), who went to court in hopes of getting millions of mail-in ballots thrown out, thereby overturning Biden's Keystone State victory.
That loss for Trump was quickly followed by Ward v. Jackson, a unanimous ruling by the Arizona Supreme Court which rejected a state Republican Party challenge to Arizona's election results. "The challenge fails to present any evidence of 'misconduct,' 'illegal votes' or that the Biden Electors 'did not in fact receive the highest number of votes for office,' let alone establish any degree of fraud or a sufficient error rate that would undermine the certainty of the election results," the Arizona Supreme Court observed.
There is something almost pathetic in the sight of a sitting president clinging to such outlandish lawsuits only to watch them predictably sputter and fail in the courts. That the losses are sometimes accompanied by a bench slap from one of Trump's own judicial appointees does not improve the optics.
If the Supreme Court ultimately rejects the far-fetched lawsuit that was filed this week by Texas, as I suspect it will, Trump's judicial humiliation will be complete.

What are the claims? In court there is no mention of fraud and in public nothing but calls of fraud. There are procedural issues but many of the procedures were put in place by the people complaining about them.
The only substantive claim is that Joe Biden won the election and President Trump is upset about that. This is not an issue for courts or legislature its an issue for Trump's therapist to address.
The Texas lawsuit has one claim that a statistician says the odds of Biden winning the contested states was “less than one in quadrillion”. Can the Supreme Court disbar lawyers that waste its time?
Trump’s latest deranged tweet is a claim that he couldn’t have lost because bookies were giving odds that he was winning on election night. I’m not making that up. An actual President of the United Stated actually said that in this timeline of the multiverse.

Do we decide the merit of cases by counting the number of amicus curiae briefs filed? Are you aware that filing an amicus curiae brief is not "joining" a case, and many of those briefs from red state Attorneys General stop short of fully supporting Texas' arguments.

As someone with a background in math -- I've been particularly interested in claims around statistics. (It's true that I do software rather than mathematical analysis for a living, but it's still of interest.) There are literally affidavits that said something like "Saw election worker roll their eyes when they saw a tRump ballot" followed by "I believe 1000s of tRump votes were not counted" No connection from what they saw, to a fraudulent act.
Even the star witness - Mellissa Carone - stated in her first video affidavit, that she was not 100% sure, but 99% sure the computers were connected to the internet - even after admitting she was not aloud to touch them (if you hover over the connection icon on a windows machine it will tell you if you have a connection to the Internet not just a local network). She also testified that thousands of ballots were trucked in from two vans even though she didn't actually see ballots. She was sure they must have been ballots. Apparently it was food for the workers... but hey, don't let facts get in the way.

Are you confusing appellate jurisdiction with original jurisdiction? Texas is seeking to invoke the latter.
Hah! When the cases are coming up from the state courts, the Supreme Court is acting as an appellate court, and they don't rule on the facts, they rule on the law. So if the fact finders, at the state level, are saying that the evidence is hot garbage, the appeal doesn't really go anywhere.
The Texas case is not an appeal, it's an original jurisdiction case. It could have been filed without any of the prior cases. The strategy here is to throw everything at the wall to see what sticks, simultaneously riling up their base...and getting over $200 million in donations from them in the process.
The SCoTUS can consider and decide on anything.

This article suggests a presumption that if an executive appoints a judge, then that judge should be beholden to them and expect a pay day. Forgive my naivete, but I thought judges were appointed in accordance with their judicial philosophy, bench slaps notwithstanding.

It's relevant because such loyalty is exactly what Trump seemed to be relying on. He repeatedly made comments in briefings and on twitter that he expected the supreme court to decide the election, and so ACB being confirmed was of the utmost importance.

The claim is votes can be switched when being tabulated to achieve a desired proportion, but if you selected even a relatively small random sample of ballots, counted them by eye, and then fed them through the machine, you would see this vote flipping happening. The more radical the change the easier it would be to detect in this way.
Many states use voting machines that are touch screens. When I voted I inserted a piece of paper and got nothing in return - no receipt, nothing. It would be beyond easy to stop tabulating 150 million votes in the middle of the night and insert code into either the server or the machine to alter the outcome. How would that be trackable? Youtube has a video of Dominion exec Eric Coomer explaining how to do it. Until they censor it...

If that is the case, and someone inserted code into into either the server or machine to alter the outcome, it would be trackable by selecting some number of ballots (could be all of them), looking at what the paper you fed into the machine said, tabulating that, and then feeding the paper into the machines again. If the by-eye count matches the machine count, no votes were being changed. This should also reproduce the original tabulation.

As I understand, typically only judges who dissent from denial of cert explain their reasoning, while the denial is issued per curiam. I assume that's also typical for denial of injunctive relief, as in the PA case.
When a court entertains an application for preliminary injunctive relief, it typically makes findings as to the four factors to be considered.

Can someone who knows more than me explain how this will be viewed legally? The same thing could be said about California, or the combination of New York and Minnesota, or many many other combinations. Or, if this lawsuit were successful, then Texas and Florida could be said to decide the election.
It seems like a better rationale is that PA, GA, WI, and MI are the only states that violated the Constitution by the way they changed their election results (according to the plaintiffs). But I actually don't know if that is true -- did any other states change election laws in a way that would be illegal according to the theory presented in the Texas lawsuit? I'm especially curious about states that ended up going for Trump.
It won't be viewed legally, not for long. This is political theater, not the practice of law. Republican AGs (who invariably have political ambitions) are trying to score points. Democrat AGs did the same thing with emoluments cases. The reality is that all of the electoral votes determine the outcome of the election. The Supreme Court does messaging. The dismissal of the PA case was a clear signal that said, "We're not diving into this cesspool."

Then buried in the 12th paragraph they admit it was over 6% if you count ballots with other kinds of rejection. Than they mark the claim that Trump said Georgia had ballot rejection rates of 6% in 2016 as "False."

No, it doesn't. Drop 100 letters to the same person in the mailbox at the exact same time sometime. See how many get to the destination at the same time. I've done this multiple times professionally research purposes. If 70% get there the next day, your postal service had a good day. If 70% get there in the next week, your postal service is pretty average. That 10k ballots for Biden, and nobody else, showed up all at once can only happen if a) a group that all voted together drops 10-12k ballots in the box at the same time or b) somebody somewhere magically knows the vote in a sealed envelope. Otherwise, even if a majority of votes were for Biden, you'd still see spikes (though smaller) for Trump, Jorgensen, and other down-ticket ballots.
The thing to note is that frequently these spikes weren't just spikes in normal voting, they were singular spikes in a background of steadily counted (pro-Biden) mail in ballots.
Flip a fair coin for 8 hours and you'll get 50/50 H/T. Flip an unfair coin for 8 hours and you'll get 60/40 H/T (or whatever). Flipping either one, getting 10,000 heads in a row is beyond statistically anomolous.

Which is it? If they were piled together, then the Biden/Trump ratio should be random through the pile. The entire pile might lean one way or the other, but the pile shouldn't get more/less Biden/Trump as you go through it. Moreover, you shouldn't see jumps in the ratio without massive piles of one-sided ballots.

Case in point; it's entirely possible that lots of Biden mail-in voters held off in varying swing states until judicial decisions said their mail-in votes would be counted and then voted all at once (and the post office, somehow, preserved the blip).

There is no video of those drop sites (though that is legally required) and in all likelihood, based on the almost zero rejection rate for ballots and thousands of 100% Biden ballots coming in all at once, certain Democrat precincts had immense numbers of illegal ballots that would have been tossed in a normal election, but not one where everyone is working together to unseat "New Hitler." Trump had the largest share of minority votes of any Republican candidate in history so Biden getting 100% of the vote anywhere is statistically unlikely. As for turnout, a few things
1) The page you link to notes that the counties in NY and CA that had lower provisional turnout were still counting, so that might change. The accompanying map, which only shows turnout for counties with at least 70% of the counting done, show increases across NY and CA.
2) Even if there was a drop in certain counties, you need to account for overall population changes.
3) Even if there was a drop in certain counties after accounting for population changes, it is not at all surprising that swing states where both campaigns spent a lot of money and had huge get-out-the-vote operations would see an increase in turnout compared with states that weren't ever expected to be competitive and didn't see the same kind of attention.
I should note that the USA today article is from one month ago. Final numbers should now be available.

Now, (at least in GA) they are trying to say that they never said they we going to stop and the observers left on their own, even though there are contemporaneous media accounts quoting the same people saying they were stopping.
The only place I’ve seen evidence of this happening is Georgia’s State Farm Arena. I support an investigation into that incident and it seems like someone at the very least messed up, but the ballots that were counted were also under video surveillance the whole time, and there is no reason to doubt their validity in particular.

My point is specifically that as long as the GOP (not average voters) declines to take this threat seriously, they are going to lose elections. I saw it happen in CA as they failed to appreciate how important Ballot Harvesting was, and they are doing it in these states as well.

Specifically in the case of the video of Fulton county counters- there is the video evidence and there is the CLAIM that Trump lawyers say it proves. As near as I can tell, the Trump lawyers never introduced it in court. That is probably because people who watched the full video can see that the Trump team's claims aren't accurate. They claim these ballots were produced out of nowhere. But you can see in the video that these ballots are produced as part of the normal process, stored when people think they are going home and then pulled back out when they are told to get off their asses and keep counting.
In the cases of statistical anomalies, none of these anomalies have been presented anywhere in court to my knowledge.
They were presented to the Georgia state legislature who has sole constitutional control over who gets Georgia's electoral college votes.
By federal statute, electors are to be selected on November 3. Three independent counts have determined that the Biden electors were selected on that day.

Litigants do not have to present definitive, conclusive proof that fraud occurred, only probable cause, for a lawsuit to proceed. These filings more than met that standard.
Courts rejected the cases because they didn't want to throw US democracy into chaos and because judges didn't want to become political outcasts. Whether that was a good choice remains to be seen.
