Feds still fighting for TikTok ban but will delay enforcement. TikTok isn't quite safe yet, but President Donald Trump's absurd and authoritarian attempt to effectively ban the app by forbidding Americans from doing business with ByteDance, its parent company, is flailing.
To carry out the president's order, the Commerce Department declared back in August that as of November 12, 2020, certain business transactions with TikTok—including "any provision of internet hosting services" and "any provision of content delivery network services"—were banned. In September, a federal judge preliminarily rebuffed implementation of the ban, however, and in October, another federal court blocked the Commerce Department from enforcing the ban.
Yesterday, the Commerce Department appealed the latter ruling but also said it would not enforce the order "pending further legal developments."
"The U.S. crackdown on Chinese social-media apps has been led by President Trump, and it is unclear how President-elect Joe Biden will address the situation," notes The Wall Street Journal. "Many members of Congress in both parties, however, have sounded alarms about potential Chinese data-gathering and surveillance in the U.S."
Like their GOP counterparts, Democrats have a history of raising concerns about TikTok and, more broadly, of using data privacy as an excuse to give the government more control of internet data and content. Trump's move—which seemed calculated to play to his base's animosity toward China and Big Tech more than anything—may have been more arbitrary but also more limited than the type of data "protection" policies Democrats are dreaming up.
Politicians in both major parties tend to give away the game a little in the details. Trump was OK with TikTok operating so long as it was partially sold to an American company, the U.S. government could possibly get a cut of that money, and he could brag about the good deal he brokered. Data protection bills and proposals tend to let internet companies keep collecting as much user data as they already are, provided they let the government (and users who request it) know what they've got.
Whatever happens, other court challenges to Trump's TikTok order are pending, including one from ByteDance asking the U.S. Court of Appeals for the District of Columbia Circuit to overturn the Committee on Foreign Investment's ruling that ByteDance must divest TikTok.
ByteDance is reportedly also still in negotiations with U.S. buyers. More from the Journal:
As the legal underpinnings of the Trump administration's effort appear to be weakening, there were signs that the parties also were still far apart on the terms of the deal. Still, people familiar with ByteDance's thinking said the company was hopeful about reaching an agreement that would allow TikTok to remain in the U.S.
Mr. Trump issued an order in August stating that TikTok would be banned in the U.S., but later told reporters that he might approve a divestiture to a U.S. company.
Under a preliminary proposal that Mr. Trump approved in concept in September, Oracle Corp. and Walmart Inc. would take a combined 20% in TikTok Global, a new U.S.-based company that would run the global service. But among the major sticking points in the continuing negotiations was the size of the stake that ByteDance would get to keep in TikTok, according to people familiar with the matter.
People familiar with ByteDance have said the company is working to take measures to safeguard the data of its American users, but noted that they don't believe the U.S. government has authority to dictate the corporate structure of a Chinese company.
The Washington Post points out that "if the Trump administration and TikTok don't work out a deal soon, that could put the ball in Biden's court once he's in office. He could reverse the order that imposed the ban and find another way to address the app's security concerns—or choose to defend the government's ban in court as the legal process continues." More:
Biden has said little about what he would do to rein in the app should the company fail to reach a deal with Trump.
While Biden has largely criticized Trump's China policy as ineffective when it comes to trade, he has expressed his own concerns with TikTok and said he would review security concerns with the app. "I think that it's a matter of genuine concern that TikTok, a Chinese operation, has access to over 100 million young people particularly in the United States of America," Biden said during a campaign stop in September.
A Biden representative said the team had nothing to share at this time regarding its plans for TikTok. TikTok declined to comment on if the company had spoken with the Biden team about the ban.

Clinton got 3M more votes than Trump in 2016. All of them came from California.
Biden got 5M more votes than Trump in 2020. Most of them came from California.
Of course, it should go without saying that the mythical "national majority" is irrelevant. And with 48% Clinton didn't get it.
Trump may sound like a sore loser and spoiled petulant child having a temper tantrum but in complaining about it the Democrats sound like there worrying about something. If Trump's antics get some light shone on some cheaters it's all to the good. Even if there wasn't "enough" fraud to affect the outcome there's no reason not tog after those responsible.
Who becomes President is not up to Donald Trump. Neither is it up to Joe Biden or the media.
Procedures will be followed, vote counts will be certified, electors will meet and someone will be sworn in on 1/20/21.

The repugnant plan brewing for state legislatures to steal the election must be stopped
The electoral college count is going against President Trump. His efforts to overturn those results in courts are unlikely to succeed. So some Republicans — including the president’s son — are starting to promote a bid to have GOP-controlled state legislatures undo the will of the voters in states won by former vice president Joe Biden.
They would accomplish this undemocratic feat with the electoral college version of the nuclear option. The ordinary practice in a state where Biden won the popular-vote total would be that state officials certify the election results and send a slate of electors pledged to Biden to Congress for its formal approval.
But state legislatures that conclude the popular-vote total has somehow been corrupted could claim the constitutional authority to submit competing slates of pro-Trump electors and ask Congress to accept that result instead. That radical move would set up a potential clash between the House, with its Democratic majority, and the Senate, which is likely to remain in Republican hands. This bicameral breakdown would create electoral chaos and a constitutional crisis.

The primary objective in an antitrust suit is almost always a consent decree, and the Biden Justice Department will use that consent decree to 1) protect every social media platform that signs onto it from liability under certain conditions and 2) the conditions under which they'll be protected from liability is if they censor "conspiracy theories" and "hate speech".

Because almost every Republican supports at least one of these positions, the effect is that they're trying to purge the public square of Republican voices.
The next step in the process to accomplish that is repeal Section 230. That way, every other social media platform will be forced to sign onto the consent decree in order to be protected from liability for statements made by their users. That is the goal or Facebook. That is the goal of Twitter. That is the goal of Google's YouTube unit. That is the goal of every progressive, established social media giant.
Repealing Section 230 is the key to a progressive takeover of the moderation rules for every social media platform. It worked the same way in the tobacco consent decree. The question is whether they'll do whatever they can to become free from liability for what their users write on their platforms--and the answer is absolutely. 1) When you're being sued 10,000 times a year, winning 10,000 cases a year isn't enough. You need to avoid the lawsuits altogether. These companies are selling advertising. Defending yourself in court is not a profitable activity. Lots of companies settle just so they won't have to waste their time and resources in court. You could go broke winning lawsuits.

One of the biggest problems with broadcast stations now is that because the Republicans forced that bill through that required the cable companies to carry local broadcasters, the major networks bought the local stations from their owners and starting reducing their broadcast signals to force customers to pay for broadcast stations through their cable company (that they would be getting for free with an antenna otherwise). That law was an attempt to force a solution on a virtual monopoly that ended up being jkust another angle for rent seeking.
However, with their rent seeking, they created the seeds of their own destruction. One of the primary reasons why cable is so expensive is because the cable companies are forced by law to pay local broadcasters a premium to carry their signals whether they want those channels or not. When you subscribe to the streaming services of Sling ($30 a month), Philo ($20 a month), or T-Mobile's Tvision Vibe ($10 a month), you get the cable channels you want without the broadcast stations and just plug an antenna into your Wifi router to get broadcast stations for free.
In other words, the reason the local broadcasters can't compete now is in large part because of their rent seeking. They priced themselves out of the market when streaming came along, and they thought they could get away with it because for a while, there, cable really was a local monopoly. It was cable's monopoly status that supposedly justified the law that made that rent seeking possible.
And it almost always happens this way!
It's the same thing with social media. If some 48% of the voters going for Trump means that some 48% of Americans are being treated like shit by the social media companies, then it's only a matter of time until someone comes along and figures out how to appeal to them. In the Soviet Union, they did all kinds of things in order to ensure that the giant industries favored by the government couldn't be beaten by the competition--and in doing that, they created the seeds of those industries' destruction, to the point that none of those industries are competitive on a global scale anymore.

There's an easy check for that - if a lot of people were voting split-ticket, Biden on top and GOP down ballot, then there should be a lot more down-ballot votes for the GOP than votes for Trump. There's not.
Look at it this way, you've got a thousand voters. 400 of them vote straight GOP, 400 vote straight Democrat, 200 vote Biden/GOP. This would explain how both Biden and the GOP won, but it would mean the GOP candidate got 600 votes while Trump only got 400 votes. That didn't happen, Trump got pretty much the same number of votes as the down-ballot GOP candidates. There just weren't that many split-ticket voters.
The question is: If Biden got so many more votes than Trump, why didn't the down-ballot Democratic candidates win as well? Because there were a shitload of ballots that had only a Biden vote on them and no down-ballot votes at all. Which might seem a little suspicious - why would so many people go to all the trouble of voting for Biden without taking the few extra seconds to make sure he had a Democratic House and Senate as well? Something smells a little fishy there.

There's another aspect to this aside from the election fraud as well. Taken in good faith we have a mountain of votes where people were too uninformed or apathetic (or whatever) to vote for their local Congressperson but, somehow, mustered up the intelligence to vote Biden (cue Remy standing outside a tent, wiping doritoes on his shirt, and saying "That's how you run a global economy!"). The relatively smaller or even same-sized mountian of black/latino/whatever voters who were informed and motivated enough to vote for both Trump *and* their local Congressperson isn't going to take too kindly to that. Especially if if these votes are perceived as belonging to the whiter, more affluent, Eric Boehms out there. And that issue is more critical to an informed and representative democracy than the electoral college.
The fact that we can't guarantee that the people who voted "Biden and nothing else" even have driver's licenses or are here legally doesn't help.
Conservative and independent voters voting for Republicans for Congress and against Trump is not unexpected at all. He is unpresidential in demeanor and has been accused of bungling the COVID-19 response pretty much every day in the media since March.

Record turnout in WI, and mathematically improbably pro-Biden mail in ballots in PA and MI are the biggest signs of shenanigans, but hard to prove as fraudulent at this point.
I don't know if it's that odd. There are a lot of people who aren't Democrats, but dislike Trump (whether for good reasons or silly ones) and want him gone. Between December 2009 and December 2016, the unemployment rate dropped 5.2 percentage points, from 9.9% to 4.7%. By December 2019, it had fallen another 1.2 percentage points, to 3.5%. A cursory look at those numbers might lead you to believe that the improvement under Trump was at best a continuation of a trend that began nearly a decade earlier.
It’s necessary to place those numbers in context. By 2016, officials in the Treasury Department and at the Federal Reserve had concluded that the economy was at full employment and that further improvement in the labor market was unlikely. This was in line with the Congressional Budget Office’s guidance that further declines in the unemployment rate would push the economy beyond its sustainable capacity.
Once in office, Trump ignored this consensus. He implemented a program of tax cuts, spending increases and unprecedented pressure on the Fed to cut interest rates to zero and keep them there. Trump’s goal of 3% growth was derided as delusional, while a bipartisan chorus of commentators declared his policies reckless and irresponsible.
They were anything but. Not only did the unemployment rate continue to fall, but the percentage of Americans aged 25 to 54 either employed or looking for a job saw its first sustained rise since the late 1980s. This inflection point changed the character of the labor market.
In 2016, real median household income was $62,898, just $257 above its level in 1999. Over the next three years it grew almost $6,000, to $68,703. That’s perhaps why, despite the pandemic, 56% of U.S. voters polled last month said their families were better off today than they were four years ago.

At the center of the debate is the "cycle threshold" at which a PCR test operates. PCR tests work by multiplying a virus fragment over a series of cycles until it can reliably detect and confirm the virus within a sample. The more cycles a test must go through before it detects the virus, the smaller and weaker the original sample was.

Individual test manufacturers and labs, rather than infectious disease authorities, are generally in charge of setting the cycle threshold of a COVID-19 test. "Most PCR assays for infectious diseases have Ct cutoffs in the range of 35-40," the Alaska Department of Health and Human Services states in a COVID-19 PCR informational document.
The state in that document noted that most of its PCR tests utilize cycle thresholds of 37, while its backup tests put the number as high as 40.

All these people squawking about vote fraud are barking up the wrong tree - I don't think vote fraud was any worse than it's ever been, it's just that the mail-in balloting has allowed it to be more complete than usual. Are inner-city voters somehow more patriotic or civic-minded than the average person and therefore more likely to vote? Every big city has a discretionary fund (AKA "slush fund") to provide funding for these "community improvement groups" that go around helping their community by establishing soup kitchens and food pantries, drug clinics, ride-sharing to make sure old folks can get to doctors appointments, sprucing up vacant lots, fixing broken windows, organizing volunteers for this, that, and the other - ask Obama about that, he spent a stint as a community organizer. Specifically, ask Obama if that was a volunteer position or if he got paid for it. Ask him how much money he got from the city, ask him what sort of accounting he had to produce to show where the money was going. (If you look hard enough, you might find that Bill DeBlasio's wife is being asked the same questions regarding some $1 billion she controls in some sketchy community activity and her $2 million per year staff. And ask Rufus about Justin Trudeau and all his friends and family's involvement in a sketchy charity that mysteriously received a huge no-bid contract from the government.)
But regardless of the community activity group's stated purpose, it's secondary (or really primary) purpose is to make sure everybody gets registered to vote so that they can vote to keep the gravy train rolling. Hell, everybody knows that part of the problem with the gang violence in Chicago is that plenty of these gang members are untouchable because they're on the city's payroll and the city depends on them to deliver the votes for the usual suspects in Chicago government. If you want something out of the city - a ride to your doctor's appointment, a box of food when your food stamps run out, your broken front door fixed - well, it's only natural that the city may suggest a little quid pro quo. And they understand that voting may be complicated and confusing, so those nice community activist people will be happy to check over your ballot to make sure you've filled everything out correctly - hell, they'll make it real simple and if you just sign the ballot, they'll fill it out for you!
Now, it used to be that with in-person voting, it took some work to get people to the polls, you had to send around buses to collect the voters, you had to pay for the refreshments on the buses - beer, cigarettes, pizza, lottery tickets, cash vouchers, you know all the normal refreshments you'd find on a bus trip - and then you had to drive them back home. But with the mail-in balloting, it so much easier to take your time and make house calls to guarantee that everybody's voted and you don't have to offer so many refreshments to induce them to do their civic duty!
And relatedly, I sure would be curious to know what the voter registration rate and the voting rate is at these big state- or city-run old folks homes and compare those to the rate of residents of those old folks homes that are mentally competent enough to fill out a ballot all by themselves without requiring any help to make sure they've filled out the ballot correctly. I would be curious, but I'll bet I wouldn't be surprised by the numbers.
People who talk about blacks being kept on the liberal plantation are perhaps more literal than they know. You can complain about blacks being too ignorant to know not to vote Democrat, but I'll bet a significant chunk of those black voters don't know they're voting for Democrats. They just have a piece of paper thrust in their faces and get told to fill it out and they know from experience if they don't fill it out that they're just going to be nagged over and over and over again about it until they do, and in the meantime unfortunate things may tend to happen to them. Maybe some unknown punk throws a rock through their window, maybe they get mugged, maybe a codes enforcement officer shows up at their door wanting to talk about the length of their lawn, maybe their food stamps don't get delivered on their usual schedule, maybe their ride to their doctor's appointment doesn't show up, lots of little unfortunate things might happen if they don't fill out that piece of paper. Is anyone really surprise that the 2020 election was the most secure? It was certainly the most scrutinized. It benefitted from reforms after the 2000 and 2016 elections. The spring, summer and fall primaries provided election staff experience in handling an election in a pandemic and handling mailed in ballots. Voters took notice and planned their votes. Yes it is obvious this was the most secure and the most votes in a long time.

One of my favorite things about voting is talking to the invariably wonderful people who volunteer as election workers. That's why I, personally, would never vote by mail (although I did do early voting this time, to avoid long lines).
I knew/know 3 of my local poll workers personally. Went through the formality of telling one my name and address even though he knew it. I fixed one of them's laptop for him. Fortunately, he was an actual standup guy and not the kind of guy Hunter Biden is.
You know, it occurs to me that Trump is going to embody that famous Alec Guinness quote, "If you strike me down, I shall become more powerful than you can possibly imagine." Despite Biden vowing to undo everything Trump has done on day one and despite the fact that 5 minutes after he's gone it will be as if he'd never been there at all, I can guarantee you that for at least the next 4 years every single bad thing that happens is going to be all Trump's fault. Trump is somehow going to accomplish much more in the next four years than he ever managed to accomplish as President. That's a hell of a legacy, ain't it?
